Nos. : ; ; ; ; ; and Date: October 23,2006 t s requested that the Cty Commsson consder the followng nformaton and recommendatons: BACKGROUND: On August 15, 2005, Vermland Robnette, as Trustee of the Bertha L. Sparkrnan Trust, and Henry and Los Wlls, submtted a completed Petton for annexaton of 56 m.o.1. acres of property located on the west sde of U.S. 301 behnd the proposed Hampton Hotel, between Wllngham Avenue to the north and the Perfecton Partners parcel to the south. The property s currently desgnated RES-6 (6dulga) under the County's Comprehensve Plan. The applcant proposes to develop the property resdentally wth both sngle famly and mult-famly dwellngs. The subject property abuts and s contguous to the Cty lmts on the north, south and eastern boundares. SSUES: Chapter 171, Florda Statutes, requres certan characterstcs to be present before land may be annexed by a muncpalty. The subject property meets all crtera as the north, south and eastern boundares of the subject property are drectly contguous wth the exstng Cty lmts. The property s also reasonably compact, not part of any other muncpalty, and wll not create an enclave. ALTERNA TZKES: 1. ntroduce the attached Ordnance and authorze staff to advertse same for the approprate publc hearng. 2. Do not ntroduce the attached Ordnance.

(SPARKMANWLLS PROPERTY). WHEREAS, VERMLAND ROBNETTE AS TRUSTEE OF THE BERTHA L. SPARKMAN REVOCABLE TRUST and HENRY and LOS WLLS, are the present owners of the lands herenafler descrbed n Secton 1, Parcel l(a) below, and have requested and consented to the annexaton by the Cty of Dade Cty of the lands heren descrbed n Secton 1, Parcel l(a) below; and WHEREAS, the Cty s authorzed by Chapter 171, Florda Statutes, to annex contguous and nfll areas, and to extend the Cty lmts upon recept of wrtten consent of the land owner(s), together wth the approval of the Cty Commsson after notce and publc hearng; and WHEREAS, the Cty Commsson has revewed and evaluated the applcaton submtted, and has determned that the annexaton of sad lands nto the Cty s n the publc nterest and s 1 consstent wth the Cty's Comprehensve Plan and Land Development Regulatons. SECTON 2: Sad lands are contguous to or are nfll of the present Cty lmts of the Cty of Dade Cty. That sad lands are now unncorporated and le n the same County as sad Cty, and when annexed would form a compact addton to the ncorporated terrtory of sad Cty. That the owners of sad lands contaned n sad area to be annexed have gven wrtten consent to have such annexaton for sad area. SECTON 3: The Cty of Dade Cty, Florda, s authorzed by the legslature of the State of Florda, pursuant to Secton , Florda Statutes, and pursuant to the Charter of the Cty of Dade Cty, to annex contguous and nfll areas and to extend the Cty lmts or temtoral boundares upon recept of a wrtten consent of all owners of land contaned n the area to be annexed, together wth the approval of the Cty Commsson of the Cty of Dade Cty, of sad annexaton duly expressed by Ordnance. SECTON 4: t s the ntenton of the Cty Commsson of the Cty of Dade Cty, Florda to annex the above-descrbed lands to sad Cty wthn ts temtoral lmts and the boundary lnes of sad Cty are hereby redefned and extended so as to nclude sad area of land wthn ts terrtoral lmts upon the fnal passage of ths Ordnance. SECTON 5: Ths Ordnance shall be publshed n a newspaper of general crculaton for two (2) consecutve weeks, and proof of publcaton of ths Ordnance shall be fled heren. SECTON 6: Upon the flng of the Proof of Publcaton and fnal adopton of ths Ordnance, a copy of same shall be fled wth the Clerk of the Crcut Court of Pasco County, Florda, and a copy wll be forwarded to the Department of State, Tallahassee, Florda.
