Akbar Jazayeri Director of Revenue and Tariffs August 2, 2005 ADVICE 1907-E (U 338-E) PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA ENERGY DIVISION SUBJECT: Submetering Installation Clarification and Tariff Revisions Pursuant to Decision 05-05-026 Southern California Edison Company (SCE) hereby submits for filing the following changes to its tariff schedules. The revised tariff sheets are listed on Attachment A and are attached hereto. PURPOSE This advice filing revises SCE s Schedules DM, Multifamily Accommodation - Residential Hotel - Qualifying RV Parks, DMS-1, Domestic Service Multifamily Accommodation, Submetered, Rule 18, Supply to Separate Premises and Use by Others, establishes the Domestic Multifamily Accommodation Submetered Declaration, Form 14-309, and withdrawals the Eligibility Declaration for Schedule No. DMS-1, Form 14-319, pursuant to Decision (D.) 05-05-026 Ordering Paragraphs 2, 3, and 7. BACKGROUND In August 2004, the National Submetering and Utility Allocation Association (NSUAA) filed a Petition for Rulemaking (Petition) requesting that the California Public Utilities Commission (Commission) open a rulemaking to consider rule changes to permit the billing of electricity on a submetered basis in existing multi-unit buildings. 1 The Petition sought modification of tariffs established by Commission Decisions 88651 and 93586. 1 As used herein, the noun submeter and all relevant forms of the word refers to a non-sce meter used to separately measure the electricity used for billing the occupants of each single-family accommodation within a multi-unit building. The master meter customer who is providing submetered service is responsible for owning and operating the electrical delivery system within a multi-unit building (which is not provided by the electric utility even for directly-metered tenants of multi-unit buildings). ADVICE 1907-E (U 338-E) - 2 - August 2, 2005 In D.88651, issued April 1978, the Commission required utilities to provide for separate metering by the utility for electric service to each unit in new multi-unit residential buildings. Pursuant to that decision, SCE closed its Schedule DM (Master Meter Tariff) and Schedule DMS (Master Meter/Submetering Tariff) to new installations. 2 Schedule DMS-1 was subsequently reopened to provide for separate metering by SCE or for individual unit submetering by the developer, owner, or operator for each unit in new multi-unit residential buildings. 3 Shortly thereafter however, following the adoption of D.93586, SCE closed Schedule DMS-1 4 again to new installations. On May 26, 2005, the Commission issued D.05-05-026, which denied the request of NSUAA to open a rulemaking, governing the provision of submetered gas and electric service, but instead provided substantially all the relief requested in the Petition. The Commission defined the term new installations as follows: new installation should be interpreted to mean a customer whose multi-unit residential building for which service is sought was constructed after the date the tariff was closed. A customer whose building was constructed prior to the date the Master Meter / Submeter tariff was closed and was served as a master meter customer would be eligible to convert from its Master Meter Tariff to the Master Meter / Submeter tariff. 5 Therefore, pursuant to Ordering Paragraph 2 of D.05-05-026, SCE has revised its Schedule DM to provide that a customer currently served under this Schedule whose multiunit residential building was constructed prior to December 7, 1981, and now includes submeters, is eligible to receive service under Schedule DMS-1. In addition, Ordering Paragraph 7 of D.05-05-026 stated that to the extent that an existing Master Meter Tariff (Schedule DM) customer converts to the Master Meter/Submeter Tariff (Schedule DMS-1) and begins billing submetered tenants for electricity, that customer shall concurrently revise its rent downward to reflect the removal of the energy-related charges for the duration of the lease consistent with Public Utilities Code 739.5. Schedule DM has been revised in accordance with this directive. Moreover, in accordance with Ordering Paragraph 3 of D.05-05-026, buildings that were originally constructed for a non-residential purpose that have since converted to residential use either before December 1981 or without the need for a building permit on or after July 1, 1982 should be eligible to convert from their prior tariff to the existing Master Meter/Submetering Tariff. As such, corresponding language has been added within Rule 18.B. ADVICE 1907-E (U 338-E) - 3 - August 2, 2005 To determine eligibility based on the above requirements, as well as document which condition a customer has met to receive service under Schedule DMS-1, SCE proposes to establish the Domestic Multifamily Accommodation Submetered Declaration, Form 14-309. SCE is simultaneously withdrawing the Eligibility Declaration for Schedule No. DMS-1, Form 14-319 as it was last revised in May 1989, and is now obsolete. No cost information is required for this advice filing. This advice filing will not increase any rate or charge, cause the withdrawal of service, or conflict with any other schedule or rule. EFFECTIVE DATE This advice filing will become effective on the 30th calendar day after the date filed, which is September 1, 2005. ELIGIBILITY DECLARATION FOR SCHEDULE NO. DMS-1 (Not Applicable to Installations Made After December 6, 1981) TO SOUTHERN CALIFORNIA EDISON COMPANY (EDISON) : The undersigned Customer hereby : 1. Declares that the Edison Meter No. installed prior to December 7, 1981, in the Customer's Park located at provides electricity to submetered spaces for only nontransient residential trailers, qualifying recreational vehicles (RV's), and/or mobilehomes ; and each is used as a residence and has been in the same space at least nine months out of the year. 2. Understands that : (a) A nontransient residential trailer is a trailer qualifying as a single-family dwelling used as a permanent residence that has been in the same space at least nine months out of the year, is not used as a recreational vehicle, and is not pulled out of the park on a regular basis, except that any such permanent residence trailer which has, within the last nine months, been permanently located in a space with the intent of rem f e ti o ay be considered a nontran (b) A q t that is used as a permanen' for at least nine months o he qualifying RV is not to be re el ti:c to be pulled out of the park on a regular basis. (c) A mobilehome is a structure designed for human habitation and for being moved on a street or highway under permit pursuant to the California Vehicle Code. Mobilehome also includes a manufactured home as defined in the California Health and Safety Code, but does not include a recreational vehicle or a commercial coach as defined in the California Health and Safety Code. 3. Declares that there is a total of submetered spaces connected to said Edison meter, of which spaces are vacant, spaces are occupied by nontransient residential trailers, spaces are occupied by qualifying RV's, and spaces are occupied by mobilehomes (each as defined in Paragraph 2 above) ; and further agrees to furnish Edison with information and business records acceptable to Edison to support this declaration. 