2 How it all works We like to keep things simple and understandable at Hunter. So if you are looking for a lovely new home to rent, it couldn t be easier. We do need to gather a lot of information, but we hope we ve made it as simple as possible for you. So what do you need to do? 1 Read through this pack In particular make sure you are happy with the terms and conditions in section 7. If you have any queries whatsoever, please drop us an or call us. 2 Gather the information Then complete the forms in sections 1-5. Please note that we need originals of the documents specified in section 6. 3 Come and see us We will go through the documentation and answer any questions you have. Our homes get rented out very quickly, so if you want to secure a home you can pay a reservation deposit. 4 Pay the bond and the first month s rent And we will agree a move in date for you! 5 Move in and relax! 9 Assured Shorthold Tenancy Pack 6 Terms and conditions 1. Definitions 1.1. In these terms and conditions we or us means Hunter Property Limited the landlord and letting agent as detailed in section you means the tenant as detailed in section property means the rental property as detailed in section AST means this document the Assured Shorthold Tenancy agreement. 2. Reserving a property 2.1. To reserve a property, you need to complete and sign this AST pack (sections 1 7), and pay the securing deposit of one week s rent. To avoid disappointment, it is in your interest to return the completed forms and monies quickly, so that we can process your application. If you are in a hurry to move into the property it is important to ensure your securing deposit clears quickly (online bank transfer is quickest) Until we receive a completed application form and your deposit we will continue to advertise our property and show prospective tenants around, which means you are at risk of losing this property to another applicant The securing deposit is non refundable. The exception of this is if the property is withdrawn and no longer available The deposit you have paid will be deducted from your first week s rent. 3. Length of the tenancy 3.1. All tenancies begin as a 6-month AST (Assured Shorthold Tenancy) contract. At the end of the 6 months, the tenancy automatically switches into a rolling monthly contract providing there are no arrears or other issues outstanding This means that there are no further signatures required which benefits you and us. 4. Checking in 4.1. Checking in is the day all the paperwork is completed and financial arrangements are made Once the completed application forms have been received and checked we will contact you to arrange a date for moving in We have the right to refuse you tenancy at any time without explanation, our decision will be final and binding and because of the requirements of the Data Protection Act 1998 we cannot enter into any discussion or explanation on any such decision Hunter Property Ltd does not charge an administration fee In order to avoid embarrassment and additional costs you will not be able to check in unless: All necessary payments have been made and cleared All tenants are able to sign the necessary legal documentation before the tenancy begins Standing order payments are set up and completed 4.6. The check in process, signing of contracts and reviewing the inventory will take place at the property. You will be given a copy of the inventory for your records If you require a duplicate contract or inventory, we will charge you 5.00 per item. 5. Moving in 5.1. Appointments to move into the property can only take place with prior arrangement. We will plan to meet you at the property to complete the contract and inventory, the keys will be handed over providing the necessary funds have been paid and cleared On the day of moving into the property, we expect to have received from you a bond (1 week s rent as security against damage) and one week s rent in advance. Please note the rent may be more than one week, depending on the exact tenancy commencement date. The amount will be confirmed at check in Two sets of keys will be provided on the moving in date. We will not be able to issue keys until we have received the first month s rent and the bond. Page 9 of 14

10 6. Bond (sometimes called a deposit) 6.1. We retain a bond as security. For your protection this is lodged with the Deposit Protection Service which is an independent third party authorised by the UK Government. No interest is paid on this bond. Tel Web At the end of your tenancy your bond will be returned to you if no deductions are made as a result of damage or other debts to us. We will return the bond by bank transfer within 10 days If, however, at the end of the tenancy, you owe us more than the value of the bond, we will retain the bond and require you to pay us any balance within 14 days of the end of the tenancy In the case of a dispute between you and us regarding the amount of bond to be repaid, DPS have a dispute resolution service which we use. 7. Rent payments 7.1. Rent must always be paid by standing order or direct debit on the same day each week (this is normally Friday); an online application form for this will be shared with you at the check