2 UNLEASED COTTAGE SITE AUCTION APPLICATION TERMS AND CONDITIONS (Please read carefully before initialing below) All endowment assets of the State of Idaho must, per the state Constitution, be managed in such manner as will secure the maximum long term financial return to the trust beneficiaries. Endowment Land auction and purchase is subject to, including, but not limited to, the following Idaho Constitution and statutory references: 1. Idaho Constitution - Article IX, Sections 8 and Idaho Admissions Act - Section 5(a). 3. Idaho Code Title 58, Chapters 1 and 3, including, but not limited to, , , , , A and Submission of this application does not guarantee that the application will be approved or that the Endowment Land will be sold at auction. The State Board of Land Commissioners (Land Board) or IDL Director may determine that a sale would not be in the best interest of the endowments at any point prior to close of escrow. TRANSACTION COSTS BORNE BY APPLICANT: 1. Appraisal Fee: One Thousand Dollars ($1,000) payable to First American Title Company shall be paid by Applicant at the time of submission of this application. If there is a successful bidder other than Applicant, the Appraisal Fee shall be paid by the successful bidder and the Appraisal Fee paid by Applicant shall be refunded to Applicant. 2. Title Commitment Deposit: Two Thousand Dollars ($2,000) for Payette Lake lakefront lots, or Eight Hundred Dollars ($800) for Payette Lake upland lots or Priest Lake lots, payable to First American Title Company, shall be paid by Applicant at the time of submission of the application. IDL must obtain a title commitment in order to verify the status of title to the endowment land to be sold at auction. The title commitment shall be provided by First American Title Company ( Title Company ). If Applicant is the successful bidder and acquires a title policy from the Title Company, then the Title Commitment Deposit shall be applied towards the cost of the premium for the title policy. If for any reason the auction of the subject Endowment Land is rejected and no auction occurs, or if Applicant is the successful bidder and fails to purchase a title policy from the title company, then a cancellation fee shall be calculated in an amount equal to one-half (½) of the amount of what the premium would have been for the title policy. If any party other than Applicant is the successful bidder, then the successful bidder shall pay the required Title Commitment Deposit, and the Appraisal Fee paid by Applicant, which amounts shall be refunded to Applicant. 3. Administration Fee: At the closing of the Purchase and Sale Agreement for the Endowment Land, the successful bidder shall pay an Administration Fee of six percent (6%) of the successful bid at public auction for the Endowment Land. 4. Closing and Escrow fees shall be paid half by the successful bidder and half by IDL in accordance with the Purchase and Sale Agreement. TERMS UPON SUBMISSION OF APPLICATION: Once an Unleased Cottage Site Auction Application is submitted, IDL will review the application and attachments for completeness. Incomplete applications will be returned to Applicant. Applicants will be notified of completeness in writing. If an Applicant does not receive a notification of completeness within thirty (30) days, the application shall be deemed denied. Upon IDL s acceptance of a complete application, IDL will contract for an appraisal to be conducted. The appraiser shall determine market value for the Endowment Land pursuant to IDL s written appraisal instructions. IDL reserves the right to deny any application for any reason. 6 STATEMENT OF NON-COLLUSION (Applicant) The undersigned, as applicant for the auction of state lands to be offered for sale at public auction by the Idaho Department of Lands ( IDL ), hereby attests that the undersigned has not and shall not, nor has or shall anyone to the undersigned s knowledge on the undersigned s behalf, ever intimidate, hinder, prevent or attempt to intimidate, hinder or prevent, any person from: 1) filing an application to lease or to purchase any state lands or to enter any bid for the lease or purchase thereof; or, 2) attending or submitting any bid at any public auction held to lease or purchase any state lands, or any portion thereof. The undersigned has not and shall not offer, on the undersigned s own behalf or on behalf of any other person, firm, partnership or corporation, to accept, nor has nor shall the undersigned accept compensation of any type in exchange for the withdrawal of a bid; or for the withdrawal of an application to bid, lease, or purchase, any state-owned lands or timber, minerals, or other interest; or for foregoing a right to bid at any auction for the sale or lease of any state lands. The undersigned has not and shall not pay or offer to pay, on the undersigned s own behalf or on behalf of any other person, firm, partnership or corporation, compensation of any type in exchange for the withdrawal of a bid; or for the withdrawal of an application to bid, lease or purchase any state-owned lands or timber, minerals, or other interest; or to cause or attempt to cause another person, firm, partnership or corporation to forego a right to bid at any auction for the sale or lease of any state lands. The undersigned has not and shall not engage in any of the above-stated behaviors or activities over the course of this auction process or through the completion or closing of any disposal of state lands. The undersigned understands that a false statement by the undersigned in this statement or in any application to lease or bid on any auction to lease or purchase any state lands shall constitute a breach of any lease which the undersigned may have for any state lands as well as a breach of any purchase or acquisition of state lands that the undersigned has acquired or may acquire; and the undersigned understands that any false statement shall constitute a breach of any such lease subject to the immediate termination of any such lease of state lands; and, that any such breach may result in the nullification of any state lands purchased or acquired by the undersigned.
