6 ARTICLE TITLES AUTHORIZATION PURPOSE AND ENACTMENT CLAUSE 000 LONG TITLE A resoluton provdng for the zonng of the unncorporated area of Jackson Townshp Seneca County Oho by regulatng the sze locaton heght and use of buldngs and structures the area and dmensons of the unncorporated area of the Townshp nto zones or dstrcts of such number sze and shape as are deemed best suted to carry out sad purposes and prescrbng penaltes and proceedngs for the admnstraton and enforcement of ths Resoluton WHEREAS the Board of Trustees of Jackson Townshp Seneca County Oho (herenafter Board ) deems t n the nterest of the publc health safety morals comfort and general welfare of sad Townshp and ts resdents to establsh ths general plan of zonng for the unncorporated areas of the Townshp NOW THEREFORE BE IT RESOLVED by the Board of Trustees of Jackson Townshp Seneca County Oho: 0200 SHORT TITLE Ths Resoluton shall be known as the Zonng Resoluton of Jackson Townshp Seneca County Oho (herenafter Resoluton ) 0300 AUTHORIZATION Ths Resoluton s authorzed by Chapter 59 of the Revsed Code of the State of Oho 0400 PURPOSE The purpose of ths Resoluton s to promote publc health safety morals comfort and general welfare; to conserve and protect property and property values; to secure the most approprate use of the land and to facltate adequate but economcal provsons for publc mprovements The Board fnds t necessary and advsable to regulate the locaton heght bulk number of stores and sze of buldngs and other structures ncludng tents cabns traler coaches and the use of land for trade ndustry resdence recreaton or other purposes and for such purposes have dvded the unncorporated area of the Townshp nto dstrcts or zones as shown on the offcal Zonng Map of Jackson Townshp Seneca County Oho a copy of whch s attached and ncorporated by reference as Exhbt A 0500 ENACTMENT CLAUSE Ths Resoluton was enacted on November and was subsequently modfed on a number of occasons The Resoluton and subsequent modfcatons reman n full force and effect Page 6 of 62

7 ARTICLE 2 INTERPRETATION 2000 INTERPRETATION AND APPLICATION Interpretaton and applcaton of ths Resoluton shall be held to be the mnmum requrements adopted for the promoton of publc health safety morals comfort and general welfare of the Townshp Whenever the requrements of ths Resoluton conflct wth the requrements of any other lawfully adopted rules and regulatons ncludng but not lmted to those set forth n the Oho Revsed Code Oho Admnstratve Code and all applcable Federal and local rules regulatons ordnances or resolutons the most restrctve or that mposng the hgher standard shall govern VALIDITY AND SEVERABILITY It s hereby declared to be the legslatve ntent that f any provson of ths Resoluton or the applcaton thereof to any zonng lot buldng or other structure or tract of land s declared by a court of competent jursdcton to be nvald or neffectve n whole or n part or to be napplcable to any person or stuaton the effect of such legal decson shall be lmted to the provson or provsons whch are expressly addressed n the decson All other provsons of ths Resoluton shall contnue to be of full force and effect and the applcaton thereof to any other persons or stuatons shall not be affected ARTICLE 3 GENERAL REGULATIONS 3000 PURPOSE General Regulatons shall apply to all dstrcts Where the requrements of a General Regulaton and a dstrct regulaton dffer the more restrctve requrements shall preval 300 A Zonng Permt must be obtaned before excavaton of a foundaton or basement erecton of any structure requrng space on the ground or change of use of land or space as stated n any zonng dstrct; except as provded n Secton All zonng related fees shall be posted at the Jackson Townshp Meetng House 004 County Road 28 Jackson Townshp Seneca County Oho PERMITTED USES Land n any dstrct may be used for agrcultural purposes No zonng certfcate shall be requred for the constructon of buldngs ncdent to the use for agrcultural purposes 3020 Resdental structures shall not be classfed as agrcultural n the enforcement of ths Resoluton Any attachments or addtons to a resdental structure shall requre Zonng Permts No buldng shall be erected converted enlarged reconstructed or structurally altered nor shall any buldng or land be used desgned or arranged for any purpose other Page 7 of 62

