Building Division 303.438.6370 BUILDING PERMIT FEES Effective February 15, 2015 The applicant for a permit shall provide an estimated permit value at the time of application. Permit valuations shall include total value of work, including materials and labor, for which the permit is being issued, such as electrical, gas, mechanical, plumbing equipment, and permanent systems. If, in the opinion of the building official, the valuation is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the building official. Final building permit valuation shall be set by the building official based on the most recent Building Valuation Data published in the "Building Safety Journal" magazine by the International Code Council as a minimum. Depending on the scope of the project, separate plan review fees for electrical, plumbing and mechanical may be assessed in the same manner (65% of the electrical, plumbing, mechanical permit fee calculated above). Services Expansion Fee All new residential permits (single and multi-family) are subject to the Services Expansion Fee (SEF). The fee is $1.00 per finished square foot of dwelling area and shall be collected prior to the issuance of the Certificate of Occupancy. Fire Sprinkler and Fire Alarm Permits The North Metro Fire Rescue District is the fire department serving the City and County of Broomfield. They are involved in various aspects of plan review, permits, and inspection, depending on the scope of your project. Additional fees may be required for fire district reviews or permits. Contact the Fire Prevention Bureau at 720-887-8217 for more specific information. Page 5

BUILDING PERMIT FEES (page two) Building Permit Use Tax The applicant for a permit shall provide an estimated permit value at the time of application. Broomfield Municipal Code Section 03-08-020 declares that every person who uses or consumes in Broomfield any building and construction materials, as herein defined, is exercising a taxable privilege and the use tax imposed is done pursuant to the authority granted to the city by article XX of the Constitution of the State of Colorado. Building and construction materials means and includes any materials, goods, or commodities which are used or consumed in connection with the building, construction, reconstruction, alteration, expansion, modification, or improvement of any dwelling, building, structure, or private improvement. It specifically includes any item, materials, goods, or commodities which become a part of the dwelling, building, structure, or improvement, or which are affixed to or provided with the dwelling, building, structure, or improvement, or the lot or parcel of ground on which the dwelling, building, structure, or improvement is located. The City and County of Broomfield collects use tax on building materials at the time of building permit issuance. For use tax purposes, 50% of the total project valuation is assumed to be materials in accordance with BMC 03-08-060. Homeowners performing all of their own work shall list the total materials cost on the permit application. The applicant should show the building permit payment receipt to the supplier or retail home center when purchasing materials for the project. The supplier or home center should not charge any city sales tax since the Broomfield use tax has been paid with the permit. Payment of state and RTD sales taxes is still required on all materials. Questions regarding use tax can be answered by the Sales and Use Tax Division, Broomfield Finance Department at 303-464-5812. WATER AND SEWER FEES Effective April 3 rd, 2017 Water License and Tap Fees Water license fees are based on hydraulic requirements as well as annual consumption estimates. This basis establishes a Tap Equivalent (TE) as compared to an average single family dwelling. Residential water license fees are paid at 1.0 TE per single family dwelling, 0.6 TE per townhouse unit, and 0.4 TE per apartment unit. Non-residential fees are calculated at 1.0 TE for each 163,000 gallons of estimated annual consumption. Water license fees for irrigation taps are based on an annual consumption estimate of 4.0 TE per irrigated acre of landscaping. Additional license fees may be due in the future for consumption in excess of the originally purchased water license. A drought surcharge is not presently in effect, but could be in the future in accordance with the Broomfield Municipal Code. Physical tap and meter fees are separate, additional, and subject to change; see below. THE CURRENT WATER LICENSE FEE IS $22,454.00 PER TE Minimum monthly service charges shall begin on the date a water license is purchased. See Broomfield Municipal Code Chapter 13-02-090. The fee will be based on the size of the meter, the cost of the meter at time the fee is paid, and cost for the installation of the meter. The city will maintain a current price listing for the cost of different sized meters and the installation cost for the meters. The developer or builder shall provide pits, yokes and covers; meter only fees shall be paid with the water license. Certain existing lines shall pay for the city supplied pit, yoke and cover with the meter. * Material and work conforming to city standards and specifications will be provided by the licensed contractor or plumber making the tap. $100 required inspection fee for the city to inspect the tap. ** Meters for use with re-use irrigation water are not listed and will be charged separately. Contact Building Division for tap and meter sizes over 4 inches. Page 7

