Moore & Bruggink s survey confirms that the metal fence is set back 0.61 feet (7.3 inches) at the east end and 1.10 feet (13.2 inches) at the west end along Burchard. The south edge of the 10-inch wide block retaining wall is 0.75 feet (9 inches) inches into the right of way of Burchard Street at the east end and 0.36 feet (4.3 inches) into the right of way at the west end, near the southwest property corner. Historically, the City Commission has denied granting licenses to property owners for installation in street right of way areas. September, Briarwood, SE; Owner was required to remove a retaining wall that had been constructed. September, Bellclaire, SE; Owner had been granted a license to install pillars flanking his driveway approach in 2004, but was denied a modification of the license for the addition of a low wall along the curb line, and was required to remove it. If the Commission were to grant a license in the present circumstances, it should be recorded with the Kent County Register of Deeds so as to inform anyone with an interest in the property. Action Requested: That the Commission resumes the public hearing that was tabled on August 21, 2017, and votes on the application of the owners of 1064 Lakeside Drive, SE, for an exception at that address from the requirements for fences and walls, according to the application presented for relief from the following ordinance: Section 8.61B, to allow a front yard fence to remain in place that is four feet in height where three feet is the maximum, a variance of one foot. Section 8.61C, to allow a fence and wall to remain in the street side yard of this corner lot along Burchard Street; the fence has an estimated setback four inches or less, and the wall is placed just inside the city right of way, where a one foot setback is required. Background: Kurt and Laurel Ratering and their daughter Alisa, the owners of 1064 Lakeside Drive, SE, filed this application on July 21, 2017 for an exception from the fence ordinance at their address in response to a June 5, 2017, notice of violation. The request is to allow a recently-constructed fence and wall to remain in the front yard and the street side yard of this corner lot. In the front yard, the fence is properly located, but is four feet high where the limit is three feet, a variance of one foot. In the south side yard along Burchard Street, the fence set back varies from zero to about 4 inches from

The fence and wall in the side yard are otherwise conforming as to height and clear visibility. Fences and walls are allowed in the street side yard of a corner lot to within one foot of the street side lot line, but the height is limited to three (3) feet unless the fence has clear visibility through it, such as a chain link-type fence. The ordinance, which is part of the Building Regulations section of the City Code, authorizes the City Commission to allow exceptions from the strict requirements of the ordinance for good cause, utilizing the same procedure as would be used for a zoning variance. The Raterings purchased this home in early 2016 as a residence for Alisa. The fence and wall were installed in the spring of The exception application includes the application, a narrative statement, a 1979 survey, and photos of the fence and wall. Also included is a photo showing a before view of the property from Burchard Street. Their attached narrative statement correctly describes the dimensions of the fence and the wall and provides the reasons that they believe relief should be granted. The location of the fence and wall in relationship to the property lines is not addressed. Using the survey provided by the applicants, city staff took measurements at the site on July 25. Except for the portion of the fence near the front property line, which is approximately four feet high where three feet is the maximum, the height of the fence is compliant, as is the clear vision design of the fence. Unfortunately the retaining wall appears to be entirely within the city right of way, between the property line and the back edge of the sidewalk. The fence that is installed atop it is likewise not far enough back. As the application notes, there is a pre-existing stacked-concrete wall at the edge of the sidewalk occupying the east 30 feet of the frontage along Burchard. The new wall was constructed as a continuation of the older wall. In short, both the fence and the wall along the Burchard Street property line are non-compliant because they are not set back at least one foot from the property line. Brian Donovan, City Manager

FAASSE ZONING ADMINISTRATOR Memorandum CITY OF EAST GRAND RAPIDS 750 LAKESIDE DRIVE SE EAST GRAND RAPIDS, MICHIGAN TO: Honorable Mayor and City Commissioners/ Zoning Board of Appeals FROM: Tom Faasse, Zoning Administrator DATE: September 11, 2017 RE: Request for Variance 230 El Centro Boulevard, SE Zoned R-1 Single Family Residential ACTION REQUESTED: September 18, 2017 Introduction of the application; comments by the applicant and the public. No action required by the commission. The public hearing and vote may not occur on this date. Due to an omission by the newspaper, notice of the hearing was not published in a timely fashion. The applicant, currently living in Illinois, is not able to attend on October 2, and had already purchased airline tickets for the September date. October 2, 2017 That the Commission conducts a public hearing and votes on the application of the owner of 230 El Centro Boulevard, SE, for a zoning variance at that address according to the plans presented, for relief from the following zoning ordinance: Section 5.28A, Table , for a primary (west) front yard setback on this threefrontage corner lot of 16.2 feet at the narrowest point instead of 30.0 feet, a variance of 13.8 feet. BACKGROUND: Stephen Kusmierczak, the owner of 230 El Centro Boulevard, SE, has applied for a zoning variance at that address. The applicant has demolished the existing house, which he plans to replace with a new ranch-style home in approximately the same location on the lot, facing north, with the long axis running east-west. The primary front yard on this corner lot with three street frontages (as described in Section 5.62C), is the west yard facing El Centro Boulevard. The east yard facing Rexford is the secondary front yard, and the south yard along Reeds Lake Boulevard is a street side yard.* Additionally, note that there are no sidewalks on El Centro, so that front yards appear to extend all the way to the curb. An attached garage would be situated on the west end of the new home, accessed via a new driveway off El Centro. (The existing driveway access off Reeds Lake Boulevard from the south would be removed.) The setback of the existing home from the El Centro Boulevard property line was 9.0 feet. The proposed west front yard setback, which is the primary front yard of this corner lot with three street frontages, would be 16.2 feet at the narrowest point the narrowest point occurs at the northwest corner of the attached garage instead of the required 30.0 feet, so they are requesting a variance of 13.8 feet. * The established front yard setback average can not be reasonably applied in this instance. The sharp curve in El Centro Boulevard and the distance to the nearest home to the north places the subject home, in effect, on a different block. Therefore the standard R-1 setback of 30 feet was applied for this analysis.

