1 Request For Proposal: Sale of residential building site for construction of one single-family home, located in the City of Virginia Beach, Virginia PURPOSE: The City of Virginia Beach, Public Works/Real Estate, is seeking proposals from individuals and/or developers and/or building contractors licensed and in good standing by the Commonwealth of Virginia as either Class A or Class B contractors for the following: 1536 Indiana Avenue / 1540 Indiana Avenue (GPINs: / ) (to be subdivided, vacating interior lot lines (if applicable), into one Building Site for one single-family house) more particularly described on Exhibit A (the Building Site ). QUALIFICATION REQUIREMENTS: The City acquired the Building Site pursuant to its APZ-1 Acquisition Program and desires to sell to an individual or a developer who has procured the services of a Class A or Class B contractor licensed in Virginia, in good standing, who will build a noise-attenuated (see Exhibit B) single-family dwelling that is attractive and compatible with the surrounding neighborhood (see Exhibit D). Building contractors as described above may also apply. The purchaser of the Building Site must timely construct the specified house and, upon completion, occupy the house or offer the house for purchase by an owner-occupant. PROPOSAL REQUIREMENTS 1. Submittal of Proposals: a) Each respondent must complete and submit with their proposal a Proposal Form, attached as Exhibit C. b) An original signed proposal and one copy shall be submitted, with a business card, if applicable, attached. c) The City prefers that Respondents submit a CD-ROM containing the full version of the offer in a MS Word Office application or PDF format. d) All proposals shall be received and date stamped in the location described below no later than: 4:00 p.m. on July 12, All proposals received after that time will not be considered, and will be returned unopened to the respondent. e) Location for submissions: Attention: Alexander M. Incomplete packages will not be accepted under any circumstances. g) Proposals submitted by telephone, facsimile, or will not be considered. 2. Contents of Proposal: Respondents must include Exhibit D Proposal Form and include all information requested, including: a) Purchase Price: Purchase price for the Building Site to be paid to the City in exchange for the Property at closing. b) Cost to Purchaser: Anticipated asking price for the completed dwelling on the Building Site. c) Concept Plan: i) ONE 8 ½ x 11 concept exhibit showing the proposed singlefamily dwelling, clearly showing the house style, elevation, and landscaping. ii) If the Respondent intends to subcontract the construction of the dwelling or the landscaping work; the name, address and license number of the subcontractor must be provided with the proposal. iii) Respondent s exterior design must conform or be similar to the pre-approved architectural and design style, see Exhibit D attached hereto. d) Provide favorable written references from: i. Two satisfied customers in the Hampton Roads area, preferably Virginia Beach; and ii. Two major suppliers; one being the intended supplier of construction material, lumber or concrete. e) Provide a construction timeline for completion of construction and an estimated date for the sale of the home to a buyer who will be an owneroccupant. 2

3 3. Additional Requirements: The winning Respondent must: a) Have work performed by or supervised by a Class A or Class B contractor licensed in Virginia. Please provide name and license number of licensee. b) Comply with all the laws and regulations of the City of Virginia Beach, including but not limited to; laws involving the use, building permits, zoning, and code enforcement. c) Not be involved in current litigation or in a contractual dispute with the City of Virginia Beach. d) Agree to provide to the City of Virginia Beach reports, financial information, and other information, as requested, which may be needed to ensure compliance with local, state and federal laws and regulations. TERMS OF SALE Purchase Price: Price for the Building Site offered in proposal, which shall be payable at closing by wire transfer of funds or by certified check. Purchase Agreement: A purchase agreement will be signed within thirty (30) days of being notified of selection. A sample purchase agreement is available for review, upon request. Earnest Money Deposit: Purchaser shall deposit FIVE THOUSAND AND NO/100 DOLLARS ($5,000.00) per Building Site at the execution of the Purchase Agreement. The deposit shall be non-refundable. The deposit shall be applied to the Purchase Price at closing. Use: Closing: Purchaser intends to use the property for residential development of one singlefamily dwelling on the Building Site, consistent with the provisions of the adopted APZ-1/Clear Zone Master Plan, and shall, after construction, transfer the Property to an owner-occupant. The dwelling shall have enhanced noise attenuation. Closing (or Settlement ) shall occur on or before ninety (90) days after City Council approves sale to Purchaser. Costs and Expenses: Purchaser and Seller shall each pay for their respective attorneys' fees. All recording fees and taxes (other than the Grantors' tax) shall be borne by Purchaser. Real estate taxes shall be prorated as of the date of sale. Purchaser shall pay for all costs and expenses in connection with the construction and 3

