1 PURPOSE OF USE This document was developed by the Architectural Control & Landscaping Committee, with input from residents, and approved by the Board of Directors in an effort to provide residents a guide around requirements of common changes made to the exterior of homes, in addition to allowing for greater flexibility with some changes by eliminating the requirement of submitting an ACC Request. DISCLAIMERS Prior to making any change to the exterior of your home and/or yard, please review the following disclaimers: 1. CHANGES NOT LISTED If a change you would like to make is not listed, an ACC Request is likely required. Please contact the Architectural Control & Landscaping Committee should you have questions regarding any item, listed or not, in this document. As a reminder, per the Governing Documents, making a change that is not allowed or without the required approval may result in violations and/or fines to be levied against the homeowner. The ACC process was created to enhance the quality of life for all members of the Association, to maintain the aesthetics and property values of the homes in our community. 2. LIABILITY OR WARRANTY For any change not requiring an ACC Request, as indicated in this document, the homeowner shall not construe such allowance as an approval or warranty regarding engineering and structural design, building or zoning code compliance, feasibility or marketability for any purpose, or compliance with applicable building ordinances, standards, or regulations. The Crosswater Condominium Association and its representatives (including members of the Architectural Control & Landscaping Committee, Board of Directors, and Property Manager) assume no liability or responsibility for any said change made by the homeowner for any defect or impact created as a result. 3. IMPACTS TO ADJACENT LOTS For any change not requiring an ACC Request, as indicated in this document, where such change may impact an adjacent property, the homeowner shall exercise prudence regarding the following: a. NOTIFICATION TO ADJACENT RESIDENTS: The homeowner is strongly encouraged to inform the homeowner(s) of the adjacent lot(s) of such change, prior to making the change. b. DRAINAGE, SLOPES: For any change that affects drainage and/or slopes, by making such changes, the homeowner assumes full liability and responsibility, and shall hold the Crosswater Condominium Association and its representatives (including members of the Architectural Control & Landscaping Committee, Board of Directors, and Property Manager) harmless to any negative impact created as a result, and will assume full liability and responsibility for any claims made by the homeowner of any adjacent lot or any other person or entity regarding the changes made. c. VENTS: The homeowner SHALL NOT cover, block, or prevent access to the vents of a neighboring home and assumes full liability and responsibility for any negative impact created as a result of such change, and shall hold the Crosswater Condominium Association and its representatives (including members of the Architectural Control & Landscaping Committee, Board of Directors, and Property Manager) harmless to any negative impact created as a result, and will assume full liability and responsibility for any claims made by the homeowner of any adjacent lot or any other person or entity regarding the changes made. d. EASEMENTS: The homeowner SHALL NOT block, or prevent access to, the easement of a neighboring home and assumes full liability and responsibility for any negative impact created as a result of such change, and shall hold the Crosswater Condominium Association and its representatives (including members of the Architectural Control & Landscaping Committee, Board of Directors, and Property Manager) harmless to any negative impact created as a result, and will assume full liability and responsibility for any claims made by the homeowner of any adjacent lot or any other person or entity regarding the changes made. 4. CHANGE MADE OUT OF SCOPE The Board of Directors and the Architectural Control & Landscaping Committee reserve the right to require homeowner to undo, alter, correct, or to submit an ACC Request for, any change made that is indicated as not requiring submittal of an ACC Request, as indicated in this document, if such change appears to fall out of scope with the intent of this document. The homeowner is liable for any violations or fines levied as a result of the homeowner failing to undo, alter, correct, or submit an ACC Request for such change, upon notification to the homeowner that such change falls out of scope with the intent of this document. 5. CORRECTIONS AND AMENDMENTS The Crosswater Condominium Association and its representatives (including members of the Architectural Control & Landscaping Committee, Board of Directors, and Property Manager) reserve the right to make corrections and amendments to this document, whether typographical or related to content. All efforts will be made to notify homeowners of any change made to this document determined to be of relative importance. 6. EFFECTIVE DATE Any change that has been made prior to the effective date, indicated as not requiring submittal of an ACC Request, as indicated in this document, and meeting the conditions noted, shall become approved upon the effective date of this document. Rollaway and retractable screen doors are allowed under these conditions. Storage shed Small shed used for the storage of such items as yard and lawn tools and supplies Back Yard: Yes, if the structure either: (A) will be clearly visible from the street (if hidden from view or visible only from an alley but not the street, then okay without approval) OR (B) will be built onto the home, regardless of whether condition (A) applies, as it then is becoming a permanent structure/part of the home Front Yard Not Allowed Trellis / arbor Trellis or similar entity in any section or area of yard Back Yard Yes, if trellis or similar entity will be taller than fence line. See DISCLAIMER if structure is at or below height of fence line Potential visibility and spacing impacts Alley Not Allowed Window screens Window screens on any or all windows of the house No, if installed by Discount Screens ( or other vendor that has similar types of screens Page 7 of 7
