EAST ALLEN TOWNSHIP Board of Supervisors Monthly Business Meeting September 27, 2018 CALL TO ORDER 7:00 PM The recorded meeting was called to order at 7 PM by Vice Chairperson, M. Schwartz who led the pledge of allegiance. ROLL CALL Present were: Vice Chairperson, M. Schwartz; Supervisor, P. Moser; Supervisor, G. Hunsicker; Supervisor, D. Heiney; Township Manager, B. Green; Township Solicitor, J. Piperato, III; Township Engineer Representative, J. Milot; Public Works Coordinator, G. Mathesz and Secretary/Treasurer, R. Wedde. Chairperson, R. Unangst was absent. PUBLIC COMMENT (3 min. /individual Agenda Items only) Kristen Wenrich 5520 Monocacy Drive questioned the large gap at the driveways on Monocacy Drive. Discussion ensued. The Township Engineer will go out and look at the driveways and report back to the Board. MINUTES FOR APPROVAL August 23, 2018 September 12, 2018 MOTION made by D. Heiney to approve the August 23, 2018 and the September 12, 2018 Board of Supervisors minutes. Seconded by G. Hunsicker. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes and M. Schwartz, yes. FOUR IN FAVOR. MOTION CARRIED. ENGINEER REPORT A copy of the monthly report was distributed to the Board. Monocacy Creek Watershed Act 167 Stormwater Management Ordinance LVPC is updating the Act 167 Stormwater Management Ordinance. It was approved by DEP in May and the Township will need to approve it by the meeting on November 14. The Board to authorize advertising for the Planning Commission on October 4 and back to the Board on October 10 for authorization to advertise for October 25. It will be on the Planning Commission agenda in October. End of Maintenance North Halbea Street Inspection MOTION made by D. Heiney to approve the end of maintenance to BiState and return the bond to contractor. Seconded by P. Moser. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes and M. Schwartz, yes. FOUR IN FAVOR. MOTION CARRIED. Extension St. Luke s Hospital (Rte. 512) MOTION made by G. Hunsicker to approve an extension for St. Luke s to March 30, 2018. Seconded by D. Heiney. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes and M. Schwartz, yes. FOUR IN FAVOR. MOTION CARRIED. Grading Plan Seemsville Road Received the grading application and will be reviewing with the Township ordinances to be ready for the Planning Commission meeting. They had an ongoing review of the HOP and this is what they need to submit. SOLICITOR REPORT Airport Road Lot 1 - Letter Dated 9/21/18 The Township received a letter from LHV, Airport Road Lot 1 stating that the Township needs to turn over the right-ofway on Airport Road in order for them to commence road improvements. A copy of the letter dated September 21, 2018 was distributed to the Board. The Township can indemnify Penndot, which they are not going to do or condemn the property. MOTION made by D. Heiney to authorize the condemnation at the expense of the developer, and a resolution will need to be executed. Seconded by G. Hunsicker. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes and M. Schwartz, yes. FOUR IN FAVOR. MOTION CARRIED.

MANAGER REPORT 2018 Northampton County Gaming Grant Project Requests Notices were sent to all Boards and Departments asking for requests for spending the grant funds. Copies of the requests from the departments: Parks, Public Works, Administration, Ambulance and Fire have been distributed to the Board. The total amount of the grant is $31,440.00. The total amount of requests is $32,976.40. The request from the Fire Department may be an issue because of the ownership of the tool would be the Township and the other equipment would be the Fire Departments. It would be difficult to track that asset because we only own the aerial truck that they currently have in service. For the request from the Ambulance, B. Green is unsure the grant covers trainings and fears an audit question would arise on this request. B. Green is looking for a recommendation to authorize the requests from Parks, Public Works and Administration. This will allow the Township to purchase security cameras for each of the pavilions at Bicentennial Park as well as the maintenance building on the east side of the park. It will allow for the purchase of a Tilt Couple for the backhoe with a Ditching Bucket. The other item is a new phone system for the Township building. MOTION made by G. Hunsicker to use the grant funds to purchase security cameras for the park, a Tilt Couple for the Backhoe with a Ditching Bucket and a new phone system for the Township Office. Seconded by D. Heiney. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes and M. Schwartz, yes. FOUR IN FAVOR. MOTION CARRIED B. Green will reach out to the Ambulance Corp and Fire Department to see if they have other requests that we may be able to fulfill. Toll Brothers Regency at Creekside Deferral Request for Developer Recreation Fees The Township received a request verbally on Thursday, September 20, 2018 from M. Daugherty, who works for Toll Brothers on the possibility of a deferral on the payment of the required Fees-in-Lieu of Dedication for the Developer Recreation Fees. A letter was requested on Friday, September 21, 2018 and was received by our office on September 26, 2018. Toll Brothers is requesting its fees for the Developer Recreation Contribution Fees be paid at the time of a building permit being issued or occupancy permit being issued as the development progresses, instead of paying the $221,191.74 at the time of the plans being recorded for Phase 1. Recreation funds must be spent within a certain time frame and it is not the Township policy to do it this way. The Township would also be at a disadvantage in applying for grants for our recreation facilities if we would be getting the money sporadically throughout the year because of not having a lump sum of money to apply for available grants. Discussion ensued suggesting they submit the fees per phase. MOTION made by G. Hunsicker to deny the request from Toll Brothers regarding deferring payment of their recreation fees. Seconded by P. Moser. