ANNEXATION DISCUSSION WITH CAPITOL CITY GOLF CLUB ESTATES & CHAMBER ESTATES STAFF: ACTION: RICK WALK, COMMUNITY& ECONOMIC DEVELOPMENT DIRECTOR INFORMATIONAL MEETING TO RECEIVE PUBLIC COMMENT The City of Lacey held a community forum on January 31, 2017, to receive input from residents in Capitol City Golf Club Estates and Chamber Estates regarding annexation. Over 120 people attended and expressed concerns. The purpose of this second community forum is to gather additional feedback from residents and respond to initial questions. In response to questions about tax increases, property taxes will generally decrease if annexed to the city of Lacey. However, some new utility taxes will be added. Annexation into the city limits will not result in the City mandating that property owners connect to the city sewer system. Residents will be required to connect to sewer if a septic system has failed and a sewer main is within 200 feet. This would occur if the home is located in Thurston County or the City, regardless of annexation. If a septic system fails and a house is not within 200 feet of a City sewer main, then a resident may be allowed to repair their septic system based on Thurston County Health approval. The City does not assume responsibility to maintain or take over the control of private streets upon annexation. However, the city will assume responsibility to maintain and operate all public roads upon annexation. Lacey City Council Worksession June 1, 2017 Page 1

4 The City of Lacey and Thurston County adopted joint plans for the Lacey Urban Growth Area. The zoning classification of property within the annexation area will remain the same whether annexation occurs or not. All legally established existing uses within the annexation area will be allowed to continue. Any nonconforming use(s) are allowed to continue provided the nonconforming use(s) do not cease for a period of 18 months or a new land use application approval is requested by the property owner. The City of Lacey Police Department will provide police service upon annexation. Fire and medical services will remain the same upon annexation. Garbage service within the City of Lacey is provided by Pacific Disposal, the same services provider of unincorporated Thurston County. Legal home occupations that comply with County requirements will be permitted in the City after annexation. The City s initial business license fee is $25 and the annual renewal is $10. Annexation will not affect school district boundaries. Mayor Ryder opened the floor to public comments. 6 Allen Mowain, th Avenue SE Inquired about impacts to the golf course - City has notified golf course owners of proposed annexation, but have not received a response yet. Joel Graham, th Avenue SE Inquired about the impact of a property tax levy - there will be a minimal change of the property tax rate. If Council decides to move forward with the proposed annexation, a resolution would be approved to schedule a public hearing to receive formal comments. Council would either take action to adopt or not to adopt an annexation ordinance. The annexation would be effective 45 days after ordinance adoption if a referendum petition were not filed. A referendum petition would be signed by registered voters equal to or more than 10% of the votes cast within the annexation area in the last general state wide election. An election would be held within 90 days. Mayor Ryder remarked that the City Council understands the concerns expressed by the residents of Capitol Golf Club Estates and Chambers Estates, and will consider their comments. He added that under the Growth Management Act, there is an expectation by the county and the state, that the city will eventually annex properties within its urban growth boundaries. PUBLIC RECOGNITION: The City Council has established the quarterly Compassion is Contagious awards program to honor the people who put empathy into action by helping others, and strengthening the greater Lacey community. The first recognition award is to the outstanding volunteers from Southern Baptist Disaster relief. After the severe weather event in the City of Lacey on May 4, Southern Baptist Relief volunteers helped two local families of limited resources repair the storm s damage to their homes and property. 8 Coordinator, described the many disaster services offered by their organization. The second recognition award is to the outstanding volunteers of Lacey Spring Fun Fair. For more than 30 years, members of the Fun Fair Committee have dedicated countless hours and significant effort to provide the community with an incredible twoday family festival at no cost. Committee Chair, Ruth Weigelt, has served on the committee for 30 years. She recognized all of the long-time volunteers who make this event such a success. Walt Bowen, Chair of the Dixieland Jazz Festival, announced the festival will be held from June 22-25, 2017 at St. Martin s University. The festival offers four venues, four dance floors, 100 hours of music and a parasol parade. Meg Martin, Director of Emergency Overnight Shelter of the Interfaith Works Warming Center, provided a briefing on the program. The center operated from November 1 December 8, 2016, 5 days a week from 7 a.m. 5:30 p.m. A survey was conducted of the program and showed that 65% of the population came from outside Thurston County, 82% of that number were in Olympia, 83% have mental or emotional health issue, 52% struggle with substance abuse, and 65% have some kind of physical disability. Ms. Martin noted that the program is underfunded and understaffed to meet the needs of the homeless population. PUBLIC COMMENTS: Allison Vane, Volunteer for Thurston County Cancer Relay for Life, announced Relay for Life will be held June 23 June 24, PROCLAMATION: Mayor Ryder and Council proclaimed July 1, 2017, as Honor Guards Day. Lieutenant A.J. Paulson, Fire District 3, accepted the proclamation on behalf of all honor guards. RESOLUTIONS: Resolution No approves the adoption of the Lacey Food Bank as a Compassionate Community Project. Page 2 of 4

