1 ENDERBY PARISH COUNCIL Minutes of the Meeting of Enderby Parish Council held on the 13 th March 2019, 7:30pm at the Civic Centre, King Street, Enderby Present: Cllr. N. Grundy (Chairman of the Council), Councillors: J. Bartlett, Mrs. S. Conway, R. F. Geisler, Ms. T. Green, W. Hetherington, R. W. Hunt, J. Jones, F. O Rorke and J. O Sullivan. The Clerk, Ms. S. Hansford and Deputy Clerk, Mrs. S. Stearn and District Councillor F. G. H. Jackson were also present. 151/18 Attendance & Apologies Apologies for absence were received from Councillors D. King. 152/18 Declarations of Interest by Members and Officers None. 153/18 To Receive and Approve Requests for Dispensations on matters which Members have a Disclosable Pecuniary Interest None. 154/18 Minutes of the Council Meeting held 13 th February 2019 The Minutes of the Meeting of the Council held on the 13 th February 2019, were considered for accuracy. RESOLVED: That the Minutes of the Council Meeting held on 13 th February 2019, be signed, as a true and correct record. 155/18 Chairman s Announcements a) Election Packs The Chairman offered Members assistance with their Election packs if they wished to stay behind after the meeting. b) Chairman s Annual Dinner An enquiry was made as to the date of the Chairman s Annual Dinner. The Chairman confirmed the Annual Dinner had not yet been discussed and suggested this be arranged after the Elections in the hope that it would be well received and attended. RESOLVED: That the Chairman s Annual Dinner be considered on a future Agenda. 156/18 To Receive Committee Reports: - RESOLVED: That the following reports be received: - Planning Committee 13 th February Policy & Finance Committee 27 th February Planning Committee 27 th February /18 Parishioners Time Dog Fouling Stencilling The Chairman noted the recent stencilling activity around the Village undertaken by the Parish Council s Groundstaff and conveyed the Council s thanks for their efforts. 158/18 To Receive Reports: District Councillor(s)/County Councillor/Parish Councillors/Conference or Delegate District Councillor F. G. H. Jackson a) Blaby District Council Growth Plan Blaby District Council has adopted a new Growth Plan, which commits to six key non-negotiable principles for future development. 1

2 The Growth Plan will sit with the newly approved Local Plan and the Leicester & Leicestershire Strategic Growth Plan. It sets out the Council s ambition for the delivery of future houses, infrastructure and jobs in the District. b) Communities Scrutiny Working Group Air Quality The Scrutiny Working Group will examine the Annual Air Quality status report and review the AQMA Action Plan. c) Blaby Business Boost Blaby Business Boost e-newsletter has been circulated to local businesses within the District. d) Rail Freight Hub Narborough Parish has raised its concerns regarding the proposed rail freight Hub as disruption at Narborough Station is already being experienced. A recent survey conducted identified that only 30 seconds are permitted on occasion between barrier close which allows approximately 4 cars to pass. Trains are also being cancelled leading to further transport delays. e) LRALC Annual General Meeting The LRALC Annual General Meeting will be held 15 th June 2019, 10am-3pm, venue to be confirmed. RESOLVED: That these items be noted. 159/18 To Consider Recommendations Made to Council by the Council s Standing Committees PF/65/18 To Consider Draft Lost Property Policy for Adoption by Enderby Parish Council RECOMMENDATION RESOLVED: That the proposed Lost Property Policy be adopted by Enderby Parish Council. PF/66/18 To Consider PPL/PRS Music Licencing Tariffs and Review Hire Charges for the Civic Centre and St. Johns Community Centre RECOMMENDATION RESOLVED: That all hourly rates for Regular Use increase by 50p per hour and Occasional Use by 1.00 per hour to offset PRS Licencing fees and that these become effective from the 1 st April 2019, giving hirers sufficient notice of the proposed increase: - ST JOHNS COMMUNITY CENTRE HIRE CHARGES Occasional Use Monday to Sunday Regular Use Monday to Sunday Senior Citizen Rate* 16 per hour 9.50 per hour * 7 per hour CIVIC CENTRE HIRE CHARGES Large Small Combined Council Occasional Use Monday to Sunday Hall Hall Halls Chamber First hour For each additional hour Regular Use Monday to Sunday First hour For each additional hour /18 Authorisation of Accounts Members were in receipt of a report on the Accounts paid since the date of the Council meeting held 13 th February 2019 (Payments made from 14 th February 2019 to 13 th March 2019), along with the following reports: - Bank-Cash and Investment Reconciliation as at 28 th February 2019 Detailed Income & Expenditure by Budget Heading up to 28 th February RESOLVED: That (1) the Accounts and Payments, as detailed in the schedules attached to and forming part of these minutes, be approved for payment. (2) Cllr. Ms. T. Green and Cllr. Mrs. S. Conway sign the cheques. 2

