1 RULES AND REGULATIONS WESTGATE AT HUNTERS RUN CONDOMINIUM ASSOCIATION, INC CLUBHOUSE LANE, BOYNTON BEACH, FL PART A: GENERAL PART B: CLUBHOUSE PART C: POOL PART D: SECURITY PART E: PETS PART F: RENTALS PART G: GOLF CARTS In addition to the Condominium Documents Updated October 2012 PART A: GENERAL 1. Each dwelling unit shall be used and occupied as a single-family residence only. The term single-family shall be defined as a married couple or head of household with marital or blood-related dependents, or those regularly living together. 2. For the purpose of this section, regularly living together shall be deemed to mean individuals who reside together at Hunters Run and have an exclusive relationship with each other. All disputes and interpretations under this section shall be decided by a majority of the Board of Directors at a regularly scheduled meeting, which decision shall be binding upon the parties. 3. Each unit owner shall provide a key to the unit to the Condominium Association. The key will provide access to the unit in case of emergency and for scheduled monthly pest control services. These keys will not be released by Security to anyone under any circumstances, including delivery people. Safeguards for this key will be established by the Board. Owners changing locks are responsible to supply the Association with the new key. 4. All appliances and apparatus utilizing water within each unit, such as toilets, sinks, garbage disposals, etc., shall not be used for any purpose other than originally intended. Resultant damage to the unit, Limited Common Element or Common Element due to the above abuse is the responsibility and liability of the owner of the misused unit. 1 P a g e

2 5. With the prior written consent of the Association, a unit owner may plant or landscape outside the unit on Limited and Common Elements. Such planting, landscaping expenses and future maintenance costs will be the sole responsibility of the unit owner. Damages to the Limited and Common Elements necessitation repairs due to this planning and/or landscaping is the responsibility of the unit owner. 6. Parking on Common Elements, including but not limited to driveways and parking areas, shall be for conventional passenger autos, bicycles, motorcycles and mopeds. There is to be no parking of trailers, vans, mobile homes, campers, trucks, boats and any commercial vehicles, except for transient deliveries. Additionally, no vehicle belonging to any owner or family member, guest or tenant, or employee of owner shall be parked in such a manner as to impede or prevent access to another parking space. Parking areas are to be restricted to immediate area unit owners and their guests. There shall only be allowed one (1) vehicle per parking space. No unit owner or owners shall be entitled to utilize more than two (2) parking spaces on the condominium property. Extended parking for owners leaving for two (2) weeks or more should be restricted to remote parts of the owners own parking area. No vehicle which cannot operate by its own power shall remain within the condominium property except for emergency repairs. Any owner leaving an automobile in any parking lot for two (2) weeks or more must advise the Board in writing. Any unit owner notifying the Board should include the name and phone number of the person who has access to the keys of the vehicle and who should be contacted by the Board, should circumstances require that the vehicle be moved for any reason. 7. Unit owners using the Association bicycle racks to store a bicycle must first register the bicycle at the Management Office. They will be issued a numbered sticker to attach to the rear fender of their bicycle. Any bicycle not properly identified with a sticker may be subject to removal by the Board. 8. Changes in the Limited Common Element (LCE) require the approval of the Association by the submission of an ARC form. LCE includes rear screened porches, side yard patios, rear yards and walks, front stairs and walkways, and side yards. Changes requiring approval include, but are not limited to any building modification, alteration or addition, parking of a golf cart, painting or repainting any color other than the original or previously approved color. 9. The sidewalks, stairway and landings which are a part of the Common Elements or Limited Common Elements shall not be obstructed in any way or manner whatsoever and shall be used exclusively for ingress to or egress from the units. By way of illustration, and not limitation, no baby carriages, shopping carts, bicycles, toys, trash cans, garbage cans, chairs, benches, tables, potted plants or other articles will be allowed to stand in said areas. 2 P a g e

3 10. All trash, dirt, refuse and garbage which cannot be disposed of in the garbage disposal unit or in the trash compactor shall be placed in plastic bags, tied and deposited in the dumpster. All dumpster covers and dumpster fence door leading to same are to be closed after using except on garbage pickup days. On those days, the doors will be opened and closed by workers before and after the garbage pickup. All cardboard cartons must be crushed before placement in the dumpster. Absolutely no construction materials or trash is to be placed in the dumpster. 11. No loud and unnecessary noise disturbing the other unit owners will be permitted within individual units, Limited Common Elements or Common Elements. 12. Without written permission of the Association, no contractor or workman shall be permitted to work in or about any unit, except for emergency repairs, between the hours of 6:00 p.m. and 8:00 a.m. 13. No chairs, lounges, blankets or sunbathing shall be permitted on the Common Elements of any unit, front, side or back. 14. Cover-ups or tops shall be worn at all times when going to and from the unit. 15. No clothes, rugs, mats, bedding or other items may be hung or displayed from any window, door, railing or balcony. 16. Unit owners are required to keep circuit breakers controlling the outside front lights in the ON position at all times. 17. No potted plants shall be kept on the walkways, stairs or in planting beds when the owners are not in residence. The Association, after issuing notice, may remove and dispose of any potted plants kept in these areas. 18. Floor tiling of upstairs apartments shall be limited to the following areas: kitchen, foyer entry, exterior patios and bathrooms. Soundproofing material must be installed under the tile. 19. Children shall not be permitted to play on or about the walkways, sidewalks, roadways or parking lots within the Association area. 20. Any corporation, partnership or other legal entity ( other than an individual or married couple) holding title to any unit shall designate in writing to the Association one person or married couple as the occupant of the unit to qualify under Rule 1 A of the General Rules and Regulations. Said designated occupant shall be subject to all the rules and regulations and documents of the Association as if they were the sole title owner. 21. There shall be no swimming or boating on any lake or pond of the Association. 22. The Association shall formulate rules and regulations for the operation and the use of the clubhouse and pool of the Association. Such rules and regulations set forth under Clubhouse and Pool Rules and Regulations shall be enforceable by the Association. 3 P a g e

