The Handbk may be amended frm time t time by the RORP and it des nt cnstitute legal advice nr an exclusive reference t all requirements stated in the DIFC Real Prperty Laws and Regulatins, r any ther laws. DIFC THE REGISTRAR OF REAL PROPERTY (RORP) The Registrar f Real Prperty (RORP) is a separate legal bdy established as a Crprate Sle. The Registrar f Real Prperty (RRP) is respnsible fr apprval and registratin f all types f transactins relating t Real Prperty lcated within the Dubai Internatinal Financial Centre (DIFC) in accrdance with the DIFC Laws and Regulatins. The Registrar f Real Prperty (RORP) maintains register f all prperties. Any prperty in the DIFC must be registered with the Registrar f Real Prperty (RORP) under the relevant DIFC Laws and Regulatins. Registry Services Registry Services is the department respnsible fr handling and prcessing all types f applicatins related t Real Prperty registratin and recrdings n behalf f the RRP. 4 General Guidelines Language: All supprting dcuments shuld be submitted nly in English. RORP Frms: Lease Registratin / Surrender and Terminatin can nly be accessed thrugh the DIFC Client Prtal. Fr mre infrmatin, please refer t the Leases sectin n page 13. The remaining RORP frms are available n Please nte the fllwing when filling/submitting the applicable frms: All fields must be filled cmpletely and clearly including the date, witness signature and name etc. All fields must be typed and dully filled. Alteratin r the use f crrectin fluid is nt accepted and will result in the rejectin f the applicatin. The Buyer s signature must match the signature n his/her passprt. Payments f Fees: Belw please find the payment methd accepted at the Registry Services. Please nte that payment f applicable fees may nt necessarily cnstitute as apprval f the transactin withut the submissin f the relevant dcuments, and the final apprval f the RORP. Payment Methd Cnditins Cash (AED Only) Payment in AED nly, nt exceeding AED (5,000) per unit transactin. The riginal passprt f the authrised persn must be prvided. POAs issued utside the UAE: POAs issued utside the UAE in languages ther than English r Arabic, require legal translatin int 5

6 English. The POA and legal translatin shuld be attested by the UAE Ministry f Freign Affairs riginal dcuments t be presented fr verificatin. The riginal passprt f the authrised persn must be prvided. Identificatin Dcuments (KYC) fr individuals and Legal Entities The fllwing identificatin dcuments will be required fr Real Prperty Registratins: Individuals: Original passprt (if the passprt desn t have a signature specimen then a ID with a clear signature specimen will be required). If the individual is utside the UAE, the passprt cpy must be attested by the Ministry f Freign Affairs. Legal Entities established within the UAE: Certificate f Incrpratin r the cmmercial license ntarised by the issuing authrity. Cpy f the articles f assciatin ntarised by the license issuing authrity. Passprt cpies f the sharehlders hlding shares equal t r greater than 5% (Nt applicable t public cmpanies). Bard Reslutin apprving the transactin and appinting the signatries and pint f cntacts t carry ut the registratin f the assigned prperty (riginal passprt f the assigned signatries t be submitted fr verificatin). Attested Certificate f incumbency prviding details abut the current sharehlders n the entity and their shares. Freehld Transfer (Sale and Purchase f Real Prperty) Applicatin fr Prperty Registratin This sectin sets ut the main requirements fr the registratin f prperty lcated within the DIFC. Transfer f Freehld Transactin must be registered with the RRP within 30 days f entering int the transactin. Failure t register within 30 days will result in fines as prescribed in the DIFC laws and Regulatins. If yu wish t have further assurance n the status f the prperty that yu are intending t acquire, yu can apply fr an fficial search request t identify the status f the unit/plt that yu are acquiring. The search request prcedure is set in this dcument under the Official Search Sectin. 6