3 161/18 To Receive Updates (If Any) on the Acquisition of the following: - a) Purchase of Land from Trustees of Drummond Deceased to Extend Enderby New Cemetery The Council s Solicitor has submitted his report in respect of the acquisition of land from the Trustees of the Drummond (Deceased) Estate to extend Enderby New Cemetery. Points of particular interest are raised by the Solicitor in relation to TP1 which correctly identifies the land to be acquired (6.45 acres (2.61 hectares) of land bordered by Blaby Road and Kirk Lane. Proprietorship Register There are two restrictions registered against the property both of which will require certificates to be provided by the Drummond Trustees to ensure that these are removed at the Land Registry once the land is acquired by the Council. There are no covenants comprised in the registers of title which will affect the Council s ownership. However there are covenants imposed by the Trustees in the TP1 which will need to be addressed. Local Search i) The Planning Permission reference 15/1511/FUL is identified in the Local Search and is the latest application made by the Council. ii) The land is subject to a Smoke Control Order and it is assumed that the Parish Council has no plans for the land to be uses as a crematorium. iii) Both Kirk Lane and Blaby Road are adopted highways and the Council intends to obtain access to the site from kirk Lane. Access to the land does not therefore present a problem. Environmental Search The Environmental Search carried out indicates that from an environmental point of view the land is satisfactory for banking security, environmental liability is unlikely and statutory or third party action in relation to contamination matters is also unlikely. The searches identified a low to moderate flooding risk and low to moderate but acceptable risk of contamination. The search revealing no potential contaminative land uses of the site as a whole but potentially contaminative past and current uses together with two historical landfills of minor concern in the proximity of the land. The search undertaken has not identified a potential contaminant pathway receptor relationship that may give rise to significant liability. Contract The land is sold with vacant possession upon completion at the purchase price of 60, TP indicates that the inward T marks on the plan identify the boundaries to be maintained by the Council. There are none marked on the plan at present. The Solicitor will contact the Trust Solicitors to confirm the position in this respect indicates that there are no rights specifically granted with the property. The Solicitor intends to incorporate further general rights like those set out at 12.4 in favour of the Retained Land when the Transfer is finalised with the Trust Solicitor sets out rights reserved in relation to the Trustees Retained Land including rights of free passage of water and soil between the Retained Land and the Property to be transferred to the Council. It also includes rights for the Trustees and people acting on their behalf to enter upon the land to be sold to the Council in relation to the matters referred to at There are further rights reserved in relation to uninterrupted and unimpeded access to light which may be important if the Council intend to erect any buildings on the site and rights of support at if you are likely to undermine the adjoining land owned by the Trustees adjacent to any of the boundaries. If the Council believes this is an issue the Solicitor has requested to be advised sets out details of restrictions to be imposed on the land by the Trustees which restrict any building or causing of a nuisance on the land. 3

4 12.7 the Council enters into personal covenants to use the Property for the purpose of a cemetery and to permit the cemetery to be used for burials and remains of persons formerly residing outside of the Parish of Enderby and in relation to burial charges: To use the Property for the purposes of a cemetery only and not for any other purposes To permit the cemetery to be used for the burial of the remains of persons formerly residing outside of the Parish of Enderby To ensure that the burial charges for New Lubbesthorpe are the same as those charged for persons formerly residing in the Parish of Enderby save that a different charge may be applied to those formerly residing outside of the Parish of Enderby and New Lubbesthorpe but this charge shall not be excessive or prohibitive Not to transfer lease or otherwise dispose of the Property to any person without including in the transfer lease or other assurance covenants by that person directly with the owner for the time being of the Retained Land in the same form as the covenants in this clause The Solicitor has requested to be notified of any issues arising at this stage. As a Burial Authority, the Council, is required to agree the purchase of Exclusive Rights of Burial for a specified lease term in respect of grave spaces/cremation plots and revision of Pt is therefore proposed. RESOLVED: That the Solicitor be advised of the above and revision of clause be sought. b) Transfer of King Street and John Street Car Parks from the Ownership of Blaby District Council to that of Enderby Parish Council Blaby District Council has now confirmed the Electricity supply site references for 4 lamps at King Street and 1 lamp at John Street and as such the Transfer of both Car Parks may proceed. RESOLVED: That the Chairman and the Clerk of the Council sign the TR1 for King Street Car Park (LT ) and the TR1 for John Street Car Park (LT384318). c) Transfer of Public Open Space from the Ownership of Miller Homes (East Midlands) Ltd. to that of Enderby Parish Council (S.106 Agreement Planning Application 07/0468/1/PX) The Solicitor s report is awaited. RESOLVED: That this item be noted. 