No subletting may occur without first obtaining approval from the Board of Directors of Yellowstone Blvd. Owner s, Corp. Your completed package should be sent to: John B. Lovett & Associates, Ltd., c/o Victoria A. Balbuena th Avenue College Point, New York ***Contact Victoria: vbalbuena@lovettrealty.com Direct Phone: Rules to Sublet Apartment: Shareholders are permitted to sublet after one year of initial building residency by the shareholder of record. The maximum allowable term that a shareholder is allowed to sublet is three (3) out of every 5 (five) years. Apartment rentals can be used for residential use only. The monthly rent must be market value. The minimum term for a sublet is one year. Short term leases are prohibited by current law. If applicant has a pet, the pet must attend the interview. Please refer to the Pet Rider (included in acknowledgements/authorizations) for detailed specifications in regard to pets. The number of sublets at any one time (including sponsor sublets) for any reason cannot exceed 20% as owner occupancy rates cannot fall below requirements set by mortgage lenders for occupancy. In order to process the sublease, the Board of Directors requires that you submit one (1) original and one collated set of Sublease Application Package (Total of 2 set) with the following fees in Certified Check or Money order Only: 1. Non-Refundable Processing Fee in the amount of $ made payable to John B. Lovett & Associates, Ltd. 2. Non-Refundable Credit Report Fee in the amount of $75.00 PER APPLICANT, made payable John B. Lovett & Associates, Ltd. 3. Non-Refundable Criminal Background Fee in the amount of $ PER APPLICANT AND/OR PER OCCUPANT. Please make the check payable to John B. Lovett & Associates, Ltd. (Please note that everyone over the age of 18 must complete the authorization form). 4. 2 5. Refundable Move-out Deposit from the Shareholder in the amount of $ must be submitted with the application. Please make check payable to Yellowstone Blvd. Owner s, Corp. 6. Refundable Move-in Deposit from the Applicant in the amount of $ must be submitted with the application. Please make check payable to Yellowstone Blvd. Owner s, Corp. Move in/out security deposits are refundable only after the move is complete, the House Rules have been adhered to, and no damage has been done to any part of the building. 7. Sublet Fee: Paid by Shareholder A Sublet Fee based on the below schedule must be paid together with the submission of the Sublease Application. If the Board of Directors denies the Application, the Sublet Fee will be returned. If the Sublet is approved, this Sublet Fee is then non-refundable, and if for example, the Subtenant vacates the premises prior to the end of the Sublease term for any reason whatsoever, there will be no refund of any pro-rata portion of the Sublet Fee. Please make check payable to: Yellowstone Blvd Owner s Corp. Records on length of sublets will be kept on a cumulative basis for each apartment for purposes of determining fees. Fees are per apartment, not per subtenant. Period of Sublet: 1st year 10% of annual maintenance 2 nd year 15% of annual maintenance 3 rd year 20% of annual maintenance Please Note: when the sublease renewal is due, and has been approved by the Board of Directors, the shareholder will be notified in writing by Management. At the time the renewal is processed a non-refundable $ Sublease Renewal fee is due and payable to John B. Lovett & Associates, Ltd. Upon receipt of all documents, letters and fees, a meeting/interview will be scheduled with the Board of Directors and the prospective applicant (s). PLEASE NOTE THE FOLLOWING: INCOMPLETE PACAKGES WILL BE RETURNED TO SENDER. DO NOT BIND OR STAPPLE APPLICATIONS TOGETHER. NO DOUBLE SIDED PAGES. ALL PAYMENTS MUST BE IN THE FORM OR MONEY ORDER OR BANK CERTIFIED CHECKS All sublet applications will be reviewed by the board. All prospective tenants will be subject to a board interview and must obtain board approval before being allowed to move in or occupy the unit. All Applicants/occupants are required to attend interview. The board reserves the right at its sole discretion to reject and application for any reason. Tenants guests may stay for up to sixty (60) days (as long as the tenant is occupying the apartment Revised 02/20/18 VAB

3 as well). Prior to guests arrival, the tenant must inform the board in writing and provide guests name(s) and contact number(s). A copy of the fully executed lease agreement between the shareholder and the tenant (basic Blumberg Lease Agreement) shall be submitted to management along with any riders or additional clauses that the shareholder and/or their attorney may include in sign lease agreement. Home Owners and Renters Insurance must be maintained at all times, and a copy shall be provided to management by both shareholder and renter. Certificate of insurance must name the coop., the agent, and the shareholder. Interview: All applicants/occupants age 18 and over must be present at the Board interview Pet Policy: pets are allowed-see rider w/restrictions. PROCESSING OF YOUR APPLICATION MAY TAKE UP TO 3-4 WEEKS. o All applications are date stamped and processed in the order in which received. 4 IMPORTANT INFORMATION REGARDING YOUR SOCIAL SECURITY NUMBER PROTECTING YOUR PRIVACY In order to protect your privacy please remove / blackout your social security number from each financial institution document inserted into the application. ONLY send one (1) Credit Agency Authorization Form to our office with your original application - do not make or send additional copies of the Credit Agency Authorization Form. The Credit Agency Authorization Form containing your Social Security number will be shredded in our office as soon as we submit the information to the Credit Agency and obtain your credit report. 