19 230 El Centro Variance page 2 In his narrative statement, the applicant addresses the reasons that he believes a variance is warranted. The reasons include the unusual, if not unique shape and the steeply loping topography of this lot from north to south. He also mentions the desire to place the new house without disturbing desirable trees and shrubs. Proposed overall lot coverage on this 28,463 square-foot lot would be well within the maximum limits of 35 percent for buildings and 40 percent for total impervious surface coverage. 29 CITY OF EAST GRAND RAPIDS 750 LAKESIDE DRIVE SE EAST GRAND RAPIDS, MICHIGAN (616) DOUG LAFAVE ASSISTANT CITY MANAGER MEMORANDUM TO: Honorable Mayor and City Commissioners FROM: Doug La Fave, Assistant City Manager DATE: September 18, 2017 RE: Durant Street-Special Assessment Project (Lakeside Drive to end) Action Requested: Consideration to adopt a resolution directing the City Manager to provide information and recommendations regarding the proposed improvement. Background: The City received a petition request in late March for street improvements to Durant Street which is one of the few unimproved streets in East Grand Rapids. Unimproved street improvements are made through the special assessment process. Typically street and utility improvements are made by a developer to local unit of government standards when an area/plat/neighborhood is developed and the cost of these improvements are included in the cost of a lot when it is sold. When the improvements are completed they are accepted by the local unit of government for funding, maintenance and replacement going forward. After a street has been improved (paved) then it is added to the State of Michigan Act 51 funding system going forward. The defined area consists of nine parcels/properties and the petitions submitted consisted of five out of nine (55%). The City held an informational meeting with the residents of Durant Street on June 5, 2017 to go over the initial estimate and answer questions. The Infrastructure Committee reviewed the request at the July 19, 2017 meeting. Project ballots were sent out and received from all residents. The final vote was six yes and three no (66.6%) to proceed with the initial step of the special assessment process. The preliminary estimate for the Durant Street improvements is $180,597 (includes 10% contingency) which was used for the process to this point. If the City Commission approves the resolution noted, staff will work with engineers to further study the area and provide an updated estimate, design and feasibility for review. Special assessments are calculated per foot by frontage with a 50% credit for corner lots that is evenly distributed amongst all parcels. Special assessments may be paid in full or over a 10-year period through equal installments. The annual installments are collected over this period and noted as a line item in summer tax assessments. The interest rate charged for the special assessment financing is the current federal prime rate plus 1%. If this potential project is ultimately approved by the City Commission, the initial cost for the project would need to be included as a budget amendment for the initial construction cost in FY Brian Donovan, City Manager

36 PROCEEDINGS OF THE CITY COMMISSION CITY OF EAST GRAND RAPIDS Regular Meeting Held September 18, 2017 Mayor Seibold called the meeting to order at 6:00 p.m. in the City Commission Chambers at the East Grand Rapids Community Center and led the audience in the Pledge of Allegiance. Present: Absent: Also Present: Commissioners Dills, Duncan, Hamrick, Miller, Schad, Zagel and Mayor Seibold None City Attorney Huff; City Manager Donovan; Assistant City Manager LaFave; Public Safety Director Herald; Finance Director Mushong; City Clerk Brower Peter Dimitriou, 2621 Inverness (GR), thanked the city for the opportunity to participate in the recent master plan sessions and talked about weather events and climate change. Bryan Walters, 1039 Pinecrest, suggested the city give plenty of opportunity for public input on the draft of the master plan when completed Commissioner Schad announced the Hearts of Gold football game would be held Friday as a benefit for the Kids Food Basket organization. Commissioner Zagel announced the grand openings of the James Salon renovations and Kilwins Fudge this week in East Grand Rapids. He also complimented the master plan sessions last week and all the great input and suggestions that came from those attending. Commissioner Hamrick felt the master plan sessions were very valuable and appreciated all of the maps and drawings used. She reported she had recently attended the Michigan Municipal League conference and would be sharing several ideas she picked up at the sessions. Commissioner Dills thanked the staff and volunteers for the well run Reeds Lake Triathlon on September 9. Mayor Seibold thanked the Public Safety Department for their work on the recent break-ins and the attempted robbery last weekend. City Manager Donovan noted the Planning Commission meetings in October, November and December would be the next steps in the Master Plan process and asked everyone to put these on their calendars City Clerk Brower gave a demonstration of the new city website that will launch on September A zoning variance hearing was held regarding the request of Stephen Kusmierczak, owner of 230 El Centro, to allow the construction of a new home with a front yard setback of 16.2 instead of the required Assistant City Manager LaFave explained the default setback for this lot would be 30 due to the curve of the road making it impossible to establish an average setback. Stephen Kusmierczak, owner of 230 El Centro, was present to explain the plans for a new home that would fit in the neighborhood and preserve the mature trees on the lot.