4 development of the Building Site; including without limitation all tap fees, meter fees and drainage, fixture and utility (DFU) fees, and building permits and development review fees. Purchaser shall also pay re-subdivision costs and demolition costs where applicable. Brokerage: Each party represents to the other that no broker is involved in the transaction as agent for either party. AS IS/WHERE IS: The Building Site shall be conveyed AS IS, WHERE IS. Deed Restriction and Reverter: The Building Site will be conveyed to the selected purchaser subject to a deed restriction that limits the Building Site to one single-family dwelling in perpetuity, regardless of zoning, and prevents the owner of the Building Site from making any claims against any governmental body regarding jet noise. The selected purchaser must provide notification of such deed restrictions and APZ-1 location to the ultimate owner-occupant. The Deed may contain a reverter (to expire upon completion construction of a single-family dwelling) to insure the completion of the construction in a timely manner and final disposition of the Property. Construction Deadlines: Respondent is advised that a structure on the Building Site may have been demolished. In that event, the Purchaser is limited by zoning regulations to a two-year grandfathered period from the date of demolition in which to submit a site plan and have it approved for the construction of a new single-family dwelling. The Purchaser is advised to determine the demolition date, if applicable, to ensure ability to meet the time frame required to obtain approval of a site plan for new construction. For this building site, the grandfathered period expires on October 12, All construction shall be subject to all applicable local, state and federal laws and regulations regarding construction of improvements on the Building Site, including without limitation complying with the City s site-plan review process and obtaining all required permits. All property maintenance laws must also be complied with. Once construction is started, work must continue steadily until completed. The construction must be completed (with an occupancy permit issued), on or before the date that is twelve (12) months after a site plan has been approved by the City. However, Purchaser is prohibited from starting construction until after the Building Site has been conveyed at Settlement. Risk of Loss: Risk of loss or damage to all or any portion of the Building Site (other than loss or damage caused by Purchaser or its agents) shall remain upon the City until transfer of possession of such damaged portion of the Building Site to Purchaser. 4

5 City Council Action: The Purchase Agreement and all other definitive agreements shall be contingent upon City Council action. II. REVIEW AND SELECTION Upon a review of the proposals received, the City will evaluate the proposals based on several criteria, including: the proposal as a whole, the quality of the proposed development, diversity of re-sale price to potential buyers, diversity of construction and design within the surrounding neighborhood, the credentials of the organization or individual, the compatibility of the proposed design with the design criteria (described in Part V below) and all other factors relevant to the City s goals of preserving the neighborhood through a limited amount of quality development and the best interests of the City. The participants will be notified by mail of the City s selection. The City expressly reserves the right to reject any and all proposals and to select the proposal that it deems is in the best interests of the City, even if it is not the highest purchase price. The selection among the proposals shall be in the sole discretion of the City Council. Only responsive and responsible proposals will be considered. Proposals that attempt to change or do not meet the requirements in this Request for Proposals may be rejected as being nonresponsive. Each proposal shall be considered a valid offer until the City notifies participants that it has selected a proposal. If a proposal is selected, the City will notify the selected respondent (Purchaser) and will prepare a purchase agreement ( Purchase Agreement ) setting forth the terms of sale consistent with the terms in this Request for Proposals and the Purchaser s proposal. The Purchaser will sign the Purchase Agreement, and then the matter will be put on the City Council s Agenda for a public hearing and formal approval pursuant to the laws and procedures governing the City s sale of excess property. III. CLOSING PROCEDURE The City Attorney s office will prepare the Purchase Agreement between the City and the Purchaser and coordinate the sale of the Property to the Purchaser. The Purchaser must agree to the terms of the Purchase Agreement, which includes requirements for the resale of the property to a qualified owner-occupant. The Purchase Agreement may include a provision that the Purchaser will forfeit the surety or that the Property will revert to the City if the Purchaser does not fully comply with all terms of the Purchase Agreement. IV. DISQUALIFICATION Employees of the City of Virginia Beach are disqualified from submitting a proposal. 5