9 The project is a partnership between the City of Lacey, North Thurston Public School District, Lacey South Sound Chamber and the Thurston County Food Bank. The establishment of a Lacey Food Bank located on Martin Way E. would serve the greater Lacey community and would address an essential need for individuals and families. DEPUTY MAYOR PRATT MOVED TO APPROVE RESOLUTION NO ADOPTING THE LACEY FOOD BANK AS A COMPASSIONATE COMMUNITY PROJECT. COUNCILMEMBER CLARKSON SECONDED. MOTION CARRIED. MAYOR S REPORT: STANDING GENERAL COMMITTEES: BOARDS & COMMISSIONS: Mayor Ryder acknowledged Carolyn Cox and Paul Enns, Planning Commission members, who were in attendance. Transportation Committee Councilmember Hearn reported the committee met on May 17, 2017, to receive an update on the Marvin Road construction, and Hogum Bay Road improvements. Intercity Transit Councilmember Clarkson reported that 176 van pools are available for use one of the major users is JBLM. WSDOT has awarded a grant of $885,000 to replace 40 vehicles. JASCOM Councilmember Young reported the quarterly budget report is positive with a draft of vision and values. Lacey South Sound Chamber Councilmember Hearn reported the Board received a presentation from the Education Panel at St. Martin s. Challenges are keeping up with technology and preparing for the workforce. SWAC Councilmember Greenstein reported that work on the Solid Waste Management Plan has been completed it will be reviewed by all participating jurisdictions prior to adoption. Page 3 of 4

10 TRPC Councilmember Clarkson reported the Board held its biennial retreat recently. He remarked that the retreat could have been more effective with a greater focus on major challenges facing the community, such as water, the environment, and climate change. WORKSESSION: Mayor Ryder adjourned to worksession at 8:22 p.m. to discuss a Voluntary Long Term Renewable Service Agreement. Puget Sound Energy Green Direct is a voluntary renewable energy option for the city approved by the UTC. The program is available to municipalities, government institutions and commercial operators, but not residential. The green tariff allows the customer to buy renewable energy under a long-term contract. Fifty-one new renewable energy generation families (wind farms) have been constructed in Thurston County. All costs and benefits are contained within the program. The enrollment period ends on July 1, Advantages to the program include a consistent price, a local investment without a large capital commitment, maintaining the city s green power commitment and carbon reduction plan, and meeting our standard reduction of carb emissions by 15%. Disadvantages include market risks of a long-term investment over years, past and future power prices, and NW Wind REC s trending market. Staff proposes authorizing the city manager to execute the standard UTC approved agreement with a recommended standard rate schedule of 20 years. Councilmember Clarkson suggested requiring a first year report in 2021 to gauge the effectiveness of the program. COUNCILMEMBER GREENSTEIN MOVED TO AUTHORIZE THE CITY MANAGER TO SIGN THE VOLUNTARY LONG TERM RENEWABLE ENERGY SERVICE AGREEMENT WITH PUGET SOUND ENERGY FOR A 20 YEAR RATE AT 2% WITH A FIRST YEAR REPORT IN DEPUTY MAYOR PRATT SECONDED. 13 LACEY CITY COUNCIL MEETING June 22, 2017 SUBJECT: Adjustments to Planning and Building Cost Recovery Fees RECOMMENDATION: Adopt new Planning and Building Cost Recovery Fees. Resolution No Resolution No Exhibit A FISCAL NOTE: Based on the 12-months ended September 30, 2016, the impact to the General Fund of the proposed fees would be an increase of approximately $87,000 annually: a 2.67% increase. PRIOR REVIEW: General Government Committee November 14, 2016 Council Worksession May 18, 2017 BACKGROUND: The City s planning and building cost recovery fees have not substantively changed through a comprehensive review of service cost in 25 years. During that time, regulations affecting development and construction have increased, and projects have become far more complex. At the same time, technology has helped to speed up some processes. These factors have caused the cost recovery fees to become misaligned with the actual cost of providing the services even with annual percentage increases based on the average salary increase accrued by department employees over the previous 12 months. In 2016, the Department began an extensive review of its services and costs. A fullyburdened labor rate was calculated, and comparisons were made to the cities in Washington with similar populations to Lacey. Using a target to recover 75% of the costs Page 1 of 4

