1 MADISONVILLE MUNICIPAL/REGIONAL PLANNING COMMISSION RESOLUTION PC A RESOLUTION TO AMEND THE SUBDIVISION REGULATIONS OF MADISONVILLE, TENNESSEE TO ADD FINAL PLAT CERTFICATIONS FOR EXISTING WATER, SEWER, ELECTRICITY, SEPTIC SYSTEMS, AND RESERVE AREA WHEN AN EXISTING SEPTIC SYSTEM WHEREAS, in accordance with Tennessee Code Annotated Section , the has the authority to adopt regulations governing the subdivision of land and amend such regulations from time to time; and WHEREAS, such regulations are necessary to ensure the public health, safety, and prosperity through sound development practices in accordance with minimum standards of design; and WHEREAS, all notice, publication and public hearing requirements to amend the Subdivision Regulations of Madisonville, Tennessee have been met. NOW, THEREFORE, BE IT RESOLVED, that: Section 1. The does hereby amend Article II. Procedure for Plat Approval, Section C. Final Plat, Subsection 3. c., of the in lieu thereof the following: c. Certification from the utility provider that the water supply system meets requirements of the controlling state agency or that new water lines will be installed per an agreement between the subdivider and the utility provider. In the event the water supply is from existing water lines, the utility provider shall certify that newly created lots have access to existing water lines. Section 2. The does hereby amend Article II. Procedure for Plat Approval, Section C. Final Plat, Subsection 3.d. of the in lieu thereof with the following: d. Certification that the subsurface sewage disposal system is approved by the local health authority. Certification by the utility provider that the public sewerage system installed, or proposed for installation along with a financial guarantee provided, meets requirements of the controlling state agency. In the event sewer service is from existing sewer lines, the utility provider shall certify that newly created lots have access to

In the event an existing residence where the local health authority has no septic system records and such residence is being subdivided out from a larger tract, the property owner shall certify that the existing septic system is in proper working order and that the septic system is contained within the boundary of the individual lot. Certification by the local health authority when there is an existing septic system on site certified by the property owner, that a reserve area exists. Section 3. The does hereby amend Article II. Procedure for Plat Approval, Section C. Final Plat, Subsection 3.e. of the in lieu thereof with the following: e. Certification by the appropriate city authority and an approved independent street testing firm that all streets and appurtenance have been installed in accordance with established standards. Certification by the appropriate city authority that the existing street has been accepted as public. Section 4. The does hereby amend Article II. Procedure for Plat Approval, Section C. Final Plat, Subsection 3., of the Subdivision Regulations of Madisonville, Tennessee by inserting the following new letter g. and re-alphabetizing the remaining item in alphabetical order: g. Certification from the utility provider that electric service is from existing electric lines and that the newly created lots have access to existing electric lines. Certification from the utility provider that the electric lines have been installed or that the new lines will be installed per an agreement between the subdivider and the utility provider. Section 5. The does hereby Certification Forms, of the Subdivision Regulations of Madisonville, Tennessee by changing certification 3. to 3a. and adding 3b. Existing Water Certification, as follows: 3b. EXISTING WATER CERTIFICATION The property shown on this subdivision plat is within the service area of. I certify that all lots shown on this subdivision plat have access to an existing water line located within the existing road right-of-way.

Subdivision Certification Forms, of the Subdivision Regulations of Madisonville, Tennessee by adding 4c. Existing Sewer Certification, 4d. Existing Septic System Certificate, and 4e. Certification of Reserve Area for Subsurface Sewage Disposal, as follows: 4c. EXISTING SEWER CERTIFICATION The property shown on this subdivision plat is within the service area of. I certify that all lots shown on this subdivision plat have access to an existing sewer line located within the existing road right-of-way. 4d. EXISTING SEPTIC SYSTEM CERTIFICATE The existing septic system(s) is (are) located as shown on the plat as Lot(s). The location includes the septic tank and all field lines. To the best of my knowledge the septic system is in proper working order on this date and the septic system(s) is (are) contained within the boundary of the individual lot(s). Owner 4e. CERTIFICATION OF RESERVE AREA FOR SUBSURFACE SEWAGE DISPOSAL Lot has an existing septic system. In the event of the failure of the current system, a reserve area of suitable soils that can support the existing residence for subsurface sewage disposal has been designated in the area(s) shown. Cutting, filling, or alteration of the soil conditions may void this approval. Environmental Specialist

Lots are/will be served by new powerlines as per agreement between owner of subdivision property and utility. NOTE: In any of the above instances, extension of the service connection is the responsibility of the individual lot owner, in accordance with the established policies of this utility company. Section 9. This resolution shall become effective from and after its adoption, the public welfare requiring it.
