These are the people that will inspire others, even if they are experience a bad day, to smile when they see them. This reaction is not necessarily gender specific as women can feel a similar reaction when meeting a handsome adolescent boy or men can feel a similar response when seeing a young woman, not unlike Eva who is seen here. Eva is being introduced here to her home community for perhaps the first time in more than a century. She lived here through much of her life and was photographed by a noted local photographer, Milmine. For the first time again, Eva is introduced to Belvidere. The work of a photographers a century ago was perhaps more highly creative than the selfie s that people enjoy shooting of themselves and their pals today. Here we can see Eva seated on the top of a stepladder. It is unknown if the ladder was her idea or that of the photographer but the ladder provided an interesting prop that was used to enhance the interest for the viewer. Eva holds what could perhaps be defined by some as an assertive pose. She suggests a slight smile though the angle of her head also conveys a level of certainty about who she is that cannot be denied. Some have remarked of a similar pose that Leonardo de Vinci obtained from his model who sat for his Mona Lisa. Body language was first discussed by psychologists and human behaviorists in the 1970s in response to the advancement of psychological precepts that moved into the modern world. Experts appeared in the 1970s who claimed to decipher body language to explain what a pose or a position of one s body could disclose of psychological qualities or thoughts. These experts appeared on daytime talk shows, such as the Mike Douglas Show, and reported to the host and the TV audience what folded arms across one s chest communicated as body language. Here, Eva has squared shoulders to convey her confidence. She sat with a straight spine and that too communicated confidence. Further, Eva had her hands placed on her lap that also conveyed a sense of comfort and ease. Her large bowtie disclosed more of her confidence that she was assured of herself and who she was to make such a bold statement wearing the tie as a neck ornament. Her skirt was discrete and appropriate for that era though female ankles being exposed was a new idea. Further, her stockings and shoes were likely similar to want many young women wore at the end of the 19th Century. However, the boldest statement that Eva made with her appearance on that day were the luxurious banana curls that she wore that cascaded past her shoulders. And, the ribbons that she wore under her hat were also a bold Much to Decide In Nov. Election By James Middleton In two weeks, Boone County voters go to the polls to participate in the mid-term General Election. In addition to choosing federal, state and local candidates, voters have a bevy of referenda to decide. County voters will also decide among a number of candidates and incumbents, who will serve on the Boone County Board. And, for the first time in decades, county voters will elect a new sheriff. Two federal races could capture the attention of voters. The race for the U.S. Representative from the 16th Congressional District pits incumbent Adam Kinzinger (R) against his Democratic opponent, candidate Randall Wayne Olson. If reelected, this would make Mr. Kinzinger s second full term in office. Voters will also decide who will serve in the U.S. Senate for a new six-year term. The choice for voters is between the incumbent Richard J. Durbin (D), candidate James D. Jim Oberweise (R) and candidate Sharon Hansen (L). In statewide elections voters do not have a choice to make in two races. The office of the 69th Representative District of the Illinois House of Representatives has Joe Sosnowski (R) as the returning incumbent who runs unopposed. In the 70th Representative District of Illinois, Robert W. Pritchard (R) is the incumbent and he too is running unopposed. statement of style. Eva was not dressed for Sunday school nor was she likely dressed for chemistry class. She appeared here, to one eye, to have been dressed as if she was about to meet friends for an afternoon of fun, excitement and perhaps adventure. To compliment her chosen wardrobe, Eva also placed a brightly colored and patterned kerchief or scarf in the breast pocket of her pristine white shirt. Eva conveyed a confident image on the day when she visited the photographer Milmine and why not. After all, her family hired Milmine for the sitting and Eva would not ever imagined that the photograph would be enjoyed more than a century later on the front page of the local newspaper. Eva likely imagined that the photograph would be seen by only her family members. Who would have imagined? Thought and preparation is employed when choosing a photograph to be used for this front page. If a specific holiday will occur during the week when the photograph will run then an image of that day will be used. If the image is of a certain event or place and time and if that event would reasonably occur at the time when the photograph would appear, that too can move an image to be chosen for a specific front page. However, the irresistible smile on Eva s face and the unspoken words that her slight smile the angle of her shoulders and the items that she wore on the day the image was shot; all of these considerations made the selection of Eva an ideal choice for this week. Who could resist not eyeing her and smiling when passing her as she walked down South State Street toward Likely the most important race in Illinois is for the governor s office. The incumbent Democrat, Pat