in and must be completed before the tenancy can commence If you do not pay the rent on time we will charge you a late payment fee of 10 for every week you are in arrears Rent will be reviewed every year on the anniversary of the move in date and may be increased on or after this date. 8. Your obligations. Things you must do: 8.1. You must keep the property clean and tidy and in good condition, repair and decorative order: You must not permit any damage to the property, or make any alteration or addition to the property without our consent, and pay for any repair as a result of damage caused by your actions You must not remove any of our possessions from the property You must keep the windows clean You must ensure the property is kept secure at all times, locking doors and windows You must ensure that the property remains adequately heated and ventilated throughout the tenancy especially during the winter months to avoid damage from condensation. If condensation occurs, you must promptly wipe down and clean surfaces as required to avoid the build-up of mould growth or damage to the property, its fixtures and fittings You must take appropriate action to protect the property from frost damage You must not cause any blockage to the drains, pipes and gutters. Common causes of blockages for which you would be responsible would include, but not limited to, pouring oil or fat down the sink, not removing hair from plugholes and flushing inappropriate items (such as disposable wipes and sanitary towels) down the toilet You must notify us promptly of any wet rot, dry rot or infestation by wood boring insects You must not add any cable supply, aerial, antenna or satellite dish to the property without our consent, which will not be unreasonably withheld You must keep the garden neat and tidy You are responsible for providing your own disposable items such as toilet rolls, washing up liquid, dustbin liners etc Energy. If your room has its own electricity meter which records usage; the reading will be noted on the day you move in. Although energy and utility bills are paid by us, we ask you to be environmentally aware and keep energy bills to a fair level (e.g. not having heating on whilst the are windows open and avoiding long showers). If energy bills become excessive, we may ask you for a supplement or raise the weekly rent to cover the difference Locks. You must not change the locks (or install additional locks) to any doors, nor make additional keys without our consent, which will not be unreasonably withheld If you lose your keys, we will charge 15 for duplicate keys and 75 for change of locks per lock 8.4. You must pay the costs of any court action taken for possession of the property or breach of tenancy, as provided Page 10 of 14

11 for in the court s judgement You must promptly notify us by phone or if you become aware of: Any defect, damage or want of repair in the property, other than such you would be expected to repair yourself Any notices or letters relating to us, or the property, and forward them promptly Any loss or damage, which may give rise to a claim under our insurance You must not permit any visitor to stay in the property for a period of more than two nights within any week You must not sublet the property or permit anyone else other than those people on this AST to live at the property You must ensure that all additional adult occupiers of your room maintain a right to rent as defined by the Immigration Act 2014 at all times during the term Access. After we have given 24 hours notice, you must permit us or our agents, to enter your room at reasonable hours of the daytime using our own keys where necessary: To view the state and condition and to execute repairs and other works To show prospective purchasers of the property during the tenancy, or To show prospective tenants the property, during the last month of the tenancy Please note: We will only access your room without 24 hours notice in an emergency Safety You must report to us any brown or sooty build up around gas appliances or any suspected faults You must not keep or use any oil stove, paraffin heater or other portable fuel burning appliance You must not keep motorcycles or other similar machinery inside the property except in an outbuilding or garage You must not prop open any fire doors in the property or tamper with the self-closing mechanisms You must not cause obstruction in any common areas of any building of which the property forms a part. We reserve the right to remove any such obstruction and charge you reasonable costs for so doing You must not tamper with the smoke alarms or emergency lighting You must not smoke anywhere in the property or permit friends or visitors to do so either For the safety of all tenants, please don t leave external doors open so that a stranger could walk in off the street 8.9. Being socially responsible and a good neighbour Please keep shared areas clean and tidy for the sake of other tenants. Clean the kitchen after use so it is ready for the next person. If using a shared shower, please keep showering time short for the sake of other users and the environment, and remove your hair from the plug Please sort your rubbish and