The provisions of Sections 5, 6 and 7 of this Act shall become effective 120 days after its enactment. The Chief of Police shall transmit to the Legislative Secretary the general order described in Section 6 of this Act no later than April 1, Section of Title 4, Guam Code Annotated, is amended by adding a new subsection (16) to read as follows: "(16) Property Management Officer at the Department of Corrections. Unpingco AN ACT TO AUTHORIZE THE GOVERNOR TO SELL THE REMAINING FORTY-EIGHT LOTS IN TRACTS 104 AND 3241, UMATAC, TO QUALIFIED APPLICANTS, TO WAIVE THE REQUIREMENTS OF THE CHAMORRO LAND TRUST ACT, TO AUTHORIZE THE GOVERNOR TO SUBDIVIDE TRACT 3241, UMATAC AND SELL TO QUALIFIED APPLICANTS THE RESULTING LOTS, AND MAKING AN APPROPRIATION FOR MAPPING SUCH PROJECT.

Authorizing the Governor to sell the remaining forty-eight lots tracts 104 and 3241 in Umatac. Authorizing the Governor to subdivide Tract 3241 in Umatac and sell to qualified applicants. Limitations in Deed. The Director of Land Management and the Attorney General shall execute deeds. The provisions of Chamorro Land Trust Act is not applicable. Legislatures approval of the land sales authorized by Section 2 and 3 of this Act. Appropriations to the Department of Land Management for surveying, mapping and engineering of Urnatac projects. BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM: Section 1. Statement of Legislative Purpose. The Legislature finds that, as set out in the Department of Land Management's recent inventory of existing government subdivisions in Umatac, there are forty-eight (48) vacant, unsold lots within Tracts 104 and 3241, as follows: (a) Within Tract 104 as shown on Land Management Drawing No. 156-FY-81, Lots Nos. 1, 9, and 12 of Block 1; Lots Nos. 1 and 6 of Block 2; Lots Nos. 5, 6, and 8 of Block 3; and Lots Nos. 1, 6, 7, 8, 9, and 10 of Block 4. (b) Within Tract 3241 as shown on Land Management Drawing No. 341-FY-84, Lots Nos. 1, 2, 3, 4, 5, and 6 of Block 1; Lots Nos. 9, 10, 11, and 13 of Block 2; Lots Nos. 3, 4, 5, 8, 12, 13, and 14, of Block 3; Lots Nos. 3, 4, 5, 6, and 7 of Block 5; Lot No. 3 of Block 8; Lots Nos. 5 and 6 of Block 9; Lots Nos. 4, 6, 8, 9, 10, and 11 of Block 10; and Lots Nos. 1, 2, and 3 of Block 11. Section 2. Sale of lots. The Governor is authorized to sell the forty-eight (48) lots described in Section 1 of this Act to the following applicants, the sale price of each not to exceed Two Thousand Five Hundred Dollars ($2,500); provided, that those deemed eligible to purchase and who were, on June 28, 1980, residing on any lots in tract numbers 104 or 3241 under a Land Management Land Use Permit and continue to reside there, shall receive first preference notwithstanding that their names do not appear on the lists in Sections 2 or 3 of this Act, and that the lots shall be sold only to persons who are at least eighteen (18) years of age, who own no land in Guam, and

3 who are qualified to own land in Guam; however, if a person owns property in Umatac which is not developable as a residential site then he may exchange property equal in value for a lot if he meets the other quawications set forth in this Act: Francisco and Tomasa S. Umatac Subdivision Expansion Project. The Governor of Guam is hereby authorized to further subdivide Tract 3241, Umatac, into additional residential lots, and sell the resulting lots to the following qualified applicants, the sale price of each lot not to exceed Two Thousand Five Hundred Dollars ($2,500); provided, that the lots shall be sold only to persons who are at least eighteen (18) years of age, who own no land in Guam, and who are qualified to own land in Guam; however, if a person owns property in Umatac which is not developable as a residential site then he may exchange property equal in value for a lot if he meets the other qualifications set forth in this Act: Pedro Meno; Joseph Q. and Donna H. Limitations in deed. Each deed conveying a lot pursuant to this Act shall contain a right of reverter to the government if the grantee sells or leases any of the conveyed property within twenty (20) years after the date of execution of the deed, or if the grantee inherits or otherwise acquires other land in Guam in addition to the conveyed lot and at the time of such subsequent acquisition of land the grantee has not constructed any structure on the conveyed lot. Section 5. Governor to execute deeds. The Director of Land Management and the Attorney General shall take all necessary action to effectuate the land sales authorized by Sections 2 and 3 of this Act, the Governor to execute all deeds, documents and other instruments needed to carry out the conveyances authorized by this Act. Section 6. Land Trust not applicable. The provisions of the Charnorro Land Trust Act, as amended, shall not apply to the land sales authorized by Sections 2 and 3 of this Act. Section 7. The land sales authorized in Sections 2 and 3 of this Act are hereby deemed approved by the Legislature.

Two Hundred Thousand Dollars ($200,000) are appropriated from the General Fund to the Department of Land Management for the surveying, mapping, and engineering of the Umatac Subdivision Expansion Project.
