1 Regional Council Minutes Wednesday, October 11, 2017 The following are the minutes of the Regular Council meeting held at 4:05 p.m. in the Regional Council Chamber, 150 Frederick Street, Kitchener, Ontario, with the following members present: Chair K. Seiling, L. Armstrong, E. Clarke, S. Foxton, T. Galloway, H. Jowett, K. Kiefer, G. Lorentz, J. Mitchell, J. Nowak, K. Redman, S. Shantz, S. Strickland, B. Vrbanovic. Members Absent: D. Craig, D. Jaworsky Closed Session Moved by S. Foxton Seconded by L. Armstrong That a closed meeting of Council be held on Wednesday, October 11, 2017 at 3:45 p.m. in the Waterloo County Room in accordance with Section 239 of the Municipal Act, 2001, for the purposes of considering the following subject matters: a) receiving of advice subject to solicitor-client privilege related to an agreement Moved by S. Strickland Seconded by E. Clarke That Council reconvene in Open Session. Declarations of Pecuniary Interest Under The Municipal Conflict Of Interest Act None declared. Delegations a) Sam Nabi and Sean Campbell, Hold the Line appeared before Council with respect to the Hold the Line Festival. The purpose is to raise awareness about the Countryside Line. It was a cycling and music festival held at the

2 Council Minutes /10/11 Waterloo Rod and Gun on September 16 th. They showed a video and distributed postcards from the event. They thanked Council for creating and protecting the Countryside Line. It was suggested they should consider attending the Township Councils to make their presentation. b) Steve Scherer cancelled his delegation. c) Sam Kamminga appeared before Council with respect to the pedestrian access between Traynor Ave and Fairway Road through the one kilometre Light Rail Transit (LRT) corridor between Wilson Ave and Courtland Ave in Kitchener. A copy of the presentation is appended to the original minutes. He highlighted the location of the area and the LRT fence that was constructed has prevented walkability in this neighbourhood and access to Fairway Road. He requested that an opening be created in the new fence while the train is not yet running and a level pedestrian crossing be installed. Chair Seiling advised this was never a public access and the land is not publicly owned. The City of Kitchener has undertaken a study and it has not yet been completed. Once that report comes forward, further discussions can be held. Suggestions were made that the businesses should be consulted and perhaps they can assist with a solution such as a shuttle. Thomas Schmidt, Commissioner Transportation and Environmental Services advised the study by the City of Kitchener is almost complete. A gated, level pedestrian crossing is the suggested recommendation but there are private property issues that need to be resolved. He stated there is no funding in the current budget and staff is recommending it could be included as a federal funding application next Spring. d) Kevan Wagner did not appear when called with respect to LRT Cambridge Minutes Of Previous Meetings Moved by L. Finance Reports a) COR-17-03, 2017/18 General Insurance Program for Waterloo Region Housing Moved by S. Strickland Seconded by K. Redman That the Regional Municipality of Waterloo accept the bid from the Frank Cowan Company Limited for the 2017/18 General Insurance Program for Waterloo Region Housing in the amount of $380, plus the Housing Services Corporation fee and all applicable taxes; And that the Chief Financial Officer be authorized to sign all documentation pertaining to such insurance coverage as set out in report COR dated October 11, b) COR-TRY-17-88, P Supply of Equipment for the Galt WWTP Electrical Switchgear