Each unit owner shall be responsible and accountable for any violations of these Rules and Regulations by himself, any member of his family, guests, tenants, agents, licensees or employees of the unit owner. 24. Any complaint regarding management and/or the Association property or the actions of any unit owners or Management staff or occupants of a unit regarding violation of these Rules and Regulations shall be made in writing to the Association. Upon receipt of a written complaint, the Board of the Association or its designee or designees shall investigate the complaint. A written report of its findings shall be made within five days to the parties involved in the complaint. The Association, acting through its Board, shall then take such action as it deems advisable. 25. The Association, through its Board, shall have the right and duty to enforce the Rules and Regulations contained herein by any necessary actions, including, but not limited to, the levying of monetary penalties, legal action or other means of enforcement. 26. The speed limit in Westgate is 20 M.P.H., unless otherwise posted. 27. Notices of all Board of Directors meetings and meetings of the Membership will be posted at the Condominium Pool and Clubhouse area. PART B: CLUBHOUSE The clubhouse is community property and must be respected as such. 1. The use of the clubhouse is exclusively for Westgate unit owners and renters. 2. Shoes and tops must be worn in the clubhouse. Wet bathing suits are not permitted in the clubhouse. 3. The use of the clubhouse for Association functions shall be subject to the conditions and approval of the Board of Directors. 4. Any group using the clubhouse must clean up after use and replace the furniture in an orderly fashion. 5. No furniture or equipment shall be removed from the clubhouse. 6. Any use of the clubhouse, which includes food, beverages, gaming, or dancing, for any reason, including the use of the pool will be allowed with Board approval. Immediate cleanup after use is mandatory. 7. The use of the clubhouse for private parties of a Westgate unit owner may be requested in writing no earlier than ninety (90) days before the desired date. Availability will be on a limited basis with fees and conditions for use to be set by the Board. Final approval or disapproval shall be made by the Board in writing. 4 P a g e

5 Conditions for the use of the clubhouse: a. The clubhouse may be used for Westgate Association functions. b. The use of the clubhouse may be requested by a unit owner or renter for a family function. c. The use of the clubhouse may be requested by a unit owner or renter for a party of up to 80 guests, 50% of whom must be residents of Westgate or other communities within Hunters Run. d. The clubhouse is not a rental facility and, therefore, may not be requested by a unit owner or renter for use by an organization, club or group which is not part of Hunters Run. e. The use of the clubhouse by other Associations within Hunters Run is subject to the approval of the Board of Directors and at the fee structure as provided by these rules and regulations. 8. Clubhouse Use: Residents and clubs will be required to give a $100 refundable security deposit. If food is served, there is a $50.00 non-refundable usage fee. Per resolution passed February 7, 2005, non-westgate residents who wish to use the Westgate Clubhouse must give a $ security deposit which is refundable and a $ non-refundable usage fee. All of the above is required for each event. 9. Unit owners are responsible for damage caused by themselves, their families, their tenants or guests. 10. No pets are permitted in or about the clubhouse. 11. The clubhouse may be used by Westgate Unit owners and renters for card playing. They are obligated to clean up and restore the card room before leaving. The lights must be turned off and the air conditioning must be reset to run program. PART C: POOL 1. Use of the swimming pool and pool area is restricted to unit owners, renters, members of their families and guests. 2. The Association reserves the right to limit the number of guests in the pool area from time to time. 3. Children under ten (10) years of age must be accompanied by an adult while in the pool area and pool. 4. Children with diapers are not allowed in the pool at any time. 5. No food, alcoholic beverage or glass containers of any kind allowed at the pool area. Nonalcoholic beverages may not be consumed within 4 feet of the pool. 5 P a g e