Broomfield will no longer issue ¾ temporary construction meters for single family residential home construction. Beginning April 3,2017 the Building permit issued by Community Development / Building Department will include a one-time Construction Water Fee of $25.00. You will be required to use a Pre-Manufactured Meter Yoke Jumper or Idler in the meter pit for any water needed for the construction of the home prior to requesting a permanent meter set. Fire lines will be charged tap fees but are not metered. A monthly service charge for standby fire protection will be charged based on the size of the line. Sewer License and Tap Fees The minimum sewer license fee for all single family residential units effective 2/1/2013 is $12,559 plus a $50 tap inspection fee per tap for a total of $12,609. Multi-family, apartment buildings, and other attached residential buildings with one common sewer tap are assessed a sewer license fee of one equivalent residential unit (ERU) for each dwelling unit, plus the tap inspection fee. As an example, an 8-unit apartment building would purchase a sewer license for eight ERU s and one tap inspection fee: (8 x $12,559) + $50 = $100,522. Non-residential license fees are determined on a case by case basis and are based upon 320 gallons of average daily flow (116,800 gallons per year) for each ERU. All sewer taps shall be made according to the city's standards and specifications by a qualified contractor or plumber licensed by the city, and all material and labor shall be provided by the property owner. All sewer taps shall be inspected by the City and County of Broomfield. Broomfield is charged service fees for each check or draft that is returned to the bank for NSF. The average bank charge that Broomfield pays for each NSF check is approximately $27. The current $20 fee allowed by the BMC does not enable Broomfield to fully recover the cost of collection on NSF checks. A review of the NSF fee structure from the other local governments in the Denver metro area showed fees that ranged from $25 up to one hundred percent of the delinquent NSF amount. Staff recommends a change to the BMC to allow the city manager or his or her designee, with notice to be given to city council, to set the amount of the fee to allow for flexibility in setting the fee. At first reading of the ordinance council requested clarification of the language in the ordinance to more clearly outline how the fee would be determined. The ordinance presented here, as amended, reflects the changes requested. Proposed Ordinance No. 2055, as amended, amends the BMC Chapter 3-22-010 (A) - Returned Check Charge to delete the specific fee amount and allow for the city manager or his or her designee to set the fee. Since the first reading, the proposed amendment has been further amended to reflect the policy position that the fee to be charged is intended to recoup the city s actual out-of-pocket costs to handle returned checks or drafts. Currently out of pocket costs to Broomfield stands at $27.11 for each NSF check or draft. The fee to be charged will not reflect internal costs. Prior Council Action Ordinance 1207, dated December 10, 1996, established the NSF fee at $20. Ordinance 2055 passed on first reading on December 12, 2017 Financial Considerations From January 2016 to February 2017 the lowest average monthly fee for bank NSF charges to Broomfield was $20.38 per item (in July of 2016) and the highest was $37.58 (in January of 2017). The average monthly NSF fee over that time period was $27.11 per item. Broomfield incurs approximately $500 in NSF bank charges each month. Average monthly collections by Broomfield for returned check charges to customers are $370. This results in an annual shortfall related to NSF changes of approximately $1,600. Increasing the returned check fee as proposed will cover this annual shortfall. Alternatives Leave the NSF fee at $20.00 and the additional costs continue to be absorbed by Broomfield. ORDINANCE NO. 2055 AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 03-22-010 OF THE BROOMFIELD MUNICIPAL CODE RELATING TO NON SUFFICIENT FUND FEES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY AND COUNTY OF BROOMFIELD, COLORADO: Section l. Section 03-22-010 (A) of the Broomfield Municipal Code is amended to read as follows: The city manager or his or her designee shall assess a~ eraf e fee against any person who issues a check or draft to the city in payment of taxes, licenses, and permits, fines, court costs, water, and sewer services, recreational fee, or any other fees or charges collectible by the city and such check or draft is returned for insufficient funds or lack of an account or otherwise dishonored by the bank, savings and loan institution or credit union on which it is drawn. The amount of such fee shall be determined by the city manager, or his or her designee, and the manager may change the amount from time to time as the manager deems it necessary, with notice given to city council. The fee shall be determined in a manner so as to allow the city to recoup its average actual out-of-pocket costs for returned checks or drafts. Section 2.