Quinn is seeking reelection and his chosen Lieutenant Governor is Paul Vallas. The Republican Party has nominated Bruce Rauner for the Governor s office and he has Evelyn Sanguinetti as his Lieutenant Governor. Candidate Chad Grimm is the Libertarian candidate for Governor and his Lieutenant Governor candidate is Alexander Cummings. Local countywide candidates running for reelection are also running unopposed and one candidate for sheriff is also running unopposed though he has never served in elective office. For the office of Boone County clerk, the incumbent Mary Steurer (R) is running unopposed as is the incumbent for Boone County treasurer, Curt Newport (R). For the first time in more than 3 decades there will be a new Boone County Sheriff. David M. Ernest (R) won the primary balloting in the spring and he is running for that office unopposed. In statewide ballot measures, there are two items that require voter approval to become amendments to the Illinois State Constitution. The first amendment would make changes in the state Constitution to create a Crime Victims Bill of Rights. This amendment would expand certain rights already granted to crime victims in Illinois and to give crime victims the ability to enforce their rights in a court of law, according to the language of the proposed amendment as it will appear on the November ballot. The second proposed amendment to the Constitution would add a new section to the Suffrage and Elections Article. The amendment would prohibit any law that disproportionately affect the rights of eligible Illinois the bridge? The follow-up question would ask, Why would anyone want to even resist giving her a smile? The Journal wants to thank the Boone County Historical Society for allowing use of this photograph. citizens to register to vote or cast a ballot based on the voter s race, color, ethnicity, status as a member of a language minority, national origin, religion, sex, sexual orientation or income, according to the language of the ballot measure. In addition to the two proposed Constitutional amendments, there are also three statewide advisory referenda. The first asks voters if they approve setting the Illinois minimum wage for adults aged over 18 at $10 per hour. The second matter asks voters if they approve allowing any health insurance coverage plan that provides prescription drug coverage as a part of the health insurance plan, to include prescription birth control as a part of the coverage. The final statewide advisory referendum asks if the Illinois Constitution should be amended to require that each school district receive additional revenue based upon the number of students from an additional three percent tax on income greater than $1 million. Advisory referenda do not carry the weight of enacted law. Instead, their purpose is for the government that advances the item to have a reading of the public support or lack thereof for the matter at issue. There are also two countywide referenda that impact Boone County and Belvidere School District #100. The county asks voters if they would allow the county to construct and to equip a new animal services building and issue its bonds to the amount of $800,000 for the purpose of paying the costs for that structure. This referendum asks voters to approve a change in the law that would allow members of the Board of Education be elected and or appointed at large from all the residents of the school district. Current law provides for members of the District #100 Board of Education to be localized to their site of residence and only a proscribed number of Board members could came from a specific area of the district. Approval of this measure would allow members of the Board to be elected at large and without restriction by area of residence within the district. Finally, Boone County voters have decisions to make regarding who will serve on the Boone County Board. Boone County has three districts and in each, two candidates and/or incumbents will be elected to serve. County District #1 has one Democrat and two Republican s vying for two positions. Bill Pysson (D) is running for reelection with Sherry Giesecke (R) and Raymond Larson (R) running for a first term of service. County District #2 has two Democrats and two Republicans running for office with only one incumbent. Democrats include Ray Pendzinski (D) and Francis Egan (D) and the Republican candidates include incumbent Karl Johnson (R) and Jeffrey Carlisle (R). Mr. Johnson is the only incumbent among the District #2 candidates. District #3 also has four candidates running for office with two Democrats and two Republicans. The Democrats include Theresa Terri Glass (D) and Brandon Wells (D). The Republicans include Sherry Branson (R) and Brad Stark (R). Also in District #3, incumbent Kenneth Freeman (R) is running unopposed to serve a two-year term in office. The only remaining offices open for voting include questions asking voters if they will retain six serving judges to continue to practice in the 17th Judicial Circuit. Voting begins on Tuesday, November 4, 2014 at 7 a.m. and runs throughout the day until the polls close at 7 p.m. Anyone that is uncertain of their polling place or have any other questions about the voting process, other than who to select on the ballot, they may call the Boone County clerk and recorder s office at (815) Clarifying a Point By James Middleton An article appeared in these pages that questioned the validity of a vote that occurred in a Belvidere City Council meeting on October 6, The question arose over the vote on Resolution # that asked if the city would purchase real