8 ARCHITECTURAL CONTROL & LANDSCAPING COMMITTEE CHANGE REQUEST DIRECTIONS DIRECTIONS and DISCLAIMERS The following outlines how to properly complete the application process: Review the Home & Yard Architectural Change Matrix ( ACC Matrix ) for the change you are proposing. It may not be necessary to submit an ACC Request, if the change fits the criteria outlined in the ACC Matrix as being not required. A copy of the ACC Matrix can be obtained from visiting the community website ( or by requesting a copy from the Property Manager. Fill out both the application and the Adjacent Property Owner Acknowledgement Form completely. Failure to submit a complete application may result in your application being denied or delayed. It is not necessary to submit the Directions and Disclaimers pages. For the Description of Work and supporting information and material, provide as much detail and specifics as possible, such as: drawings, photos, and schematics dimensions, measurements, and location material types, colors, and intended use plant, tree, and shrub types (common name or species) For the Adjacent Property Owner Acknowledgement Form, obtain the signatures of applicable owners potentially affected by the proposed change A good rule of thumb is to obtain signatures from those who can see the change For example, if the change is planned for your front yard, then the signature of the neighbor behind you is likely not necessary It is acceptable to obtain signatures from all owners, if you are unsure which ones would be necessary If there is no home on one side, put N/A ; if the home is vacant, put Vacant You may be asked to acquire the acknowledgement of an adjacent owner if one is not included, if deemed necessary There are four ways to submit your ACC Request: Under the My Home & Yard menu on the community website ing our Property Manager, Ria Blake, at rblake@pinnaclefamily.com Faxing to , Attention: Ria Blake Mailing the application to: Crosswater HOA, c/o Pinnacle Property Management 2801 Alaskan Way, Pier 70 #200 Seattle, WA, If you have any questions regarding the application process, contact the Architectural Control & Landscaping Committee (contact information can be found on the community website), or our Property Manager. 9 ARCHITECTURAL CONTROL & LANDSCAPING COMMITTEE CHANGE REQUEST DISCLAIMERS DIRECTIONS and DISCLAIMERS Prior to submitting the application for a change to the exterior of your home and/or yard, please review the following disclaimers: 1. INCOMPLETE APPLICATION A submitted application that is received and deemed as incomplete, including failure to submit the ADJACENT PROPERTY OWNER ACKNOWLEDGEMENT FORM, may cause the application to be delayed or denied outright. 2. SITE VISIT The Architectural Control & Landscaping Committee ( the Committee ) may request a site visit to your property to better understand the scope of the requested change. 3. PROPOSED CHANGE OUT OF SCOPE The Committee and the Board of Directors reserve the right to deny the application as submitted if it is deemed that the proposed change would be out of scope with the intent of the architectural and landscaping standards of the community, or to conditionally approve the application as long as conditions are met to bring the change in line with such standards. 4. FOLLOW UP AFTER APPROVAL The Committee reserves the right conduct a site visit to your property after approval of your application to confirm that the change has been made as approved. 5. SUBJECT TO VIOLATIONS AND/OR FINES You, the homeowner, are subject to and liable for any violations and/or fines levied as a result of making any change out of scope or not as approved, or for making a proposed change after an application has been denied. 6. LIABILITY OR WARRANTY The approval of plans and specifications by the Committee applies only to the style, exterior finishes, appearance, and general location of the structures shown in such plans and specifications and shall not be relied upon as an approval or warranty regarding engineering and structural design, building or zoning code compliance, feasibility or marketability for any purpose, or compliance with applicable building ordinances, standards, or regulations. By approving the plans and specifications, the Crosswater Condominium Association and its representatives (including members of the Committee, Board of Directors, and Property Manager) assume no liability or responsibility thereof, or for any defect in any structure constructed there from, and said persons further specifically exclude from such approval any implied warranty of merchantability and fitness for any purpose. 7. APPROVAL TIMELINE Please allow up to thirty (30) days for review of your application. Be advised that delays may occur as a result of an application submitted with incomplete, vague, or unclear information, or for unresponsiveness to requests made for a site visit to your property.
