2 Appication/Agreement to Use Association Amenities and Reease of Liabiity (Avaiabe Amenity: Poo) (AKTA) Kensington Trais Association of Homeowners, Inc. Appicant hereunder represents to be the property owner and by his/her signature beow acknowedge and accept the terms and conditions contained herein. After Appicant has signed this Appication and Agreement, Appicant shoud make a copy for his/her persona fies. Shoud a copy of this agreement be required at a ater time pease contact Goodwin Management, Inc., (512) or emai AmenityAccess@Goodwintx.com to request a copy. In consideration of being provided access to any of the Association s amenities incuding, but not imited to, swimming poos, basketba courts, tennis courts, voeyba areas, payscapes, pay features, cubhouse, amenity center, bathhouse, boat docks, piers, parks, trais, greenbets, parking areas, parking garages, etc.. Appicant hereby agrees that the use of such amenities is at the soe risk of Appicant, Appicant s famiy, Appicant s guests, Appicant s tenants, Appicant s invitees, or anyone for whom Appicant faciitates access to said amenities. Appicant acknowedges that amenities may be unsupervised (no ifeguard) and that accident, injury, or death may occur as a resut of use. Appicant hereby agrees to indemnify, defend, and hod harmess the Association, Goodwin Management, Inc., the Association s agents, empoyees, and contractors, from and against any and a caims, demands, causes of action, and/or iabiities associated with the use of the Association s amenities by Appicant, Appicant s famiy, Appicant s guests, Appicant s tenants and their guests, Appicant s invitees, or anyone for whom Appicant faciitates access to said amenities. For purposes of this paragraph, the term Appicant sha be deemed to be Appicant, Appicant s famiy, Appicant s guests, Appicant s tenants and their guests, Appicant s invitees, and anyone for whom Appicant faciitates access to the amenities. Appicant agrees to abide by a pubished and/or posted rues and reguations associated with the amenities and to obey the instructions of any person or entity that may be present at such amenities for the purpose of monitoring or controing amenity use on behaf of the Association. (For exampe, poo monitor instructions must be obeyed.) Appicant agrees to use amenities in a reasonabe and typica manner during the time frames aowed by the Association, to not make excessive noise so as to disrupt or disturb others, and to imit guests to the number aowed by the Association s rues/reguations as same may be determined from time to time. Uness additiona rues/reguations are more restrictive, Appicant agrees that a parties and groups of more than 4 peope require specia permission from the Association. Appicant agrees to provide a copy of this Appication and Agreement (incuding any attached additiona rues/reguations) to any tenant of Appicant and to have tenant agree to abide by a provisions required of Appicant Pick Up: If you seected to pick up your access device (key, access card, access code, remote), you wi receive a ca or emai when it is ready. We are ocated at Research #100, Austin, TX and are open 8:30 am unti 5:30 pm. Deivery by Mai: If we are maiing the access device, pease aow 3-4 days for deivery. IMPORTANT!!! Your account must be current in order for us to provide you an access device. Access Device Charge Poicy: 1st Poo Card at No Charge. An Additiona Card or Repacement Card $30. Limit 2 Cards Per Househod. Any charges wi be bied to your HOA account. Payment for Access Devices: Any charges wi be posted to your account based on Charge Poicy above. 3 Kensington Trais Community Poo Rues Kensington Trais Homeowners Association is NOT responsibe for accidents or injuries at the poo. There are NO ife guards on duty. Residents use these faciities at their own risk. POOL HOURS: Apri October Tuesday Sunday (Cosed Monday for ceaning) 6:00am-9:00pm 1. NO DIVING, RUNNING, HORSE PLAY, EXCESSIVE NOISE LEVELS, ABUSIVE LANGUAGE OR ABUSE OF POOL PROPERTY 2. NO CHILD UNDER 16 YEARS OLD WITHOUT AN ADULT 3. NO GRILLS permitted in the poo area. 4. NO GLASS BOTTLES ALLOWED IN THE POOL AREA. Drinks are aowed in the poo area but not aowed in the poo. 5. NO FLOATATION DEVICES at a except arm foaties, noodes or safety foatation for chidren 6. PARENTS ARE RESPONABLE FOR THE BEHAVIOR & SAFETY OF THEIR CHILDREN 7. LIMIT OF 4 GUEST PER FAMILY. Guest must be accompanied by resident whie visiting the poo. Resident is responsibe for the behavior of their guests. DON T end your poo card out to anyone. 8. POOL GATE SHOULD REMAIN LOCKED AT ALL TIMES. Under no circumstances shoud the gate be propped open. The fence and gate that surround the poo area are for residentia protection. 9. NO PETS ALLOWED in poo area 10. NO TOBACCO PRODUCTS, DRUGS OR ALCOHOLIC BEVERAGES 11. NO SEXUAL CONDUCT in poo or surrounding areas Updated June 12, of 3
4 12. TRASH MUST BE DISPOSED OF PROPERLY. Trash can be thrown away in garbage can on site or taken back to resident s home. 13. CLEAN UP AFTER YOURSELF WHEN USNG THE RESTROOMS. The restrooms are ceaned and sanitized once a week. 14. APPROPRIATE ATTIRE REQUIRED; no cut-offs or jeans aowed in the poo; chidren that are not potty trained shoud be in swim diapers 15. NO SKATEBOARDS, ROLLER BLADES, BICYCLES OR OTHER VEHICLES aowed in poo area 16. NO PARTIES ARE ALLOWED due to imited space and consideration of a homeowners. 17. HOA WILL NOT BE RESPONABLE FOR LOST OR STOLEN ITEMS brought to poo area 18. VANDALISM AND USING THE POOL AFTER HOURS wi resut in oss of access to the poo immediatey and crimina charges wi be pursued. 19. ANY DAMAGES OR COST INCURRED BY THE ASSOCIATION FROM DAMAGES OR NEGLIGENCE WILL BE BILLED TO THE HOMEOWNER AND WILL BE SUSPENDED FROM THE POOL PERMANENTLY. 20. ONE KEY CARD WILL BE PROVIDED PER HOUSE IN GOOD STANDING AT NO CHARGE. POOL MEMBERSHIP FORM MUST BE COMPLETED BEFORE KEY CARD IS ISSUED. Repacement cards wi cost $30, od cards wi be deactivated. A resident that owes HOA dues or fines from vioations is not in good standing. Resident wi need to pay a fees before a key card is activated. 21. FAILURE TO FOLLOW POOL RULES CAN LEAD UP TO PERMANENT LOSS OF POOL PRIVILEGES.
