3 1.0 Products Covered by this Manual This manual covers the same products as section 2 of the Maple Products Regulations (MPR), namely: AMaple product@ means any product obtained exclusively by the concentration of maple sap or maple syrup, excluding any substitute.@ Maple sugar, soft maple sugar, maple butter and maple taffy are maple products, according to this definition. AMaple sap@ means the sap obtained exclusively from trees of the botanical genus Acer. AMaple syrup@ means the syrup obtained by the concentration of maple sap or by the dilution or solution of a maple product, other than maple sap, in potable water. N.B. Products containing maple syrup or other maple products (such as maple cookies, maple tarts, maple candy cones) are not subject to the MPR. They are subject to the Food and Drugs Act and its regulations, the Consumer Packaging and Labelling Act and its regulations and any other pertinent legislation. Such products are subject to CFIA inspection but the facility is not subject to federal establishment registration. 1.1 Registration and trade requirements This section covers the registration and trade requirements for operators of registered establishments and other merchants, as defined in the MPR. An inspector monitors the application of these requirements by operators and merchants Exclusive grading right of registered establishments The MPR stipulates three grades for maple syrup packed in Canada: 1. Canada No Canada No Canada No. 3 and five colour classes: 1. Extra light 2. Light 3. Medium 4. Amber 5. Dark. Registration confers upon the operator of an establishment the exclusive right to grade (or supervise the grading of) maple syrup using the Canadian grading system. 4 5.(2) Maple syrup shall be graded in: a) a registered establishment; or b) any place, where it is graded by or on behalf of the operator of a registered maple syrup shipper establishment. 5.1 (1) Subject to subsection (2), no person other than a grader shall grade maple syrup. (2) Maple syrup may be graded by the operator or an employee of a registered establishment if the grading is carried out under the supervision of a grader Types of registration by preparation activity Section 2 of the Canada Agricultural Products Act (CAPA) defines Apreparation@, as follows: APreparation@ includes, in respect of an agricultural product, processing, slaughtering, storing, inspecting, grading, packing, assembling, pricing, marking and labelling. Three types of establishments are identified in section 2 of the MPR according to their preparation activities. An operator is eligible to obtain a particular type of registration, depending on its proposed activities. 1. ASugar Bush Establishment@ (MSB) means an establishment in which the preparation of maple products directly from maple sap, including colour classification, takes place. A sugar bush establishment must prepare maple products directly from maple sap. Maple products, including maple syrup, from other establishments cannot be prepared and/or stored at this facility. Products can be packed in retail containers, in barrels, in tanks, etc, and must meet the container sizes prescribed by the MPR. The operator is responsible for grading maple syrup by grade and colour class. 2. APacking Establishment@(MP) means an establishment in which the preparation of maple products, including colour classification, takes place, but does not include a sugar bush establishment or a maple syrup shipper establishment. 5 A packing establishment can purchase maple products, including maple syrup, from any registered and/or non-registered producers. A packing establishment prepares these maple products (e.g., heating and mixing) and packages them in retail containers, in barrels, in tanks, etc. The containers must meet the sizes prescribed by the MPR. The operator is responsible for grading maple syrup by grade and colour class. A registered packing establishment may purchase maple syrup in tanks from one or more producers, and prepare them further (e.g., mixing, packaging). Sugar bush establishments and shipper establishments cannot do this. 3. AMaple Syrup Shipper Establishment@ (MSS) means the establishment of a person who buys maple syrup that is packed in bulk containers for colour classification, preparation and resale in bulk and who exports the syrup or conveys it from one province to another. A shipper establishment can purchase maple syrup in barrels directly from any registered establishment in Canada and/or any non-registered establishment within his own province. The shipper is responsible for grading the syrup by grade and colour class. Shipper establishment does not mix and/or package maple syrup. The shipper markets the maple syrup in their original containers Requirements pertaining to trade Establishments registered under the MPR may engage in interprovincial and international trade of maple products. As mentioned in section above, only the operator of a registered establishment may grade maple syrup under the MPR. However, an individual could under certain circumstances trade in a maple product outside the province where it was prepared without necessarily being the operator of a registered establishment. It is important to have a clear understanding of what is permitted and prohibited under sections 15 and 16 of the MPR (below) to determine whether a given type of trade with respect to a given maple product is compliant or not. Export and Interprovincial Trade a) Prohibition Under section 15(1) of the MPR, no person shall export out of Canada or send or convey from one province to another any maple syrup unless: it is marked with a grade name and it meets the requirements for that grade set out in Schedule I. b) Permission - maple syrup for a packing establishment in another province Under section 15(2) of the MPR, maple syrup may be sent or conveyed from one province to another without being graded and marked as prescribed by the MPR if: Chapter 1 - Maple Products Establishment Inspection Manual - January Revised in May 2013 for external Web publication 3

