2 CUMBERLAND COUNTY PLANNING COMMISSION Minutes of the Meeting February 15, 2018 The monthly meeting of the Cumberland County Planning Commission was held Thursday February 15, 2018 at 7:30 a.m. at 310 Allen Road, Carlisle, PA. Call to Order: Pledge of Allegiance/ Moment of Silent Reflection John Epley called the meeting to order at 7:30 am. 2. Minutes: January 18, 2018 Jack Showley made a motion to approve the January 18, 2018 minutes. Barb Wilson seconded the motion and the vote was unanimous. 3. Public Comment None. 4. New Business A. Ordinance Amendments (Action) 1. Southampton - Zoning Map changes Rezone 32 parcels from Village Center (VC) to Agricultural/Conservation (AC) (Revised rezoning from 11/16/17. Includes 11 new parcels) Southampton Township submitted 32 parcels proposed to be rezoned from VC to AC. The CCPC took action on a similar proposal at the November meeting. The CCPC s February review focuses on 11 new parcels that were submitted for rezoning consideration. The review of each parcel is summarized on the attached sheet. Tom Ginnick and Greg Lebo from Southampton Township provided an overview of the rezoning request. The township is updating its comprehensive plan and believes that the township is overzoned for residential. The township wants to rezone several parcels from VC to AC. Nine of the parcels are under 5 acres in size with most being under 3 acres in size. These parcels have existing residential structures but the residents are not able to conduct agricultural operations in the residential zone. Other parcels on the western side of the township are adjacent to farmland in 1

3 Franklin County. Rezoning those parcels to agriculture would provide enhanced consistency with the land uses in Franklin County. Steve Hoffman reviewed the staff comments on the proposal (see attached). If rezoned, 9 of the 10 small parcels would become nonconforming parcels as their lot size would be smaller than what is permitted in the agriculture zone. The larger 125 acre parcel would be suitable for rezoning as it is actively being farmed and is adjacent to other ASAs in Franklin County. Jim Ross asked if a new zoning district could be created that would allow for agriculture and larger lot residential. The zoning district would allow residential uses to pursue agriculture uses that are not currently permitted in the VC district. Tom indicated that the concept could be considered. Action: RJ Fisher made a motion to recommend approval of the staff comments on the rezoning and suggest that Southampton Township consider adding a new zoning district that would allow residential use and agriculture uses. Chris Knarr seconded the motion and the vote was unanimous. 2. Lower Allen Comprehensive Plan update Steve Hoffman reviewed the Lower Allen Comprehensive Plan. The plan follows the new implementable format that focuses on key issues rather than covering all topical elements listed in the Municipalities Planning Code. The plan is generally consistent with the Cumberland County Comprehensive Plan. Review comments suggested that a future land use map be included in the plan or a reference to the map in the 2006 plan if that map is still relevant. In addition, suggestions were made to clarify that intent for the Lisburn Road Study Area. The plan recommends preserving the rural character of that area and developing activity hubs similar to the Arcona development. Action: RJ Fisher made a motion to recommend approval of the Lower Allen Township Comprehensive Plan with staff comments. Ra Kligge seconded the motion and the vote was unanimous. B. Agricultural Security Area (Action) 1. Southampton Leroy and Joyce Reiff, 110 Strohm Rd., 10 acres Steve Hoffman reviewed the Reiff ASA application that proposes to add a 10 acre ASA to an existing tract that is enrolled in the Agricultural Conservation Easement Program. The application meets all of the criteria of the ASA program. Action: Chris Knarr made a motion to recommend approval of the Reiff ASA application. Barb Wilson seconded the motion and the vote was unanimous. C. Ordinance Amendments (Information) Jeff Kelly reviewed the ordinance amendments submitted for staff review and action in February. 1. Middlesex Sub Ord. Amendment Submission procedures for Conservation Subdivisions; Direct access to arterial streets These updates address comments made by the CCPC staff provided during the county s review of the township s updated subdivision and land development ordinance. Jim Ross expressed concern that the requirement for residential subdivisions and major subdivisions/land developments to have direct access to an arterial street may be overly restrictive. RJ Fisher suggested that the proposed regulation should be limited to just residential lots and not major subdivision/land developments. 2

4 Jeff agreed to advise Middlesex Township of the CCPC s concerns in addition to previously submitted staff comments. 2. Newville Zoning text change - Regulations for swimming pools; Fences The Borough is updating it swimming pool regulations to make them consistent with the international building code. The Borough was also implementing fence regulations which it currently does not have. Staff provided minor comments and recommended approval. 3. Silver Spring Zoning text change Permit sale of consumer fireworks in I-2 zone Pennsylvania Act 43 expanded the types of fireworks that can be sold in the state and used by residents. This amendment provides regulation for where such fireworks can be sold in the township. State regulation provides additional, more stringent regulation than the township ordinance. Staff recommended approval and forwarded comments to the township. D. Subdivision and Land Development Plans (Information) Jeff Kelly reviewed the highlights of the sixteen subdivision and land development plans received in February (see attached list). E. Sewage Module (Information) Jeff Kelly reported that three sewage modules were received in February. Staff had no outstanding comments and provided comments back to the respective municipalities. F. Planning Commission Retreat Kirk Stoner reviewed the results of the pre-retreat survey completed by CCPC members. The CCPC decided to conduct the retreat as part of normally scheduled meetings. Kirk will send out an electronic survey to gather retreat-related input for presentation at the next CCPC meeting. G Planning Program The Planning Program Report was provided in board packets for CCPC review 7.
