The hearing was scheduled for October 13, S / FRANK R. RETZLER AND GWENDOLYN RETZLER / NW W5 / FIRST PARCEL OUT / COSY COVE AREA Revised Motion to explain that the application had been tabled pending further information regarding the undeveloped road allowance. Manager Rosson also mentioned that the application may be withdrawn. D / CONNECT ENERGY / DONALD JAMES MOORE AND SANDRA LEE MOORE / STORAGE SITE FOR FRAC SAND AND AGGREGATES / NW W5 / LITTLE SMOKY AREA Revised Motion to explain that the application had been tabled pending further information regarding proposed materials storage. Manager Rosson stated that Development Officer Leurebourg would be contacting the Landowner to find out if there was an agreement in place with Connect Energy. Manager Rosson explained that Township Road 702 required upgrade to Greenview standards prior to approval of the Subdivision application. Member Delorme entered the meeting at 9:06 a.m. Development Technician Soucy vacated the meeting at 9:06 a.m. Manager, Agricultural Services, Quentin Bochar, entered the meeting at 9:07 a.m. There was continued discussion regarding the road upgrade requirements for Subdivision application S Manager Rosson explained that after the application had been tabled pending further information at the September 13, 2017, Municipal Planning Commission meeting, the Landowner had applied to Greenview to upgrade the road to Greenview standards. She further stated that as the road upgrade was associated with a Subdivision application, it would be brought to Council for consideration. Concerns were raised regarding the length of time the process would entail to upgrade the road. Administration required further direction as to whether the upgrade would be the responsibility of Greenview or the Landowner. Members commented that there had been an existing road to the parcel; however, it had not been constructed to Greenview standards. Members

3 Page 3 asked if it would be possible to receive a report from Infrastructure and Planning as to the condition of the existing road. Manager Rosson reminded Members that it would be a decision of Council. MOTION: Moved by: MEMBER DAVE HAY That Municipal Planning Commission (MPC) recommend that Administration provide information as to the conditions of the existing road, as well as whether Greenview or the Developer is responsible for upgrade of the road for Subdivision application S to Council at the next Council meeting. Development Technician Soucy re-entered the meeting at 9:13 a.m. #4 DELEGATIONS #4.1 DELEGATION 4.0 DELEGATIONS 4.1 A / ALBERTA LIMITED / NW W6, PLAN , BLOCK 2, LOT 2 / RURAL COMMERCIAL (RC) DISTRICT TO INDUSTRIAL (I) DISTRICT / GROVEDALE AREA Development Officer Lemieux presented an overview of proposed Land Use Amendment application A The application proposed to rezone 5.43 hectares ± (13.42 acres) from Rural Commercial (RC) District to Industrial (I) District within NW W6, Plan , Block 2, Lot 2, in the Grovedale area, Ward 8. Development Officer Lemieux presented additional information as follows: The proposed rezoning would allow for the subsequent development of a trucking operation upon obtaining a development permit. Mr. Bruce Tattrie, A.L.S., Beairsto and Associates spoke as the Applicant. The Applicant stated that the Landowner would be selling the property to a purchaser, who had intended to utilize the parcel as a trucking operation. He added that there had been similar uses in adjacent parcels. However, he stated that the present Rural Commercial (RC) District zoning of the parcel had not been suitable for the proposed use. Municipal Planning Commission discussed the following: When Members asked if the Applicant had been satisfied with the lot, Mr. Tattrie responded that the layout and size of the lot had been adequate; however, the rezoning had been requested for the purchaser s intent of use. Manager Rosson advised that there had been drainage concerns that required addressing at the development stage. Further to that, it was asked whether the Applicant would work with the existing approaches, road and drainage. Mr. Tattrie replied that as it was a large parcel and had been

4 Page 4 proposed for industrial use, the Applicant would intend on submitting a site grading plan to Greenview, which would cover those issues. Members asked how the site would be accessed. Mr. Tattrie stated that the cul-de-sac on the east side of the parcel would provide the best turning radius and access to the parcel. Members questioned the gate station right-of-way plan at the north end of Lot 4. It was noted that the original intent had been to gate off the road at that point upon construction of the Public Services Building; however, when the Public Services Building was constructed elsewhere, the road had not been gated off. Mr. Tattrie stated that the gate station right-of-way plan could be discharged and a new one be registered. As well, the access requirements could be defined upon construction of the road at the development stage. Members agreed with rezoning the parcel as there had been a need for an industrial district in the Grovedale area. Therefore, Members asked Administration about rezoning the remainder of the parcels under the proposed Land Use Bylaw. Development Officer Lemieux stated that the proposed Land Use Bylaw would rezone this area from Rural Commercial (RC) District to Light Industrial (M-1) District. She added that a trucking operation would be classified as a discretionary use within Light Industrial (M-1) District; and that it was a discretionary use in Industrial (I) District under Greenview s current Land Use Bylaw. Chair Dale Smith advised Mr. Tattrie that Municipal Planning Commission would render a decision later in the meeting. 