The Village, with the assistance of Camiros, is developing a comprehensive text amendment updating the Village s Zoning Code so it will continue to serve as a tool to maintain and enhance the character of the Village; promote and protect the public health, safety and welfare of the Village; conserve the value of land and structures, promote orderly growth, and encourage appropriate investment of land and structures throughout the Village. During this meeting the ZBA/PC will be reviewing the first Sections 7 through 11 of the Staff Review Draft Ordinance previous distributed in the March 22, 2018 agenda packet. VI. VII. VIII. Prospect Avenue, Clarendon Hills, Illinois I. CALL TO ORDER. Chairman Greg Kuhn called the meeting of the Zoning Board of Appeals/Plan Commission to order at 7:30pm. II. III. IV. ROLL CALL. Present: Absent: Others Present: APPROVAL OF MINUTES. Chairman Greg Kuhn, Jim Scheer, Joe Tobolski, Karin Hanke and Martha Kanter Jeff Keiner and Tom Szurgot Community Development Director Dan Ungerleider Bill James, Camiros, Ltd. a. March 22, Mr. Scheer made a motion, seconded by Mr. Tobolski, to approve the minutes from the March 22, 2018 ZBA/PC meeting. The motion unanimously passed by a voice vote. OLD BUSINESS. a. Case No 486 / Zoning Ordinance Modernization Project - Staff Review Draft Ordinance. Mr. Ungerleider introduced Mr. Bill James of Camiros, the consulting firm assisting the Village with a comprehensive amendment of its zoning regulations. Mr. Ungerleider explained that this is a continuation of the ZBA/PC s workshop discussions in consideration of this project. He added that our goal would be to review Articles 1-6. Mr. James presented each section, identifying notable additions and modification is policy proposed in the Staff Review Draft, dated March The ZBA/PC members requested that the draft provide notes in the margins indicating revisions. Mr. Williams explained that these notes would be added in the next version of the proposed ordinance document. It was noted that the day period noted in 1.4 E should be consistent with the Building code, and that 1.4 G Pending Applications addresses pending zoning applications may be considered by the ordinance in effect at the time of its application. Mr. James explained that the Article 2 Definitions is better organized and includes more relevant definitions. Chairman Kuhn asked that Mr. James confirm the definitions adequately consider and define accessory structures. He also asked that a definition for estate sales and the like be added. The Commission discussed how a residential ice skating rink might be considered an accessory structure or temporary use on a single family property. Mr. Scheer noted that this Article would be easier to review if changes were noted in the margins. During the review of Article 2, Section 2.4 the Commission reviewed the illustrations and text defining dimensional standards followed by this ordinance. Mr. James noted that the illustrations describing bios wales was developed by Camiros based on common practice. The Commission asked that this design concept be reviewed and confirmed by the Village Engineer.

4 Zoning Board of Appeals/Plan Commission Minutes Page 2 April 17, 2018 Mr. Tobolski asked that the village consider using its geographic information mapping systems to insure the ordinance adequately address existing lot types and sizes found in the Village. Mr. Ungerleider explained that our current systems are not capable of this at this time. Mr. James reviewed Article 3 - Zoning Districts. Notable changes included the introduction of the P-I Public and Institutional, R-2 Medium Density Residential, L-O Limited Office, and O-T Office Transitional districts. P-I District will protect the use of public and institutional lands, and prevent their expansion without first going through a public hearing process. R-2 District allows for residential development being in character between a standard single family lot and multiple family building (ie small lot single family, duplex single family or townhome). L-O and O-T both provide for transitional districts. Chairman Kuhn expressed that he liked the idea of creating a special zoning designation for public facilities, schools and churches. Mr. James reviewed the proposed bulk regulations for the proposed residential districts. He noted that the current draft indicates the reduction of maximum impervious surface coverage ratio, making way for incentive bonuses for using pervious material and provision of stormwater facilities. The Commission requested that Camiros provide before and after visual examples transitional setback standards between residential and commercial districts. Members also asked that the ordinance credit development for including green roof systems. V. NEW BUSINESS. None The Commission is expected to review Articles 7-11 at their next meeting on May 17, VI. VII. VIII. COMMENTS FROM THE AUDIENCE. None DISCUSSION ITEMS. None ADJOURNMENT. A motion was made by Mr. Tobolski, seconded by Ms. Hanke, to adjourn the meeting at 9:25 pm. The motion passed unanimously by a voice vote. GENERAL INFORMATION: Petitioner Todd Naccarato, Molto Properties, LLC & Contract Purchaser 18W140 Butterfield Rd, Suite 