WHEREAS, Jon and Beverly Thompson, owners; Contour Real Estate and Development, LLC., applicant; and JBI Partners, Inc., surveyor /engineer; have submitted a planned development zoning change request Z - -0011) to the City of Keller, which has been reviewed by the City Staff; and WHEREAS, notice of a public hearing before the Commission was sent to Planning and Zoning real property owners within two- hundred feet 0`) of the property herein described at least ten (10) days before such hearing; and WHEREAS, notice of a public hearing before the City Council was published in a newspaper of general circulation in Keller at least fifteen (15) days before such hearing; and WHEREAS, public hearings to issue a zoning change on the property herein described were held before both the Planning and Zoning Commission and the City Council, and the Planning and Zoning Commission has heretofore made a recommendation to approve the zoning change request with conditions; and 1

1 WHEREAS, the City Council is of the opinion that the zoning change herein effectuated furthers 2 the purpose of zoning as set forth in the Unified Development Code and is in the best 3 interest of the citizens of the City of 4 Keller. 5 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KELLER, TEXAS: 6 Section 1: THAT, the above findings are hereby found to 7 be true and correct and are incorporated 8 herein in their entirety. Section 2: THAT, the Unified Development Code of the City of Keller, Texas and the accompanying 10 Zoning Map, are hereby amended by changing the zoning from SF -LD ( Single Family 11 Residential -Low Density- 36,000 square -foot minimum) and PD -SF -25 ( Planned Development - Single Family Residential - 25,000 13 square -foot lots) to PD -SF -15 ( Planned Development- Single Family Residential - 15,000 14 square -foot lots) for Bridgewood, a proposed single- family residential development 15 consisting of 51 residential lots and 4 open space lots, located on 27.74 -acres of land 16 out of the Richard F. Allen Survey, Abstract No. 2, Tracts 2A and 2C1, and the Daniel Barcroft Survey, Abstract No. 141, Tract 6A, located on the south side of Mount Gilead Road, approximately 1,100 feet east of 1 Bourland Road, at 616 and 708 Mount Gilead 22 Road, in the City of Keller, Tarrant County, Texas, with the proposal attached hereto as Exhibit "A ", and as incorporated herein, if fully set forth with the following conditions: 23 1. The request to reduce the minimum lot width from one hundred five feet ( 105') 24 to one hundred feet ( 100 shall be 25 allowed. 2. The 26 request to allow two ( 2) lots ( Lots 11 and ) to have less than the minimum 27 required fifty feet ( 50') street frontage shall be allowed. 2

3. The 1 request to allow the minimum side yard setback to be ten feet ( 10') in lieu 2 of required ten percent ( 10 %) of lot width and no more than fifteen feet ( 15') 3 shall be allowed. 4 4. The minimum dwelling 5 2,800 square feet. unit size shall be 6 5. The request to allow the use of wrought iron fencing along Mount Gilead Road in 7 lieu of the required six -foot (6') solid 8 masonry screening wall shall be allowed. 6. The request to allow the informal planting of perimeter trees along Mount 10 Gilead Road in lieu of required twenty- five foot - ( 25 spacing shall be 11 allowed. 7. The request to allow the open -type residential side 13 fencing to be five feet 5') from the side property line in lieu 14 of required eight -foot ( 8 distance 15 16 shall be allowed. 8. The request to allow two ( 2) additional trees to be planted for each residential lot within the street parkway allowed. shall be Section 3: THAT, any person, firm, or corporation 1 violating any of the provisions of this Ordinance, as read together with the Unified Development Code and accompanying map thereto, shall be guilty of a misdemeanor and upon final conviction therefore shall be 22 fined in a sum not to exceed Two Thousand Dollars ($2,000. 00). Each and every day such 23 violation continues shall constitute a 24 separate offense and shall be punishable as such hereunder. 25 Section 4: THAT, the City Secretary is hereby 26 authorized and directed to cause publication of the descriptive caption and penalty 27 clause hereof as an alternative method of publication provided by law. 3
