1 Minutes of a Regular Meeting of the Verona Township Council on Monday, July 9, 2018 beginning at 7:00 p.m. in the Municipal Building, 600 Bloomfield Avenue, Verona, New Jersey. Call to Order: Municipal Clerk reads notice of Open Public Meetings law. The notice requirements of the Open Public Meetings Act have been satisfied with respect to this meeting; specifically, the time, date and location were included in the annual notice of meetings adopted by the governing body, posted in the Municipal Building, and sent to the official newspapers of the Township, the Verona Cedar Grove Times and the Star Ledger. Additionally, the agenda for this meeting was posted in the Municipal Building and sent to the two newspapers before 4:30 p.m. on the Friday preceding this meeting. Roll Call: Mayor Kevin Ryan; Deputy Mayor Michael Nochimson; Councilman Alex Roman, Councilman Ted Giblin and Councilman Jack McEvoy are present. Township Manager Matthew Cavallo, Township Attorney Brian Aloia, and Municipal Clerk Jennifer Kiernan are also present. Mayor Ryan leads the Pledge of Allegiance. Mayor s Report: Mayor Ryan reports the annual water quality report for 2017 has been released and the Township is in a good position. He reports that the Board of Adjustment will meet this Thursday. One item on the agenda is the application of Kensington and Associates desire to put a senior living facility on the site of the Richfield Regency. They are requesting seven (7) variances. The Mayor urges the public to address any concerns to the Board at that meeting. He attended the grand opening of the Essex County dog park in North Caldwell. This is the fourth dog park in the County. Mayor Ryan reports that VTV is now working and all meetings are up and running. He states the Council is committed to ensuring VTV stays up and running. He also reports that tonight there is a new format for public participation. Modifications are that each member from the public will approach the lectern and have four (4) minutes to address the Council and/or Manager. After that time, the resident will be seated and the Council and/or Township Manager will address their question/comment. The Mayor reports that Garden State Radio will play the next concert in the Civic Center on Wednesday. The last concert is August 8 th at the Verona Community Pool, which is open to Verona residents only. Manager s Report: Township Manager Matthew Cavallo announces the upcoming concert schedule includes the B Street Band A Tribute to the Boss on July 18 and the Rachel Allyn Band on July 25, AM Gold on August 1. Movies Under the Stars will be held on Tuesday, August 14 at 8 p.m. This year s showing will be Moana in the Civic Center. Everyone should bring his or her own blankets, chairs and drinks. There is a Hawaiian Luau Theme: Wear a Grass Skirt or a Hawaiian Shirt. He also encourages everyone to help support the Church of the Holy Spirit-Verona Food Pantry by bringing a nonperishable food item that evening. The 2nd Annual Sports, Instrument and Baby Gear Swap will be held on Sunday, July 29th from 10 a.m. to 4 p.m. at the Community Center Ballroom. Drop off will be on Saturday, July 28th from 3 p.m. to 5 p.m. Volunteers are needed. All proceeds benefit the Verona Children s Fund. Tuesday nights are Family Night at the Verona Pool. During Family Night s the pool is open until 9:00 p.m. Bid Specs are complete for the Post Aeration System Rehabilitation at the Wastewater Treatment 1

2 Plant. Bid Specs for the Fairway Tank Rehabilitation are substantially complete and we expect this to be out this month as well. Bid Specs are in the process of being drafted for the Municipal Solid Waste Collection bids. I expect them to be on the road mid-july with a scheduled bid opening mid- September. The core switch that controls network traffic between the Township and the Board of Education was scheduled for replacement on Wednesday, July 11 but has now been postponed until further notice. This was funded earlier this year. Mr. Cavallo reports that his office is currently beginning the onboarding process to launch the BidNet platform in Verona. This will allow all bids to be downloaded from the internet. It is expected that this will increase our visibility on upcoming bids. This service is provided at nocharge to the municipality. He states that on this evening s agenda is the necessary resolutions to execute the agreements with ParkMobile. Anyone who uses the ParkMobile application to pay for parking in Verona will be charged a $0.45 cent per transaction surcharge. I expect the onboarding process to begin next week and hope to be active by August. Municipal Lot #1, behind Terry s Pharmacy now has six (6) parking spots designated for 20-minute business district pick-up. Residents can utilize those spots to pick up a prescription from Terry s or take-out from many of the fine restaurants Verona has to offer. The Fairview Avenue well is still out of service. Mott MacDonald has been engaged to draw up bid specifications for the project. The warrant study for Pease and Montrose was returned by the Engineer earlier this week. The accident history, speed and volume of vehicles traveling on Montrose did not reach the levels for a warrant. Only due to the sight