property at 621 South State Street in the amount of $375,000. The basis for the question resulted from the vote that appeared to be a tie among the elected members of the City Council. The mayor voiced his vote as an abstention and that was deemed a vote in favor of the motion. The city has 10 elected aldermen. Seven of the 10 were present at the meeting with five favoring passage, two opposed with three absent. This newspaper argued that the motion failed because the vote was tied with 5 favoring passage, two opposed and three absent. The mayor voted with no clear majority of the elected aldermen and, under Robert s Rules of Order (Robert s), that vote failed. Further, the mayor voted in Abstention and under Robert s, a vote in abstention is a vote for the prevailing position. Therefore, this newspaper reported, because the vote failed with no majority, the prevailing side opposed the motion and the mayor s vote in abstention favored those opposed to passage of the motion. Last week the Belvidere city attorney, Michael Drella called and said that the analysis was incorrect. This article seeks to clarify the record. Mr. Drella referred to two citations from the Illinois Compiled Statutes at 65 ILCS 5/ and at 65 ILCS 5/ and an Illinois Supreme Court decision issued on June 18, 1982, Ronald Prosser v. The Village of Fox Lake, 91 Ill.2nd 389 (1982) (Prosser). ** At 65 ILCS 5/, Illinois law presents a broad view of a City Council and identifies voting procedure by reciting: The mayor shall preside at all meetings of the City Council. Except as provided in Articles 4 and 5 of this Code, the mayor shall not vote on any ordinance, resolution or motion except the following: (i) where the vote of the aldermen has resulted in a tie; (ii) where one-half of the A New Vision for Boone County Elect Sherry BRANSON Boone County Board District 3 Paid for by Sherry Branson * (815) Times for Boone County & Surrounding Areas! Nothing in this Section shall deprive an acting mayor or mayor pro tem from voting in the capacity as alderman, but he or she shall not be entitled to another vote in the capacity as acting mayor or mayor pro tem. In the vote on October 6, the vote was a tie and section (i) above would apply granting the mayor a vote on the question because the vote was a tie among the elected city aldermen. The Code does not require the mayor to vote only that he shall vote and, arguably, that offers the mayor the option to either vote or not to vote. But he may not vote as an alderman and follow with another vote as a mayor. At 65 ILCS 5/ the Code recites in part: The passage of all ordinances for whatever purpose, and of any resolution or motion (i) to create any liability against the city or (ii) for the expenditure or appropriation of its money shall require the concurrence of a majority of all members then holding office on the City Council, including the mayor, unless otherwise expressly provided by this Code or any other Act governing the passage of any ordinance, resolution or motion. In this instance, as applied to the October 6 vote, the Resolution was an item designed as a city expenditure. Therefore, according to Illinois law, the spending of money by the corporate authority shall require the concurrence of a majority of all member then holding office on the City Council. Mr. Drella suggested that the measure to spend public money could result from majority approval of the elected members that were present and voting. In this instance, if legal, with five aldermen favoring the resolution, two in opposition and three absent, there was not a tie vote and therefore, according to this calculation, the Resolution would have been passed. Yet, in the Minutes as reported from the October 6 meeting, the mayor gave a vote in Abstention and, according to Illinois law, the mayor can vote to break a tie vote. In the case of Prosser, the question becomes complicated regarding the counting of votes. In Prosser, Justice Ward wrote for the majority to identify the issue as, The issue for our review is whether the failure of an elected trustee who serves also as the acting village president, to vote on a proposed ordinance during a meeting of the trustees at which he was present constitutes concurrence in the action taken by the majority of those voting. In Prosser, the facts showed that five of six aldermen were present at the meeting with three voting Yea, one voting Nay and one, Prosser, was absent. One alderman that was the acting village president did not vote resulting from advice received from the village attorney. The village clerk reported that measures voted on were approved and a lawsuit resulted claiming that the count was incorrect. Prosser claimed that the three Yea votes did not constitute a concurrence of a majority of the six members. The Opinion cited the Illinois Municipal Code at, The statute provides for the taking of only two types of votes, Yeas and Nays. Thus, an attempt to vote other than Yea or Nay, for example Abstain or Present, is not deemed to be a vote. Justice Ward wrote further, If a quorum is present, municipal legislators cannot avoid their Culver s of Belvidere 1635 Big Thunder Blvd. Across from Shopko 2015 Calendars Are Now Available!! The Justice added, Thus, a municipal legislator s failure to vote either Yea or Nay on a proposed ordinance must be interpreted to have the same effect as either a Yea or a Nay vote. In conclusion the Justice added, Hamm s (the trustee/ acting village president) failure to vote as a trustee operated as a concurrence with the approving votes of the three trustees who constituted a majority of the trustees