162/18 To Consider Grant Applications None. 163/18 To consider the Elections Timetable and Review the Council s Calendar of Meetings 2019 It is proposed that the Calendars for 2018/19 & 2019/20 are both altered slightly due to the Elections 2 nd May Newly Elected Members will not take Office until the 7 th May 2019 and due to the requirement for Members to be summoned giving a minimum of 3 clear working days the date of the Annual Parish Council Meeting is proposed to be adjusted to the 15 th May This means that all meetings in May will be moved forward 1 week. The Annual Parish Meeting (called by the Chairman) has however been moved back from the 8 th May 2019 to the 24 th April 2019). 5 Election Packs were collected from Narborough on Wednesday, 6 th March The Notice of Election will be published by the District Council 22 nd March and nominations will be accepted between 9:30am and 4:30pm each working day from 22 nd March through to the deadline at 4pm on 3 rd April. Members are responsible for completing and submitting their Election papers. Further notices will be published by the District Council once Nominations close. The Local Elections May 2019 Candidate & Agents Briefing took place on Wednesday, 6 th March 2019, at the District Council Offices. Elected Members who have experience of the Election process are requested to assist newer Members where possible. RESOLVED: That revision of the Calendar of Meetings be approved. 164/18 To Consider Host Responsibilities for the Great British Spring Clean Event and Establish Date of Event, Health & Safety Requirements and Community Engagement As a Host of the Great British Spring Clean there are a number of responsibilities which are required to be undertaken by the Parish Council with respects to Risk Management and Health & Safety and Public Liability. The Parish Council s Insurance Company would also need to be informed of the event in advance to fulfil public liability requirements and Risk Assessment would need to be completed. It was noted that Desford in Bloom will also host a Clean-up on the 30 th March 2019 and the date proposed for Enderby Parish Council s Clean-up is 27 th April 2019; it being noted that this is slightly outside of the event period of 22 nd March 23 rd April 2019, it was hoped that the clean-up could still be registered as a public event allowing people to find the listed clean-up and volunteer to join The Great Spring Clean It was confirmed that compliance with the guide and health & safety equipment requirements are to be followed. The Chairman suggested that his remaining allowance could be used towards the event however it was suggested that the Parish Council could approach Blaby District Council to obtain equipment on loan such as Litter-pickers and Hi-visibility vests. Contact details were offered by District Councillor F.G. H. Jackson. Hi visibility vests - required to be worn at all times during the event. Rakes or shovels A camera First Aid Kit Protective Gloves (required to be worn at all times during the event). Bin Bags & Bags for recycling - 60 litterbags have been sourced via Keep Britain Tidy for the event at no cost to the Council. Anti-bacterial wipes or hand sanitiser Bag hoops Luggage scales (for weighing litter) Litter-pickers Skip (Not required to be hired for the event as disposal of the litter would be carried out by the Council s Groundstaff using the Charity Permit). The route proposed by the Council s Litter-picker to include Blaby Road was considered but it was felt that the route should fan out from the Library to include the various In-Village Footpaths (Jitties) e.g. Salts Close, Moores Lane allowing a greater area to be covered depending on the number of volunteers on the day. RESOLVED: That (1) Enderby Parish Council s Clean-up be hosted on the 27 th April 2019 and that this be a Public event allowing volunteers to sign up. (2) That the Clerk approach Blaby District Council to seek its support of the event by way of equipment sponsorship. (3) That local groups be notified of the date of the Clean-up. 165/18 Correspondence: - a) Leicestershire & Rutland Association of Local Councils: 2019 Newsletter No.1 Members are in receipt of a copy of the 2019 Newsletter No.1. G. H. Jackson left the meeting for the following discussion. RESOLVED: That the Public Bodies (Admission to Meetings) Act, 1960 be invoked excluding the Press & Public to consider Matters of Sensitive Pre-Contractual Consideration. a) Matters of a Sensitive Pre-Contractual Consideration RESOLVED: That Enderby Parish Council enter into an Agreement with Derbyshire Leicestershire Nottinghamshire & Rutland Community Rehabilitation Company to place adults, subject to unpaid work as part of a community order, at Enderby Community Library to complete their required units.