7 Registering a Transfer f Freehld can nly be submitted thrugh the DIFC Client Prtal. If yu wish t submit a request fr Freehld Transfer, then please btain access t the DIFC Client Prtal by fllwing the steps belw: Please visit the fllwing link: Navigate t the panel n the left side and click n Request Access fr Nn DIFC clients. Fill in the Prperty Services Access request frm and uplad a valid passprt cpy then click Submit. Upn submissin, the system will send a ntificatin t the address prvided with user access details. Once yu get the access please fllw the belw steps belw t submit the Freehld Transfer Applicatin: Visit the DIFC Client Prtal: Lg int the Prtal with the user name and passwrd prvided. G t the Prperty Services sectin. Click n Transfer f Freehld. Befre filling the frm please nte the belw: The service request submitted n the DIFC Client Prtal is fr the initial review and bking the appintment t finalize the transactin, The Freehld Transfer registratin r recrding will be cmpleted upn submissin f the Freehld Transfer Fee, all the remaining fees and riginal dcuments. All riginal frms and dcuments shuld be prvided by the appintment date and time. Transfer f Freehld must be registered / recrded alng with the payment f the Freehld Transfer Fee within 30 days frm the date f entering int the Freehld Agreement. Failure t cmply with the deadline will result in a penalty f USD 1,000 and an interest as per DIFC Real Prperty Laws and Regulatins. If the transfer is happening n a mrtgaged unit, then the discharge f mrtgage can be dne befre r alng with the submissin f the service request t register/recrd the Freehld Transfer. All the dcuments upladed n the service request must be clear and with a high reslutin. Failure t submit clear scanned cpies will result in rejecting the request. Submissin Prcess Fill in the required fields n the service request then click Save The system will direct yu t the next page. Review the details entered then add the tenant details and the landlrd details. Please ensure all the infrmatin prvided is accurate. Once the seller and buyer details are entered, navigate t Dwnlad/Uplad Dc t uplad the required dcuments. Click n Submit. A pp up message will appear infrming the user that freehld registratin frms have been generated. Navigate t Dwnlad/Uplad Dc again and print the generated dcuments (please refer t the dcuments with the status Generated ) Obtain the required signature n the frms and uplad a scanned cpy f all the signed dcuments t the prtal. Click n Save & Submit Upn receipt f the service request, registry services team will review the request and cnfirm the appintment date and time. In case f any pending requirements r infrmatin, the service request will be returned fr mre infrmatin r fr re-uplad. An ntificatin and SMS will be sent accrdingly. RORP System Generated Frms: Please uplad a scanned cpy f all the frms generated by the system upn finalizing the request. The frms must be signed and scanned with a high reslutin. Payments required Recrding f Caveat fee USD 100 (AED 367.5) t be paid by the buyer. Withdrawal f Caveat fee USD 100 (AED 367.5) if applicable t be paid by the seller. Registratin fee is 5% ver the ttal value f the prperty payable t the Dubai Internatinal Financial Centre Authrity. On Plan Prperties Dcuments t be upladed fr the Seller (If the seller is nt the Develper): Original title deed. Levy Clearance Certificate frm the Bdy crprate. Transfer f freehld between a cmpany and its sle sharehlder(s), r between cmpany whse beneficiary is the sharehlder(s) f the ther cmpany This prcess shuld be submitted manually and cannt be cmpleted thrugh the prtal. Please nte that the same requirements under n plan and ff plan purchases apply, except fr the belw: The sales and purchase agreement can be substituted by a letter frm the sharehlder(s) cnfirming the transfer f the freehld between the 2 parties. The freehld transfer fees f 5% are nt applicable. Fees f USD 273 (AED 1003) will be required. This case is applicable nly f the sharehlders hld the same percentage f interest in the prperty and the entity. Withdrawal f Caveat This sectin sets ut the requirements if a party is requesting t withdraw recrded caveat in a real prperty ldged with the RORP. On plan and ff plan prperties: 9

10 Signed Withdrawal f Caveat frm by the interest hlder (Withdrawal f Caveat frm N. 43). Relevant dcument specifying the nature f interest withdrawal - if relevant. Passprt cpy if the interest hlder is an individual. If the interest hlder is a legal entity, bard Reslutin apprving the transactin and appinting the signatries wh will carry ut withdrawal f the caveat (Original passprt f the assigned signatries t be submitted fr verificatin). This dcument must be ntarised by the issuing authrity if the entity is within the UAE. Fr verseas entities, the reslutin needs t be attested by the UAE Ministry f Freign Affairs. Payments Required Withdrawal applicatin fee USD 100 (AED 367.5) Adding & Remving C-Owner This sectin sets ut the requirements if a C-Owner is t be added as a tenant in cmmn, where each wner wns an undivided share in the prperty, hwever, they are nt cnsidered the wner f the whle prperty but nly a specified percentage f the prperty. This sectin is nt applicable t Jint tenants, as any changes wuld require transfer f the entire enters as per 4.2. Adding/Remving a C-Owner (Tenants in Cmmn) T register persn(s) expressing interest as tenants in Cmmn in a registered real prperty in DIFC. Off Plan Prperty: Dcuments t be submitted by the Seller Signed Withdrawal f Caveat frm (Withdrawal f Caveat frm N. 43) indicating the percentage f a lt being sld. If the seller is an individual, a cpy f the seller s passprt is required. If the seller is a Legal Entity, a bard Reslutin apprving the transactin and appinting the signatries wh will carry ut withdrawal f the caveat (Original passprt f the assigned signatries t be submitted fr verificatin). This dcument must be ntarised by the issuing authrity if the entity is within the UAE. Fr verseas entities, the reslutin needs t be attested by the UAE Ministry f Freign Affairs. If the prperty is wned by mre than ne wner, an attested cnsent letter frm the remaining cwners apprving the sale t the new buyer will be required. Dcuments t be submitted by the Buyer Identificatin dcuments as per 4.5 n page 5. N Objectin Letter frm the develper intrducing the C-Owner, prperty details, and the dcuments submitted in supprt t the ldgement f Caveat. Please nte that all mrtgages registered r recrded with DIFC Registries must be apprved by a bank listed with DIFC as a prvider fr prperty financing facilities. Fr mre details n hw t list a bank r a financial institutin with DIFC, please us n Mrtgage Registratin This sectin sets ut the requirements t register a mrtgage n a plt r unit lcated within the DIFC with the DIFC Registrar f Real Prperty. Mrtgage registratin must be dne by the mrtgagee, wh has an interest in real prperty lcated in DIFC, t establish a mrtgage in a particular prperty. Off Plan Prperty 11

