1 Inspection Services Mission Statement The Mission of the Inspection Services Program is to safeguard life or limb, health, property and public welfare by inspecting buildings, structures and sites for compliance with local, state and federal laws regulating and controlling the construction, quality of materials, use and occupancy, location and maintenance within the City and County of San Francisco. 3 Building Inspection Division Wing Lau - Chief Building Inspector Function The Building Inspection Division (BID) is responsible for inspecting the construction of all new and existing buildings and structures for conformity with approved plans and permits, and for compliance with state and local building code requirements. BID responds to emergency situations and complaints of unsafe structures, work without permit, and prepares Notices of Violation as necessary. Unabated cases are referred to Code Enforcement for Director's Hearings and further action. This division also conducts inspections for Police and Fire permits issued by those agencies and issues Noise Permits for construction work at night as prescribed in the San Francisco Police Code. Highlights and Accomplishments Performed 52,114 or 98%of all inspections within 48 hours. Performed an average of 12 inspections per person/day. Performed 5 spot check inspections a week per Senior Inspector. Received 1,999 new complaints; inspected 1,922 or 96% of new complaints received; abated 788 or 39% of complaints received. Responded to 1,666 or 84%of all complaints within 48 hours. Building Inspector Adwin Lau inspects reinforcing steel prior to placement of the shortcrete Issued 1,217 NOV's; abated 558 or 46% NOV's. Implemented an address restriction process for appealed and sensitive projects to prevent over-the-counter issuance of building permits without Planning and Building Inspection review. Implemented updated procedures for renewal of expired building permits. A minimum of one reinspection fee is being charged for an expired permit for final inspection. 5 Building Inspection Division On-going Projects Continue to provide inspection services to Treasure Island, Moscone Expansion project, San Bruno Jail, and the San Francisco Ferry Building Seismic Retrofit. Continue to perform spot check inspections as required by the Audit report Goals Inspect 90% of complaints received within 48 hours. Review quality control "spot check" procedures. Cross-train Plumbing and Electrical Inspection staff. Distribute 30 emergency backpacks for cars with partial and/or expired supplies. Activation of Department Operations Center during City-Wide October exercise. Meet with HIS to establish common procedure and coordination for the issuance of CFC's where a change of residential unit count is being addressed; cross-train staff. Arrange an asbestos awareness presentation (by DPH) for all field inspection personnel to help identify and avoid potential sources of contamination in older buildings under-going remodel work. 7 Code Enforcement Section Marvin Ruiz - Manager Leo McFadden, Supervisor Function The Code Enforcement Section (CES) investigates complaints of violations of the Building, Plumbing and Electrical Codes and employs abatement procedures to correct code deficiencies. This section also initiates follow-up enforcement when cases have been referred by other divisions within DBI by holding Director s Hearings and referring cases to the City Attorney for litigation. Assessment fees are collected from building owners that have code violations in order to recover costs incurred by investigations. CES prepares 3-R Physical Inspection Reports for buildings being converted to condominiums. The section also assists in the preparation and issuance of Emergency Orders for imminent hazards arising from natural disasters and emergencies. Highlights and Accomplishments Produced 18 3R inspection reports per month. Performed 408 Inspections. Abated 374 CES cases. Received 671 new complaint referrals from BID, PID and EID. Processed 212 cases or 32% for Director's Hearings within 60 days after receipt by CES. Responded to 100% of Director's letters within Director's deadline. Responded to 100% of phone calls within 24 hours. Completed 2001 Lien Cycle; prepared 2002 Lien Cycle. 11 Disabled Access Section Marvin Ruiz, Manager Rafael Torres-Gil, Supervisor Function The Disabled Access Section (DAS) investigates complaints of violations of the Disability Access related Code requirements, issues Notices of the Violations, and pursues a code enforcement abatement process to correct the deficiencies. This section holds Director's Hearings and refers cases to the City Attorney. Assessment fees are collected from building owners that have an Order of Abatement in order to cover the cost incurred by investigations. The Manager/Senior Building Inspector also serves as the Secretary to the Access Appeals Commission and the division clerk serves as the Recording Secretary. Highlights and Accomplishments Abated or referred 77 DAS cases. Received 152 new DAS complaints. Posted 98 DAS Notices of Violation. Collected $40,911 in code enforcement costs for DAS cases. Developed a Plan of Action for acquiring additional staffing to achieve 88 days complaint resolution goal Goals Initiate investigation of new complaints within 30 days. 13 