Redman That the Regional Municipality of Waterloo accept the proposal of Thomson Technology Power Systems ULC for P Supply of Equipment for the Galt Wastewater Treatment Plant (WWTP) Electrical Switchgear in the amount of $1,480, plus all applicable taxes as set out in Report COR-TRY dated October 11, Committee Reports Community Services The Summary of Recommendations of the Community Services Committee was presented by Geoff Lorentz, Chair of the Committee. Moved by G. Lorentz Seconded by K. Kiefer That the Summary of Recommendations of the Community Services Committee, dated October 3, 2017, Items 1 to 2, be adopted as follows: 1. That The Regional Municipality of Waterloo ( Region of Waterloo ) consents to the sale of and the assignment of legal agreements (including without limitation the contribution agreement, affordable housing operating agreement and general security agreement) ( Legal Agreements ) for an affordable housing property situated at 99 Stanley Street, Ayr in the Township of North Dumfries ( Property ); and That the Regional Municipality of Waterloo authorizes the Commissioner, Community Services to execute such documentation as may be required to give effect to the assignment of the Legal Agreements and the sale of the Property from Elena Melnychuk (a.k.a. Lena Melnychuk) and Michael John Melnychuk to a new company to be created and affiliated with RTZ Management Inc. with such documentation to be to the satisfaction of the Regional Solicitor, all as more particularly described in Report CSD-HOU dated October 3, That the Regional Municipality of Waterloo approve the following actions with regard to the Home for Good program, as outlined in report CSD-HOU-17-20, dated October 3, 2017:

5 Council Minutes /10/11 a) Increase the 2017 Operating Budget for Housing Services by $116,625 gross and $0 net Regional levy; b) Increase staffing within Housing Services by one permanent full time equivalent (FTE) position to support program implementation; fully funded through the Province; c) Authorize the Commissioner, Community Services, to execute such agreements and documentation necessary with the Ministry of Housing (including a Transfer Payment Agreement with the Province and Take-Up Plan), upon terms and conditions acceptable to the Regional Solicitor, as may be required to advance funding for this program; and d) Authorize the Commissioner, Community Services to determine local funding locations and execute agreements in a form satisfactory to the Regional solicitor, to ensure funding for this program is fully utilized. Administration and Finance The Summary of Recommendation of the Administration and Finance Committee was presented by Sean Strickland, Chair of the Committee. Moved by S. Strickland Seconded by E. Clarke That the Summary of Recommendations of the Administration and Finance Committee dated October 3, 2017, Item 1, be adopted as follows: 1. That the Region of Waterloo take the following action with respect to the Tax Supported Capital Program: 1. Amend the Transportation Capital Program by advancing $535,000 from 2019 to 2017 to allow for the purchase of property in advance of construction for project Ottawa Street Hwy7 Westbound Ramp to King Street; 2. Amend the Transportation Capital Program by advancing $350,000 from 2018 to 2017 and $100,000 from 2019 to 2017 to allow for the purchase of property in advance of construction for project Ottawa Street Mill Street to Homer Watson; 3. Amend the 2017 Facilities Capital Program by reallocating $353,000 from project WM Waterloo Building Renewal to project Main Street

Increase the 2017 Facilities Capital Program by $75,000 for project Philipsburg Yard Renewal to be funded by the Roads Capital Levy Reserve. Planning and Works The Summary of Recommendations of the Planning and Works Committee was presented by Tom Galloway, Chair of the Committee. Moved by T. Galloway Seconded by K. Kiefer That the Summary of Recommendations of the Planning and Works Committee dated October 3, 2017, Items 1 to 8, and 4 reports from closed session, Items 9 to 12, be adopted as follows: 1. That the Regional Municipality of Waterloo take the following actions with respect to the Class Environmental Assessment Study for the Iron Horse Trail to Future Transit Hub Active Transportation Connection in the City of Kitchener: 1. Approve the Recommended Route Alternative Hybrid 2-3 for the Active Transportation Connection as outlined in the ReportTES-TRP dated August 22, 2017; 2. Direct staff to file the Notice of Completion for this Class Environmental Assessment Study by means of advertisements in local newspapers and mailings to adjacent property owners, tenants and agencies, and place the Project File on the public record for a period of 30 days; 3. Direct staff to proceed with the detailed design and interim implementation measures pending property acquisition; and 4. Direct staff to pursue planning opportunities in the future to realize the Alternative 1/1A and Alternative 2 alignments as properties in the vicinity are redeveloped. 5. Direct staff to report back annually on the progress of the alternative trail routes.

