1 MINUTES OF THE FERNLEY PLANNING COMMISSION MEETING April 10, 2002 The meeting was called to order by Chairperson Marty Hardie at 6:00 p.m. at the Fernley City Hall, 595 Silver Lace Blvd., Fernley, NV. Present were Planning Commissioners Bill Amerman, Bill Clegg,, Marty Hardie, Bert McCoy, and Nick Stiren. Also present were Mayor David Stix Jr., City Manager Gary Bacock, City Attorney Rebecca Harold, Community Development Director Peter Wysocki, Public Works Director Kurt Kramer, and Recording Secretary Kimberly Swanson. Planning Commissioners Danny Lunsford and Rodger Denn were absent. 1. Approval of Minutes for February 13, 2002 Planning Commissioner Bill Amerman stated he would abstain due to his absence on February 13, Bill Clegg MOVED TO APPROVE THE MINUTES AS PRESENTED FOR THE FEBRUARY 13, 2002 MEETING. Nick Stiren Seconded. Motion carried Bill Amerman abstained. 2. Public Comment (Issues discussed cannot be acted upon other than to place them on a future agenda.) There was no public input. 3. Planning Commission and staff concerns/reports. (No Action will be taken.) Pete Wysocki, Community Development Director, updated the board on the 3 planning items that were approved by the City Council as recommended by the Planning Commission. 4. Public Hearings Discussion and Possible Action. FPC 4/10/02 Page 1 of 7

Zoning Map Amendment ZMA (Provide recommendation to City Council) Applicant: Peggy Foley Owner: Peggy Foley Request: A zoning map amendment to change the zoning of a 12,600-square foot parcel from NR-2 (Multiple Residence Nonrural Residential, 8,000-square feet minimum) to C-2 (General Commercial). Location: 45 Locust Street APN Pete Wysocki, Community Development Director, addressed the board, recommending approval of the zone change based on the findings identified in the staff report. Peggy Foley, owner of the property, stated the property is planned for a strip mall. Nick Stiren MOVED TO RECOMMEND APPROVAL TO THE CITY COUNCIL OF THE ZONING MAP AMENDMENT BASED ON THE FINDINGS AND CONDITIONS PROVIDED IN THE STAFF REPORT. Bert McCoy Seconded. Motion carried B. Tentative Subdivision Map TSM (Provide recommendation to City Council) Applicant: Sierra Vista / Hawk Properties Owner: Wendal Lehman Request: A tentative subdivision map to subdivide an existing acre parcel zoned NR-3 (Non-Rural Residential, 9,000 minimum) into 93 singlefamily residential parcels, the smallest being 9,000 square feet. Location: North side of Cottonwood Lane, west of Jenny s Lane APN Pete Wysocki, Community Development Director, addressed the board recommending approval subject to the conditions listed in the staff report. Because access to the property is off of Cottonwood Lane, one of the conditions is the widening of that road. The other recommended condition was there should be no access from Cottonwood Lane into the single family parcels. Staff also recommended that the applicant participate in a prorated payment of fees for the improvements to the intersection of Cottonwood, 95A and Farm District Road. Carol Dodson, with Lumos and Associates, representating the applicants, stated that this project has very good utilization of the infrastructure which is readily available to the site. She reviewed the staff report and agreed with the findings and conditions. Bill Clegg MOVED TO RECOMMEND APPROVAL TO THE CITY COUNCIL OF THE TENTATIVE SUBDIVISION MAP TO DIVIDE THE EXISTING 27.6 ACRE FPC 4/10/02 Page 2 of 7
3 PARCELS INTO 95 SINGLE FAMILY RESIDENTIAL PARCELS, THE SMALLEST BEING 9,000 SQUARE FEET, BASED ON THE FINDINGS AND CONDITIONS PROVIDED IN THE STAFF REPORT. Bill Amerman seconded. Motion carried C. Tentative Subdivision Map - TSM (Provide recommendation to City Council) Applicant: CHRH Properties, Gary Hutchings Owner: Truckee Hills Ltd. ET AL Request: A tentative subdivision map to subdivide an existing acre parcel zoned NR-1 (Non-Rural Residential, 6,000 square feet minimum) into 307 parcels, the smallest being 6,000 square feet. Location: South of Inglewood Drive, east of Rolling Meadows Subdivision Lane APN Marty Hardie disclosed she is within the notification area. Pete Wysocki, Community Development Director, addressed the board. The applicant is proposing a park site along the south side of the project area where the detention basin is proposed. Staff had no issues with detention basins being used as park sites. However, staff had not received any details on the types of improvements that would be required to the basin. Therefore, staff recommended that a minimum one acre park site be provided. If the applicant designs the detention basin to a size that is feasible for a