Electrical Inspection Division Michael Hennessy - Chief Electrical Inspector Function The primary function of the Electrical Inspection Division (EID) is to provide for the public safety by enforcing municipal and state regulations and codes relative to construction, alteration and installation of electrical, life safety, and telecommunication systems. Highlights and Accomplishments Performed an average of 36,268 or 100% of inspection requests within 48 hours. Performed an average of 11 inspections per inspector/day. Performed an average of 4 spot check inspections a week per Senior Inspector. Received 193 complaints; inspected 193 or 100% complaints; abated 68 or 35% of complaints received. Responded to 175 or 91% of all complaints within 48 hours. Issued 140 NOV's; abated 37 or 26% of NOV's. Served as Hearing Officer for 26 Director's Hearings. Referred 8 cases to Code Enforcement. 3 Electrical Inspectors obtained certifications. Responded to 100% of Director's letters within deadline. Support staff Myra Williams, Lisa Yu Pan and Ben Man Responded to 851 customer requests for off-hour inspection services and life safety witness testing. Develop a handout sheet to help customers identify the most significant changes in the 2001 California Electrical Code and the San Francisco Amendments. Work with MIS technical staff to introduce a new electronically integrated permit and complaint processing system for use by field and office staff. Arrange the necessary training and technical support to ensure an orderly transition to the new system. Resolve the on-going dispute with Southern Bell Communications, Pacific Bell and American Telephone and Telegraph regarding Electrical Code jurisdiction in their San Francisco facilities. 17 Housing Inspection Services Rosemary Bosque - Chief Housing Inspector Function Housing Inspection Services (HIS) implements and enforces the San Francisco Housing Code and pertinent related City Codes. HIS establishes and maintains minimum maintenance standards for existing residential buildings to safeguard life, limb, health, property, and public welfare by conducting periodic health and safety inspections and responding to tenant complaints. Highlights and Accomplishments Performed 4 spot check inspections a week per Senior Housing Inspector. Received 3,288 new complaints; responded to 3,123 or 95% of complaints received within 48 hours. Inspected 6,211 of all complaints received; abated 3,970 of complaints received. Conducted 3,371 routine inspections on apartment buildings. (This figure does not include occupant complaint based inspections). Housing Inspector Dan Shiu inspects heating ducts in response to a complaint Conducted 162 routine inspections on residential hotels for the four quarters. (This figure does not include occupant complaint based inspections). Responded to 95% of life hazards or lack of heat complaints within 24 hours. Referred 27 code enforcement cases to the to City Attorney per direction from the Litigation Committee of the Building Inspection Commission. 18 Collected $169,339 in Assessment of Cost fees for Enforcement Cases. Referred 136 notices of noncompliance to the State Franchise Tax Board. Inspected 23 task force cases, issued 21 NOV's on task force cases, abated 25 task force cases. Issued 5 Emergency Orders, abated 28 Emergency Orders (including billing property owners for repairs made by City contractors), continued 21 Emergency Orders (including billing property owners for repairs made by City contractors). Issued 4 citations for heat violations and 12 citations for miscellaneous violations. Responded to 27 Director s letters within Director's deadline and 10 within 5 days of the Director's deadline (further research was needed) Issued 11 Subordinations on code enforcement cases. Increased the number of initial routine inspections from the 1st quarter by 100%. (595 Initial Routine Inspections were performed in the Ist quarter versus 1,133 performed in the 4th quarter). Conducted training sessions regarding dry rot in exterior wood surfaces, Planning Code Enforcement procedures (for appropriate referrals), and mold & mildew. 19 Housing Inspection Services On-going Projects Continuing to make improvements to, and reduce the backlog within the Routine Inspection Program. Continue to research and identify apartment buildings and hotels not currently within the R-1 Occupancy database for inclusion within the Apartment House & Hotel License program Goals Maintain a 50% increase in the number of initial routine inspections performed on apartment houses from the 1st quarter. 