4.2 D / MUNICIPAL DISTRICT OF GREENVIEW NO. 16 / EXPLOSIVE STORAGE SITE; 8 FOOT FENCE / SW W5, PLAN , BLOCK 1, LOT 1 / VALLEYVIEW AREA Mr. Tattrie vacated the meeting at 9:34 a.m. Development Officer Leurebourg presented an overview of Development Permit application D The application was received on August 22, 2017, and had been endorsed by the Applicant and Landowner for a Type 9 Explosives Magazine Site within SW W5, Plan , Block 1, Lot 1, in the Valleyview area, Ward 3. Development Officer Leurebourg presented additional information as follows: The proposed development was considered a discretionary use within Agriculture (A) District and met the requirements of the Land Use Bylaw. The proposed development site was a hectare ± (40.07 acre) parcel owned by Greenview and would be utilized to accommodate a 4 Foot by 8

5 Page 5 Foot Type 9 Explosive Magazine with an 8 Foot Security Fence, which would be topped with barbed wire. The Magazine would house Fibre-gel or Geo-gel explosives and include a 24 hour monitoring system. The Fire Department would be made aware that it was a let burn building, which would allow the structure to burn in place. Three (3) key-holders with security certificates would have access to the site. As the site was within 800 metres of Highway 43, a Roadside Development Permit had been obtained. Mr. Quentin Bochar, Manager, Agricultural Services, spoke as the Applicant. The Applicant stated that the magazine would be located on a 20 metres by 20 metres area within the 40 acre parcel and placed on a skid approximately 30 inches off the ground. He explained that one (1) side of the magazine would house explosives and the other side would house charges. He added that federal standards for distances from a provincial highway and district roads had to be met; these included 270 metres from a provincial highway (Highway 43) and 180 metres from a district road (Range Road 223) and no variances would be granted. Municipal Planning Commission discussed the following: Members asked how the site would be accessed. Manager Bochar explained that the existing approach from Range Road 223 would be utilized. Members asked what the criteria had been for selecting this site. Manager Bochar explained that after researching all Greenview-owned properties, this site had met required distances, was not in close proximity to residential lands and was located in a fairly central area for Greenview s use. He added that the magazine would be located adjacent to the stockpile site; however, the fence line for the stockpile site could not have been used as a boundary as it fell short of the 270 metre requirement from the highway right-of-way at 222 metres. Although there was no concern about the location of the development, there was concern expressed about access and it was recommended that a new approach be constructed from the stockpile site rather than Range Road 223. It was suggested that an alternative to constructing an approach would be to access the magazine site through a gate at the southwest corner within the stockpile site. Members asked for clarification on the measurements of distances. Manager Bochar stated that placement of the magazine in the centre of the parcel would provide adequate space and would meet federal distance requirements. Members asked for details on the 24 hour monitoring system. Manager Bochar explained that it would register every opening of the door and whether it had been opened with the correct method. A battery system

6 Page 6 would be utilized, which would also alert users when the battery required replacement. Chair Dale Smith advised Manager Bochar that Municipal Planning Commission would render a decision later in the meeting. Manager Bochar vacated the meeting at 9:54 a.m. #5 LAND USE AMENDMENTS 5.0 LAND USE AMENDMENT APPLICATIONS 5.1 A / ALBERTA LIMITED / NW W6, PLAN , BLOCK 2, LOT 2 / RURAL COMMERCIAL (RC) DISTRICT TO INDUSTRIAL (I) DISTRICT / GROVEDALE AREA Development Officer Lemieux had previously presented an overview of proposed Land Use Amendment application A The application proposed to rezone 5.43 hectares ± (13.42 acres) from Rural Commercial (RC) District to Industrial (I) District within NW W6, Plan , Block 2, Lot 2, in the Grovedale area, Ward 8. No comments or questions were noted from Municipal Planning Commission. NW W6, PLAN , BLOCK 2, LOT 2 #6 SUBDIVISIONS MOTION: Moved by: MEMBER DALE GERVAIS That Municipal Planning Commission (MPC) recommend that Council APPROVE Land Use Amendment Application A to re-designate a 5.43 hectare ± (13.42 acre) parcel from Rural Commercial (RC) District to Industrial (I) District within NW W6, Plan , Block 2, Lot SUBDIVISION APPLICATIONS 6.1 S / TREVOR MILLER / NW W5 / FIRST PARCEL OUT / VALLEYVIEW AREA Development Officer Leurebourg presented an overview of proposed Subdivision application S The application was for a 1.55 hectare ± (3.83 acre) parcel within NW W5, in the Valleyview area, Ward 3. Member Bill Smith vacated the meeting at 9:55 a.m. Development Officer Leurebourg presented additional information as follows: The proposal would allow for future residential development on the existing vacant parcel.

