The Town Council reviewed the application on October 20, 2015, and voted to move the resolution authorizing the Town Manager advertise a public hearing to the consent agenda. There have been no proposed changes by the applicant, therefore the Site Plan previously submitted is still standing. This is a request for a Conditional Use Permits for a mixed-use project in the B-1, General Business district. The development will consist of ground floor commercial with four stories of multifamily residential apartments on a 6.2 acre site, bordered by Quantico Creek along the northern property line. Background is as follows: STAFF REPORT CUP # , Parkside at Dumfries A. Request - This is a request for a Conditional Use Permit for a mixed-use project in the B- 1, General Business district. B. Site Location - The 6.2 acre site is identified by the following GPIN The site is located on Fraley Boulevard, along the southern bank of Quantico Creek, and directly across the street from the Williamstown Road intersection and Grace Church. C. Comprehensive Plan - The site is designated as Commercial in the 2014 Future Land Use Map, with Open Space/Green Space on the northern portion of the lot continuing north through Garrison Park. D. Zoning The site is currently zoned B-1, General Business. E. Surrounding Land Uses - The subject site is bordered by the B-2 Zoning District to the West and North West, and B-1 to the East and North East, the land is zoned B-1 South along the Fraley Boulevard corridor. Across the street to the East warehouse units operate, in addition to Grace Church north of Williamstown Boulevard. Uses to the South are largely automobile uses, as well as a strip mall and a couple office buildings. The land North of the property has been approved for a mixed use Town Center Development with residential over ground floor commercial. F. This application was reviewed by the Planning Commission July 13, 2015; August 14, 2015; and a public hearing was held September 14, The Planning Commission unanimously voted to move the CUP forward to the Town Council with a recommendation to approve the CUP as presented.
3 II. Current Situation is as follows: A. The applicant is requesting the CUP to allow for multifamily residential apartments, located above a ground floor commercial, retail or office use. The Town recently assisted the property owner in designating the land as a revitalization area for mixed use mixed income projects through the Virginia Housing Development Authority. B. The five story mixed-use building proposed is allowable in the B-1 District by CUP approval. The ground floor of the building will contain approximately 16,000 gross square feet of space with 12,700 square feet of retail storefront. The remaining 3,300 square feet of floor space will be reserved for vestibule and elevators, office, trash areas, utility and maintenance rooms, restrooms, and a mail area. The four floors of residential above ground floor commercial will house a mix of multifamily residential apartment units. C. Applicant has submitted a CUP application and will be working concurrently with the BZA applying for a Variance for building height. The Variance will be applied for due to the constraints of the large area of RPA on the lot. The CUP request is solely for the use of residential over ground floor commercial. Current allowable building height in the B-1 District is 50' and the applicant will be applying for a Variance to raise the height to 60'. D. A majority of the parking area on this site sits on land that has already been developed, and therefore considered a redevelopment in the RPA, which is permitted by Town Code Sect (b)(2). E. With this application a large recreational area of open green space is proposed to include a picnic area, and kayak trail and launch into Quantico Creek. The green space for this project will border the creek, which is adjacent to the recreational improvements proposed and agreed to for the First Town Center project. III. Issues in order of importance are as follows: A. Zoning Ordinance 1. Intent of B-1 zoning Does the proposed use further the intent of the B-1 zoning district? The proposed use is harmonious with the surrounding properties where it backs to the B-2 Zoning District. The site poses many obstacles to development and may otherwise remain vacant. The commercial retail meets the requirements of the B-2 Zoning District. The proposed open space allows for pedestrian connectivity to Main Street and approved the Town Center. The proposed development would be an amenity to the Town residents.

Zoning requirements Does the site otherwise meet the requirements of the Zoning Ordinance? a) The applicable sections of Section (B)(20) in the B-1 zoning district are as follows: "Residential, multifamily, located above a commercial, retail or office use on the ground floor." 3. Conditions Are there any conditions that should be applied to the use to limit the impact of the use on the surrounding area? Meet transportation Impact Analysis requirements. Provide pedestrian connectivity between proposed development and recreational area on north side of creek. Retail space must be located along perimeter of building. B. Legal Uses of the Property - A mixed use building with residential above ground floor commercial is allowable by CUP in the B-1 District. C. Parking- This development will offer 168 parking spaces, meeting the Town Code regulations for parking credit allowances. The residential portion of the development would require 136 spaces, and 51 for commercial parking. Town Code Sect (k) allows a parking credit for parking spaces required for one use, when parking spaces required for another use on the same lot can be used because of a difference in operating hours. D. Timing When must the Planning Commission take action on this application? What effect would the conditional use permit have on future use of the property? There are no time constraints for taking action on this application. The CUP would be an improvement to the property. Other developers have made inquiries on the property, but were not comfortable with the obstacles in place with the RPA and potential expansion of Fraley Boulevard. IV. Recommendation is that the Town Council allow the Town Manager to move forward with scheduling a public hearing. Approval of the application as presented is recommended. Attachments A.