5 EXPEDITE AUTHORIZATION FORM Please note that all applications are date stamped upon receipt and processed within 3-4 weeks in the order in which they are received. There is an option to have the application processed in our office within 72 (business) hours and forwarded to the board. The expedite fee is not a mandatory fee, however, should you wish to use this service, the fee is $250 payable to John B. Lovett & Associates, Ltd. (certified check or money order only). Please note that the expedite fee is only to have the application processed by our office within 72 (business) hours of receipt. It does not expedite the board s review, nor does it guarantee that the application will be approved. The memo must be completed and sent with the submission if this option is selected. 6 Authorization to Expedite Application I am aware, as is stated in the Resale and Sublease application agreement; it takes approximately 3 to 4 weeks for the Managing Agent to process, once the application is accepted as complete. However, I am under a time constraint and I am requesting the Managing Agent expedite the processing of my application. I am aware the expediting of my application only provides the application will be processed by the Managing Agent within 72 hours of receipt of receiving my completed application, and forwarded to the Board of Directors for consideration. I am aware that the expedite fee does not expedite the Board of Directors review of my application, nor does it guarantee approval by the Board of Directors. 7 IMPORTANT NOTES Due to the large volume of calls, and applications, received by this office, we kindly ask that you refrain from calling for an update, during the three (3) week processing period. When an update is ready, we will contact your point person, which we recommend should be your Real Estate Broker, or in the absence of a Broker your Attorney. Please advise all parties involved and provide them with the brokers and/or attorney s contact information. In an effort of fairness, we must process applications on a first come first serve basis. If you are concerned about the receipt of the package, please use a method of return receipt via USPS, Fed Ex, messenger service or hand delivery, etc. If there is a problem with the application submitted you will be notified accordingly. RIDER TO SUBLEASE AGREEMENT It is agreed between Overtenant and Undertenant that the sublease is subject to all terms and conditions of the Proprietary Lease, House Rules and such other rules and regulations promulgated by the Board of Directors. It is further agreed and understood that if the Overtenant shall default in the payment of rent or additional rent to the Cooperative Corporation, the Cooperative Corporation may, at its option so long as such default shall continue, demand and receive from the Undertenant the rent due or becoming due from the Undertenant to the Overtenant, and apply the amount collected to pay sums due and to become due from the Overtenant to the Cooperative Corporation. Any such payment by the Undertenant to the Cooperative Corporation shall constitute a discharge of the obligation of the Undertenant to the Overtenant to the extent of the amount so paid. The acceptance of the rent of the Undertenant by the Cooperatives Corporation shall not be deemed as a release or discharge of any obligations of the Overtenant to the Cooperative Corporation, except to the extent of the rent so collected from the Undertenant. If payment is so demanded by the Cooperative Corporation the Undertenant shall make his rent directly payable to the Cooperative Corporation. Lovett & Associates, Ltd., Managing Agent th Avenue College Point, New York I (we) acknowledge herewith my (our) understanding of the House Rules that DOGS are permitted in the residence at Yellowstone Blvd. Owner s Corp with following conditions DOG & CAT POLICY (with restrictions) The Board recognizes that pets contribute to quality of life and provide companionship as well as relief from everyday stress. For this reason, the co-op will be allowing ownership of dogs and cats. This policy must also denote the willingness, on the part of the pet owners, to accept responsibility for the conduct of their pets in the building as well as on the surrounding grounds. 1. Residents will be permitted a maximum of two dogs and two cats per unit. 2. Below are Pet breed restrictions unless approved by the Board a) Pit Bull, b) Rottweiler, c) German Shepherd, and d) Doberman 3. Pet s weight at maturity cannot exceed sixty (60) pounds. 4. Pet penalty for misbehavior and/or violation of pet rules; a) First offense is a warning b) Second offense $300 c) Third offense $ Pets must be on a leash or carried at all times while on the co-op s premises. They are not permitted to roam free or be tied up or left unattended in any common area or on the building s grounds. 6. Pets are required to have their vaccinations and must be submitted to management. New pet owners must submit proof of vaccination within fourteen (14) days of obtaining the pet. 7. Pets must wear proper identification tags at all times. 8. Each resident must register their pet with management which shows type of pet, photo, etc. as building must be aware of pets in the building. Obtain Pet Registration form from Debbie or via dpoverelli@lovettrealty.com 9. There is a one-time fee of $25 to register a pet (payable to Yellowstone Blvd. Owners, Inc.) 10. Each pet owner must curb their dog and properly dispose of waste in a sanitary manner. Cat owners must clean litter boxes regularly to avoid odors permeating into the common areas. Kitty litter is not to be thrown down toilets or down the compactor chutes. The litter must be tied tightly in a plastic bag and placed on the compactor room floor. Revised 02/20/18 VAB 14

