MINUTES November 14, 2018 Zoning Commission I. Meeting called to order. Meeting called to order by Chairman Matthew Pryor. II. Roll call of members: The following members were present: Wade Schexnaydre, Ken Firmin, Julio Dumas, Morrie Bishop, and Mathew Pryor The following members were absent: Aaron Chaisson Jr. and Anthony Christy III. Introduction of Staff Jamaica Banker- Secretary, Zoning Cody Martin- Legal Council Lance Brock- Zoning Official Eric Poche- Planner Jerome Fournier- Director, Planning and Development IV. Minutes A. Acceptance of the Minutes of the October 10, 2018 Meeting Commission Action: A motion was made by Wade Schexnaydre, seconded by Julio Dumas to accept the minutes and written decision of the October 10, 2018 Zoning Commission meeting. A Yea and Nay vote was called and resulted as follows: Yeas: Wade Schexnaydre, Ken Firmin, Julio Dumas, Morrie Bishop, and Mathew Pryor Nays: Absent: Aaron Chaisson Jr. and Anthony Christy 5 Yeas, 0 Nays, 2 Absent and the motion carried. A) Zoning Review ID PZ Tract GB-2 for Conerview, LLC Located on the north side of Corneview Road 300 west of Kling Road to amend the Ascension Parish Zoning Map from Medium Intensity Residential (RM) to Mixed Use Corridor (MU). The applicant pulled item from the agenda prior to meeting. B) Zoning Review ID PZ Lot TP-2 of the Thomas Pertuit Property & TP-1-A-1-A & TP-1-A-1-B being the resubdivision of Tract TP-A-1 being a portion of the Thomas Pertuit Property for Thomas F. Pertuit. Located on the north side of Cornerview Road approximately 1320 west of Kling Road to amend the Ascension Parish Zoning Map from Medium Intensity Residential (RM) to Mixed Use 2 (MU2) The applicant pulled item from the agenda prior to meeting. C) Zoning Review ID PZ Conditional Use for Telecommunication Tower for Ralph J Stassi Jr. application submitted by New Cingular Wireless, PCS, LLC d/b/a AT&T Mobility Located on the north side of Lemanville Cutoff Road approximately 1350 east of the LA Hwy to request a conditional use to construct a new Telecommunication Tower. Board Member Julio Dumas recused himself from this agenda item due to a conflict of interest. Mrs. Natalie Maples from Baker Donalson Attorney Office representing New Cingular Wireless, PCS, LLC d/b/a AT&T Mobility. Mrs. Maples presented a request for a Conditional Use permit to construct a new Telecommunication Tower and a variance for setback based on proposed tower is within a distance equal to 100% the height of the tower plus thirty (30) feet. Public hearing was opened. No one spoke during public comment. Public hearing was closed Commission Action: A motion was made by Morrie Bishop and seconded by Wade Schexnaydre to APPROVE to the request for a Conditional Use permit and the variance for setback based on proposed tower is within a distance equal to 100% the height of the tower plus thirty (30) feet. There is an existing commercial use (Office & Construction Yard, Ascension Wastewater Treatment). Based on applicant s request a new office would be constructed on the petitioned properties. The maximum floor area (square feet) of building is 8500 in a Mixed Use 2 (MU2) District. 8. Staff recommends: To accept the Mixed Use 2 (MU2) as requested. The Mixed Use 2 (MU2) designation would allow offices to be constructed on property.

Rezoning Criteria: The applicant is requesting to rezone property from Medium Intensity (RM) to Mixed Use 2 (MU2). The property is located on the southeast corner of LA Hwy 73 and Post Office Road. The Zoning Commission has reviewed several petitions to rezone to commercial along LA Hwy 73 within the last year. The Zoning Commission had a Public Hearing on Petitioned property in May Staff recommends: Mixed Use 2 (MU2) maybe an option for petitioned property.

Rezoning Criteria: The applicant is requesting to rezone property from Medium Intensity Residential (RM) to Mixed Use 2 (MU2). The property is located on the southwest corner of Alice Braud has a road width of approximately 12 feet along the front of property. The existing Mixed Use 2 (MU2) designation along the west side of LA Hwy 73 is approximately 530 feet north from the petitioned property. The applicant has expressed an interest for office space or retail business. The Zoning Commission has reviewed several petitions to rezone to commercial along LA Hwy 73 within the last year. The Zoning Commission had a Public Hearing on petitioned property in August Staff recommends: To deny the Mixed Use 2 (MU2) as requested. It is not recommended to rezone away from inter-section with Zoning District being continuous along the west side of LA Hwy 73.