6 it is packed in containers that have a capacity of more than 5 L; and it is to be graded or reprocessed at a packing establishment registered under these Regulations. In such a case, the individual who sends or conveys the said product does not necessarily have to be an operator of a registered establishment, if the above conditions with reference to the product have been met. Export a) Prohibition Under section 16(1) of the MPR, no person shall market in export trade any maple product unless it is packed and marked in accordance with Parts II and III. b) Permission - maple product in a non-prescribed size container and not marked as prescribed by the MPR Under section 16(2) of the MPR, (...) maple syrup or any other maple product that is not packed in a container of a size prescribed by the MPR and not marked as prescribed by the MPR may be marketed in export trade if the registration number issued to the operator of the packing establishment, to the sugar bush operator or to the maple syrup shipper is marked on the label of the container or appears on the bill of lading or contract of sale; and the label or other markings on the container do not misrepresent the quality, quantity, composition, characteristics, safety or value of the maple syrup or maple product. In such a case, the individual who sends or conveys the said product does not necessarily have to be the operator of a registered establishment, if the above conditions with reference to the product have been met. N.B. It is recommended that the operator of an establishment who does not wish to take advantage of the privileges that registration confers not apply for registration or not renew it with CFIA, as the case may be. 7 Individual shipments not exceeding 100 litres of maple syrup or 25 kg of maple products Registration is not required for individual shipments out of province that do not exceed 100 litres of maple syrup or 25 kg of maple products. Such shipments are sometimes made to fill orders placed via the Internet. Transactions of this kind are subject to CFIA inspection to verify compliance with the limits on the maximum quantities of product that may be sent out of province in any one shipment. The MPR, including Section 18, contains other specific permissions. (Note: article 19 of the MPR includes import trade requirements.) 1.2 Steps in Applying for an Establishment Registration Filling out Form CFIA 3043, Application for Registration of an Establishment. Here is how to fill out this form. Type of application [Check the appropriate box.] $ New: For a new establishment $ Renewal: For the annual renewal of a registration (on the 12-month anniversary date of issuance of registration) $ Revision: For any changes made to the legal name of the establishment or the address of the processing establishment (if the location of the establishment has moved). Preferred language of correspondence [Check the appropriate box.] Existing Registration No. (if applicable) For renewal or revision applications, indicate the registration number assigned to the establishment. Legal status of business [Check the appropriate box.] $ Corporation or Limited Company: This consists of a registered or incorporated company. The business name usually includes Ltd. or Inc. (e.g., National Maple Inc.). The business is created under federal or provincial legislation. Copies of official articles of incorporation or other provincial or federal registration documents are required. $ Partnership: A partnership is an association of two or more individuals coming together to operate a business. 8 $ Individual: Sole proprietorship. The owner can operate the business without registering or incorporating it provided the person=s first name and surname are used in the business name (e.g., John White=s Maple Products). An individual can operate a business without using his or her own name in the business name, but in that case the company name should be registered. $ Co-operative: Business, such as a farmers= co-operative, that has been created under the Canada Cooperatives Act. This type of business must have organizational documents (federal or provincial) (e.g., Maple Syrup Packers Co-operative). Legal Name of Business as Registered Ensure that the legal name of the business entered on the form is exactly the same as in the partnership documents or articles of incorporation. Also Doing Business as (if applicable) In cases where the business legal name is not registered, the complete name of the individual applying for registration must be used in establishing the legal status of the business. The name under which the business operates should be added as additional information under AAlso Doing Business as@. When the applicant make business under other names, they must write the names as it appear in the Government Financial Institution Register under AAlso Doing Business as@. The applicant must also enter the name of every business that will be using the premises (in the case of shared facilities) and the establishment numbers for which the applicant will be responsible and which will be using their registration numbers. Street Address or Legal Description of Location of Establishment The actual location of the establishment. Do not enter a postal box number here. The mailing address, if different, must be entered on the following line. Urban Areas Indicate the street number, street name, city and province. Rural Areas Indicate the street number, street name, town and province. Where street numbers and names are unavailable, the legal address in use in the province must be entered. The Ontario format is as follows: lot, concession, township and municipality or country. In the Atlantic provinces, some locations are still identified only by a registered location certificate number. Canadian address mandatory To be eligible for registration, an establishment must have a physical location in Canada. This Canadian address will appear on the registration certificate. The establishment owner may be a resident of a foreign country, e.g., leasing an establishment in Canada. Mailing Address (if different) If, as sometimes happens, the mailing address is different from the legal address, enter the Chapter 1 - Maple Products Establishment Inspection Manual - January Revised in May 2013 for external Web publication 6