who actually voted. One trustee voted against the ordinances (in question). Thus, the ordinances were passed by a margin of four to one. The real question in doubt in Prosser and in the instant situation in the October 6 meeting of the Belvidere City Council asks, is a majority vote needed among the elected aldermen or is a majority vote calculated from among the elected aldermen present in a quorum needed to enact a measure. It would appear from 65 ILCS 5/ that for a municipal body to agree to spend money, as was the case on October 6, a majority of all members then holding office on the City Council would need to concur. However, under Prosser, it appears that the method of calculating a majority would rely upon the number of duly elected aldermen that were present in a quorum and present at the meeting and that participated with their vote. Lawyers and attorneys are employed to argue the definition of words. The Prosser case has not been overturned by a later Court and that would mean that the findings there remain settled law. However, the dissenting opinion in Prosser indicated that the question of Yea and Nay arising from the elected officials present at a meeting rather than a majority arising from the total number of elected officials, regardless of how many are present at a meeting is not settled law. Recognizing the legal concept of settled law is certainly in the eyes of the beholder and reliant upon the strength of the voice of the advocate. The conclusion of the Prosser Court could be perceived as a contradiction of the edicts of the Illinois Compiled Statutes but reciting contradictory conclusions by Courts in legal opinions has a long tradition here in this system of American jurisprudence. 3 In Our 19th Year The Boone County Journal Oct. 24 th., A Graceful Exit There is a style and an elegance that can emerge when making an exit, if made when the time is correct. There is, of course, another manner of making an exit that more resembles a pratfall after that exit is long overdue. Residents of Belvidere have been waiting for a long ignored exit to occur and this exit that should occur for the betterment of the community. A current elected aldermen from the Belvidere Third Ward should make her exit because she has been absent through most of the year This is not to say that the alderman has not served her constituents with honor and distinction. But, the honor has disappeared as the weeks and the months have lapsed with her absence and soon, a year will pass by without her constituents receiving her support. The absence of an elected official is not a new occurrence in Belvidere politics. Almost 10 years ago the city had an alderman who served sporadically because he was involved working on behalf of state elected officials to provide them with public relation services. During the final year that he was absent from the City Council almost the entire year was lost to his constituents because of his chosen absence. He was exercising a chosen absence because he continued to work outside Belvidere and he chose to ignore his obligation to the city. In the case of the current absence, in the Third Ward, it is likely that family members have chosen to deny her resignation from the City Council rather than to allow her to make a graceful exit. A few years later another Belvidere aldermen was also absent over a long term due to his employment. This former alderman served in the Second Ward and he too was absent for almost one full year before he made a graceful exit. There was talk across the city that he might choose to challenge the former Mayor Frederic Brereton but that race did not occur. Oddly enough, a race did occur when Mr. Brereton and the absent Third Ward alderman ran against each other. Mr. Brereton was returned to office after winning the election over the Third Ward aldermen by a mere 13 votes. The success of her near defeat allowed her to take her position on the City Council where she worked for a couple more years, gained reelection then her absence began. Though people serve and some become ill they reach a point when they must decide if they will recover to the extent that they can return to serve or, if not, they will make a graceful exit and retain their dignity. This Third Ward alderman must certainly have reached that point where her spouse or her family must be aware if she will ever recover to return to perform for her constituents and earn her salary as an alderman. If one is drawing a salary but not earning that salary, in any context, that is a breach of ethics. The Belvidere City Code is silent on the obligation or the responsibility of elected aldermen to attend public meetings. Current city aldermen should discuss enacting legislation to provide an avenue for removal of an alderman that is incapable or chooses not to participate. It should be obvious that elected officials have an obligation to do the work that they were chosen to perform. However, the Belvidere City code says nothing regarding if the city has any expectation for the attendance of elected aldermen. This is a vacancy in the City code that should be rectified. Without such language that applies some level of attendance expectation, those that choose to remain absent and continue to draw their salary can do so with impunity. This is what the absent Third Ward alderman is doing; drawing her salary with impunity and not attending meetings or serving her constituents. The purpose of a City Council is for taxpayers to have in place where a collection of elected legislators can debate and enact the law that the city needs to perform, to pay bills, to hire