8 than that specfcally permtted n the dstrct n whch the buldng or land s located The Board of Zonng Appeals may ssue a Condtonal Zonng Certfcate for any of the condtonally permtted uses lsted for each respectve dstrct PROHIBITED USES 3030 Inoperable/Abandoned Vehcles Watercraft etc No noperable or abandoned automoble watercraft boat traler camper 4-wheeler 3-wheeler snowmoble motorcycle recreatonal vehcle etc wth or wthout parts removed wll be permtted on any premses n any dstrct except as provded n the Industral Dstrct An noperable or abandoned vehcle watercraft boat camper recreatonal vehcle etc (collectvely Vehcle ) s any one of the followng that occurs for a perod of two weeks pror to recevng notce to remove the Vehcle: A The Vehcle s wthout a vald current regstraton and/or lcense plate; B The Vehcle s apparently noperable; C The Vehcle s wthout fully nflated tres and/or has any type of support holdng the Vehcle uprght; D The Vehcle s not properly ttled lcensed or able to be operated n a lawful manner on land a publc thoroughfare or waterway; E The Vehcle s consdered refuse or debrs n accordance wth RC at the sole dscreton of the Zonng Inspector; F The Vehcle has a mssng or shattered wndow or wndsheld; or G The Vehcle has an extensvely damaged or mssng door motor transmsson or other smlar major component Nothng heren shall prevent the parkng or storng of a vehcle n a garage or smlar permanent structure that s entrely enclosed ncludng 4 walls and a roof Garbage/Refuse Storage/Dsposal Except for normal accumulaton n context wth the use of premses dumpng storng buryng reducng dsposng of or burnng garbage refuse scrap metal rubbsh offal entrals or dead anmals s prohbted unless done n accordance wth ths Resoluton or other applcable law Storage Nobody shall use an automotve vehcle boat camper recreatonal vehcle coach bus body van truck body truck cab or traler for storage of any knd Moble Homes Any Moble Home shall be subject to all regulatons heren A fee wll be rendered at the tme a Moble Home s moved nto the Townshp Any Moble Home shall have water and sewer servce pror to beng occuped and shall be contnuously occuped wthn thrty days (30) thereof The Moble Home shall be contnuously occuped and may not be used as storage or be stored on sad property unless t s occuped A Moble Home may not be more than 0 years old from the date of applyng for a zonng permt nor less than 800 square feet Whether the Moble Home has wheels connected to the frame or not t shall be subject to all zonng laws and regulatons Manufactured Homes/Housng Any Manufactured Home shall be contnuously occuped and have water and sewer servce wthn thrty (30) days of ts placement Page 8 of 62

9 wthn Jackson Townshp Manufactured Home nstallaton s subject to the permt applcaton and fee requrements for all buldngs not otherwse exempted heren A The Zonng Inspector shall not ssue a buldng permt for a Manufactured Home unless sad home s approved n accordance wth the Oho Manufactured Home Installaton Standards B The applcant must present proof of ttle to the Manufactured Home C The Manufactured Home may not be more than ten (0) years old from the date of applyng for a buldng permt nor less than 800 square feet D The applcant must provde the Zonng Inspector wth a current Seneca County General Health Dstrct certfcate that septc and water plans are acceptable before the Zonng Inspector can ssue sad permt E Wthn (6) sx months upon ssuance of a zonng permt all Manufactured Homes shall be skrted GENERAL LOT AREA REGULATIONS No parcel of land shall be reduced or dvded so as to provde less than the mnmum lot sze requred n the dstrct n whch such land s stuated 3040 Lot Area Excepton For Exstng Certan Substandard Lots The mnmum front yard depth shall be nnety (90) feet from the center of the traveled porton of the road The mnmum rear yard depth shall be ffty (50) feet The mnmum sde yard wdth on each sde shall be twenty (20) feet General Lot Area Per Fve (5) Acres or More Any parcel of land contanng fve (5) acres or more wll be requred upon subdvson at any tme thereafter to have a three (3) to one () depth /wdth rato before a buldng permt may be ssued GENERAL YARD REQUIREMENTS Except as heren provded every requred yard shall be open and unobstructed and shall not be reduced or dmnshed n area so as to be smaller than prescrbed by ths Resoluton 3050 Yard For Sngle Buldng No requred yard or other open space around one buldng shall be consdered as a yard or open space for any other buldng No requred yard or other requred open space on an adjonng lot shall be consdered as provdng the yard or open space on the lot where a buldng s to be erected or establshed Yard Measurements A The mnmum front yard depth shall be measured from the center of the traveled porton of the road Streets havng no establshed rght-of-way shall have such rght-of-way establshed by classfyng the streets n accordance wth classfcatons n the subdvson regulaton or f such subdvson regulatons does not exst by assumng the street has a sxty (60) foot rght-of-way wth the center of the traveled porton of the street beng the center of the rght-of-way All front and sde street yards shall be measured from the rght-of-way lnes so establshed B The mnmum sde yard wdth and rear yard depth shall be measured from the center of the lot lnes to the nearest pont of any structure Page 9 of 62