park, staff would then consider that for a park site. Staff also recommended the layout of the map is modified to connect the northwesterly culdesac to the northwest corner of the property. This would also provide the necessary easements for the water and sewer lines. Staff also recommended that a stub street be provided to Winnie s Lane. He suggested that wooden fences not be used along the rural residential parcels. Staff recommended that the Planning Commission recommend this project to the City Council for approval. Carol Dodson, with Lumos and Associates, representating the applicants, stated she has had meetings with some of the adjoining neighbors to work on some of the key issues. She stated the issues of the property owners were the security of the fences and a fair amount of room between their property and the new subdivision. Carol showed the Planning Commission the revised lot layout plan with the lots along the southern border being 9,000 square feet, long and narrow. She stated that the fencing preference of the homeowners was anything that could be framed and secured. She also met with property FPC 4/10/02 Page 3 of 7
4 owners on the north side who were concerned about the stability of a wood fence because of the sandy conditions. For this side of the subdivision she is suggesting a solid vinyl fence. She stated she tried to listen to all of the concerns and the developer has lost a considerable amount of lots in doing so. There are a few conditions she wanted to mention; 1A, which is the paved stub streets, the property owners were concerned about people getting through and causing property damage, that is one of the reasons that a pedestrian access way was not put in. The next condition was 1C, which is the highway 50A access. She requested waiting until the start of phase 2 before putting in the highway access. She also asked the Planning Commission to remove the sidewalks because of the industrial area. She also stated she would like to develop the detention basin for the park. Regarding condition #8, she would like to work with staff on nonwood alternatives for fencing. Danny Lunsford arrived at 7:10. Kurt Kramer, Public Works Director, stated he had a great concern about starting subdivision going through another subdivision with only one access. Bert McCoy stated access to Highway 50 should be constructed with phase 1. Bill Clegg stated that the Fire District would not sign off on the project without the highway 50 access. Tom Watson, resident on south side of project, stated he is worried about his property value dropping. He stated he left a message for Carol Dodson and she never returned his call. He thought a block wall would work best. He would like to see a 30 foot easement between his property and the new houses. Diana Lang, resident of Inglewood Dr., stated she purchased her property for retirement. She said the traffic is already bad and this subdivision would make it worse. She would like to see an 8 foot concrete block wall. She does not want kids climbing the fence and coming onto her property. She wants to see some sort of dust control while the construction is being done. Donya Herrera, resident of Winnie Lane stated the number of lots should be limited so there are not so many homes. She was also concerned about the increased traffic and the type of fencing. Joni Ellington, resident of Inglewood Dr., stated her concern was the fencing. She also stated that 5 to 6 homes are going to bump against her property. Steve Felton, resident of Inglewood, stated his concern was car accidents even when the turn lanes are constructed. Robert Paxton, resident of Jenny s Lane, stated the road to the highway should be constructed before the subdivision is built. Jim Kerr handed out minutes from a meeting FPC 4/10/02 Page 4 of 7
5 in 1998 on this project that was denied by the county. He stated he would like to see less density on the project, and 8 foot block wall, and 8 10 foot landscaped strip. He would like the project to start in the north east corner with the fence going up first. He also stated that covered trash bins when construction is being done is also a must. Theresa Wilson, resident of Winnie s Lane, thanked Carol Dodson for her efforts. She stated this subdivision is incompatible with her larger lot property. She asked the developer if they were going to compensate her for her lost property value. She also stated she wants masonry fence. Ed McCoy, resident of Inglewood Dr, stated he want to see a masonry fence and bigger lots. Carol Watson asked the developers to be sensitive to the homeowner s issues. She stated she would like to