2 Bidding Registration & Venue If you are intending to bid you MUST register prior to bidding. You will be required to complete a bidder s registration form and produce two forms of identification as detailed below. IF YOU DO NOT PROVIDE THIS IDENTIFICATION YOU WILL NOT BE ALLOWED TO BID. Bidders can register on the day of the auction by bringing the two forms of identification into the registration room. Please arrive in good time before the auction is due to start to ensure that you will be successfully registered. It is suggested that bidders arrive AT LEAST 30 MINUTES BEFORE THE AUCTION IS DUE TO COMMENCE. PROOF OF IDENTITY Individuals Companies If the bidder is acting on behalf of a Limited Company, the bidder will be required to provide personal proof of name and address, and in addition: - Copy of the Company Certificate of Incorporation Written authority from the Company that the bidder has the authority to represent and purchase on behalf of the Company at the auction Photocopies of documentation may be taken as part of the auction process. The Sea View Public House: Bidders are required to provide Breal Asset Valuations Limited with proof of identify and proof of current residential address by producing the following documents prior to signing the contract at the auction. Please note it is essential to provide one example from each of the following two categories:- Photographic evidence of Identity e.g. current passport / new style UK driving licence / Firearm or Shotgun Certificate / Resident Permit issued by the Home Office to EU Nationals / valid identity card for HM Forces, Police Warrant, Prison Officer, Government/Local Authority issued card. Evidence of Residence e.g. utility bill; not mobile phone (last 3 months) / bank or building society statement (last 3 months) / credit card statement (last 3 months) / HMRC notification (current tax year) / current motor or house insurance certificate / recent Council Tax bill or council rent book. Data Protection - The information that you provide on the Bidder s Registration form and the identification documents submitted are required under the Money Laundering Regulations 2007 for identification and security purposes and will be retained by Breal Asset Valuations Limited for a minimum of five years from the above date. The details may also be supplied to other parties if Breal Asset Valuations Limited are legally required to do so. Directions From The North and South:- M6 to Junction 29 and take the M65 towards Blackburn. Take the next exit for the M61 and head towards Bolton/Manchester. Leave the M61 motorway at Junction 8, from the junction head west along the A674 to the first roundabout and take the third exit and head north along the A6 (Preston Road), the Sea View Public House is approximately 800m on the right hand side (just after the traffic lights). 1

3 Auctioneer s Pre-Sale Announcements 1. The auctioneer will offer the lot as shown in the catalogue. 2. An addendum to the catalogue and conditions of sale may be available for distribution in the auction room, please check with the auctioneer on arrival. 3. The addendum is an important document providing updates and corrections to the auction catalogue. Breal Asset Valuations Limited reserve the right to withdraw lots from sale if sold prior to the day of the auction. 4. Breal Asset Valuations Limited will always endeavour to inform prospective purchasers of changes that may have taken place after the catalogue was printed when such changes are brought to Breal Asset Valuations Limited s attention. 5. Would prospective purchasers please ensure they have a copy of the auction catalogue and an addendum prior to bidding. 6. Prospective purchasers are deemed to have read the addendum (if applicable) whether they have done so or not. 7. You are bidding on the basis that you have checked the general conditions of sale which are detailed at the back of the catalogue and the special conditions of sale relating to each individual lot, available from our website at 8. You are bidding on the basis that you have made all necessary enquiries and have checked the general and special conditions of sale and are satisfied that you fully understand their content. 9. If you have a question in respect of any of the lots within the catalogue would you please ask one of the Breal Asset Valuations Limited representatives who will attempt to answer your questions during the auction. The auctioneer will not answer your question during the auction. The auctioneer will not answer questions whilst the auction is proceeding. 10. Any guide prices shown in the catalogue are merely an approximation and the auctioneer s opinion only. They should not be regarded as anything more. 11. The auctioneer will not describe each individual property in detail or elaborate on its features or finer points. He will merely state the address, lot number and a very brief description. 12. Please remember it is the bidder s duty to attract the auctioneer s attention. 13. Please bid clearly and do not delay. 14. At the fall of the hammer the successful bidder will be in a binding contract of sale. At this point an auction runner will come to your place of bidding, take your name and address and details of your solicitor and will lead you to one of the contact table in the auction room where you will be asked to provide some form of identification. 15. You will then be invited to sign the memorandum or contract of sale and provide a 10% deposit. 16. We only accept deposit cheques on the basis that there are adequate funds in the account on which the 2