21 Residential Hotel Unit Conversion and Demolition Ordinance Legislative History The Residential Hotel Unit Conversion and Demolition Ordinance (HCO) was originally adopted by the Board of Supervisors as Ordinance No on June 26, The Board found that the Ordinance was necessary to preserve the existing stock of residential guest rooms as housing for low-income, elderly, and disabled persons. The Board noted in 1981 that the residential guest room housing stock had been decreasing at an alarming rate due to vacation, conversion and demolition of these units to tourist and other uses. The Board found that this reduction created a housing emergency, and adopted Chapter 41 of the S. F. Administrative Code to minimize the conversion and demolition of residential guest rooms. Residential Hotel Certification Beginning in 1981, the HCO required all hotel and apartment house owners and operators with guest rooms to report to the Bureau of Building Inspection (now the Department of Building Inspection) how the guest rooms were being used on September 23, If the guest room was actually occupied by a tenant for thirty-two consecutive days or longer, the room was designated as residential. If the room was occupied for less than thirty-two days the room was designated tourist. The property owner/operator had fifteen days to appeal the certification of these designations by the Bureau of Building Inspection. Residential Hotel Description A hotel is considered residential if it has one or more residential guest rooms certified by the HCO. Approximately 521 hotels are designated residential by Chapter 41 of the S. F. Administrative Code, which includes those hotels owned or operated by non profit organizations. The overall number of residential hotels can fluctuate because the Ordinance permits a hotel to change its residential designation upon approval of a Permit to Convert. Residential guest rooms can be legally converted to tourist uses with approval by the Director of Building Inspection. The Permit to Convert requires the hotel owner to replace the converted residential guest rooms with in lieu (replacement housing) fees, the construction of new units, or the creation of new residential guest rooms in an existing building. 76 Department of Building Inspection Annual Report Fiscal Year

22 Reports and Records Required All residential hotels which do not have documentation on file with the Department of Building Inspection indicating that the hotel is operated by a non-profit organization (recognized by the IRS) must file an Annual Unit Usage Report on November 1st every calendar year. These active residential hotels must also maintain daily logs, weekly reports and corresponding receipts for up to two years. The Certificate of Use indicating the number of residential and tourist guest rooms assigned to the hotel must be posted at the hotel lobby along with the weekly report. Residential hotel owners and operators must rent residential guest rooms certified by the HCO for seven days or longer. From May 1st through September 30th a residential hotel operator may rent 25% of their residential guest rooms on a nightly basis provided that the guest room is legitimately vacant. Housing Inspection Services maintains files on residential hotels which are available for public review. These files contain documentation required by Chapter 41 of the S. F. Administrative Code, such as the Certificate of Use, filed Annual Unit Usage Reports and Complaint Tracking Data regarding enforcement activities. Within the last five years, no winter rentals have been applied for pursuant to Sections 41.19(a)(3) and 41.19(c) of Chapter 41of the S. F. Administrative Code. Funds deposited into the San Francisco Residential Hotel Preservation Fund Account are transmitted to the Mayor's Office of Housing for disbursal pursuant to Section of the Chapter 41 of the S. F. Administrative Code. During this fiscal year three Permits to Convert were approved which required replacement housing fees to be deposited in the San Francisco Residential Hotel Preservation Fund Account. 23 Residential Hotel Unit Conversion and Demolition Ordinance Summary of Enforcement Efforts Housing Inspection Services has conducted an audit of the HCO files. Delinquent notices are sent to those residential hotel owners/operators who have not filed their Annual Unit Usage Report (due November 1, every year) or are missing other historical information. Summary of Enforcement Efforts Housing Inspection Services investigates complaints of record keeping violations of the HCO, as well as alleged conversion of residential guest rooms to tourist use. The Division also conducts in-house audits of HCO records when on-site inspections reveal violations of the Ordinance. 25 Lead Abatement Section Marvin Ruiz, Manager Louise Kimbell, Supervisor Function The Lead Abatement Section (LAS) is responsible for a wide variety of programs with emphasis on the Asthma Task Force Program, the Environmental Health and Safety Program, the Integrated Pest Management Program, the Lead Hazard Reduction Program and the Mentor/Intern Program. The Asthma Task Force (ATF) Program is responsible in representing the Department at the ATF of the CCSF, as mandated by an ordinance passed by the Board of Supervisors (Ordinance No , Ordinance Amending Ch. 19A of the Administrative Code by Adding Article II to Establish an Asthma Task Force). The Environmental Health and Safety Program is responsible in developing policies to reduce the potential for injuries and illnesses of the Department's employees and to comply with applicable health and safety regulations. The Integrated Pest Management (IPM) Program is responsible for developing and managing an IPM plan for the Department, as mandated by an ordinance passed by the Board of Supervisors (Administrative Code, Lead Abatement staff Bernard Tom, Vince Fabris, May-Ling Dea, and Tara Bazile Chapter 39). The Lead Hazard Reduction Program inspects buildings for compliance with the Work Practices for Exterior Lead-Based Paint legislation (SFBC Ch. 34, Section 3407). The Mentor/Intern Program is responsible for providing meaningful employment and work environment for City students at the Department. 80 Department of Building Inspection Annual Report Fiscal Year