That the Regional Municipality of Waterloo enter into an Agreement for Professional Consulting Services with CH2M HILL Canada Limited, for the detailed design and services during construction for the Galt Wastewater Treatment Plant Upgrades Contract 1, in the amount of $1,998, plus all applicable taxes. 4. That the Regional Municipality of Waterloo enter into a Consulting Services Agreement with IBI Group Professional Services (Canada) Inc. to provide engineering consulting services for detailed design review, tendering, contract administration and construction inspection services for Weber Street (Regional Road 8) Reconstruction from Queen Street to Borden Avenue in the City of Kitchener at an upset limit fee of $123, plus applicable taxes for the detailed design review and tendering phases with contract administration and construction inspection services to be paid on a time basis as described in report TES-DCS-17-21, dated October 3, That the Regional Municipality of Waterloo approve the extension of the above noted agreement with the Region of Niagara for an additional period of twenty-five (25) months commencing March 1, 2018 to March 31, 2020, under the same terms and conditions in the original proposal as previously approved by Regional Council. 6. That the Regional Municipality of Waterloo forward Report PDL-CPL-17-31, dated October 3, 2017 to the Ministry of Natural Resources and Forestry as its response to the Province of Ontario s draft 7. That the Regional Municipality of Waterloo forward Report PDL-CPL , dated October 3, 2017 to the Ontario Ministry of Agriculture, Food and Rural Affairs as its response to the Province of Ontario s draft Agricultural System mapping and implementation procedures. 8. That the Regional Municipality of Waterloo prequalify King Victoria Transit Hub Partners Inc. for RFQ PQ , Development of the King Victoria Transit Hub Infrastructure and Mixed Use Development Lands, and that the Region invite King

12 Council Minutes /10/11 Victoria Transit Hub Partners Inc. to respond to a Request for Proposal for purchase by negotiation, pursuant to Report COR-FFM-17-17/COR-TRY-17-87, dated October 3, That The Regional Municipality of Waterloo (the Region ) approve and enter into a settlement agreement with Ontario Ltd., (the Owner ), and execute all documentation in relation to the expropriation of the property municipally known as 22 Ottawa Street South, Kitchener, being a fee simple interest in Lot 21 Plan 262 and Part Lot 22, Plan 262, AS IN , save and except Pt 12 on WR being all of PIN (LT) in the City of Kitchener, with all documentation to the satisfaction of the Regional Solicitor, wherein the Region: (a) pays the Owner the sum of five hundred and twenty- five thousand Dollars ($525,000.00) as full compensation for all claims under the Expropriations Act; (b) reimburses the Owner for their reasonable legal and associated costs pursuant to the Expropriations Act; And That the Regional Solicitor has all necessary authority to execute such documents to carry out the agreement and to settle the reasonable legal and other costs of the Owner pursuant to the Expropriations Act. And That the Transportation Capital Program be amended by advancing $530,000 from 2019 to 2017 to allow for the purchase of the property in advance of construction. 10. That the Regional Municipality of Waterloo approve an Agreement of Purchase and Sale, with such agreement to be satisfactory to the Regional Solicitor, and authorize and direct the Regional Solicitor to execute all documentation related to such Agreement for the acquisition of Part Lot 14, W/S King Street North, Plan 491, designated as Part 3 on Plan 58R being Part of PIN (LT), City of Waterloo, Regional Municipality of Waterloo, being part of 85 King Street North in the City of Waterloo, from 85 King Inc. for the sum of $107,100.00, at a rate of $ per square foot based on actual land areas as determined by an Ontario Land Surveyor plus legal and associated costs. 11. That The Regional Municipality of Waterloo approve the settlement with Zico Ltd. (the Owner ) in relation to the partial expropriation from the property municipally known as 210 Pinebush Road, City of Cambridge (the Property ) whereby the Region:

13 Council Minutes /10/11 (a) pays compensation to the Owner in the amount of $311,880.00; (b) conveys to the Owner, subject to satisfactory completion of the Region s road closure, surplus property and real property disposition procedures, for nominal consideration, part of Franklin Boulevard road allowance abutting the Property to provide a replacement parking area with the Region to reimburse the Owner for its actual paving costs of such; and (c) pays to the Owner its reasonable legal and other costs pursuant to the Expropriations Act as determined by the Regional Solicitor. 12. That The Regional Municipality of Waterloo approve the settlement with The 625 King Corporation Inc. (the Owner ) in relation to the partial expropriation from the property municipally known as 625 King Street East, Kitchener (the Property ) whereby the Region pays compensation to the Owner in the amount of $94,900, plus interest and the Owner s reasonable legal and other costs pursuant to the Expropriations Act as determined by the Regional Solicitor Other Matters Under Committee Of The Whole a) PDL-LEG-17-77, Authorization to Expropriate Land (1st Report)Stage 1 of the Rapid Transit Project Permanent and Temporary Easements Stage Courtland Avenue and Adjacent Lands, Kitchener Moved by L. Armstrong Seconded by S. Foxton That The Regional Municipality of Waterloo direct and authorize the Regional Solicitor to take the following actions with respect to the expropriation of a parcel of land in the City of Kitchener for the construction and operation of light rail transit ( LRT ) as part of the Rapid Transit Project Stage 1 in accordance with the Recommended Rapid Transit Implementation Option Report E dated June 15, 2011: A. Complete application(s) to the Council of The Regional Municipality of Waterloo, as may be required from time to time, for approval to expropriate land, which is required for the Rapid Transit Project Stage 1 and described as follows: Permanent Easement: The right and easement, being a permanent easement in gross, for the free and unobstructed right, interest and easement in perpetuity on, over, under and through the land for the purpose of constructing, installing, operating, maintaining, inspecting, altering, moving, replacing, reconstructing, enlarging and repairing improvements

14 Council Minutes /10/11 associated with light rail transit including, without limitation, a Vehicular Access Control Gate, Pedestrian Access Control Gate and a Traffic Light Loop Detection System, concrete panels, concrete pedestrian landing and curbing to facilitate vehicular and pedestrian crossing of the light rail transit tracks, and appurtenances thereto, and for all purposes necessary or incidental to the exercise of the rights hereby created, the free, unimpeded and unobstructed access to the lands at all times by employees, agents, contractors, workers and anyone authorized by it, and vehicles, supplies and equipment at all times and for all purposes and things necessary for or incidental to the exercise and enjoyment of the right and easement. 1. 27 Timeline (Part 1 of 2): November LRT works starts; closure of the Traynor Park and the Community Trail. April First communication from LRT and Hydro One to residents; construction fence was up and the first conversations started about the future crossing over LRT. July Permanent fence installed on the Traynor side of the tracks; Research finding regarding other similar long stretches along the LRT corridor that cuts through a residential and commercial area is that this is a unique portion of the LRT route. At the time, still no plans for a pedestrian crossing. Kitchener Ward Councillor advocates with the City of Kitchener Transportation Staff to do environmental assessment as they have already requested a pedestrian crossing which was denied by Grandlinq/Regional staff. Concerns remain the speed of the train, access to private land along the tracks, retrofitting the construction plan is expensive.

October City of Kitchener meets with residents and the Social Development Centre Waterloo Region to plan for the public consultation regarding regarding the study of potential options for the pedestrian crossing. January Public consultation was held with the participation of both City of Kitchener and Region of Waterloo staff; Social Development Centre Waterloo Region and KW Tenant Group undertake door to door survey with the residents of Traynor-Vanier. October The permanent fence on the Fairway side of the tracks is installed. Both City of Kitchener and Region of Waterloo say a pedestrian crossing is unlikely.