4 cheque is drawn. We reserve the right to take any action as appropriate against a purchaser whose cheque is not honoured on first presentation. Prospective bidders please note that cash will not be accepted for payment of a deposit. 17. A successful purchaser will be required to pay a Buyers Administration Charge of 1,500 plus VAT in respect of property lots. 18. In reference to property lots: Completion of the sale and payment of the balance of the purchase money is 28 days after the auction unless the conditions of sale provide otherwise. 19. In respect of chattel assets (all lots excluding property, if applicable), a successful purchaser will be required to pay Buyers Premium of 10% (plus VAT) of the hammer price, in addition to the purchase price. 20. Unless otherwise stated all property is sold subject to a reserve price whether declared or not. 21. Please note you will not be entitled to keys or access to vacant properties until completion of the sale. If access is required it may be arranged through our office with the permission of the vendor. 22. Breal Asset Valuations Limited operate a dedicated mailing list free of charge to applicants. If you wish to be placed on the mailing list, please give your details to one of our representatives. 3

Prospective Purchasers are advised to:- Inspect the property and check the particulars of sale as to areas, measurements and all other matters to which the properties are expressed to be subject to or have the benefit of. All measurements and areas are approximate. Satisfy themselves as to the condition of the property. No representation or warranty whatsoever is made or intended in respect of the state of repair thereof. Services, gas and electrical fittings have not been tested and their condition is unknown. Information or documentation in respect of any item of disrepair does not imply that others do not exist. Inspect the Special Conditions of Sale in respect of the precise interest to be sold. Consult their legal advisers and make all appropriate enquiries with all relevant authorities and bodies. 2. All property is sold subject to a reserve price whether declared or not, unless otherwise stated. 3. Any guide prices are the auctioneer s opinion only and should not be regarded as anything more. 4. In respect of the properties: The fall of the hammer at the final acceptable bid constitutes a binding contract and the purchaser is required to pay 10% of the purchase price, cheques to be made payable to Breal Asset Valuations Limited. Completion of the sale and payment of the balance of the purchase money takes place four weeks later unless the conditions of the sale provide otherwise. 5. Location plans are provided to enable prospective purchasers to locate the property only. They are photographically reproduced and therefore not to scale and are expressly excluded from any contract. Arrows and other markings on photographs or plans are also to enable the purchaser to locate the property only. Plans based on the ordnances survey are with the sanction of the controller HM Stationery Office, Crown copyright reserved. 6. Rateable Values are obtained on verbal enquiries to the local Authority and no responsibility is accepted for any error or omission. 7. Viewing is at the prospective purchaser s own risk personal protection equipment may be required when inspecting any property offered. 8. Description: The property comprises: Buckshaw Hall: A grade II* listed hall of significant historical importance, dating back to circ. 1654; A 5 bedroom detached barn conversion which has been partially renovated. Situated: The properties are situated on the Buckshaw Village estate with access to local amenities. The property benefits from good transport links and is situated circ. 400m from Buckshaw Parkway train station. Current Condition: Buckshaw Hall has undergone major restoration to the exterior, however internally works are required in order for use as a residential dwelling. There are a number internal features which are of historical importance. The barn has been partially renovated to first fix stage, the building appears structuraly sound and weatherproof and the room layout has been designated internally, no internal features have been installed. 