9 mailing address here. However, if the mailing address is exactly the same as the address given above, enter the words Asame as If the establishment has a postal box number, enter it here. Only a Canadian address is acceptable. Telephone/Facsimile Provide the telephone and fax numbers of the establishment or the operator. You can also enter an address, if you have one. Name and mailing address including postal code of applicant (please print) If these are exactly the same name and address as in the above fields, enter Asame as above@. If the establishment is a small business, this can be either the establishment=s address or the operator=s personal address. For large businesses, this can be either the establishment=s address or the address of the company=s head office, if it is located in Canada. Telephone/Facsimile Provide the applicant=s telephone and fax numbers, if they are different from the establishment=s or operator=s. You can also provide an address, if you have one. Partnership/individual ownership This area is to be completed only for partnerships or sole proprietorships, providing the names, titles, and addresses of all parties involved in the business. This information can be provided on a separate sheet, if more space is required. Signature The person who signs the form must be an authorized representative of the business, i.e., a director or shareholder, and must reside in Canada. In addition to signing, the person must print his or her name, the date of the application, and his or her title or official capacity within the company. Agency Use Only This area is reserved to write the signature of the CFIA inspector, the date, and any necessary comments after reviewing the application. (REVERSE SIDE OF FORM) CANADA AGRICULTURAL PRODUCTS ACT [Check the appropriate box.] Check the box for the Maple Products Regulations and the boxes for any other regulations that apply to your operation. Applicants can apply for registration for several types of processes within the same establishment. The CFIA must then issue the necessary registration certificate number. 10 1.2.2 Filling out Form CFIA 3382, Descriptive Profile of Applicant Establishment for Processed Products This descriptive profile must always accompany the registration application form and must be properly completed. It indicates the type of the establishment and the type of products packed. The applicant must complete the following parts of the form: Here is how to fill the form: Name and location of establishment The name and location of the establishment must match the name that appears on the AApplication for Registration of an form. The address of the establishment must also be provided. If the establishment can be difficult to locate, use the back of the form to draw a sketch or diagram of the location of the establishment or sugar bush. Type of establishment [Check the appropriate box(es).] Indicate the type or types of maple products establishments that apply, as described in section ATypes of registration@. An establishment that wants to conduct operations that are reserved for more than one type of maple products registration must check the appropriate boxes. A single maple products registration certificate will be issued, stating the types of establishment that it covers. You can check the boxes for other types of processesbother than maple productsbthat are carried out in this same establishment, and for which you want a registration. CFIA will then issue the necessary registration certificate number. It is important to check all appropriate regulations on the registration application form (CFIA 3043). Commodities packed [Check the appropriate box(es).] For Internal Use This area is reserved for CFIA use Meeting the establishment inspection standards The applicant must ensure that the establishment meets the inspection standards that apply to the areas of the establishment that must be inspected. For MSB, all inspection criteria can be found in a single Chapter (chapter 4, dated February 2012). For MP and MSS, in Chapters 4 and 5 dated January 2007, we identified which tasks apply depending on the type of establishment. Chapter 4 sets out the general inspection criteria, which is similar to the CFIA=s existing HACCP program. This chapter is divided into the following eight main sections: - Premises - Transportation and Storage Chapter 1 - Maple Products Establishment Inspection Manual - January Revised in May 2013 for external Web publication 8

11 - Equipment - Personnel - Cleaning and sanitation - Recalls - Written Programs - Records Chapter 5 (January 2007) sets out the inspection standards that cover the major steps of the manufacturing controls for maple products. This chapter is divided into ten main sections: - Incoming Material - In-process Package and Container - Product Preparation/Blending - Container Filling - Container Closure - Cooling - Labelling - Defective Products and Corrective Action - Written Program - Records Submitting your application to the CFIA A complete registration package must include the following: 1. Application for Registration of an Establishment (CFIA 3043); 2. Descriptive Profile of Applicant Establishment for Processed Products (CFIA 3382); 3. Written programs, according to the type of establishment (see Chapter 4, section 4.7);* 4. Articles of association or incorporation (if applicable; photocopies are acceptable); 5. Registration fees (see section 1.2.5). * For lengthy written programs, inspector will assess on site and add a note in the establishment file regarding this verification. The applicant must submit this registration package to the local CFIA inspection office and must contact this office to arrange a pre-registration establishment inspection Paying the registration fees The annual fees for registering a new establishment (and for renewing an existing registration) are as follows: Type of Establishment Sugar Bush Operator (MSB) Maple Products Packing Plant (MP) Maple Syrup Shipper (MSS) Annual Fee $40 (GST not applicable) $210 (GST not applicable) Chapter 1 - Maple Products Establishment Inspection Manual - January Revised in May 2013 for external Web publication 9