employees and to enhance the quality of life for all in the community. Over the last year or more, one alderman has been absent without being involved or even engaged in doing the work that she was in good faith to perform. This is a lapse of ethics and the aldermen should address this subject either in private to persuade the Third Ward alderman s family to obtain her resignation or to enact legislation that would apply an end date for her absence. The city can still recognize her service but by her continued absence, the city is allowing her and her family to obtain a free income from the taxpayers. This is not good policy and this is a bad example of ethical behavior that should come to an end. It is not too late for the Third Ward alderman and her family to do the right thing and to make a graceful exit from the Belvidere City Council. But the longer this goes on, the more difficult it will be for that graceful exit to occur. Est Est Real Journalism For A Real Democracy Publisher David C. Editor The Boone county voters have a question on the November ballot to fund $800,000 for a new animal services building. I don t usually support raising taxes, but this is a needed facility. The tentative plan, as I understand it, is that we can pay this bond off in three years. This should not be an ongoing tax. The numbers I keep hearing are: $24 to $27 spread over three years, based on a $100,000 of property value. That is $8 to $9 each year. Typically, everyone says the current facility is a disaster. I have no doubt that once this facility is under construction, many animal friendly groups will do fund raising to help equip the facility with the best equipment, knowing the animals that have to stay in the facility will have adequate care. I support this referendum (I even had signs made up). Vote yes on November 4th. Dan Snow Dear Editor, My name is Sherry Branson. I am honored to be a Republican Candidate for the Boone County Board (district 3). I became active in local government about a year ago, when problems arose in my neighborhood. I realized that the general public has four consistent complaints about our local government: 1. The public is poorly informed of pending County board decisions. 2. The public wants to be heard before decisions are made. 3. Our elected officials should vote to support the views of the majority of the people (and not their personal agendas). 4. People need their personal and property rights protected. I believe that the people are to be served and represented by their elected officials. In our current government, I see big discrepancies between what I hear the people saying and what the government is doing. We deserve better! The way to change this is by voting for candidates who will keep us informed, listen to our concerns and vote to support the views of the majority. We especially need elected officials ncerns and make their wishes known to the board. I would also vote to support the views of the majority and fight to protect your personal and property rights. He was a father, a professional electrician, a public servant and a friend to many people who lived in Belvidere. It was an unexpected loss and a loss that many will overcome with the passage of time. Final arrangements are being made. Ray was a professional electrician and served as an executive with the International Brotherhood of Electrical Workers. He was also a valuable public servant having been a former member of the Belvidere City Council in the 4th Ward. Ray was also involved in civic activities, helping with the Belvidere/Boone County Food Pantry. Our deep condolences go to his children and to his family as we express our sorrow for their loss. 8 8 Oct. 24 th., 2014 The Boone County Journal In Our 19th Year Circuit Clerk to Retire at the End of the Year By James Middleton She said that she had been thinking of retiring from the office for quite a while. Her husband has been retired over four years and there have been health problems in the office and parents are aging too. I wanted to have more time with my family, she said and with that, Nora Ohlsen the Boone County circuit clerk announced that she will retire from the office, effective December 31, She began her work in the circuit clerk s office in March, 1986 and will soon finish 28 years in office. On July 1, 2004 Ms. Ohlsen took over as the circuit clerk when her predecessor, Julie Klivey who retired after her long tenure in office. The circuit clerk and the county clerks in Boone County have marked their tenure by serving many years. Ms. Ohlsen said that the time now seemed right for leaving. I have said that this would be my last term in office, Ms. Ohlsen said. Her years as the county circuit clerk will be noted as a time of big changes. When Ms. Ohlsen took over the office the county was anticipating a major remodeling of the Boone County Courthouse. She managed the office through those changes. She also has run the office through great changes to modernize the records system and the introduction of the thousands of court documents into the county computer system. Ms. Ohlsen had to create and to manage the document entry that has occurred with efficiency over the years. Employment in the office has grown but our caseload has been greatly increased over the years, Ms. Ohlsen added. Through her years of tenure Ms. Ohlsen has clerked in court cases and that is the work that she really enjoyed. The level of administrative work for me in the office takes up a lot of time, Mr. Ohlsen also said. She indicated, though, that she has a number people on the staff that have many years of experience working