10 C Lots adjacent to more than one () street shall comply wth the mnmum front yard depths from all streets Clear Vew of Intersectng Streets In all zones whch requre a front yard no obstructon or plantngs n excess of three (3) feet n heght shall be placed on any lot adjacent to more than one () street wthn a trangular area formed by the street property lnes of the projected pont of ntersecton of the street property lnes and a lne connectng ponts forty-fve (45) feet from the ntersecton of the street property lnes or the projected pont One-Story Garages or Accessory Buldngs One-story prvate garages or Accessory Buldngs n resdental dstrcts whch are one-story detached prvate garages or any other accessory buldng may not be located wthn fve (5) feet from sde and rear property lnes An accessory buldng whch measures no more than twelve (2) feet by ten (0) feet may be erected wthout obtanng a zonng permt It must conform to the property lnes stated n the precedng paragraph and may not be attached to any exstng structure Sale Lease or Use of Requred Yard Space Space needed to meet the wdth yard area coverage parkng or other requrements of ths Resoluton for a lot or buldng shall only nclude that area not sold leased contracted or otherwse legally or equtably held by a person or entty other than legal owner of the property under consderaton Abatement Control of Vegetaton Garbage Refuse and other Debrs A Board may provde for the abatement control or removal of vegetaton garbage refuse and other debrs from land n the townshp f the Townshp Board of Trustees determnes that the owner s mantenance of such vegetaton garbage refuse and other debrs consttutes a nusance B At least seven days before provdng for the abatement control or removal of any vegetaton garbage refuse or debrs the Townshp Board of Trustees shall notfy the owner of the land and any holders of lens of record upon the land that: () The owner s ordered to abate control or remove the vegetaton garbage refuse or other debrs the owner s mantenance of whch has been determned by the Townshp Board of Trustees to be a nusance (2) If such vegetaton garbage refuse or debrs s not abated controlled or removed or f provson for ts abatement control or removal s not made wthn seven days the Board shall provde for the abatement control or removal and any expenses ncurred by the Board n performng that task shall be entered upon the tax duplcate and become a len upon the land from the date of entry The board shall send the notce to the owner of the land by certfed mal f the owner s a resdent of the townshp or s a nonresdent whose address s known and by certfed mal to len holders of record; alternatvely f the owner s a resdent of the townshp or s a nonresdent whose address s known the Board may gve notce to the owner by causng any of ts agents or employees to post the notce on Page 0 of 62

11 the prncpal structure on the land and to photograph that posted notce wth a camera capable of recordng the date of the photograph on t The owner of the land or holders of lens of record upon the land may enter nto an agreement wth the board of townshp trustees provdng for ether party to the agreement to perform the abatement control or removal before the tme the board s requred to provde for the abatement control or removal under dvson (C) of ths secton If the owner s address s unknown and cannot reasonably be obtaned t s suffcent to publsh the notce once n a newspaper of general crculaton n the townshp C If wthn seven days after notce s gven the owner of the land fals to abate control or remove the vegetaton garbage refuse or debrs or no agreement for ts abatement control or removal s entered nto under dvson (B) of ths secton the Board shall provde for the abatement control or removal and may employ the necessary labor materals and equpment to perform the task All expenses ncurred shall when approved by the board be pad out of the townshp general fund from moneys not otherwse approprated D The Board of townshp trustees shall make a wrtten report to the county audtor of the Board s acton under ths secton The Board shall nclude n the report a statement of all expenses ncurred n provdng for the abatement control or removal of any vegetaton garbage refuse or debrs as provded n dvson (C) of ths secton ncludng the Board s charges for ts servces notfcaton the amount pad for the labor materals and equpment and a proper descrpton of the premses The expenses ncurred when allowed shall be entered upon the tax duplcate shall consttute a len upon the land from the date of the entry and shall be collected as other taxes and returned to the townshp and placed n the townshp general fund Fences Hedges Walls and Plantngs Fences hedges walls and plantngs n all dstrcts are to be placed so that at maturty the drp lne of sad fences hedge wall or plantng falls upon and wthn the property of the owner In all dstrcts except ndustral fences and walls may be constructed to a maxmum heght of eght (8) feet n any requred sde or rear yard and to a heght of three (3) feet n any requred yard abuttng a street Fences or walls requred to surround and enclose publc utlty nstallatons are not lmted as to heght n any dstrct Any fence erected n any dstrct shall not be constructed wthn three (3) feet of any property lne Page of 62