11 Terms & Conditions for Proxy or Telephone Bids 1) The following terms and conditions apply to all intended buyers who wish bids to be made by proxy or by telephone. For those who are unable to attend the auction the proxy bidding form should be used in order to submit a maximum bid to the Auctioneer. This bid will not be called upon prior to the time of offering the particular lot for which the bid has been made. A prospective buyer should fill in the appropriate telephone bidding form or proxy bidding form in the catalogue and should ensure that all sections are completed. Failure to complete any part of the appropriate form may render the instructions ineffective. 2) Maximum bids must be for an exact figure and any reference to a bid to be calculated by reference to other bids will not be acceptable. In the event of there being any confusion as to the maximum bid, the auctioneer reserves the right to refuse a bid on behalf of the prospective buyer. 3) All proxy and telephone bidding completed forms must be delivered to the auctioneer with the appropriate deposit cheque not less than 48 hours prior to the start of the auction at which the property the subject of the bid is to be sold. A cheque or bankers draft in the sum of 10% of the maximum bid or 1,500 whichever is the greater, is enclosed with the proxy or telephone bidding form. Cheques should be made payable to Breal Asset Valuations Limited. Buyers Administration Charge - The successful buyer will be required to pay the Auctioneers a Buyer s Administration Charge of 1,500 (plus VAT) upon exchange of contracts for each property purchased (cheques made payable to Breal Asset Valuations Limited). 4) Any alteration to the proxy or telephone bid or withdrawal must be in writing and be received in writing and be received by the auctioneer prior to commencement of the auction. 5) The auctioneer, in accepting proxy bids, acts as agent for the prospective buyer and the prospective buyer shall be considered to have authorised the auctioneer on the basis of the terms and conditions set out in this auction catalogue, all relevant conditions of sale and any amendments to the auction catalogue. In the event of the prospective buyer s bid being successful, the auctioneer is authorised by the prospective buyer to sign any memorandum or contract relating to the property concerned. 6) The auctioneer accepts no liability for any bid not being made on behalf of the prospective buyer and reserves the right to bid himself or through an agent up to the reserve price for the particular property concerned. 7) In the event that another bidder makes a bid equal to the maximum bid the prospective buyer is prepared to make, the auctioneer reserves the right to accepts the bid of any bidder attending the auction in person or through an agent. 8) The auctioneer accepts no responsibility for failure of telecommunications in respect of a telephone bid, or any delays in the postal system if a proxy bidding form is sent through the post. 9) If the prospective buyer wishes to attend the auction and bid in person, he or she shall notify the auctioneer who will then no longer bid. Such notification must be in writing and received by the auctioneer prior to commencement of the auction. 10) Prospective bidders should check with the auctioneer s office immediately prior to the auction to ensure there are no changes to the published terms and conditions. 11) Successful / unsuccessful bids will be notified to the prospective buyer within 24 hours of the conclusion of the auction sale. 12) Should the property be knocked down to the proxy bidder by the Auctioneer at a figure which is less than the maximum bid price on the form, the whole of the deposit supplied with the form will still be cashed and will count towards the purchase price sold. 13) Proxy bidders are deemed to be making their bid with full knowledge of and in accordance with the Common and Special Conditions of Sale and the Bidding Registration notice for prospective buyers in the catalogue. 14) Proxy bidders are also deemed to have knowledge of any Addendum sheet which may be issued prior to or at the auction sale. Proxy bidders are advised to telephone the Auctioneer s offices on the day before the sale in order to find out whether 10

12 any addenda apply to the property for which they have authorised the auctioneer to bid on their behalf. 15) The proxy bidder authorises the Auctioneer or any duly authorised partner or employee of Breal Asset Valuations Limited as the prospective purchasers agent to sign the Memorandum of Sale or Sale Contract incorporating and addendum at or after the auction. 16) Proxy or telephone bidding forms should be sent to Breal Asset Valuations Limited, Suite 43, Second Floor, Barton Arcade, Manchester, M3 2BH. 11