place it in the appropriate wheelie bin. Make sure the bins are placed at the kerbside for collection on the appropriate day You must not allow anything, which may be, or may be likely to cause, a nuisance or annoyance to a person living or visiting in the area. This includes the actions and behaviour of your visitors and friends. Please bear in mind that older properties have poor sound insulation and neighbours can easily hear music, TV or loud voices through the walls You must not carry on any trade or profession upon the property nor receive paying guests but use the Property only as a private residence You must not use or allow the property to be used for any illegal or immoral purpose (note, unauthorised taking or possession of controlled drugs is considered to be illegal for the purpose of this clause). 9. Our obligations We will pay all utility bills gas, water, electricity, TV licence, cable, and council tax We must allow you quiet enjoyment of the property during the tenancy without any unlawful interruption We must return to you any rent paid for any period while the property is rendered uninhabitable by fire or other risk for which we have agreed to insure. 12 9.4. We must maintain a comprehensive insurance policy with a reputable company to cover the property, and our fixtures, fittings, furniture and effects (including carpets and curtains), but not including your belongings or liabilities for damage. This will not override your responsibility to pay for damage you cause to the property We must agree to provide a copy of the insurance if required We must not be responsible for any loss or inconvenience suffered as a result of a failure of supply or service to the property, supplied by a third party, where such failure is not caused by an act or omission on our part We must pay your reasonable costs, reasonably incurred and which cannot be mitigated, if we fail to keep the appointment to check the inventory at the end of the tenancy and another has to be scheduled. You agree to provide receipts to prove any costs incurred. 10. We agree to fulfil our repairing obligations contained within Section 11 of the Landlord and Tenant Act These are quoted below: To keep in repair the structure and exterior of the dwelling house (including drains, gutters and external pipes); To keep in repair and proper working order the installations in the dwelling house for the supply of water, gas and electricity and for sanitation (including basins, sinks, baths and sanitary conveniences, but not other fixtures, fittings and appliances for making use of the supply of water, gas or electricity); and To keep in repair and proper working order the installations in the dwelling house for space heating and water heating. 11. Repairs and Emergencies If a fault develops, please visit our website maintenance page and log a fault If there is an immediate safety risk to tenants or property, please call the following numbers 24/7: Office (normal office hours) Nigel For call outs, where you have been at fault (e.g. you have lost your room keys) we will charge you Insurance We have buildings insurance for the fabric of the property However we strongly advised you to have your own property contents insurance policy certificate by the move in date. We cannot be held responsible for any loss or damage of your property whilst you are a tenant. 13. Pets Pets are not permitted in our rooms for rent except with our express permission. If permission is refused, no reason will be given. If a pet subsequently becomes a nuisance to you will either need to leave or re-home the pet with one week s notice. 14. Renewal of or ending the tenancy contract Once the initial 6-month AST period has expired, your tenancy becomes a periodic monthly contract so you only need to give us 1 month s notice if you wish to end the tenancy. If we want to end the tenancy, we will also give you 1 months notice If changes need to be made to a tenancy agreement (e.g. the names on the agreement change), there will be a administration fee If you do not pay your rent or breach any of the other rules in this AST and you do not leave when asked, we may obtain a court order. A notice served under Section 21 of the Housing Act 1988 gives us the right to end this AST without specific reason after the initial 6 months contract has ended You must return the property in the same good clean state and condition as it was in at the beginning of the tenancy and make good, pay for the repair of, or replace all such items of the fixtures, fittings, furniture and effects as shall be broken, lost, damaged or destroyed during the tenancy You must leave the property in the same state of cleanliness as listed in the inventory Leave the fixtures fittings, furniture and effects in the rooms and places in which they were at the beginning of the tenancy Remove all rubbish All keys must be handed over at the end of the tenancy. 15. Early vacation of property Should you wish to vacate the property before the end of the notice period then we will endeavour to find Page 12 of 14

13 replacement tenants However, until the property is re-let you will remain liable for the rent and all utility bills during the notice period.
