2 BACKGROUND INFORMATION: The applicant is requesting Planning Commission approval to allow the sales of vehicles. According to the letter of intent, the applicant is also proposing a maintenance center with retail for auto accessories. The applicant has indicated that the proposed maintenance center is for minor service, to include batteries, oil changes, window wipers, lube, etc.. The applicant has filed a separate request (UN-10-17) for a special use permit to allow the proposed automobile service facility. That application is also on this agenda for Planning Commission consideration. On January 23, 2008, the Planning Commission approved a special use permit (UN-12-08) for an automobile services facility on the subject site (existing building). A business license was issued for Discount Tire, but also expired in July of Therefore, a new special use permit is required. The existing building is approximately 7,400 square feet in size and was constructed in The building is located at the corner of Centennial Parkway and Kitamaya Street, with parking located in front of the building next to Centennial Parkway. Access to the subject site is from Centennial Parkway. The building has been constructed with a combination of stucco and split face CMU block. Various roof lines with cornice elements have also been incorporated into the design building. DEPARTMENT COMMENTS: Public Works: Fire Prevention: Police Department: No comment. No comment. The North Las Vegas Police Department has no issues with this application and recommends approval. ANALYSIS: The subject site was originally constructed for use as an automobile service facility. While the original applicant is no longer in business, a new tenant (the applicant) has taken over the building and is currently operating without a business license or an approved special use permit. According to the photographs submitted by the applicant, the entire building is currently operating as an automobile service facility. As a result, 15 parking spaces are required for the automobile service facility. (Note: Parking is based upon one parking space per 500 square feet of building area.) The site plan indicates that 27 parking spaces have been
3 provided. Therefore, there are 12 extra parking spaces provided. The parking requirements for vehicle sales are one (1) parking space per 400 square feet of indoor display area, and one (1) parking space per 500 square feet of outdoor display area. The applicant is proposing to display nine (9) vehicles outside. The subject site contains 12 additional parking spaces that can be used for the display of automobiles and additional customer parking for the proposed use (vehicle sales). While staff does not necessarily have any objections to the proposed use (vehicle sales), it is important that any business selling vehicles operate in such a way that the use does not become a nuisance to the surrounding residential or impact the adjacent commercial. It has been staff s experience that other vehicle sales facilities have done very well and have increased their supply of automobiles. As a result, customer parking for their customers on the same site have been severely impacted. Therefore, staff would recommend that vehicle display be limited to no more than five (5) vehicles. This will allow additional customer parking for the proposed use and the vehicle services facilities on the subject site. Requirements for Approval of a Special Use Permit In accordance with the Zoning Ordinance, the Planning Commission may, by motion, grant a special use permit if the Planning Commission finds, from the evidence presented, that all of the following facts exist: 1. The proposed use is consistent with the Comprehensive Master Plan and all applicable provisions of this Code and applicable State and Federal regulations; 2. The proposed use is consistent with the purpose and intent of the zoning district in which it is located and any applicable use-specific standards and criteria in Chapter of this Code; 3. The proposed use is compatible with adjacent uses in terms of scale, site design, and operating characteristics (such as, but not limited to, hours of operation, traffic generation, lighting, noise, odor, dust, and other external impacts); 4. Any significant adverse impacts anticipated to result from the use will be mitigated or offset to the maximum extent practicable; and 5. Facilities and services (including sewage and waste disposal, water, gas, electricity, police and fire protection, and roads and transportation, as applicable) will be available to serve the subject property while maintaining adequate levels of service for existing development. 3
4 Staff has no objections to the proposed use. The proposed use is consistent with C-2, General Commercial District, and the Comprehensive Plan. Furthermore, if operated within compliance with the recommended conditions and all other codes and ordinances, the proposed use should be compatible with the surrounding uses, and should not have any negative impacts on the surrounding properties. RECOMMENDATION: The Community Development and Compliance Department recommends that UN be approved subject to the following conditions: Planning and Zoning: 1. That, unless expressly authorized through a variance, waiver or another approved method, this development shall comply with all applicable codes and ordinances. 2. The outside of display of vehicles shall be limited to no more than five (5) vehicles.
