4 TOWNSHIP OF NORTH GLENGARRY STAFF REPORT Date: To: May 12'\ 2016 Council Members From: Gerry Murphy Planning Manager Daniel Gagnon CAO Re: Zoning Amendment Z Owner: Boulangerie Lanthier Ltee Property Location: PLAN 5 LOTS 24 TO 27 PT LOTS; 18, 19,23 AND 28 RP14R6119; PART 3 PT PART 1 (58 Dominion St. South, Alexandria) Purpose of application: A site specific zoning amendment to permit the expansion of the existing bakery. Effect will be to reduce the front and exterior side yard requirements, increase the maximum lot coverage and provide an exemption from certain landscaping open space requirements. Zoning designation: Village Core Area Official Plan designation: Community Core Discussion: The Lanthier bakery has been in existence in Alexandria since 1932, servicing the area with quality bread products. The bakery is looking to expand its operation across North America and in order to do so, its facility in Alexandria will require major upgrading as well as an enlargement of the production facility building. The bakery is situated on the comer lot between Dominion Street and St Paul Street and enjoys a legal nonconforming status with respect to side yard setbacks, lot coverage, parking requirements and certain landscaping requirements. Once a legal non conforming building is subject to an increase in height, size or volume, the deficiencies need to be recognized and approved through the planning process. In this particular case the expansion of the faculty will result in the following deficiencies: 1) The exterior side yard set back from the streets, St Paul and Dominion St. to be reduced to 0.0 meters from the required 7.5meters and the front yard setback on Dominion Street from the required 7.5 meters to the proposed 0.0 meters.

5 2) The maximum lot coverage to be modified from the required 40% to the proposed 75% lot coverage. 3) To eliminate the requirements pertaining to open landscaping on the lot where a 3 meter landscaping strip is to be provided along the lot lines abutting a street. These Zone requirements may be approved by way of a general site specific amendment. The North Glengarry Official Plan will require the applicant to meet certain criteria that can be achieved through site plan control agreement including: A site plan development agreement with supporting documentation pertaining to: I) A storm water management plan 2) A lot grading plan 3) A site servicing plan 4) A traffic study 5) Financial Securities 6) Compliance with MOE Guidelines Dl and D6 for industrial development adjacent to residential development for noise, dust or emission. The applicant will also need to demonstrate that the development will comply with the requirements for parking in accordance with section 3.21 of the Municipal Zoning By Law. The existing bakery is deficient in parking spaces and no expansion can be approved without addressing the need for parking spaces in accordance with these zoning requirements. To this end the Bakery is in discussion with an adjacent neighbouring lot to secure a long term lease agreement designed to meet the needs of the existing bakery as well as the future expansion. At the time of the writing of this report no such lease agreement has been submitted. As supporting documentation the developer has submitted a traffic study undertaken by GHD consultants describing the existing and future estimated traffic flow to the bakery as well as proposed truck routing and loading features. The study was provided to Public works and the Counties for peer review. At the time of the writing of this report we have received comments from the Municipal Public works manager. Both documents are included for the Committees consideration. The Public Works manager has noted a number of suggestions pertaining to the truck movements and the inclusion of a no parking area on the street between Highway 34 and Dominion Street. All of these items can be imposed, subject to Council's approval, in the pending Site Plan Development Agreement. Recommendation: That the Council of the Township of North Glengarry approve by-law Z and that the by-law be read a first, second and third time in Open Council this 12th day of May 2016.

6 The Corporation of the Township of North Glengarry By-law No. Z Being a By-law to amend By-law No WHEREAS By-law No regulates the use of land and the use and erection of buildings and structures within the Township of North Glengarry; AND WHEREAS the Council of the Corporation of the Township of North Glengarry deems it advisable to amend By-law No as hereinafter set forth; NOW THEREFORE the Council of the Corporation of the Township of North Glengarry enacts as follows: 1. The area affected by this By-law is located on lands known municipally as 58 Dominion Street South, being PLAN 5 LOTS 24,25,26,27,PT;LOT 28, Alexandria Ward, Township of North Glengarry, as indicated by the shaded tone on Schedule 'A' attached hereto and forming part of this By-Jaw. 2. Schedule "C" Alexandria to By-law No is hereby amended as follows: The area shown on Schedule 'A' to this By-Jaw, the land is hereby rezoned from Village Core (CA) Zone to Village Core Exception 6 (CA-6) Zone. 3. By-Jaw No is hereby amended by adding the following exception to Section 8.1 (3) Special Exceptions. (f) CA-6, 58 Dominion Street South (Lanthier Bakery) Notwithstanding the provisions of Section 6.1 (2) (c), (d), and (h), the provisions of Section 3.13 (b) and (c) and the provisions of Section 3.14 (c), hereof to the contrary, the land zoned CA-6 on Schedule 'C' hereto, and identified as PLAN 5 LOTS 24,25,26,27,PT;LOT 28, Alexandria Ward, municipally known as 58 Dominion Street South, shall be used in accordance with the following provisions: Zone Requirements: Yard Requirements (minimum) Front Yard Depth 0 m Exterior Side Yard Width 0 m Lot Coverage (maximum) 75% Section 3.13 (b) and (c) and the provisions of Section 3.14 (c) shall not apply.