21 11. Residents are responsible for cleaning up any accidents by pets immediately and informing staff so that the area can be further cleaned and/or sanitized. 12. Pets shall not be kept, bred or used for any commercial purpose. 13. Pet owners shall indemnify and hold harmless, the cooperative corporation against the loss or liability of any kind arising from the actions of their pets. 14. Permanent removal of any pet may be required if it is determined that the pet is a nuisance or danger, either to residents or other pets as a result of constant noise or any aggressive behavior. The Animal Nuisance Law or Law of Quiet Habitability is to be obeyed. This law defines excessive noise by any animal as continuous or incessant for a period of ten minutes without stopping, or for a half hour intermittently causing the disturbance of any person at any time day or night. 15. Residents are responsible for visiting pets that are subject to the same restrictions and rules as resident pets. If the visiting pet will stay for more than five (5) days, then resident must notify management in writing within seven (7) days of its initial visit. The notifying must include the duration of the visit. The Board reserves the right at its sole discretion to modify the subletting and/or pet rules at any time. I (we) understand and agree that if I (we) violate this provision of the House Rules, I (we) will be subject to legal sanctions and further understand and agree that I (we) will be responsible for any and all legal costs incurred by the Cooperative during the enforcement of this rule. Lovett & Associates, Ltd., Managing Agent th Avenue College Point, New York The undersigned hereby agree to comply with the provisions of the Rules and Regulations of Yellowstone Blvd. Owners Corp. in the delivery (Move-In) or the removal (Move-Out) of furniture, furnishings, appliances, and personal property from the apartment identified below. In addition, the undersigned agrees to the following policy and procedures established by the Board of Directors: 1. For a Move-In: A prospective purchaser of an apartment must pay the following fee: a. The amount of Three Hundred Fifty Dollars ($500.00), payable to Yellowstone Blvd. Owners Corp. as a Security Deposit/Carpet Deposit, which shall be refunded to the under signed, subject to the condition as hereafter provided. 2. For a Move-Out: A shareholder who is the prospective seller of an apartment must pay the following fee a. The amount of Three Hundred Fifty Dollars ($500.00), payable to Yellowstone Blvd. Owners Corp., as a refundable move out security deposit, which shall be refunded after final inspection by the Superintendent that no damage has occurred during the move. 3. The date of the Move-In to, or Move-Out from, the apartment must be scheduled with the Superintendent one week in advance. Moving in or out of the building are scheduled Monday - Saturday ONLY between the hours of 9:00 a.m. and 4:00 p.m. 4. ALL MOVES MUST BE COMPLETED BY 4:00 P.M. NO EXCEPTIONS WILL BE MADE. IF A MOVE IS NOT COMPLETED BY 4:00 P.M. THERE WILL BE A $ FINE. 5. The full amount of the Security Deposit shall be forfeited if a party moving in or out in addition to a $ fine for violation of the following: a. Fails to schedule the Move-In or Move-Out of property with the Superintendent s Office; b. Arranges for the delivery or removal of property from the apartment at other than at the time scheduled; or c. Fails to have the Approval-Inspection letter signed by the Superintendent on the scheduled day of Move-In/Move-Out, or fails to return such signed Approval- Inspection letter to the Management Office at th Avenue, College Point, New York Any carrier engaged for the delivery or removal of property must be advised to comply with the instructions of the Building Staff who are monitoring and supervising the Move-In or Move-Out. A certificate of Insurance from the moving company for Workmen s Compensation and Public Liability Insurance in the amount of $500,000 property damage and $500,000/$1,000,000 bodily injury must be provided to the Managing Agent before the move. The certificate must name Yellowstone Blvd, Owners Corp., and John B. Lovett & Associates as Additional Insured. If an undersigned is performing the move without a moving company, then he or she must provide to the Managing Agent a copy of his or her Homeowner s Insurance Policy. 7. The undersigned shall be responsible for damages caused to the common areas of Yellowstone Blvd. Owners Corp. during the Move-In or Move-Out. 8. The cost for repairs and replacements for damages to the common areas (including all items therein) caused by and during the Move-In or Move-Out shall be deducted from the amount of the Security Deposit. The amount of the cost for any repairs and replacements resulting from the damages attributed to the Move-In or Move-Out from the apartment shall be at the sole and final determination of the Managing Agent. That amount shall be based upon prevailing costs for similar repairs and replacements, or upon an estimate of the loss in function or appearance of the common area, in instances where a repair or replacement is not practical. The undersigned shall be fully liable as well for any damages that exceed the amount of the Security Deposit, and promises to pay to Yellowstone Blvd. Owners Corp. any such additional amount. 9. The amount of the Security Deposit, less any deductions, shall be refunded to the undersigned within 30 days after the Managing Agent s receipt of the Superintendent s Approval-Inspection Letter.
