FAQ CONSENT APPLICATION What information do I need to apply? You must complete all sections of this application form and submit a legible sketch that contains the required information (see sketch requirements on next page). Please submit one (1) copy of your application form and one (1) copy of all sketches and plans on legal size paper (8 ½ x 14) and an electronic copy of your complete submission on a USB drive. Please note: Incomplete applications will not be processed and only authorized individuals (see Section L) can submit the application and work on the file. Staff cannot complete your application. Please note that additional information may be required once a full review has been completed by staff and outside agencies. How do I determine if my proposal will comply with the City s By-law requirements? Please consult with a Zoning Plans Examiner in the Building Department, located on the 1 st Floor of City Hall to obtain the relevant zoning information to assist you. Please note: The City of Vaughan does not assume responsibility for identifying deficiencies. When will my application be scheduled? Upon submission, all applications for minor variance and consent will require a zoning review to determine completeness. Preliminary zoning review is approximately 5-7 business days. Tentative hearing dates will not be provided at the time of submission. Once zoning deficiencies have been addressed by the applicant, as confirmed by the Building Standards Department (Zoning Section), staff will provide tentative hearing date. Where do I submit my application? You must submit your application in person to Committee of Adjustment staff located in the Clerk s Department at City Hall located at 2141 Major Mackenzie Drive, 1 st Floor. Staff are available 8:30 a.m. to 4:30 p.m. Monday through Friday (excluding holidays). Who can commission my application? Commissioners for taking oaths / affidavits are available within the Clerk s Department at City Hall. Please be prepared with photo identification to confirm identity and ensure that you have been properly authorized to submit the application. Please see Section L for more information on authorization requirements. In addition, your solicitor or a public notary can also perform commissioning services. What forms of payment are accepted? The City of Vaughan accepts cash, cheque, credit and debit. To process payment, you must obtain a receipt from Committee of Adjustment staff. Applicable fees must be submitted with the application. An additional fee, payable to Toronto Region Conservation Authority (TRCA) will be applicable if this application is within the TRCA regulation limit and may be imposed as a condition of approval. Additional fees may apply. All fees are subject to change. Public Notice Requirements: In accordance with the Planning Act, the applicant will be required to post a sign (template will be provided by Committee of Adjustment staff at the time of submission). The sign must be posted at least 14 days prior to the hearing date, and be placed in a location that is clearly visible and legible from a public highway (point of public access). The applicant will be required to submit two (2) photos, 1 where the street is visible and 1 close-up). Failure to meet public notice requirements will result in deferral of the application. In addition to the sign being posted on the subject land, Committee of Adjustment staff will mail public notice to every owner of land within 60 metres. Staff Review: Once an application has been scheduled it will be circulated and reviewed by staff and outside agencies for the purposes of providing comments and recommendations to the Committee of Adjustment. In the event an unforeseen issue should arise or additional information (i.e. environmental and technical studies) is required, staff will recommend adjournment of the application until the issues have been resolved and outstanding information has been provided and reviewed by staff. If an application requires recirculation after public notice has been issued additional adjournment/recirculation fees will apply. Staff & Agency Comments: Staff and Outside Agencies (i.e. TRCA) act as advisory bodies to the Committee of Adjustment. Comments and recommendations received from staff and outside agencies will be made available in a Staff Report which is available on the City of Vaughan website (under Agendas ) approximately one (1) week prior to the scheduled hearing. Public Correspondence: Public correspondence received will be made available on the City of Vaughan website up until 12:00 p.m. of the scheduled hearing date. Adjournment: Please note that all meeting dates are tentative. Incomplete applications will not be processed and applications requiring preliminary approvals (i.e. site plan, zoning by-law amendments etc.) additional studies, reports (i.e. parking, environmental etc.) and information may require adjournment/deferral to obtain comments and recommendations from staff. Meeting: Committee of Adjustment meetings begin at 6:00 p.m. in the Committee Room 242/243 located on the 2 nd floor of City Hall, 2141 Major Mackenzie Drive, Vaughan. The Committee of Adjustment meeting schedule is posted on the City of Vaughan website. Please note that all meeting dates and location are subject to change. Attendance at Meeting: The applicant (owner) or authorized agent is to attend the meeting to respond to any questions or concerns the Committee or members of the public may have. In the absence of authorized representation, the Committee may adjourn an application or render a decision. Adjournment/Recirculation fees will be applicable, if required. Representation at Meeting: You must have written authorization to address the Committee of Adjustment on behalf of the owner(s) / applicant(s) at a hearing. Written authorization should be provided to the Secretary Treasurer prior to the meeting. Please note that this does not apply to parties authorized in Section K of this application. Local Planning Appeal Tribunal (LPAT): A