distance requirements is the warrant proven for the intersection. The Township Engineer, Glenn Beckmeyer, has sent an endorsement of the STOP sign as required. The ordinance is on tonight s agenda for introduction. Mr. Cavallo also reports that last Monday evening, he attended the CDBG Public Hearing. At that meeting, he was presented with recommendations that the Township will receive approximately $106,000 for the rehabilitation of Linn Drive Section II. Councilmember s Reports: Deputy Mayor Nochimson requests Councilman Roman s opinion as to whether the Township should update VTV or look into live streaming meetings. Councilman Roman responds that he understands many residents may not be internet savvy and therefore, for the time being, recommends improve the current system. The Deputy Mayor states that the fireworks were spectacular and although the power went out, it allowed for hearing the sound of the fireworks. He requests the Township Manager direct Public Works to keep up with the weeding on Bloomfield Avenue. He asks the Township Manager if the roadway-sealing program can be expanded to preserve the quality of the roadway. Councilman Roman has no report and will have a sidebar conversation with the Township Manager in regards to VTV. Councilman McEvoy states he attended the 30-year anniversary of The Mane Place II. He attended a meeting in Newark for Complete Streets along with Steven Neale and Sergeant LeCrux where the discussion of lining streets and crosswalks improves safety. He also attended the NJiiF meeting Thursday at the Community Center, hosted by the Township of Verona. The topic of aquatic safety was discussed, which is a timely and informative topic. Councilman Giblin states the new tradition of the painting of the American flag on the lawn of the Civic Center is wonderful and he hopes it continues. ORDINANCE #

3 AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY LOCATED AT 25 COMMERCE COURT AND IDENTIFIED ON THE TAX MAPS AS BLOCK 1201, LOT 3.01 FOR PUBLIC USE Township Attorney Brian Aloia states that this ordinance, along with ordinance allow the acquisition of properties located at 25 Commerce Court and 111 Mount Prospect Avenue in the Township. As listed on the agenda, both ordinances are being held in abeyance while ongoing discussion ensues regarding COAH matters to be resolved before consideration of these ordinances. Township Manager Matthew Cavallo reports this ordinance authorizes the installation of two (2) stop signs on Pease Avenue and Montrose Avenue. 4 DESIGNATING THE REGULAR, CONFERENCE AND LEGAL MEETING DATES OF THE TOWNSHIP COUNCIL FOR WHEREAS, the Open Public Meetings Act, Chapter 231 of the Laws of 1975, requires all public bodies covered by said Act, at least once each year, and within seven (7) days following the annual reorganization meeting of such body, to post and maintain posted throughout the year a schedule of the regular meetings of the public body to be held during the succeeding year. NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Verona, County of Essex in the State of New Jersey, as follows: 1. The schedule of regular meetings of the Township Council of the Township of Verona will be held in Council Chambers of the Municipal Building located at 600 Bloomfield Avenue, Verona, New Jersey, as set forth in the schedule annexed hereto be and the same is hereby adopted; and 2. The Municipal Clerk is hereby authorized and directed to prominently post the schedule on the public bulletin located in the lobby of the Municipal Building, Verona, New Jersey; and 3. Special meetings may be held as and when necessary, with notice to be given as provided for in the Act on any meeting involving urgent matters; and 4. 5 prices and most responsible services to NCPA members and it offers cooperative purchasing membership to municipalities; and WHEREAS, the Township of Verona desires to become a member of the NCPA in order that it may take advantage of cooperative pricing opportunities which will benefit the Township. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Verona, in the County of Essex, New Jersey that the Township s membership in the NCPA Cooperative is hereby approved; and BE IT FURTHER RESOLVED that the Township Manager and the Township Clerk are hereby authorized to enter into any and all agreements required for such membership. RESOLUTION No AUTHORIZING A CONTRACT WITH PARKMOBILE FOR SERVICE OF A PAY-BY-PHONE PARKING SYSTEM IN ACCORDANCE WITH THEIR NCPA COOPERATIVE CONTRACT IN THE TOTAL AMOUNT NOT TO EXCEED ZERO DOLLARS OF CITY FUNDS WHEREAS, N.J.S.A. 40A:11-5 permits municipalities to award public contracts without public bidding when the vendor is part of an approved national cooperative, and ParkMobile has been approved as an NCPA National Cooperative Purchasing Alliance contractor, which cooperative the Township is a part of; and, WHEREAS, the Township seeks to commence pay by phone service for Township on-street and lot parking; and WHEREAS, pursuant to the recommendation of the Director of Administration and Economic Development, the Township wishes to contract for the services and related goods under ParkMobile s NCPA contract, under the contract attached hereto; and WHEREAS, certification of funds is not required as part of this contract, as ZERO Township funds shall be expended. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Verona, in the County of Essex, New Jersey that a contract between the Township and ParkMobile LLC is authorized for the purposes of providing the services a pay-by-phone parking system in accordance with ParkMobile s NCPA contract, for a total not to exceed amount of ZERO Dollars ($0.00) of Township funds for a term to run concurrently with NCPA Contract Number 05-19; and BE IT FURTHER RESOLVED that the Township Manager and the Township Clerk are hereby authorized to execute the attached agreement with ParkMobile, LLC and take all other actions necessary to complete and realize the intent and purpose of this Resolution. 6 PURSUANT TO N.J.S.A. 40A:4-87 (CHAPTER 159, P.L. 1948) OF A SPECIAL ITEM OF REVENUE IN THE FORM OF A 2018 NJDOT GRANT AWARD WHEREAS, N.J.S.A. 40A:4-87 provides that The Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and, WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount; and, WHEREAS, The Township of Verona has a grant award in the amount $ 235,000 from the New Jersey Department of Transportation to be used for the rehabilitation and paving of Park Avenue Section 2 and wishes to amend its 2018 Municipal Budget to include this amount as a revenue. NOW, THEREFORE, BE IT RESOLVED, that The Mayor and Council of the Township of Verona, The County of Essex, New Jersey hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2018 in the sum of $235,000. Which is now available as revenue from: Miscellaneous Revenues - Section F: Special Items of General Revenue Anticipated with Prior Written Consent of Director of Local Government Services - Public and Private Revenues Offset with Appropriations: NJDOT 2018 Park Avenue Section 2 BE IT FURTHER RESOLVED, that the like sum of $235,000 is hereby appropriated under the caption of: General Appropriations: (A)Operations - Excluded from CAPS Public and Private Revenues Offset with Appropriations: NJDOT 2018 Park Avenue Section 2. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Verona, County of Essex, State of New Jersey, as follows: 1. The public shall be excluded from discussion of an action upon the hereinafter specified subject matter. 2. The general nature of the subject matter to be discussed is as follows: a. Pending Litigation pursuant to N.J.S.A. 10:4-12(7) b. Contract Negotiations pursuant to N.J.S.A. 10:4-12(8) c. Personnel Matters pursuant to N.J.S.A. 10:4-12(8) 3. It is anticipated at this time that the above stated subject matter will be made public when said subject has been fully discussed by the Council, and the attorney rules this matter may be brought before the public without jeopardizing any pending litigation. 4. This resolution shall take effect immediately. RESOLUTION No APPROVING PROPOSED CHANGE ORDER No. 24 PHAROS ENTERPRISES, LLC, CONTRACT NO WHEREAS, Pharos Enterprises, LLC and the Township of Verona have heretofore entered into an Agreement, more particularly known as Contract No , dated May 15, 2017, for the Verona Public Library Phase II Renovation and ADA Improvements, in accordance with the requirements of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. in the contract amount of $2,526,500.00; and WHEREAS, the Township Council, previously approved Proposed Contract Change Nos. 1-15, and 23 from the Project Architect, in an amount of plus $165,823.08, for a revised contract amount of $2,692,323.11; and WHEREAS, the Township Council has received Proposed Contract Change No. 24 from the Project Architect, in an amount of (minus) $17, and (plus) $61, for a net total of (plus) $44,226.57, for the replacement of the building fire alarm; and 8

9 WHEREAS, Proposed Contract Change No. 24 does not expand the scope of the within contract; and WHEREAS, the within Proposed Contract Change No. 24 is in the best interests of the Township. NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Verona, in the County of Essex, New Jersey that Proposed Change Order No. 24 for Contract No in the amount of plus $44,226.57, for a revised contract amount of $ $2,736,549.65, is hereby approved; and BE IT FURTHER RESOLVED that the Township Manager, Township Engineer and the Municipal Clerk are hereby authorized to execute the within Contract Change Order. RESOLUTION No AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH INTERNATIONAL DATA BASE CORP. D/B/A BIDNET WHEREAS, the Township of Verona is in need of web-based solicitation and bidding services, including maintenance and support services and wishes to enter into an agreement with the International Data Base Corp. d/b/a BidNet to provide said services; and WHEREAS, there will be no subscriber fees incurred by the Township under the Agreement with BidNet; and NOW THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Verona, County of Essex, State of New Jersey that the Township Manager and Municipal Clerk are authorized to execute an agreement with International Data Base Corp. d/b/a BidNet, a copy of which is attached hereto. New/Unfinished Business: Township Attorney Brian Aloia states that in regards to the BOA case # is adjourned as both parties attempt to try to work out the differences.