with her and within the system. Much of what the office handles is the management of cases and case paperwork that serves a vital role in a modern judicial system. Keeping track of all of that paper and making certain that all of the papers have been data entered into the system and then making certain that a reasonable system of document retrieval is in place takes up a lot of her time. Bill s initiatives over the last two years have improved your county government. These are a few of Bill s accomplishments: Suggested and succeeded in having all appointed posts and jobs openings posted on county website. Demanded the County Board Chairman posts all proposed appointments in advance. Based upon the requirement of the board s advice and consent, Bill votes on no appointment unless they are posted in advance on the website and the application letters of all applicants are made public. Unfortunately the chairman only sometimes complies with this request. Questioned why the county has not completed a physical inventory of property in over seven years. In 2014 such an inventory was finally completed and a perpetual inventory system is being devised. County ordinances required such inventories yet the county failed to comply with the requirement for years. Written evaluation of employees supervised by the County Administrator will now occur once per year. Previously formal evaluations were not required and did not occur. For the first time ever, farming of the 68 acres of cropland owned by the county, went out to bid. The high bid was approved by the county board in September Despite this year s fall in commodity prices, the bid is $30 per acre higher ($280 vs. $250) than last year s price which was privately negotiated. Bill adamantly requested open bidding in 2013 and now it finally happened. The county code posted on the website was years out of date. The only means of knowing the actual code requirements was to contact county administration. Based in part upon Bill s questioning --changes to the code will now be updated quarterly. JEFF CARLISLE Republican For County Board District #2 Paid for Citizens to Elect Jeff Carlisle Campaign Ms. Ohlsen added, I have been fortunate that some of our workers have experience in all phases of the work of the office. Some of those workers are into their second and third decade working in the county circuit clerk s office. Ms. Ohlsen said that one worker in the office has expressed her interest to apply as the new circuit clerk when she leaves office. Ms. Ohlsen said, My decision to leave has been made easier because one of the workers with long tenure, Linda Anderson, said that she would like to finish out my term. Ms. Ohlsen was elected in 2012 and with her retirement taking effect on December 31 there would be two more years of her current term. Ms. Anderson has many years of service in the circuit clerk s office and she has experience in all phases of the office. The circuit clerk s office manages all aspects of the legal and judicial system in Boone County to include civil and criminal cases as well as the management and collection of judicially ordered fines and they also manage the juvenile caseload in the county. The process will move forward with Ms. Anderson and perhaps others applying with the chairman of the Boone County Board seeking the opportunity to fill-out the balance of Ms. Ohlsen s term that is two years. The applicants will meet with the chairman and he will recommend a person to fill that vacancy. The County Board administrative and legislative committee would meet and decide which person to recommend and then the recommended person would likely appear before the full Boone County Board to receive the advice and consent of the Board to be appointed to fill the vacancy. For now and through the end of December Ms. Ohlsen will be fulfilling her duties as the Boone County circuit clerk and making arrangement for the reins of authority and responsibility to be handed to her successor. If that turns out to be Ms. Anderson then the transition of authority could be seamless. Ms. Ohlsen added, I have loved the work and found it to be very rewarding. She also indicated that over the many years she has served, she and her colleagues have always done their job and she will miss working with them. But, Ms. Ohlsen also is looking forward to a new chapter in her life and to have more time to spend with her immediate and extended family as she enters her retirement. Indigent Legal Aid At County Expense By James Middleton The matter was brought to the attention of Boone County administrator Ken Terrinoni on/or about October 1 resulting from information that was delivered to him from the trial court administrator of Winnebago County Thomas Jakeway. The deeper this question is evaluated, the greater is the concern of Boone County elected officials as there remains no idea of the financial extent to which the county will be obligated, resulting from a change in Illinois law, to provide legal aid assistant to potentially indigent litigants. This aid must come from Illinois counties, according to Illinois law. Mr. Jakeway appeared before the Boone County Board finance committee meeting on October 7 and said the matter came about resulting from a rule change advanced by the Illinois Supreme Court in Mr. Jakeway said, This is a complex situation that provides for civil fee waivers for indigent litigants that would bring a case to court. This is a provision that allows indigent people to defend themselves with the county paying legal fees. The guiding law is found at 735 ILCS 5/5-105 and identified as Leave to sue or