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes and M. Schwartz, yes. FOUR IN FAVOR. MOTION CARRIED. Applicant s Authorization for Agent to Apply for HOP The Township received the paperwork related to Toll Brother s Highway Occupancy Permit involving their work on Route 512. As required by PennDOT the Township must be the applicant and permitted for work related to the HOP process. MOTION made by D. Heiney to make the Township Manager the agent for the HOP. Seconded by P. Moser. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes and M. Schwartz, yes. FOUR IN FAVOR. MOTION CARRIED. PADOT ROW Stormwater Agreement This agreement deals with the stormwater management for Toll Brother s development along the right-of-way on Route 512. PennDot requires the Township to be named for ROW Stormwater Agreement related to the HOP permit. We are the applicant and in turn through the Developers Agreement we have placed the burden and responsibility on Toll in their Developer s Agreement as a condition of their development. It is recommended the Township authorize the Chairman of the Board to sign and execute the required PennDot ROW Stormwater Agreement for Toll Brother s HOP Permit related to Regency at Creekside. MOTION made by D. Heiney to authorize the Chairman of the Board to sign and execute the required PennDot ROW Stormwater Agreement for Toll Brother s HOP Permit related to Regency at Creekside. Green reached out to some of the surrounding municipalities and found that most either do not allow for block parties or they have their block parties on state roads. Bath Borough has a road closure permit. Northampton Borough allows for block parties when a written request is received outlining the purpose, location, and time of the event and it must be

discussed at a council meeting with the requestor present. Northampton does not have a permitting process or a fee for the closure of their streets. Block parties held on state roads are permitted through PennDot. Discussion ensued. J. Piperato would like to see the paperwork that would be signed by the other municipalities from a liability stand point. Monocacy Drive Phase 2(A) The project has been completed and they have now moved on to phase 2B. The Township Manager approved for the contractor to work on Saturdays during day time hours only. The contractor has 30 days to complete the project. Debra Court Repairs B. Green stated he met with Mr. Anthony today and informed him that the Board of Supervisors would be looking at a reduced cul-de-sac and it should be completed by next year. FEMA Public Damage Assessment - 10/2/18 FEMA will be in Northampton County on October 2, 2018 doing an assessment from the recent flooding depends on the type of damage if any residents had damage they should contact the township. G. Hunsicker questioned if there was any damage to Jacksonville Bridge. B. Green explained that it was inspected and that there was no damage. Keystone Cement DEP Ltr Dated 9/14/18 A copy of the DEP letter dated September 14, 2018 regarding Resource Conservation and Recovery Act Permit Renewal was distributed to the Board. Keystone Cement ltr dated 9/21/18 A copy of the Keystone Cement letter dated September 21, 2018 regarding the Air Quality Permits was distributed to the Board. Sewage Facilities Planning Module Airport Road Commercial Park Received 9/14/18 J. Milot stated there were deficiencies in the application and will be notifying the applicant of the deficiencies. 2017 DEP 904 Recycling Performance Grant Submitted 9/24/18 B. Green stated that the 2017 DEP 904 Recycling Performance Grant was submitted on September 24, 2018. The information is gathered by Hough Associates KMIT Risk Assessment A copy of the KMIT Risk Assessment was distributed to the Board. They are suggesting the Township make some changes regarding this. PADOT Pre-Construction Meeting on 10/10/18 - Re: Route 248 A copy of the PADOT letter dated September 10, 2018 was distributed to the Board. PADOT will be paving Route 248 from Lehigh Township to Bath. Jacksonville Road Closure Grace Industries ltr dated 9/26/18 A copy of Grace Industries letter dated September 26, 2018 regarding the closure of Jacksonville Road from Hanoverville Road and Gwenmawr Road on Monday, October 1, 2018 through October 6, 2018 for the purpose of installation of a water main for the City of Bethlehem was distributed to the Board. TREASURER Monthly Financial Payment of Bills R. Wedde presented the Financial s for the month to the Board. The total receipts were $134,353.21. The total expenses were $503,184.43. MOTION made by D. Heiney to accept the Treasurer s and pay the bills in the amount of $503,184.43. Seconded by G. Hunsicker. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes; M. Schwartz, yes and R. Unangst, yes. ALL IN FAVOR. MOTION CARRIED. Fireman s Relief State Aid $32,190.89 R. Wedde stated that the Township received the 2018 Allocation for the Fireman s Relief State Aid in the amount of $32,190.89. These funds will be turned over to the Fire Department. R. Wedde has prepared check #40904 in the amount of $32,190.89 payable to the East Allen Township Fireman Relief which is part of the bill list this month.