see one half acre lots on the property lines. She also does not want to lose the 30 foot access road. She also asked the developers for reimbursement for loss of property value. She stated she wants to see an 8 foot block wall. She also commented about Carol Dodson not returning her phone call. Carol Dodson apologized for not returning the phone calls but stated she did not get the messages. She stated that she is trying to address some of these issues with the improvements that are being done. She also said that they could re-phase to get the traffic to the highway sooner. As for the density, the developers are trying to keep is down by putting larger lots in. She stated she would work to fine tune emergency access. She stated if pedestrian access if important, she will work to put it in. Kurt Kramer stated he wants a roadway easement to put a road across the ditch for water and sewer lines. Carol said that could be incorporated into the plan. Theresa Wilson stated that if Winnie s Lane is stubbed she would like to see a fence until it is paved. Pete Wysocki stated that the applicants challenged Lyon County s denial in court, and the county lost, the court overturned the denial and the court approved the subdivision. He stated it is the job of the Planning Commission to make this project work, even if they needed to put additional conditions on it. He also informed the audience that the City Council would have the final vote regarding this issue on May 1, Nick Stiren MOVED TO RECOMMEND DENIAL DUE TO THE FACT THAT THERE WAS NO PLAN THAT ADDRESSED THE SAME ISSUES AS WHEN IT WAS DENIED BY THE COUNTY. Bert McCoy seconded. Motion failed Marty Hardie, Danny Lunsford, Bill Amerman, Bill Clegg opposed. Discussion continued. Danny Lunsford MOVED TO FPC 4/10/02 Page 5 of 7
6 RECOMMEND APPROVAL TO THE CITY COUNCIL PER THE STAFF REPORT INCLUDING THE RECOMMENDATIONS WITH THE FOLLOWING MODIFICATIONS; AN 8 FOOT BLOCK OR MASONARY WALL WITH AN 8 FOOT BUFFER ZONE OR SPACE ON THE OUTSIDE OF THE WALL ON THE NORTH AND SOUTH SIDES OF THE PROPERTY; THE ACCESS TO HIGHWAY 50 PRIOR TO PHASE 1; MOVE THE PARK TO THE CENTER OF THE PROJECT, NOT IN THE DETENTION BASIN; STUB WINNIE S LANE WITH A FENCE, NOT A GATE. Bill Clegg seconded. Motion carried Nick Stiren opposed. Ms. Hardie returned the chairman s gavel to Mr. Lunsford after this item. D. Special Use Permit - SUP (Provide recommendation to City Council) Applicant: Johns Manville International, Inc. Owner: Louisiana-Pacific Corporation Request: A special use permit to manufacture rigid plastic foam roof insulation products within an existing building on a parcel zoned M-1 (General Industrial). Location: 325 Industrial Drive (former LP building) APN Pete Wysocki addressed the board recommending approval to the City Council subject to the conditions listed in the staff report. Due to the hazardous and flammable material, the applicants are required to obtain approvals from NDEP. They are also required to prepare an emergency response plan. Steve Halterbaum, Group/Plant Manager, stated they are excited about moving to Fernley. The building will suit their needs for their West Coast distribution and manufacturing. Bill Clegg MOVED TO RECOMMEND APPROVAL TO THE CITY COUNCIL OF THE SPECIAL USE PERMIT TO MANFACTURE RIGID PLASTIC FOAM ROOF INSTALLATION PRODUCTS BASED ON THE FINDINGS AND CONDITIONS PROVIDED IN THE STAFF REPORT. 7 E. Modifications to Tentative Parcel Map TPM Applicant: Sierra Pacific Power Company Owner: Roger D. Puccinelli, Jay R. and Patricia J. Gore Request: To modify condition #4 and #5 (pertaining to roadway improvements) for a tentative parcel map (approved by the Fernley Planning Commission on December 12, 2001) dividing an existing acre parcel into two parcels, the smallest being 2.96 acres. Location: 1855 Hwy 95A (50A) APN Pete Wysocki, Community Development Director, addressed the board recommending approval. He stated staff supports the gravel road upgrade to a plate 3 standard, and relocation of the easement wherever NDOT would like to see it so Mr. Puccinelli is accommodated. He recommended the City retain a 50 foot easement for a future local road. Steve Rodolf, representative of Sierra Pacific Power Company, stated in the original condition #4, it was asked that the road is dedicated as a public roadway, but NDOT does not want a public roadway. He requested that this roadway not be dedicated. Bert McCoy MOVED TO APPROVED THE MODIFICATION OF THE TENTATIVE PARCEL MAP FOR SIERRA PACIFIC POWER COMPANY INCLUDING THE LANGUAGE THAT STATED THE RIGHT OF WAY BE 50 FOOT AND THE FLOATING EASEMENT TO BE DETERMINED BY THE CITY AND NDOT.