12 30600 HEIGHT EXCEPTIONS No structure shall be erected converted enlarged reconstructed or structurally altered to exceed the heght lmt heren after establshed for the dstrct n whch the structure s located (exceptng Resdental Dstrcts); except that: roof structures for the housng of elevators starways tanks ventlatng fans or smlar equpment requred to operate and mantan a buldng and fre or parapet walls sky lghts towers steeples stage lofts and screened chmneys smoke stacks water tanks and smlar structures may be erected so as not to exceed ffteen (5) feet beyond the heght lmts establshed for the dstrct n whch same s located; provded that () such addtonal structure shall not have a total area greater than twenty (20) percent of the remanng roof area of the buldng and (2) rado televson and wreless aerals or masts and flagpoles may be erected to any heght ncludng wthn Resdental Dstrcts BUILDING REGULATIONS No buldng shall be erected converted enlarged reconstructed or structurally altered to exceed the maxmum heght accommodate a prohbted use or house a greater number of famles occupy a greater percentage of lot area nor have narrower or smaller rear front or sde yards than are specfed heren for the dstrct n whch such buldng s located 3070 Prncpal Buldng No more than one prncpal buldng shall be permtted on any one lot unless otherwse specfcally stated n ths Resoluton Accessory Buldng An accessory buldng unless drectly attached to and made structurally a part of the man buldng shall not be closer than fve (5) feet to the man buldng Town House Multfamly and Commercal Development When more than one () townhouse multfamly commercal or ndustral buldng s located on one lot the buldngs shall be consdered one () buldng for the purpose of determnng front sde and rear yard requrements Mnmum Lvng Floor Area Per Famly In all Dstrcts sngle famly and two-famly dwellngs shall have a mnmum floor area for lvng purposes per famly of not less than eght hundred (800) square feet Frontage Requred For Buldng No prncpal buldng shall be erected on a lot whch does not have at least one property lne mmedately adjacent to at least one street Streets Drveways and Thoroughfares All future streets drveways and thoroughfares whether publc or prvate shall have a mnmum rght-of-way of sxty (60) feet All turnarounds shall have a mnmum radus of sxty (60) feet Accessory Buldngs Any structure or object attached to the ground or upon the ground havng a floor square footage n excess of one hundred twenty (20) sq ft and not otherwse attached to anythng else shall requre a buldng permt Page 2 of 62

13 30708 Projectons and Decks Open sded structures such as porches decks canopes balcones platforms carports covered patos and smlar archtectural projectons shall not project beyond setback lnes or nto the requred mnmum front sde or rear yard areas Eaves and gutters up to a maxmum of two (2) feet shall be exempt from ths rule USES NOT SPECIFICALLY CONTROLLED BY DISTRICT REGULATIONS 3080 Offcal Notces Exempt Ths Resoluton shall not apply to sgns establshed by any court or publc body exclusvely for legal or offcal notce drectonal warnng or to publcze nformaton or other related legal purpose(s) Temporary Buldngs Temporary buldngs or uses for purposes ncdental to constructon work shall be permtted provded such buldngs or uses shall not be contnued as permanent structures or uses and shall not reman on the property n excess of sx (6) months An addtonal extenson of sx months may be granted upon applcaton to the Board of Zonng Appeals A zonng permt shall be requred for temporary buldngs Temporary buldngs do not have to meet the mnmum square footage requrements as descrbed n Secton Surface of Parkng Lots Off-street parkng shall be surfaced and mantaned wth a durable and dustless surface consstng of oled crushed gravel asphalt or concrete and shall be so graded and draned as to dspose of all surface water In no case shall dranage be permtted across sdewalks Surfacng and dranage shall be subject to approval by the Zonng Inspector or other competent authorty that the Zonng Inspector may desgnate Storm Water Dranage Provsons for adequate dranage of storm water shall be a part of all plans submtted for the use of land n all Dstrcts The dranage plan wll be revewed by the Zonng Inspector or other competent authorty the Zonng Inspector may desgnate ANNEXATION All property annexed by a muncpalty shall be regulated by the zonng regulatons that govern the property pror to annexaton untl the legslatve authorty of sad muncpalty offcally adopts zonng regulatons for such terrtory and passes an Ordnance extendng the corporate lne to nclude such annexed terrtory 3000 ESTABLISHMENT OF DISTRICTS For the purpose of promotng the publc health safety morals convenence comfort prosperty and general welfare of the communty the followng dstrcts are hereby establshed: Rural Resdental Dstrct Suburban Resdental Dstrct RM Mult-Famly Resdental Dstrct Hghway Commercal Dstrct General Commercal Dstrct Industral Dstrct and Commercal Recreaton Areas A Where dstrct boundares are ndcated as approxmately followng lot lnes these lot lnes shall be construed to be sad boundares Page 3 of 62