26 Highlights and Accomplishments Received 1,426 Notification of Paint Disturbing Work forms for SFBC Work Practices for Exterior Lead-Based Paint (not including those with NOVs). Performed 271 "educational outreach" inspections where an inspector stops at a work site as workers are setting up to do preparation and paint work and explains the SFBC 3407 regulations. Received 397 SFBC 3407 complaints, responded to 99.7% of SFBC 3407 complaints within 24 hours. Issued 236 Notices of Violation and 22 Second Notices of Violation; issued 100 Notices of Penalty and Fee; and abated 365 complaint cases. Referred 50 complaint cases to NOP Appeal Hearing; and, referred 26 complaint cases (i.e., contractor's names/licenses) to CA Contractors State License Board, and 8 second referrals. Responded to 100% of Director's letters within Director's deadline. Responded to 99.4% of phone calls within 24 hours. Participated as a non-voting member on the ATF of the CCSF. Researched and wrote recommendations for the Department regarding people's sensitivities to chemical based products. Prepared the Hazardous Materials Unified Program Agency (HMUPA) application for and submitted to the Department of Public Health, HMUPA. Completed DBI's Work-Site Emergency Action and Fire Prevention Plan. Completed the annual inspection of City issued vehicles for maintenance items, emergency supplies and the Notice of Motor Vehicle Accident form. Provided input on and discussed the proposed amended draft legislation, SFBC 3407, Work Practices for Lead-Based Paint on Pre-1979 Buildings and Steel Structures. Researched and submitted a "sampling" of the SFBC 3407 complaint cases (and the associated operational costs) to the City Attorney's Office as evidence in the lawsuit filed against paint manufacturers. 27 Lead Abatement Section Increased the number of student interns who participate in the Mentor/Intern Program at DBI to 15. Ten student interns from the Mayor's Office SF YouthWorks program (year around program) and five student interns from the Department of Public Works Project Pull Program (summer program). On-going Projects Continued to participate as a non-voting member on the Board of Supervisors' ATF of the CCSF. Continued to participate as a non-voting member on the Board of Supervisors' ATF of the CCSF subcommittee, Environmental and Occupational. Continued to perform quarterly health and safety inspections to identify unsafe work conditions and/or practices in the office (i.e., quarterly physical inspection of 1650 and 1660 Mission Street buildings). Continued to provide health and safety training sessions for new employees as part of an introduction to the Department with Personnel Services Division. Continued to provide quarterly health and safety injury and illness training for non-field employees (i.e., Stretching). Continued to provide Smith System defensive driver training to staff that drive City issued vehicles. Continued to participate on the Lead Hazard Reduction Citizens Advisory Committee in the development of the amended legislation, SFBC 3407, Work Practices for Lead- Based Paint on Pre-1979 Buildings and Steel Structures. 31 Plumbing Inspection Division Dennis King - Chief Plumbing Inspector Function The Plumbing Inspection Division (PID) is responsible for assuring, through inspections, the proper functioning for installations of drainage, water, gas, and other mechanical systems covered in the Plumbing and Mechanical Codes. These inspections are carried out in buildings, which are newly constructed, remodeled, or repaired. PID additionally inspects fire sprinkler installations to assure compliance with the plans approved by the Fire Department plan check staff, and conducts inspections as required by various ordinances. Such ordinances include: the Night Club and Massage Parlor Ordinances (which require code compliance prior to business license issuance); and the Boiler Ordinance which requires that PID maintain records, send renewal notices, and prepare Notices of Violations against non-complying property owners. Highlights and Accomplishments Performed an average of 99% or 26,709 of all inspections within 48 hours. Performed an average of 12 inspections per person/day. Performed an average of 3 spot check inspections a week per Senior Inspector. Received 438 complaints; inspected 89% or 389 of complaints received; abated 71% or 309 of complaints received. Four (4) 6242 Plumbing Inspectors (permanent positions) were hired to fill provisional positions. 100% of the PID inspection staff has completed a Fire Sprinkler Code Interpretation seminar. Implement inspections of Mechanical wet-side heating and cooling piping installations. Plumbing Inspector James O Sullivan inspects a wall furnace unit to ensure safety. Clarify the PID inspection fee requirements for Plumbing, Mechanical and Fire Sprinkler permits. Continue the quality control spot inspection program, improve and implement the checklist. Respond to 100% of Director's letters within 48 hours of request. Maintain the MBO goal of eleven (11) inspections average per person/day.