14 of providing planning and building services, the resulting numbers were presented to the General Government Committee for initial input before meeting with stakeholders. On December 1, 2016, Department staff met with the Government Affairs Committee of the Olympia Master Builders (OMB) for input and discussion. Based on input from the General Government Committee and OMB, it became clear that the service/fee schedules were confusing, difficult to navigate, filled with technical jargon, and the opposite of a clear and predicable customer experience. The committee requested the peer comparisons be revised to include only Olympia, Tumwater, and Thurston County to reflect the local market. Staff completed the new peer comparison, along with a new approach to the presentation of the services and fees, with clearer titles, significant consolidation of categories, and with separate building services/fee schedules for the three separate user groups, with each schedule arranged by project type. Department staff presented the revised service/fee schedules, comparisons to local peers, along with all of the requested information to OMB on February 23, Staff incorporated the additional suggestions from that meeting into the revised service/fee schedules presented here. There will be a seven percent increase in the cost for a building permit for a typical new single family home. The cost in Lacey will still be the lowest among our local peers: approximately 74% of the peer average. The permit costs to develop the subdivision in which that typical new home will be built will increase by approximately 11%, still only about 70% of our peers. On the commercial side, based on a 10,000 square ft. example, planning cost recovery fees would decrease by 15%, with Lacey at only 58% of the peer average. The Planning and Building fees Department fees will continue to be adjusted annually in July in an amount equal to the average salary increase accruing to department employees during the prior 12 months, which has historically been the practice since the fees were adopted in Input was provided at the May 18, 2017, Council Worksession, and has been incorporated by staff. In one year, staff will conduct a check-in to determine how the newly revised cost recovery fees are working, to ensure that the clarification of the services and their costs are effective, and that the revised cost recovery fee amounts are not creating problems for customers, nor having any adverse unintended consequences. Staff will undertake a full review of the services, costs, and cost recovery fees every five years to ensure that they do not become misaligned. The proposed cost recovery fees better reflect the cost of providing services. Additionally, Lacey remains below our peer average in fees in some cases well below the average. Staff therefore recommend approval of the proposed cost recovery fee schedules. ADVANTAGES: 1. Clearer and more predictable costs for all stakeholders. 2. Cost recovery fees are more fair and equitable based on the costs associated with the services provided. 3. Planning and building cost recovery fee contribution to the General Fund will increase by approximately 2.67% 4. Lacey s fees will remain below our peer average in nearly every category. Page 3 of 4

17 RESOLUTION CITY OF LACEY A RESOLUTION REVISING THE LACEY FEE SCHEDULE AS IT RELATES TO SERVICES PERFORMED BY THE COMMUNITY AND ECONOMIC DEVELOPMENT DEPARTMENT. WHEREAS, Section of the Lacey Municipal Code requires that certain fees, charges and bonding requirements and penalties for failure to pay said fees and charges in a timely manner be established by resolution of the City Council; and WHEREAS, the city staff and City Council have extensively reviewed the costs of performing services within the Community and Economic Development Department and have determined that said costs have significantly increased since passage of the last resolution setting fees for that department; and WHEREAS, the city staff met with local stakeholders and determined that citizens would be benefited from a revised fee schedule with clearer titles, consolidation of categories, and clearer description of services; and WHEREAS, the City Council finds that updating the fee schedule as it relates to services performed by the Community and Economic Development Department to be in the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LACEY, WASHINGTON, that those certain fees and charges as set forth on Exhibit A, attached hereto, shall be the fees and charges for the planning and building services provided by the City of Resolution No. Page 1 of 2

Resolution 1048 FISCAL NOTE: Public Works invoiced contracted work related to the May 4, 2017, storm response totaling approximately $100,000. PRIOR REVIEW: None. BACKGROUND: On Thursday, May 4, 2017, the City of Lacey and its UGA experienced an extreme weather event creating extensive power outages, damaged structures and homes, disruption to utilities and transportation, fallen trees and debris, and flooding in parts of Lacey. Due to the severity of this event and the potential for ongoing resources to be used by the City of Lacey in response, the Mayor signed a declaration of emergency pursuant to the procedures of the City of Lacey Comprehensive Emergency Management Plan and the utilization of emergency powers granted pursuant to RCW (2) and (1); and LMC This declaration allowed the city to waive competitive bidding requirements and award all necessary contracts on behalf of the city to address the emergency situation. Because such contracts were awarded a written finding of the existence of the emergency must now be made by the Council. Page 1 of 2