7 Page 7 There were existing approaches to the proposed Subdivision and balance of the quarter from Range Road 230. Road widening of metres was required along Range Road 230 to the west of the quarter. This was due to the planned upgrades to the road, which would require a 40 metre right-of-way. Municipal water would not be available for this subdivision. Member Bill Smith re-entered the meeting at 9:56 a.m. Municipal Planning Commission discussed the following: Members asked for clarification on whether road widening of metres had been required for both sides of Range Road 230. Development Officer Leurebourg reiterated that road widening had been required on both sides of the road due to planned upgrades to the road, which would require a 40 metre right-of-way. Members asked for clarification on the parcel size as it had differed between the application and the sketch. Development Officer Leurebourg stated that the parcel size had been changed after discussion with the Landowner, who had preferred to decrease the size of the parcel. Members asked if comments had been received on the pipeline that crossed the property. Development Officer Leurebourg explained that Town of Valleyview owned the pipeline and had no concerns with the application. Member Urness vacated the meeting at 10:02 a.m. Given the size of the proposed parcel, the existing pipeline and Greenview setback requirements from property lines, Members questioned whether there would be an adequate building site on the parcel. As well, they discussed setback requirements from a pipeline. Manager Rosson stated that the setbacks from a pipeline would vary based on pressure and H2S content of the pipeline. Member Urness re-entered the meeting at 10:06 a.m. Though Town of Valleyview had no concerns with the application, Members recommended that information regarding setbacks from a pipeline right-ofway be obtained NW W5 MOTION: Moved by: MEMBER DALE GERVAIS That Municipal Planning Commission (MPC) TABLE Subdivision Application S within NW W5, pending further information regarding pipeline setbacks.

8 Page S / TREVOR MILLER / SW W5 / FIRST PARCEL OUT / VALLEYVIEW AREA Development Officer Leurebourg presented an overview of proposed Subdivision application S The application was for a 2.78 hectare ± (6.87 acre) parcel within SW W5, in the Valleyview area, Ward 3. Development Officer Leurebourg presented additional information as follows: The proposal would allow for future residential development and the existing vacant parcel. There were three (3) existing approaches to the balance of the quarter. Construction of an approach to the proposed subdivision was required to be installed by Greenview. Road widening of metres was required along Range Road 230 to the west of the quarter. This was due to the planned upgrades to the road, which would require a 40 metre right-of-way. TransCanada had provided comments regarding crossings of their right-ofway as well as nearby construction. While these comments would inform the applicant of requirements when developing on or near a right-of-way, TransCanada was contacted to ensure there had been no concerns with the location of the proposed subdivision. Municipal water would not be available for this subdivision. Municipal Planning Commission discussed the following: Members asked if the proposed parcel would adjoin the proposed parcel on NW W5. Development Officer Leurebourg stated that both Subdivision application S and S had been proposed as individual lots. It was noted that the TransCanada pipeline that crossed the property was being decommissioned; however, setbacks from pipelines were required. Development Officer Leurebourg stated that Alberta Energy Regulator legislated setback requirements. Concern that the Landowner may not be aware of the pipeline setback requirements and how it affected the development space had been expressed. Member Delorme vacated the meeting at 10:16 a.m. Though the TransCanada pipeline was being decommissioned, Members recommended that information about pipeline setbacks be obtained. Municipal Planning Commission discussed the following: Members agreed to revise Condition 3 to include minimum setback requirements of 130 metres (426 feet) from any other property line. As fencing conditions had been federally legislated, Members questioned the inclusion of Condition 9. Manager Rosson stated that Condition 9 had been included as an indication of minimum requirements in accordance with Greenview s Land Use Bylaw. The owner/developer must abide by all Provincial Legislation and Regulations that are applicable and relevant to the proposed Development. 