Notice of Decision will be mailed to the applicant and all those who requested a copy of the decision in writing 15 days after the decision has been made. There is a period of 20 (twenty) days from the mailing of the Notice of Decision during which it may be appealed to the LPAT. An appeal may also be launched if a decision is not made within ninety days of the receipt of a properly completed consent application. The LPAT charges an appeal fee of $300.00, plus $25 for each related appeal. Please note that the City of Vaughan also charges an additional administrative fee per application appealed (see Fee Schedule). Conditions of Approval (Consent): The Committee s decision is not final approval. The applicant (owner) must fulfill all conditions imposed upon a provisional consent within a period of one year from the date of the mailing of the Notice of Decision. Neither the Committee nor Staff has authority to permit an extension to the one (1) year limitation. Please review all conditions of approval and consult respective department and/or agency for more information. Certificate of Official: Once the Secretary Treasurer has received written confirmation from staff and outside agencies that all conditions are satisfied (within the prescribed time) the Certificate of Official can be released. The Certificate must be registered on title within two years from the date of issuance or it will lapse. Application for Consent July 2018

Sketch Requirements Please ensure that all dimensions are in metric units (metres). For your application to be considered complete, a legible sketch or draft reference plan must be included as part of this application which shows: The boundaries any land abutting the subject land that is owned by the owner of the subject land. The boundaries and dimensions of the subject land, highlighting the part that is to be severed and the part that is to be retained (or if required, the location/dimensions of a proposed easement, lands to be leased etc.) The location, size and type of all existing and proposed buildings and structures (such as dwellings, sheds, cabanas, decks, pergolas, pools, retaining walls etc.) on the subject land, indicating the distance of the buildings or structures from the front yard lot line, rear yard lot line and side yard lot lines in accordance with the proposed severed and retained lot lines (see sketch below for example). The distance between the subject land and the nearest township lot line or landmark such as a bridge or railway crossing. The location of all land previously severed from the parcel originally acquired by the current owner of the subject land (include previous application number). The approximate location of all natural and artificial features on the subject land and on the land, that is adjacent to the subject land that, in the opinion of the applicant may affect the application. Examples include buildings, railways, roads, watercourses, drainage ditches, river or stream banks, wetlands, wooded areas, wells and septic tanks. The existing uses on adjacent land, such as residential, agricultural and commercial uses. The location, width and name of any roads within or abutting the subject land indicating whether it is an unopened road allowance, a public travelled road, a private road or a right of way. If access to the subject land is by water only, the location of the parking and boat docking facilities to be used. The location and nature of any easement affecting the subject land. North Arrow If you require variances for lot area and lot frontage to facilitate your consent application it is recommended that you submit a draft reference plan, prepared by an Ontario Land Surveyor to ensure requested variances are correct. Notification Sign Requirements The Planning Act requires that a notice sign be posted on the lands affected by a minor variance or consent application. A minimum of one sign must be posted for each road frontage the subject property has. Please consult with the Committee of Adjustment staff to confirm the number of signs required. The following instructions must be followed with respect to the required signage: 1. Committee of Adjustment Staff will provide sign template to applicant. 2. The sign must be posted a minimum 14 days prior to the hearing date, as required by the Planning Act. 3. You must provide two (2) photos (1 where you see the street in the photo and 1 close up, where the sign can be read). Please submit both photos (prior to posted deadline noted above) as proof that the sign has been erected. Failure to provide proof of the signage will result in the delay of the hearing of this application. Photographs should be e-mailed (please quote the file number in the Subject line) to CofA.photos@gmail.com 4. The sign(s) must be laminated or enclosed in a waterproof sheet, and must be no smaller than 11 X 17 in size. Signs must be clearly legible from the street line (if not legible please produce larger sign). The lettering must be in black on a white background (see sample below). 5. The sign(s) must be erected on the land subject of the application at approximately three (3) metres from the property line at approximately the centre of the lot frontage. 6. Yes No H. Toronto & Region Conservation Authority (TRCA) As part of the review process The City of Vaughan circulates your Minor Variance application to the TRCA. If your property is located within a TRCA area of interest your application will require review by the TRCA s Planning and Development Department for comment and may require the submission of additional information to support your proposal (i.e. environmental inventory/assessment, sediment control plan, restoration / rehabilitation / landscape plans or engineering reports if applicable). Other requirements may include surveys/studies of natural features and/or hazard lands such as floodplain mapping and geotechnical reports. If your property is located within a TRCA area of interest a separate TRCA Review Fee will apply (payable to the TRCA).