700 Oakbrook Terrace, Illinois Property Owner Scott Bonser 1 Arthur Avenue Clarendon Hills, Illinois Request Request for Special Use Permit for automobile parking and office space at 144 Burlington Avenue. Property Location Existing Zoning & Land Use North side of Burlington Avenue, East of Golf Avenue B-2 General Business District (Clarendon Hills Auto Repair) Adjacent Zoning & Land Use North: R-1 Single Family Residential South: R-1 Single Family Residential (BNSF Rail and Commuter Rail Station) East: B-2 General Business District (Office - Culligan Abraham Architecture) West: B-2 General Business District (Office) SUMMARY: Todd Naccarato, the contract purchaser of the subject property, is seeking approval of a Special Use Permit to develop and operate private automobile parking and office space at 144 Burlington Avenue (see attached location map). Specifically Mr. Naccarato is requesting the right to have Automobile Parking, but not parking of towed vehicles in the building formally known as the Clarendon Hills Auto Repair. His proposal includes the renovation of the property and the existing building to accommodate a new office space, conference room, and a car show room. Although the general appearance of the building will remain the same, Mr. Naccarato is proposing to conduct general maintenance of the building s exterior, while bringing the building into full compliance with current building and fire safety ordinances. A copy of the Applicants Applicant Request and proposed renovation and reuse plans, dated 4/16/2018, are include with this report. As required by Village Ordinance, the Zoning Board of Appeals/Plan Commission (ZBA/PC) shall consider requests for special use during a noticed public hearing. Notice has been provided by mail, newspaper and posted on site per Village ordinance (see attached). The subject property has a long running history of being home to automobile service and repair facility. The building is a brick structure having access to Burlington Avenue and a public alley to the north. Although under the provisions of the

6 Staff Report Page 2 Case No Z489 / 144 Burlington Avenue - Special Use Permit for automobile parking and office space (Molto Development) Village Zoning Code the petitioner is not required to provide off-street parking, the petitioner is committed to improving the space between the building and the public alley to accommodate guest parking. This area will accommodate at least 4 parking spaces, and if needed, a brick refuse enclosure if a dumpster were to be kept outside behind the building. Comprehensive Plan Analysis. The subject property is designated for a multi-use building with street-level commercial by the 2014 Downtown Master Plan (DTMP), an adopted component of the village comprehensive plan. The proposed use for is consistent with this designation. Special Use Analysis. Mr. Naccarato is proposing to use the property for offices and a private automobile showroom. To accommodate the parking-portion of the proposed use, Mr. Naccarato is seeking approval of a special use permit for Automobile Parking, but not parking of towed vehicles under Section B-9. Mr. Naccarato will be using the space to store and showcase his personal automobile collection. This space will not be open to the public. Village Staff has considered the petitioner s request and has found the proposed facility and related improvements to comply with following standards or findings of fact (Section D): 1. The establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare of the village. 2. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted, or substantially diminish or impair property values within the neighborhood. 3. The establishment of the special use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the zoning district. 4. Adequate utilities, access roads, drainage and/or necessary facilities have been, or are being provided. 5. Adequate measures have been, or will be, taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets. 6. The special use shall, in all other respects, conform to the applicable regulations of the zoning district in which it is located. RECOMMENDATION: Staff has determined that the proposed facility is in keeping with the submitted and above referenced findings of fact, and therefore recommends APPROVAL of the requested Special Use Permit to develop and operate private automobile parking and office space (Molto Development) at 144 Burlington Avenue, subject to the 1) installation pavement and parking striping between the building and public alley, and 2) installation of a brick refuse enclosure behind the building if the owner intends to store refuse outside of the building. REQUESTED ACTION A motion to recommend APPROVAL of a Special Use Permit to develop and operate private automobile parking and office space (Molto Development) at 144 Burlington Avenue, based on the above listed findings of fact, and the following condition: 1. Prior to the issuance of a building permit, the petitioner shall submit construction plans illustrating the installation of a paved surface and refuse enclosure behind the building in addition to the improvements proposed in the renovation and reuse plans, dated 4/16/2018.
