1 DECISION/DIRECTION NOTE Title: Proposed Rezoning from the Residential Special-1 (RA1) Zone to Residential Low Density (R1) Zone REZ File # Circular Road Date Prepared: September 7, 2016 Report To: Councillor & Role: Chair and Members of the Planning and Development Committee Councillor Art Puddister, Chair, Planning and Development Committee Ward: 2 Decision/Direction Required: To seek approval for the rezoning of 72 Circular Road from the Residential Special-1 (RA1) Zone to Residential Low Density (R1) Zone. Discussion Background and Current Status: The City received an application to rezone 72 Circular Road for the purpose of subdividing the lot, enabling the development of a new lot with frontage on Empire Avenue for the development of a single detached dwelling. The subject property is designated Residential Low Density and zoned Residential Special-1 (RA1) which requires a Lot Area of 740m². The applicant has applied for rezoning to Residential Low Density (R1) Zone which has a reduced Lot Area requirement of 450m 2. The property is located in Planning Area 2, and is in Heritage Area 2. The property is not designated by Council as a Heritage Building, however, the property is flanked on both sides by designated Heritage Buildings: 70 Circular Road (Sunnyside) and 74 Circular Road (Canada House). The Planning and Development Committee considered the request during their meeting of June 21, 2016 and Council during their meeting of June 28, 2016 approved Council Directive CD#R /15 outlined below: That the application to rezone 72 Circular Road from the Residential Special 1 (RA1) Zone to Residential Low Density (R1) Zone be approved subject to receipt of a revised site plan which, if acceptable to staff, will facilitate the scheduling of a public meeting. There are 2 undersized lots located at 6 Carpasian Road and 85 Empire Avenue currently zoned Residential Special-1 (RA1). The owners were contacted to see if they would be willing to be included in the proposed rezoning, however, they advised that they wish to remain in the Residential Special-1 (RA1) Zone. Though the Municipal Plan encourages increased density and compacted urban form to reduce the costs of municipal services, it also recognizes that this should be done where appropriate and where feasible and desirable from a general planning and servicing point of view. 2 Decision/Direction Note Page 2 72 Circular Road situated at the rear of 72 Circular Road with frontage on Empire Avenue, the historic streetscape of Circular Road will not be significantly affected. The applicant has submitted a proposed survey plan that meets the standards of the Low Density Residential (R1) Zone. In light of the above, it is recommended that the application to rezone 72 Circular Road from Residential Special-1 (RA1) Zone to Residential Low Density (R1) Zone be approved.