2. The owner/developer must abide by all the applicable conditions in the Land Use Bylaw. 3. The owner/developer must meet the minimum setback requirements of: a) 270 metres (886 feet) from the right-of-way of Highway 43; b) 180 metres (590 feet) from the right-of-way of a district road; and c) 130 metres (426 feet) from any other property line. 4. The owner/developer must contact an accredited agency to obtain all required permit(s) in accordance with Alberta Municipal Affairs Safety Services Branch, including but not limited to the following: a) Building Permit; b) Fire Inspection Permit; and c) Safety Inspection Permit. 5. The owner/developer must contact the following government agencies to obtain all necessary approvals, including but not limited to the following: a) Alberta Transportation; b) Natural Resources Canada. 6. No further development or construction is allowed without an approved development permit from Greenview. 7. The owner/developer is responsible for weed control. Contact Greenview's Agricultural Fieldman at for further information. 8. Applicant is required to contact the Local Fire Department to ensure safe work practices are carried out. 9. The owner/developer must meet the following conditions: a) Fencing shall be construct on or behind the property line; b) Fencing shall be constructed so that the finished side face the road; c) Fencing shall not interfere with or impede traffic visibility; and d) Fencing must be properly maintained and in good repair at all times. 10. Emergency response plan is required where the development involves the storage or use of materials that are hazardous. 11 Page D / SHELL CANADA LIMITED / GAS PLANT / W5 / KAYBOB NORTH AREA Development Officer Leurebourg presented an overview of Development Permit application D The application was received on September 11, 2017, and had been endorsed by the Applicant and Landowner for a Gas Plant and 25 Foot Communication Tower within W5, in the Kaybob North area, Ward 2. Member Gervais vacated the meeting at 10:36 a.m. Development Officer Leurebourg presented additional information as follows: The proposed development was considered a discretionary use within Crown Land (CL) District and met the requirements of the Land Use Bylaw. The proposed development site was a 7.65 hectare ± (18.90 acre) lease and would be utilized as a sweet gas plant, which accommodated four (4) 2500 HP compressors, an office trailer and a 25 Foot Communication Tower. Upon site inspection, development had already begun. As a result, fees for commencing development without a valid Development Permit would be issued to the Applicant. No comments or questions were noted from Municipal Planning Commission W5 MOTION: Moved by: MEMBER TOM BURTON That Municipal Planning Commission (MPC) APPROVE Development Permit application D for a Gas Plant and 25 Foot Communication Tower within W5, as per the conditions of approval attached hereto as Schedule A : Subject to the following conditions: 1. Development Officer Dixon presented additional information as follows: The proposed development was considered a discretionary use within Crown Land (CL) District and met the requirements of the Land Use Bylaw. The proposed development site was a 3.13 hectare ± (7.72 acre) lease and had been utilized as an existing multi-well site. No comments or questions were noted from Municipal Planning Commission W5 MOTION: Moved by: MEMBER ROXIE RUTT That Municipal Planning Commission (MPC) APPROVE Development Permit application D for a 530 HP Compressor within W5, as per the conditions of approval attached hereto as Schedule A : Subject to the following conditions: 1. The purpose of this application was to allow Greenview to replace the existing structure with a larger building. The replacement structure would be constructed prior to removal of the existing water point. As a result of the limited 0.50 acre parcel size, setback variances were required and had been determined as follows: o from 41 metres to 18 ± metres from provincial Highway 676; o from 41 metres to 20 ± metres from the east boundary (Range Road 10); and o from 15 metres to 6.0 ± metres from the rear boundary. As the development had been adjacent to a provincial highway, a Roadside Development Permit would be required from Alberta Transportation.