33 RESOLUTION NO. CITY OF LACEY A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LACEY FINDING THAT THE EXTENSIVE DAMAGE CAUSED BY THE SEVERE STORM EVENT ON MAY 4, 2017 CONSTITUTED AN EMERGENCY. WHEREAS, the Lacey City Manager reported to the Mayor that the severe storm event that occurred on May 4, 2017 caused an emergency by creating extensive power outages, damaged structures and homes, disruption to utilities and transportation, fallen trees & debris, and flooding in parts of Lacey; and WHEREAS, due to downed power lines and trees there was substantial likelihood of risk to persons, property, and the environment unless further efforts were taken to reduce the threat; and WHEREAS, the Mayor declared a local emergency on May 5, 2017, which allowed the City of Lacey to undertake emergency purchases and emergency public works pursuant to RCW and RCW as such purchases or public works required immediate action occasioned by the emergency. NOW THEREFORE, the Lacey City Council declares as follows: Section 1. The conditions stated in the above recitals, incorporated herein, constituted an emergency for the City of Lacey, which necessitated activation of the City of Lacey Comprehensive Emergency Management Plan and the utilization of emergency powers granted pursuant to RCW , (2) and (1); and LMC 6.01 (Ordinance no. 1103). Section 2. Pursuant to the emergency declared at Section 1, City departments and offices, as designated pursuant to the PLAN, were authorized to enter into contracts and incur obligations necessary to combat such emergency to protect the health and safety of persons, property, and the environment, and provide emergency assistance to the victims of such emergency, consistent with the PLAN. Table: Comparison of Long Lake Beach Rules N/A Lacey s Board of Parks Commissioners reviewed the proposed rules changes at its May 11, 2017, meeting, and General Government Committee reviewed at its June 12, 2017, meeting, and both approved to move this forward to full council. BACKGROUND: In response to unintended activities at Long Lake Beach and overall user experience at this park site, staff reviewed its current rules and standards with the goal of enhancing overall safety for the individual user and to provide a better experience for all users of Long Lake Beach. In addition, the proposed rule changes to Long Lake Beach establish consistent practices for open swim procedures at indoor pool sites, managed by Lacey aquatics staff, and at the swim beach. General Government Committee reviewed the amended Long Lake Beach Rules at its June 12, 2017, meeting and moved to forward to the full council. Staff Report June 16, 2017 Page 1 of 2

37 PARK RULES AND REGULATIONS BEACH RULES 1. A swim test is required for anyone under age 18 to swim beyond the shallow water buoy line. The swim test consists of a: A continuous 25 yards swim (75 feet) using a non-struggling front crawl or breaststroke (no doggie paddling ) that makes forward progress. Swimmers must have their face in the water the majority of the time. Tests need to be taken daily. 2. An adult must be in the water and within reach of any youth under age 6 or a non-swimmer. 3. Youth wearing personal floatation devices (lifejackets) must remain within the shallow water buoy line unless within reach of a supervising adult. 4. Flotation devices allowed in designated area only. 5. No running on the dock, rough play, pushing, dunking or offensive language. 6. No flips or back dives/jumps. 7. No consumption of alcohol or controlled substances. 8. No throwing rocks or other dangerous objects. 9. No standing/sitting on float lines. 10. Swim/dive in designated area only. No swimming under the dock or outside the swim area. 11. No animals in swim area or on dock. Animals must be on a leash and unobtrusive. Pet waste must be removed. 12. Animals prohibited in the majority of the park (allowed by volleyball courts) Animals would be allowed everywhere in the park except on the dock and in the swim area (water). Animals must be on a leash and unobtrusive. Pet waste must be removed. Back jumps would not be allowed due to the risk of jumping on someone without seeing them. People have the expectation that they can bring dogs to a park. This is one of the most commonly unknown rules. Lifeguards have to enforce it several times a day and it is frustrating to the public. Often, people say their animal is a service animal which causes confusion for people without service dogs.

PRIOR REVIEW: N/A BACKGROUND: This contract provides for the installation of approximately 3,800 LF of 4-inch, 8-inch, and 12-inch diameter water main along 14th Ave SE, 16th Ave SE, Magnolia St SE, Brunswick St SE, 22nd Ave SE, and Carpenter Rd SE. The project includes the installation of water service lines, meters, valves, the transfer of water services, connections to existing water systems, water main abandonments, pavement and lawn restoration and other work. The project was advertised for three weeks and bids were opened June 8, Three (3) bids were received. The 3 bids ranged from a low of $1,163, to a high of $1,224, Strickland & Sons Excavation from Buckley, Washington, is low bidder at $1,163, The Engineer s Estimate is $865, A Bid Summary Sheet is attached. The lowest bid amount is above the Engineer s Estimate and the bid exceeds the approved budgeted amount for the project. The high bids are likely due to bid timing since this is the busy time of the construction season. Staff recommends that all bids be rejected and that Page 1 of 2

There was an unexpected expense of $3,200 for plates, platters, glassware, and flatware, because the venue was unable to supply enough dishes for the size of the event. In addition, $1,900 in sales tax was charged for ticket sales. The event will include a time capsule ceremony. Prior to the ceremony, seventy-five people will be asked to write a letter to the future. The letters will be inserted into the capsule. The capsule will be catalogued by the Lacey Museum and be on display. Those who write a letter, or their descendants, will be invited to the City s 75 th Anniversary celebration when the time capsule is opened.