12 The full amount must be paid by cheque or money order payable to the Receiver General. Instalment payments are not accepted. For a new establishment, payment of the registration fees should be submitted with the registration application package or upon the inspector=s second visit. Registration fees for a registration covering more than one type of establishment If an establishment wants to carry out activities that are reserved for more than one type of registration, it must specify this in its registration application, by checking the appropriate boxes in the descriptive profile (see section 1.2.2). A single registration certificate will be issued that mentions both types of registrations. Only the registration fees for the type of establishment that requires the higher fees will be charged. For example, if a sugar bush establishment wants to package both its own syrup and syrup from other producers, that establishment will be issued a registration certificate as both a sugar bush operator and a maple products packing plant and will pay annual registration fees of $210. The fees for registering an establishment (and for renewing an existing registration) are required under section 6(1) of the Maple Products Regulations. These fees are defined in the Canadian Food Inspection Agency Fees Notice, Part 9, which applies to maple products and can be accessed on the CFIA Web site at the following address: / Inspector assistance fees If the establishment requests the services of an inspector to help it meet the requirements for registration under the Act and Regulations, compliance assistance fees will be charged. The rate is $21.75 per quarter-hour (rounded to the nearest quarter-hour), plus GST, with a minimum charge of $87 plus GST. For a new registration, these fees are payable when the registration application is submitted. For a renewal, these fees must be paid upon completion of the inspection, or when the inspection results are disclosed, or after the assistance has been provided, whatever the case may be. If the establishment has pre-authorized credit privileges with the CFIA, these fees may be invoiced. 1.3 Steps in Issuing an Establishment Registration Reviewing the registration package submitted by the establishment The inspector reviews the registration package submitted by the establishment as described in section and asks the establishment to submit any missing information. The inspector ensures that the fees have been paid. 13 The establishment shall be inspected for compliance with chapters 4 and 5 of the present manual. The items defined in chapters 4 and 5 shall be observed and evaluated to ensure compliance with the provisions governing the registration. If the establishment is in full operation, an in-depth inspection will be undertaken. If the establishment is not in full operation, a partial inspection can be undertaken to recommend registration. Once the establishment is in full operation, a full in-depth inspection must be scheduled as soon as operations begin. The inspector will discuss the results of the inspection with establishment management. The inspector and applicant will review the application package and complete or correct it, if necessary Recommending registration Once the registration application package is complete and the inspection file indicates that all the registration requirements have been met, the inspector fills in the AFor Internal Use@ section of Form CFIA 3382, Descriptive Profile of Applicant Establishment for Processed Products, as follows. Comments As necessary, indicate whether the Area Program Network Specialist should reserve certain registration numbers,. A request to reserve a registration number can be made in order to let the establishment start printing labels and cartons. When a number is reserved, the applicant-establishment must be informed that no interprovincial and/or international trade is allowed prior to the issuance of the final registration. Registration Recommended [Check the appropriate box.] The inspector in charge must sign and date the recommendation. The inspector sends internally the complete registration package along with proof of fee payment. When and if the registration requirements have been met, the Regional Director issues a registration number and a registration certificate Issuing the Certificate of Registration The Director designated by the President of the CFIA register the establishment and sign the Certification of Registration. The Certificate of Registration confirms the maple products establishment=s registration. The Certificate of Registration is then sent to the establishment, accompanied by a letter explaining the meaning and conditions of registration. The name and address of this new establishment will be entered in the National List of Registered Establishments. 1.4 Requirements and Obligations of the Operator of a Registered Establishment Chapter 1 - Maple Products Establishment Inspection Manual - January Revised in May 2013 for external Web publication 11

