PZ Series of 018 A RESOLUTION BY THE PLANNING AND ZONING OMMISSION OF THE TOWN OF DILLON, OLORADO, REOMMENDING THE APPROVAL OF A LEVEL IV DEVELOPMENT APPLIATION FOR A LASS S- SUBDIVISION REPLAT OF LOTS 41R & 4R, PTARMIGAN TRAIL ESTATES, UNIT 1 FOR THE PURPOSES OF MATHING EXISTING PROPERTY PIN LOATIONS, TO ESTABLISH A SNOW STORAGE EASEMENT, AND TO DEDIATE NEW RIGHT-OF-WAY; AND, SETTING FORTH DETAILS IN RELATION THERETO. WHEREAS, the Town of Dion is the owner of rea property ocated at 00 U.S. Highway, Dion, oorado and more specificay described as Lot 41R, Ptarmigan Trai Estates Unit 1 ( Lot 41R ), according to the Repat of Lots 41 & 4 Ptarmigan Trai Estates, Unit 1 recorded December 10, 199 as Reception No , ounty of Summit, State of oorado; and WHEREAS, 81 Dion Road, L.L.. is the owner of rea property ocated at 81 U.S. Highway, Dion, oorado and more specificay described as Lot 4R, Ptarmigan Trai Estates Unit 1 ( Lot 4R ), according to the Repat of Lots 41 & 4 Ptarmigan Trai Estates, Unit 1 recorded December 10, 199 as Reception No , ounty of Summit, State of oorado; and WHEREAS, the Panning and Zoning ommission of the Town of Dion ( Panning ommission ) has received a Leve IV Deveopment Appication from 81 Dion Road, L.L.. and the Town of Dion (the Appicants ) for a ass S- subdivision repat of ots 41R & 4R, Ptarmigan Trai Estates, Unit No. 1 ( Appication ), for the purposes of matching existing property pin ocations, to estabish a snow storage easement, and to dedicate new right-of-way; and WHEREAS, the Panning ommission has determined that the Appication is compete; and WHEREAS, foowing the required notice, a pubic hearing on the Appication was hed on January 3 rd, 018, before the Panning ommission; and WHEREAS, foowing the pubic hearing the Panning ommission has made certain findings of fact regarding the Appication and has determined that certain conditions which are reasonabe and necessary to and reate to impacts created by the deveopment shoud attach to the approva of the Appication for the ass S- subdivision repat of ots 41R & 4R, Ptarmigan Trai Estates, Unit No. 1. 2 NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING OMMISSION OF THE TOWN OF DILLON, OLORADO, AS FOLLOWS: Section 1. That the Panning ommission, foowing the required notice, hed a pubic hearing on January 3 rd, 018 on the Appication, and foowing said pubic hearing makes the foowing findings of fact: A. That the Appication is compete. B. That the Appication meets the appicabe Town of Dion Municipa ode ( ode ) requirements.. That the Appication is compatibe with the ommercia Zoning District and is compatibe with surrounding uses. D. That the Appication is in genera compiance with the Town of Dion omprehensive Pan. E. That the Appication repats Lot 41R and 4R into two revised parces, to be caed Lots 41S and 4S, Ptarmigan Trai Estates Unit 1, Dion, oorado and dedicating street rights-of-way and creating a pubic snow storage easement on Lot 4S, as shown on the map tited A REPLAT OF LOTS 41R & 4R PTARMIGAN TRAIL ESTATES, UNIT 1, dated 1/8/01 and prepared by Aztec onsutants, Inc. That the Panning ommission hereby recommends to the Town ounci of the Town of Dion the approva of the Appication for the purposes of creating two revised parces, to be caed Lots 41S and 4S, Ptarmigan Trai Estates Unit 1, Dion, oorado and dedicating street rights-of-way and creating a pubic snow storage easement on Lot 4S. The Town of Dion has received a Leve IV Deveopment Appication to repat ots 41R (Town Led Sign) and 4R (hristy Sports) of the Ptarmigan Trai Estates Unit 1, for the purposes of matching existing property pin ocations, to estabish a snow storage easement, and to dedicate new right-of-way. The new ots wi be named 41S and 4S. The appication has been submitted jointy by the Town of Dion and 81 Dion Road LL. The probem with the existing pat that created these two ots, is that the ots don t cose within acceptabe surveyor toerances. Lot 41R doesn t cose by 5 for exampe. osure is the process by which a surveyor computes the boundary of each ot by aying out the direction and ength of each property ine segment to determine if the start and end points match. In the new pat, both ots cose in under 0.01, which is a very good work. Aztec onsutants, Inc. aso reviewed how the Litte Dam Street onnector road was created and found a few discrepancies that can best be soved by dedicating a sma siver of and to the Town of Dion as right-of-way. 4 As part of the approved hristy Sports PUD, the Town aso requested that the deveoper dedicate a 4 snow storage easement aong the sidewaks on the west and south side of Lot 4S. There is aready a recreation path aong the north side of Lot 4S. An additiona ROW section was aso created at the northeast corner of Lot 41S to put the Town s sidewak and accessibe ramp in the E. Anemone Trai Right-of-Way. PUBLI NOTIE: The Town posted a sign of the pubic hearing on the site on Tuesday, December, 01. A newspaper ad was ran in the Summit Daiy Journa on Friday December, 01, and a maiing noticing the pubic hearing time and date was sent out on Wednesday, December 0, 01 to property owners within 300 of the proposed deveopment. These dates are a within the required -14 day notice period before the Pubic hearing on January 3, 018. ZONING: The proposed ots are ocated within the ommercia () Zone District. OMPLIANE WITH DILLON OMPREHENSIVE PLAN: A minor repat of two existing ots to cean up the math and dimensions is in conformance with the goas of the Town of Dion omprehensive Pan. EFFET ON THE HRISTY SPORTS P.U.D.: A Panned Unit Deveopment (PUD) for the hristy Sports store ocated on Lot 4R was previousy approved in October 01 by the Dion Town ounci. The proposed PUD was contempated based on the existing property pin ocations and measured boundary engths, so there wi not be any dimensiona changes to the PUD. After the ots are repatted into Lots 41S and 4S by the forma subdivision action of the Town ounci, a minor PUD amendment wi adjust the property description from Lot 4R to Lot 4S.