4. Declares that no spaces served by said Edison meter are held out for rental to an RV which is not a qualifying RV as defined above. 5. Declares that the Edison Meter, referred to in Paragraph 1 above, does not provide service to nonresidential load such as a motel, store, or restaurant, which exceeds 300 watts of lighting or 2 horsepower of power. 6. Understands that where a Customer's account is eligible for and receiving service under Schedule No. DMS-1, it is necessary to bill the tenants receiving such service based on the actual kilowatthour usage registered on the tenant's submeter and at the same domestic rate Edison would charge if serving the tenant directly. 7. Understands that : (a) All the terms and conditions of Edison's tariffs, including Schedule No. DMS-l, as now stated or as revised by the Public Utilities Commission shall apply. (b) It is the Customer's responsibility to notify Edison of any change in the Customer's operation which disqualifies this account for this rate, or which affects any provision of this rate relating to the number of Baseline allocations or submetered discounts. (c) Eligibility for service under Schedule No. DMS-1, including the number of nontransient residential trailers, qualifying RV's and mobilehomes, number of spaces, and any information provided regarding Baseline allocations is subject to verification, from time to time, by Edison. (d) In the event Edison determines that Customer's Park is not eligible for service under Schedule No. DMS-1 or the Customer has not complied with this Eligibility Declaration, the Account will be transferred to an applicable rate schedule and the Customer may be rebilled accordingly. RATES The rates of the single-family domestic rate schedule, Schedule D, shall be adjusted as follows: Energy Charge: The baseline quantity to be billed under rates designated as applicable to Baseline Service shall be determined by multiplying the applicable baseline quantities set forth below in Special Condition 8, by the number of single-family accommodations in (1) a multifamily accommodation; or (2) qualifying residential units in a residential hotel; or (3) qualifying RV units in a qualifying RV park; plus any eligible Medical Baseline Allocations. Diversity Adjustment: Distribution charges shall be increased by $0.100 per single-family accommodation in a multifamily accommodation or qualifying residential unit in a residential hotel, or qualifying RV unit in a qualifying RV park, per day for diversity of baseline use by tenants. Minimum Charge: The Minimum Charge shall be the same as set forth in Schedule D. SPECIAL CONDITIONS 1. Seasonal Service: For summer cottage customers and others who normally require service for only part of the year, service under this Schedule may be applicable only on annual contract. 2. Notification: It is the responsibility of the customer to advise SCE within 15 days following any change in the number of single-family accommodations in a multifamily accommodation, residential units in a residential hotel, or qualifying RV units in a qualifying RV park that qualify for basic Baseline allocations, and any change in qualifications for other than basic Baseline allocations. Separate Metering. Separate Premises will not be supplied through the same meter nor will the electric loads of such separately metered Premises be aggregated physically, electronically or otherwise, except as may be specifically provided for in the tariff schedules. B. Nonresidential Loads. In accordance with Rule 16, electric service shall be individually metered to each tenant in a non-residential building or group of buildings or other development on a single Premises with multiple tenants or enterprises. However, where, in the opinion of SCE, it is impractical to meter each tenant individually or where the Commission has authorized SCE to supply electric service through a single meter, SCE may provide service through a single meter subject to the provisions of Sections E and G below. Buildings originally constructed for a non-residential purpose that subsequently converted to residential use on or after December 7, 1981 without the need for a building permit shall be eligible to convert from their prior rate schedule to an existing applicable domestic service submetering rate schedule. Any non-residential building converted to residential use, for which a building permit was required on or after July 1, 1982, must be separately metered by SCE. (N) (N) C. Other Uses or Premises. A customer shall not use electricity received from SCE upon other Premises, except for SCE s operating convenience, nor for other purposes than those specified in the customer s application or in the rate schedule applied. D. Customer with Multiple Service Accounts/Meters at a Single Premises. When a customer (single enterprise) occupies a single Premises with multiple service accounts/meters, the readings of such meters shall not be combined for billing purposes except as provided for in Rule 9.B. However, if the customer physically aggregates the electric loads of such multiple service accounts/meters into a single service account (master-meter), the account will be provided service under an applicable rate schedule. E. Use by Others. A customer shall not charge for electricity received from SCE and used by another person, except: 1. Where energy is purchased at rates specifically applicable to resale service; or 2. Where the charge to domestic or nondomestic tenants is absorbed in the rental for the Premises or space occupied, is not separately identified, and does not vary with electrical usage. In such cases, where a customer subsequently converts to and receives service under an applicable submetering rate schedule, tenant rental charges shall be reduced for the duration of the lease to reflect removal of the energy related charges. 3. Where the customer is the owner, lessee, or operator of a multifamily accommodation and submeters electricity furnished for use by a domestic tenant in a single-family dwelling at the same rates that SCE would charge for the service if supplied directly and such customer's account is eligible for service under Schedule DMS-1 or DMS-2. In such cases, said owner, lessee, or operator shall furnish, install, maintain, and test the submeters. This electrical usage applies only to the single-family dwellings and excludes other electrical usage such as for swimming pools, recreation rooms, or laundry facilities which are used in common by tenants.