12 Cpy f the financing (Islamic r Cnventinal) agreement between the mrtgagee and the mrtgagr. Caveat Frm submitted, signed, and stamped by the mrtgage prvider (Caveat frm N. 42). Mrtgage Registratin Frm submitted, signed, and stamped by the mrtgage prvider (Mrtgage frm N. 19). This dcument will be recrded upn registering the strata plans fr the same develpment. On Plan Prperty Cpy f the financing (Islamic r Cnventinal) agreement between the mrtgagee and the mrtgagr. Mrtgage Registratin Frm submitted, signed, and stamped by the mrtgage prvider (Mrtgage frm N. 19). Payments Required Ldgement f Caveat fee USD 100 (AED 367.5) (Required fr ff plan prperties nly). Islamic Mrtgage Registratin fee f USD 273 (AED 1,003). Cnventinal Mrtgage Registratin fee USD 100 (AED 367.5). Discharge f Mrtgage This sectin sets ut the requirements f discharge f mrtgage n the registered real prperty. This prcedure applies when the mrtgagee decides t remve his/her interest in the registered real prperty in DIFC. Discharge f Mrtgage Frm (Frm N. 21) signed and stamped by the mrtgage prvider. Return f the riginal Mrtgage Cnfirmatin Letter issued by the Registrar f Real Prperty fr the respective mrtgage released in case f ff plan prperties. Return f the riginal title deed in case f n plan prperties. Clearance letter issued by the mrtgage prvider signed by the authrised signatry intrduced t the DIFC and stamped. The Bank/Finance Cmpany Clearance Letter wuld need t be addressed t the attentin f The Registrar f Real Prperty, Dubai Internatinal Financial Centre, 14th flr - The Gate Building, P. O. Bx: 74777, Dubai UAE. Payments Required Discharge f Mrtgage fee USD 100 (AED 367.5) Variatin f Mrtgage This sectin sets ut the requirements t register any variatin made t the registered mrtgage. This prcess can be applied by the mrtgage prvider that has a registered interest in real prperty in DIFC fr variatin in the mrtgage term r amunt. Variatin f Mrtgage Frm (Frm N. 20). Cpy f amended mrtgage agreement r extended ffer agreement. Payments Required Variatin f Mrtgage fee USD 100 (AED 367.5) Leases Lease/Sub-lease Registratin is required fr real prperties that are leased fr a term exceeding ne year (including 12

13 any ptin t renew whether exercised r nt). The lease must be registered within 28 days frm the date f signing the lease agreement. Failure t register the lease within the agreed time frame will result in a penalty f USD 1,000. RRP lease related services can nly be accessed thrugh the DIFC Client Prtal. If yu wish t submit a request fr lease registratin, lease surrender r Terminatin, then please btain access t the DIFC Client Prtal by fllwing the steps belw: Please visit the fllwing link: Navigate t the panel n the left side and click n Request Access fr Nn DIFC clients. Fill in the Prperty Services Access request frm and uplad a valid passprt cpy then click Submit. Upn submissin, the system will send a ntificatin t the address prvided with user access details. Lease Registratin Lease registratin f prperties with the DIFC must be submitted thrugh the DIFC Client Prtal. Befre filling the frm, please nte the belw cnditins: Cmmercial units such as ffices and retail shps can nly be leased by Cmpanies r Partnerships registered in the DIFC r are under frmatin at the time f Lease Registratin. Cmpanies leasing residential units will be asked t prvide ccupant details. A lease must be registered within 28 days f the date f entering int the Lease Agreement and a penalty f USD 1,000 applies in case f failure t register within 28 days. Please refer t DIFC Real Prperty Laws and Regulatins fr further details. All the dcuments upladed n the service request must be clear.