defend as an indigent. Mr. Jakeway sought to clarify elements of this law that came to Boone County legislators and Mr. Terrinoni by surprise. Mr. Jakeway pointed out, in order for the indigent parties to qualify for this county appointed aid both litigants must be deemed to be indigent. The extent to which the county will be obligated for fees covers the court costs, mediation fees and lawyer s fees. Mr. Jakeway also said, If one of the litigant s is not indigent then they will be obligated to pay their fees. Boone County state s attorney Michelle Courier also participated in the discussion by saying, Under this law the court can also appoint attorneys and some of those attorneys could work pro-bono. An attorney that works pro-bono is not charging his client a fee for his services. The law goes into detail describing qualified fees and charges that an indigent person could claim for the county to waive. Further, the law also dedicates space to define who would be deemed to be an indigent person. The law laid out a list of aid that a person could be obtaining from state and federal governments that could qualify them to receive court aid as an indigent person. This element of the law was provided to aid those seeking a waiver would understand what form of aid or welfare they could be receiving that would qualify them for the county waiver of fees. At Illinois law specifies, On the application of any person, before or after the commencement of an action, a court, on finding that the applicant is an indigent person shall grant the applicant leave to sue or defend the action without payment of the fees, costs and charges of the action. The primary element of the application process requires that the court have sufficient information to determine if an applicant is indigent. After receipt of an application for a waiver, the court may either rule on the face of the application or a hearing may be called if additional information may be required by the court. Further, regarding the level of waived costs in a year, Mr. Jakeway said, To determine the exact or projected cost will not be easy. He estimated that the county could be responsible for funding as many as 30 divorces or 30 family custody cases or perhaps 20 other civil matters during the span of one year. He also said, Our estimated bottom number lists about $51,000 as the total possible cost to the county for one year. But, he added, this estimate could be high or it could be low. He said that, from October 1 through the end of 2014, marks about a quarter of a year and that could serve as a potential indicator of demand and the cost. You can see now, Mr. Jakeway added, how it goes. This is effective now. County representative Cathy Ward (District 2) asked in a rhetorical context, We have to pay this but how can the state expect us to meet this cost? Mr. Jakeway answered, Counties across the state are now dealing with this. County representative Ron Wait (District 1) and a former Illinois State Representative asked, Why is this coming out now? This is an unfunded mandate. Paying the lawyers here really opens a door. This could become an endless problem. Ms. Courier sought to clarify, I think the actual numbers will be lower than the projections. I think this could be a factor of more pro-bono work from the lawyers. Mr. Terrinoni summarized, Looking at the numbers, I feel a little better. We don t need to do much about this now. It s another cost that we have to bear. Chairman of the Boone County Board Bob Walberg (District 1) added, The counties have not funded indigent people and paupers, that s what the township are supposed to do. Mr. Jakeway concluded, Courts are tied to county governments and all of the counties in the state now are figuring out what to do. In later meetings of the Boone County Board finance committee when questions of creating a new budget for Fiscal Year 2015 have occurred, the question of how the county will manage this unfunded mandate. Mr. Terrinoni said last week that he was unsure how indigent legal aid would be funded under this or any other county budget. The estimates of potential need have been varied, especially in discussions that Mr. Terrinoni has had with officials in Winnebago County. The level of uncertainty is high because this process has not been tested even though the potential execution of this process has been in pace for almost a decade. County Board Returns Dog-Boarding Amendment By Ronnie Thompson A text amendment proposed by Boone County resident Jane Gordon, appeared in the October meeting of the Boone County Board after spending many months in front of the county planning, zoning and building committee. The amendment would regulate how Boone County s dog boarding and breeding kennels could house their animals and has been presented as a community effort to keep puppy mills from operating in the county. The amendment was approved at a special meeting of the Boone County Zoning Board of Appeals (ZBA) in September. The measure passed by a vote of 3 in favor and 1 opposed. It was planned that the final draft would be voted on at the County Board meeting. It was at the special