6 V. DESIGN AND DEVELOPMENT CRITERIA These design guidelines were created to ensure that the single-family dwelling to be constructed on the Building Site blends with and enhances the surrounding neighborhood. Interior Building Design as to the Building Site Single-family, owner-occupied. Water-conserving fixtures. Plans shall comply with the Virginia Uniform Statewide Building Code, specifically Section 1207 Airport noise attenuation standards. Exterior Building Design: Design must conform to the architectural style similar to; the pre-approved design/architectural styles, for the Building Site; see Exhibit D attached hereto. Architectural details, such as roofline, gables, and window detailing, shall be compatible with existing buildings in the neighborhood. Required features for consideration are: o History and Character o Massing and Composition o Windows and Doors o Porches and Chimneys o Materials and Applications Plans must present a balanced and pleasing distribution of wall and window areas from all views. Exterior materials (including without limitation: siding, soffits, doors, windows) should be low-maintenance, energy-efficient and consistent with the look and feel of the neighborhood. Steel, brick and stucco are preferred exterior materials, if consistent with the predominant materials used in the neighborhood. See attached approved styles (Exhibit D). Also refer to the following Web Site for additional design standards Note that the City of Virginia Beach must approve each proposed architectural design as well as proposed plan prior to the award of the bid. Site and Grounds Existing trees shall be preserved when possible. Compliance shall be made with the requirements of the Site Plan Ordinance of the City of Virginia Beach regarding the preservation of existing trees. Reseed entire site lawn area within a 25 foot perimeter of the home, at the completion of the construction and land disturbance process The entire site shall be landscaped to be aesthetically pleasing in all seasons. Landforms and plant materials shall be used to define the site and blend with the adjoining property. All air conditioning units must be located in rear or side yard and screened from public view. Driveways and sidewalks should be specified on the plans. 6

RESERVING UNTO THE CITY all underlying fee in and to the streets, alleys, and other rights-of-way abutting said Property, and all easements of any description and rights of ingress and egress benefiting the City or the public. GPIN: (1540 Indiana Avenue) ALL THAT certain lot, piece or parcel of land, together with the buildings and improvements thereon, lying, situate and being in the City of Virginia Beach, Virginia, and being known, numbered and designated as Lot 8B (erroneously referred to as Lot 8 in prior Deed), as shown on that certain plat entitled, RESUBDIVISION OF LOT 8, BLOCK 9, PLAT OF OCEANA GARDENS, LYNNHAVEN BOROUGH, VIRGINIA BEACH, VIRGINIA, which said plat is duly recorded in the Clerk s Office of the Circuit Court of the City of Virginia Beach, Virginia, in map Book 128, at page 3, reference to which plat is hereby made for more particular description of said lot. Insulate floors over unconditioned crawlspaces with R-30 rated batt insulation. Seal all penetrations through floors i.e. electrical, plumbing, HVAC, etc. Exhaust Fans Dryer Vents Sealing & Caulking Use ductless kitchen exhaust range hood with electric cooking appliances. 11 Approved styles of home for Building Site: EXHIBIT D 1536 Indiana Avenue / 1540 Indiana Avenue (GPINs: / ) The potential house design should complement the early to mid-20 th Century arts and crafts, colonial revival and other architecture styles found in the neighborhood. The house can be 1 or 2 stories and feature a gable and/or hip roof with architectural asphalt shingles. When one-window dormers are used, choose gable-style dormers. Avoid using arches in the design details of roof lines, roof vents, and other uses. It is recommended that the house include a covered front entrance porch. Siding can be any combination of lap, shake and red brick. Stone and stucco siding is discouraged from being used. If there is a two-car garage, the garage doors should not be placed on the front of the house. Garages doors should be high quality Arts and Crafts or Colonial-style garage doors with windows.