The following communications were received at City Hall concerning this variance request: - Chad Edwards, 128 El Centro Conditionally support if trees are not disturbed. No other public comment was received. Mayor Seibold closed the public hearing. Mayor Seibold announced that due to a publishing error, this variance request will be held over until the meeting on October 2 and a decision made following the public hearing on that date Final Reading of an ordinance amendment to Sections 1.510, and of Chapter 9 of Title I of the City Code pertaining to city elections. City Attorney Huff explained the changes to the ordinance were due to changes in state law A. Miller-Duncan. That an ordinance amendment to Sections 1.510, and of Chapter 9 of Title I of the City Code pertaining to city elections be adopted as set forth in Exhibit A attached hereto. 38 AN ORDINANCE TO AMEND SECTIONS 1.510, 1.511, and OF CHAPTER 9 OF TITLE I OF THE CODE OF THE CITY OF EAST GRAND RAPIDS THE CITY OF EAST GRAND RAPIDS ORDAINS: Exhibit A Page 1 of 1 Section 1. Section of Chapter 9 of Title I of the Code of the City of East Grand Rapids is restated to read as follows: Effect of provisions. Commencing with city elections to be held subsequent to the June, 2017 election, city elections shall be held as provided in this chapter. Section 2. Section of Chapter 9 of Title I of the Code of the City of East Grand Rapids is restated to read as follows: Primary elections. Municipal primary elections shall be held on the Tuesday following the first Monday in August of each odd-numbered year, beginning in 2017, or in accordance with State election law. Section 3. Section of Chapter 9 of Title I of the Code of the City of East Grand Rapids is restated to read as follows as follows: Nomination of candidates. Candidates for the office of mayor shall be nominated from the city-at-large by petition and elected by the qualified electors of the city. Candidates for the office of city commissioner shall be nominated by petition and elected by the qualified electors of the ward in which they reside. Nominating petitions shall be on blanks furnished by the city clerk. Each nominating petition shall comply with state law, be signed by not less than twenty-five (25) qualified electors, and be filed with the clerk by 4:00 p.m. of the fifteenth Tuesday preceding the primary election in each odd-numbered year. Each elector who signs a petition shall date his or her signature and include his or her residential street address on the petition. If an elector signs more petitions for candidates for any office than the number of positions to be filled, then the most recent signatures shall be invalid and if the most recent signatures all bear the same date, then all of those signatures shall be invalid. The circulator of a petition shall attach to each petition a certificate stating: A. The number of signatures on the petition; B. That each signature is that of the person whose name it purports to be; and C. That each signature was made in the presence of the circulator. (Ord., Section 4. 39 CITY OF EAST GRAND RAPIDS 750 LAKESIDE DRIVE SE EAST GRAND RAPIDS, MICHIGAN (616) DOUG LAFAVE ASSISTANT CITY MANAGER MEMORANDUM TO: Honorable Mayor and City Commissioners FROM: Doug La Fave, Assistant City Manager DATE: September 7, 2017 RE: Wastewater/storm sewer rehabilitation improvements-cured in Place Pipe (CIPP) Action Requested: That the City Commission approve cured in place pipe (CIPP) sewer main lining to rehabilitate sanitary and storm sewer mains with Corby Energy Services, Inc. of Belleville, MI in the amount of ~$115,000 plus 10% contingency. Background: The City has been rating sanitary/storm sewers with an asset management rating system known as the pipeline assessment certification program (PACP) through the ongoing televising project. As condition assessments are completed as well as maintenance activities conducted by staff, sections of these mains are added to the capital improvement list for CIPP or other forms or maintenance or repairs. Corby Energy Services, Inc. (formerly Utility Services Authority, LLC), has a multi-year, extended contract with the City of Grand Rapids for CIPP (January 2017). The City has previously completed CIPP with this contract extension with Corby Energy Services, Inc. Sanitary and storm sewers that are recommended for CIPP are: Sections of Princeton Blvd. (storm) Sections of Tenway Drive. (storm/sanitary) Sections of Wilshire (storm) Sections of Oxford (storm) The City of East Grand Rapids has received satisfactory work from Corby Energy Services, Inc. in the past.
