3 [Type here] MINUTES PLANNING AND ZONING COMMISSION NOVEMBER 14, 2017 Item 1: The Lewisville Planning and Zoning Commission meeting was called to order at 6:31 pm. Members present: John Lyng, MaryEllen Miksa, Kristin Green, Alvin Turner, and James Davis. Members William Meredith and Karen Locke were absent. Staff members present: Richard Luedke, Planning Director; June Sin, Planner; Theresa Ernest, Planning Technician. Item 2: The second item on the agenda was to approve the minutes from the October 17, 2017 meeting. A motion was made by MaryEllen Miksa to approve the minutes, seconded by James Davis. The motion passed unanimously (5-0). Item 3: The third item on the agenda was Reports. Mendie White, Sustainability Manager, gave a presentation regarding the SolSmart Program. Item 4: Consent Agenda Plats were next on the agenda. There was one item for consideration: A. Final Plat of JK Mustang Properties Addition, Lots 1 and 2, Block A; on an Acre Tract of Land out of the J. W. King Survey, Abstract Number 696; Zoned Old Town Center District (OTC); Located on the South Side of West Main Street, Approximately 120 Feet West of South Mill Street. Staff gave a brief overview of the proposed plat and recommended approval. A motion was made by James Davis to approve and seconded by Alvin Turner. The motion passed unanimously (5-0). Item 5: Public Hearing Consent Agenda Plats were next on the agenda. There were two items for consideration: A. Public Hearing: Final Plat of Saturn Addition, Lot 1R, Block A; on 4.54 Acres; Zoned Light Industrial District (); Located on the Northwest Corner of Country Ridge Road and the I-35E Frontage Road; Being a Replat of Lot 1, Block A of Saturn Addition, a Part of Park Street, and a Tract of Land to Baum Auto Sales.

Kealy Addition, Lot 14R, Block B; on Acres; Zoned Old Town Mixed Use 2 District (OTMU2); Located on the North Side of Edwards Street, Approximately 280 Feet East of South Charles Street; Being a Replat of Lot 14 and 15, Block B of L.M. Kealy Addition. Items 5A and 5B were read together. Staff gave a brief overview of the proposed final plats and recommended approval. Chairman Green then opened the joint public hearing for items 5A and 5B. There being no public comment, the public hearing was then closed. A motion was made by MaryEllen Miksa to approve the final plats. The motion was seconded by Alvin Turner. The motion passed unanimously (5-0). Item 6: Public Hearing Zoning & Special Use Permits were next on the agenda. There were two items for consideration: A. Public Hearing: Consideration of a Zone Change Request from Multi-Family One District (MF-1) to General Business District (GB); on an Approximately 0.56-Acre Tract of Land, Legally Described as Lot 3B, Block A, Timber Village Addition; Located on the North Side of Valley View Drive; Approximately 470 Feet West of S.H. 121 Business, at 139 Valley View Drive; as Requested by Cynthia Rahimi of Sayr Resources Inc., the Property Owner. (Case No. PZ ). B. Public Hearing: Consideration of a Special Use Permit for a Kennel with Outdoor Runs; on an Approximately 0.56-Acre Tract of Land, Legally Described as Lot 3B, Block A, Timber Village Addition; Located on the North Side of Valley View Drive; Approximately 470 Feet West of S.H. 121 Business, at 139 Valley View Drive; as Requested by Cynthia Rahimi of Sayr Resources Inc., the Property Owner. (Case No. SUP ). Staff gave a brief overview of items 6A and 6B, and recommended approval. Chairman Green asked for clarification that the special use permit was required due to the outdoor runs, which staff confirmed. Member James Davis and Chairman Green asked for additional detail regarding the location of the dog runs on the property and confirmation that dogs would not be kept outdoors overnight. Staff explained that the dog runs would be located at the rear and sides of the property in an enclosed area and provided the proposed hours of operation for the kennel. Chairman Green then opened the joint public hearing for items 6A and 6B, and with no one coming forward to speak, the public hearing was then closed. A motion was made by James Davis to recommend approval of item 6A, which was seconded by MaryEllen Miksa. The motion passed unanimously (5-0). A motion was made by Alvin Turner to recommend approval of item 6B, which was seconded by John Lyng. The motion passed unanimously (5-0). Staff indicated that both items 6A and 6B

Hayden Survey, Abstract No. 537 and the H. Young Survey, Abstract No. 1448; Located on the South Side of Midway Road; Approximately 800 Feet West of F.M. 544; as Requested by Robert Allen of First Industrial Realty Trust, Inc. on Behalf of Billy J. Myers and Raymond L. Myers, the Property Owners. (Case No. PZ ). BACKGROUND: The properties are located to the east of the Coyote Theater and are primarily used for agricultural purposes. The applicant plans to develop an industrial park on the property which is currently zoned Agriculture Open Space District (). The applicant is requesting Light Industrial District () zoning which would allow light industrial uses. ANALYSIS: The subject property consists of four parcels bounded by Holfords Prairie to the west and Midway Road to the north. The applicant plans to develop an industrial park containing four office/warehouse buildings ranging from approximately 125,000 square feet to 250,000 square feet. The two northern buildings will be constructed during Phase 1 and the remaining buildings will be built in phase two. This site is adjoined by properties zoned to the west, which includes a drive-in theater, automotive and industrial uses. The property at the northeast corner of the subject property is zoned Public Use (PU). The property is adjoined by City of Lewisville ETJ to the north and east, and by City of Carrollton to the south. The request for a zone change to Light Industrial District is compatible with the surrounding area and would be consistent with Lewisville 2025 Plan Big Move # 6 - Employment Centers. RECOMMENDATION: That the Planning and Zoning Commission recommend approval of the zone change request from Agriculture Open Space () to Light Industrial () as requested.