PMRS State Aid - $42,159.49 R. Wedde stated that the Township has received the 2018 Allocation for Pension State Aid in the amount of $42,159.49. These funds will be applied to the payment of the 2018 MMO. Liquid Fuels Estimated Allocation for 2019 - $220,408.59 R. Wedde stated that the Township has received notice of the estimated 2019 Liquid Fuels Allocation in the amount of $220,408.59. Monocacy Drive Storm Sewer Project Phase 2 Payment Application No. 2 - $168,519.71 MOTION made by D. Heiney to authorize to release payment to Grace Industries for Application #2 for the Monocacy Drive Storm Sewer Project Phase 2 in the amount of $168,519.71. Seconded by G. Hunsicker. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes; M. Schwartz, yes and R. Unangst, yes. ALL IN FAVOR. MOTION CARRIED. Monocacy Drive Storm Sewer Project Phase 2 Payment Application No. 3 - $15,303.77 MOTION made by G. Hunsicker to authorize the release of payment to Grace Industries for Application #3 for the Monocacy Drive Storm Sewer Project Phase 2 in the amount of $15,303.77. VOTE: D. Heiney, yes; G. Hunsicker, yes; P. Moser, yes; M. Schwartz, yes and R. Unangst, yes. ALL IN FAVOR. MOTION CARRIED. PARKS & RECREATION A copy of the September Parks and Recreation was distributed to the Board. PUBLIC WORKS A copy of the September Public Works was distributed to the Board. EATVFD/EMA/EATVAC Fire A copy of the August Fire was distributed to the Board. Ambulance A copy of the September Ambulance was distributed to the Board. PLANNING COMMISSION The September meeting was cancelled due to lack of business. ZONING Service Request A copy of the September Service Request was distributed to the Board. UCC A copy of the August UCC was distributed to the Board. Monthly Permit A copy of the monthly Permit was distributed to the Board. FRCA Agenda 9/18/18 A copy of the September 18, 2018 agenda was distributed to the Board. Minutes 7/17/18 A copy of the July 17, 2018 minutes was distributed to the Board. Operations A copy of the Operations was distributed to the Board. Financial s A copy of the Financial s was distributed to the Board. Tracking s A copy of the Tracking s was distributed to the Board.

D. Heiney stated the damage to the FRCA truck that was in an accident was more extensive than originally thought. The frame was bend and the repair will be more expensive and will take longer to be repaired. PUBLIC COMMENT Fran McGouldrick 5519 Shawnee Drive was looking for clarification on the FEMA assessment. How will the residents be informed? He asked about sending out a constant contact or can something be put on the sign? B. Green stated that it would be word of mouth. F. McGouldrick asked if there was specific criteria? FEMA did not notify the Township of certain criteria. If resident s have damage, they can contact the Township. F. McGouldrick questioned the Fireman s Relief monies on what it could be used for. It was explained that the state sets the criteria. It can be used for turn out gear not trucks. Fed ex truck was on Willowbrook Road coming from 10 th Street. They are not supposed to be there. M. Schwartz stated they could call the state police. She checked the website and saw that it was changed and is not happy that this happened because of a request from a neighboring community. She would like the Board to reconsider for next year to change it back. Eric Miller 7416 Miller Drive Questioned the grading plan for Seemsville Road E. Miller wanted to know who submitted the plan. Shouldn t they be doing a Land Development? J. Milot stated that Hanover Engineering does have the submission but they do not know who the applicant is and all the requirement will be worked out when they submit to the Planning Commission. The school district still owns the land. M. Schwartz stated the Township would have the answer at the next meeting. Sharon Fournier 6316 Jacksonville Road The Horner Cemetery festival was nice and P.
