3 n^ IN THE MATTER OP The Municipal Act R.S.O Chapter M.45, Sections 297 and 300, and amendments thereto - and - IN THE MATTER OP The City of North York By-Law Number entitled a By-law to provide for the closing and stopping up of part of Beechwood Avenue and to authorize the sale thereof. AFFIDAVIT I, DENIS KELLY, of the City of North York, in the Municipality of Metropolitan Toronto, Clerk, MAKE OATH AND SAY AS FOLLOWS: 1. THAT I am the Clerk of The Corporation of the City of North York, and as such have full knowledge of the facts herein. 2. Now produced and shown to me and marked as Exhibit "A" to this my Affidavit is a true copy of a notice of the proposed closing which was published in the Toronto Star, a newspaper having a general circulation in the area of the said road, on the following days: May 14, 21 and 28 and June 4, Now produced and shown to me and marked as Exhibit "B" to this my affidavit is a copy of a letter dated June 3, 1992, advising that Metropolitan Toronto has no objection to the proposed closing, which was later confirmed by Metropolitan Toronto Economic Development and Planning Committee Report No. 12, and adopted by the Council of The Municipality of Metropolitan Toronto at its meeting held on July 2 and July 3, 1992, as required by Section 102 of the Municipality of Metropolitan Toronto Act, R.S.O. 1990, Chapter M.62, as amended.
4 THAT at a properly constituted meeting of Council held on July 8, 1992, the date upon which the notice hereinbefore referred to stated that the by-law would be considered, the Council of the Corporation of the City of North York considered the proposed closing. At the said meeting on July 8, 1992, no one appeared claiming that his or her lands would be prejudicially affected by the by-law. At a properly constituted meeting of Council held on the July 8, 1992, Council passed the said By-law THAT the said road as closed by By-law does not interfere with any public road or bridge vested in the Crown in the right of Ontario, or any public department, board or officer of Ontario. 6. THAT the said road, as closed by By-law is not an allowance for road reserved in the original survey, (a) along the bank of any river, stream or other water; (b) along or on the shore of any lake or other water; (c) leading to the bank of any river or stream; or (d) leading to the shore of any lake or other water. 7. THAT the said road as closed by By-law is neither a street, lane or thoroughfare as referred to in Subsection (4) of Section 297 of the Municipal Act, or land owned by the Crown in the right of Canada or any bridge, wharf, dock, quay or other work vested in the Crown in the right of Canada, as referred to in the said Subsection (4) of Section 297 of the Municipal Act, R.S.O. 1990, as amended.
5 THAT there is another road or way of access for all persons to gain access to their lands or place of residence. 6 < CITY OF NORTH YORK NOTICE OF ROAD CLOSING AMD SALE TAKE NOTICE that the Council of The Corporation of the City of North York proposes to pass a by-law to close and stop up that portion of Beechwood Avenue west of Hedgewood Avenue, and to authorize the sale thereof, the lands being more particularly described in Schedule "A" to the draft by-law. The said by-law will be considered by Council at a meeting to be held on Wednesday the 8th. day of July 19 92, at 2:30 p.m. at the North York City Hall, 5100 Yonge Street, North York, Ontario. At that time, Council shall hear any person who claims that their land will be prejudicially affected by the by-law, and who applies to be heard. The Economic Development and Planning Committee recommends the adoption of the following report (June 10,1992) from the Commissioner of Planning: The following road closing has been reviewed and recommended for approval by the Commissioner of Planning: North York - North York Centre South - To close and sell part of Beechwood Avenue (formerly Hollywood Avenue) road allowance, lying west of Hedgewood Avenue. The lands currently are being used for landscaping by the abutting owners. It is recommended that the action of the Commissioner be confirmed. WHEREAS notice of this by-law has been published and the provisions of the Municipal Act relating to the stopping up of highways have been complied with. NOW, THEREFORE, THE COUNCIL OF THE CORPORATION OF THE CITY OF NORTH YORK HEREBY ENACTS AS FOLLOWS: 1. THAT the lands described in Schedule "A" hereto attached are hereby stopped up and closed as a public highway. 2.