6 6. Pets are forbidden in the pool area. 7. All persons must shower before entering the pool. 8. Bathing is limited to TWENTY (20) persons at one time in the Westgate pool. 9. No rafts, water balls, kick boards or other apparatus is permitted in the pool area or in the pool except for exercising. 10. Tops and shoes are required when coming to or going from the pool area. 11. Suntan lotion is to be removed from the body before entering the pool. 12. Chairs at the pool area may not be reserved. 13. Unit owners are responsible for damage to equipment and common property as well as any violations of rules by themselves, their tenants or guests. 14. All persons using the pool or pool area do so at their own risk. 15. Pool hours are 7:00 a.m. to 10:00 p.m. daily. 16. Beach towels are required while lounging on the pool furniture, unless person is fully clothed. 17. No Diving. 18. No cell phone usage. 19. No radio playing except for exercising. 20. Umbrellas must be closed before leaving the pool area. PART D: SECURITY 1. Security gate key cards are issued to unit owners only. No key cards are issued for visiting relatives, friends or renters. 2. For security reasons the door to the Westgate clubhouse lounge is to be kept locked at all times. A key to the lounge was issued to each unit owner. It is the responsibility of the unit owner to pass along this key to a new purchaser at closing along with the keys to the unit. 3. Unit owners expecting visitors or deliveries shall call the gatehouse giving the name and expected time of arrival. 6 P a g e

7 4. Circuit breakers controlling the exterior front security lights must be left in the ON position at all times both for the safety and security of our owners. If circuit breakers are turned off, the Association retains the right to enter any unit and reset the circuit breaker so that the exterior lights will operate properly. PART E: PETS 1. No pets may be kept in or about any unit except either one small dog or cat weighing no more than 25 pounds. 2. No pets shall be permitted upon any part of the Common Elements except on a leash not to exceed 10 feet. All pets being walked shall be curbed and the owner of the unit in which the pet is housed, shall be responsible for the removal of droppings of the pet. 3. Should any pet becoming an annoyance to other unit owners, a complaint shall be lodged, in writing with the Association. If the Association, acting through its Board, should deem the complaint justified, then the unit owner in which the pet is housed shall be required and responsible to take such steps as are necessary to correct the complaint as the Association may direct. 4. No pets shall be permitted in the clubhouse or pool area at any time. PART F: RENTAL AND SALES 1. No unit owner shall sell or lease a unit without prior written consent of the Association. 2. When an owner is not in residence, and has another party residing in the unit for more than 30 days, it is mandatory that Management and Security be notified in writing as to when their unit will be occupied, by whom, and on what dates. This is considered a rental. All requests for written consent shall be made in writing to the Association on application forms provided by the Association. 3. No tenant may sublease the unit. 4. The word lease as set forth in Rule #1 shall mean allowing the use of a unit by a person or persons not related by blood, marriage or legal adoption to the unit owner while said unit owner or occupant is not residing in and occupying said unit, regardless of whether or not there is a charge or payment made for such use. 5. Applications for the sale or lease of a unit must contain full information as requested b the Association about the prospective purchaser or tenant, and shall be accompanied by a non-refundable fee. A personal interview may be requested by the Board of Directors prior to the approval of a sale or rental. 7 P a g e

8 6. Leases cannot and will not be approved for less than three (3) consecutive months and shall not be leased more than twice in any one calendar year. 7. A unit owner cannot lease their unit to the same tenant more than two (2) times according to Hunters Run Bylaws. 8. Renters are allowed to have one small dog or cat, weighing less than 25 lbs. PART G: GOLF CARTS 1. Unit owners wishing to own a golf cart must apply to the Westgate Board of Directors for permission to have the use of a golf cart and to park it on Limited Common Elements. 2. An ARC form is to be used which will indicate where the cart will be parked and where the source of electricity will be installed outside the unit by a licensed electrician. There shall be no wires hanging from the inside of the unit. An electrical outlet may be placed outside near the area in which the cart will be parked. In the event that the resident does not renew the application on a yearly basis, and provide current insurance, the Association has the right to cancel the approval. 3. If an upstairs resident requests the use of the downstairs resident s Limited Common Element, it must meet all requirements. The legal agreement shall be between the resident parties alone. The Association will be held harmless to any agreement. In the event of cancellation of the arrangement, the upstairs resident must restore the Limited Common Element to its original state. 4. If Limited Common Elements adjacent to the buildings, either side or front, are used, they must be hidden by a five (5) foot hedge so as not to be detrimental to the esthetics of the building. The preference is to use the side patio. 5. The Board of Directors will evaluate each request on an individual basis. 6. A certificate of insurance reflecting the name and address of the resident is required to prove that insurance ($1000,000-$300,000 liability and $1000,000- $300,000) is in place, whether the golf cart will be used on the golf courses or not. This certification must be resubmitted on a yearly basis. 7. For residents who will use the golf care for transportation on Hunters Run roads only, a sticker must be obtained from Hunters Run which approves its use for the current year. Those using it for golf, must pay the required trail fees and obtain the proper sticker for each current year. If these requirements are not met, the Association reserves the right to revoke the privilege for use of the golf cart. 8. Electrical power outlet must be certified to insure safety for outdoor use. 9. A standard golf cart cover must be used. 8 P a g e

9 10. Any damage to the Common Elements, due to the use of a golf cart, is the responsibility of the cart owner. 11. The golf cart owner must have a valid driver s license, as does any driver thereof. 12. Every golf cart owner will indemnify the Association and hold it harmless from any liability. 9 P a g e