One part would govern the boarding of dogs and another part would govern the breeding of dogs. Each part had its own set of regulations. Both parts were passed as one amendment and sent to the County Board with the ZBA s approval. County representative Bill Pysson (District 1), opened the discussion by suggesting that the breeding and boarding sections of the amendment should be voted on separately. He also wanted both elements to be sent back to appropriate agencies for further discussion. County representative Denny Ellingson (District 1) also favored more discussion, saying, [we] should vote it down, and immediately set up a committee to look at it. Many on the County Board agreed that there was a lot of confusion in the language of the amendment, and that it needed more discussion and simplification. County representative Paul Larson (District 2) went on to say, Everyone agrees that we should keep puppy mills out of Boone, but what is a mill? Two members of the community stood before the County Board to make public comments, and both speakers including Jane Gordon spoke in favor of separating the issues of boarding and breeding into separate votes. The County Board then suggested to remove the boarding kennel portion of the amendment so both portions could be voted on separately. However, Denny spoke against the idea saying, We re doing something that could have bad ramifications, and we re better off keeping it together so it is done properly. Both the Boone County Board and the ZBA have made it clear numerous times that they are all set on keeping puppy mills out of the county, but the language and intent of the amendment has been cause for confusion. County representative Marion Thornberry (District 3) said, There has been a whole lot of misunderstanding at the ZBA. Before the vote to remove the boarding section, County Board Chairman Bob Walberg (District 1) spoke to the board in favor of sending back for discussion. There is a lot of empathy here for [this] but making an ordinance is pushing the issue. The vote to separate the portions passed, but ultimately the board decided to send it all back to committee to make sure the amendment is done right. However, Bill Pysson said that he had a problem with the delay. The final message from the County Board on the issue, according to Bill, was that no one should go away disheartened, the board will work to get it done.

Interested vendors or those who want to attend but need more information can call Cathedral at Two Arrested At BHS By James Middleton The incident attracted attention on Friday, October 17 but authorities are not disclosing many details. Because the incident involves three minor young men their identity and the details are being withheld. Last Friday members of the Belvidere Police Department went to the campus of Belvidere High School where they arrested three young men. The three youths were charged with aggravated battery that resulted from an incident that allegedly occurred last August. Belvidere Police Chief Jan Noble said, We moved forward with the arrests after consulting with the Boone County state s attorney Michelle Courier. The alleged incident came to light last August when administrator s at District #100 and then the state s attorney began their investigations. The Belvidere Police Department conducted their own investigation of the allegations, reported their findings to the state s attorney and she directed them to execute the arrests. Chief Noble said that the youths were removed from Belvidere High School and were taken to the Belvidere/ Boone County Public Safety Building. They were processed at that facility and later released to their parent s custody. From that point forward the arrests became a matter to be Dena I. Roethler Advertising Sales & Design managed in the Boone County Juvenile Court and there will be hearings on the matter to occur later. The incident was connected with the recent granting of an administrative leave with pay for the Belvidere High School football coach Chuck Leonard. The leave took effect on Thursday, October 16 and was announced on Friday, October 17, the day the arrests were made. However, by Monday morning, the District #100 administrators had finished their investigation and had reinstated Mr. Leonard. Because the administrative leave was released, Mr. Leonard led the practice for the football team Monday afternoon. Mr. Leonard had coached the Belvidere High School football team for two years after serving as an assistant football coach for 14 years. Two more games remain on the 2014 season schedule and with Mr. Leonard s reinstatement, he will manage and coach the team through their remaining schedule. It was later released by the District #100 superintendent, Dr. Michael Houselog in a press release that allegations were made that led to an internal investigation at the district. That investigation was followed by an external investigation led by the Belvidere Police Department. The suspension of Mr. Leonard and the arrests of the three youths followed. Dr. Houselog was quoted as saying that the district conducted a thorough investigation and that student safety was at risk. The investigation by the district has been completed, according to district sources. However, the police investigation is ongoing. Associate superintendent Joel Moeller said that policy at District #100 when an administrative leave is imposed will follow a progressive form of discipline. He also said that administrator s will look at each situation and analyze the facts with care to determine the best course of action. Mr. Moeller added, The administrators felt that this was the proper path to pursue. He also said that the intent was to first protect the students, then to protect the teacher and finally to protect the district. The question was thoroughly investigated and discussed at the central administrative office. With the investigation being completed to the satisfaction of the District #100 administrators, Mr. Leonard was reinstated Monday morning and he went back to his duties as the head football coach at Belvidere High School.