14 After an establishment becomes registered, its operator must assume the following obligations and responsibilities: Renew the registration annually An establishment=s registration is renewable and valid for a period of one year from the date of registration. The registration=s expiry date is indicated on the Certificate of Registration. Before the registration expiry date, the CFIA will send the establishment a registration renewal notice (see Form Letter 1 in the appendix). The operator shall then submit the following documents to renew the registration: 1. Form CFIA 3043, Application for Registration of an Establishment and Form CFIA 3382, Descriptive Profile of Applicant Establishment for Processed Products, duly completed; 2. Written programs, if they have been modified since the preceding year; 3. Articles of association or incorporation, if different from the previous year (photocopies are acceptable); 4. Registration fees (see section 1.2.5). The full amount must be paid by cheque or money order payable to the Receiver General. Instalment payments are not accepted. If an application is submitted and if all the requirements are meet, CFIA will annually renew the registration, otherwise, the registration will end at the expiration date Inform the CFIA of any operational changes The operator may not assign or transfer the Certificate of Registration issued to that establishment. If any operational or structural changes occur as the examples below, the operator must inform the local inspector as soon as possible: - construction changes (such as expansions, renovations, and major preparation process line changes); - major preparation process additions; - moving of the establishment or of part of the establishment; - closing of the establishment; - ownership or company name changes. The local inspector will indicate to the operator if new documents or forms must be submitted and if a new certificate will be issued. An inspection of the new facilities/establishment may be required Maintain and operate the establishment in accordance with program requirements The operator must maintain and operate the establishment in accordance with program requirements. 15 and take any necessary corrective action Post the Certificate of Registration in a conspicuous location The Certificate of Registration must be kept posted in a conspicuous location in the establishment, for the period for which it is in force Use the establishment registration number in accordance with the Regulations Every container of maple syrup that is graded under the MPR shall bear a label marked with: 1. the name and address of the sugar bush establishment, the packing establishment or the maple syrup shipper establishment, or 2. the name and address of the first dealer and the registration number of the packing establishment. The first dealer means any person who acquires for sale under their own label a maple product packed by another person. When the registered operator=s full name and address appear on the product, the registered operator=s own registration number may be marked on the product, if the operator so desires. EXCEPTION to market Maple Products for exportation purpose Maple syrup or any other maple product that is not packed in a container of a size prescribed by these Regulations and not marked as prescribed by these Regulations may be marketed in export trade if, the registration number issued to the operator of the packing plant, to the sugar bush operator or to the maple syrup shipper must either be marked on the container label or appear on the bill of lading or contract of sale. 16 1.4.6 Assist the inspector in the performance of his duties. The owner or person in charge of a place referred to in subsection (1) and every person found in that place shall give the inspector all reasonable assistance to enable the inspector to carry out the inspector=s duties and functions under this Act and shall furnish the inspector with such information with respect to the administration of this Act or the regulations as the inspector may reasonably require. 1.5 Steps in Processing an Application To Renew or Modify a Registration Renewal of Registration - Since a couple of years, the renewal process is centralized at the CFIA accounts receivable offices in Moncton. The procedure to modify a registration is described below Reviewing Revision Package submitted by the establishment The inspector reviews the revision package submitted by the establishment as described in sections and and asks the establishment to submit any missing information Inspecting the establishment, if necessary If any major changes have been made to the facilities, the inspector makes an appointment for the inspection with the establishment=s managers Recommending the registration revision Once the registration revision application package is complete, the inspector fills in the AFor Internal Use@ section of Form CFIA 3382, Descriptive Profile of Applicant Establishment for Processed Products, as follows: Comments Enter the necessary changes to the registration or ask for certain registration numbers to be reserved if an existing business has been sold or is registered more than once. Registration Recommended [Check the appropriate box.] The inspector in charge must sign and date the recommendation. The inspector will send the registration revision documents internally to the appropriate person who will revise the national list of registered establishments if necessary. The new certificate and its accompanying letter will be saved electronically in order to maintain the establishment=s operating name and address and record the new expiry date on the national list of registered establishments. 17 1.5.4 Issuing the Certificate of Registration The Regional Director, designated by the President of the CFIA register the establishment and sign the Certification of Registration. A new Certificate of Registration with the new expiry date will be sent to the establishment, along with any applicable revisions, and accompanied by a letter explaining the meaning of registration.
