File no. D I oppose this request for rezoning the subject properties. The creation of secondary units will further increase the vehicle traffic on the street. There is no room for parking of extra vehicles at those addresses. These extra vehicles may lead to an increased danger for the current residents of the street. There is already a high volume of vehicles at Swanfield addresses aside and across from the described properties. This has led to a number of vehicles being parked straddling the side walk to avoid overnight parking tickets. This is impeding pedestrian traffic, forcing pedestrians to walk on the roadway. 3 Blumenberg,Catalina Subject: FW: Proposed Zoning By-Law Amendment City file #D From: Tom Potter February 0, 205 6:02 PM To: Gkotsis,Tony Subject: Proposed Zoning By-Law Amendment City file #D To whom it may concern, We are writting you in regards to the Proposed Zoning By-Law Amendment City file #D concerning Swanfield St. ), my spouse and I have concerns regarding the re- As residents of this neighbourhood ( zoning of said properties.. Parking The applicant is requesting a reduction in the required number of parking spaces from 3 parking spaces to 2. As stated in the notice received from the City of Kingston, parking will be on the existing paved area. It should be noted that the sidewalk cuts across the paved driveway of the above properties. As the number of legal dwellings is being increased we are questioning why the number of parking spaces would be decreased? Parking in our neighborhood is already at a premium. On street parking is challenging due to the number of multi-unit dwellings already located in our area. Furthermore, it is a consistent challenge for residents in our neighborhood to use the sidewalk. Residents in multi-unit dwellings tend to block the sidewalk with their vehicles. This poses many challenges for those with disabilities, those who walk dogs and the numerous young children who reside in the area. In fact, winter forces many of the above to walk on the street as the sidewalk is blocked with vehicles. Thus, creating undue danger and the possibility of harm. 2. Property Standards/ Owner Accountability As a densely populated subdivision consisting of single family homes, semi-detached homes and town homes along with multi-unit residential properties; there have been and continue to be, issues with Property Standards and Owner Accountability for some property owners who do not reside within the rental units. Including but not limited to excessive noise, failure to remove dog feces, garbage, sidewalks not being shoveled in the winter and grass not being cut in the summer, etc. 2

4 Although we appreciate Ms. Green's application to amend the zoning bylaw, we wonder what kind of accountability will be in place for the above-mentioned concerns? We appreciate the opportunity to provide feedback and express some of our concerns. Senior Planner City of Kingston By: e mail Re: 80 Bagot St.82 Bagot St. William Street Dear Ms. Lambert, Further to our meeting today I wish to submit the following comments re the application. My main concerns as previously stated are the Right of Way and fencing: I require written deeded confirmation that the mutual drive between our property will be stated to be in fact 2 feet (3.65m) wide in total and registered on title. I acknowledge that this will be paved right up to the edge of the proposed house. I acknowledge that it is stated that "no fencing will be built around the yard of the new house. This restriction must be registered on the title. The agreement for the complete removal of snow should be registered on title of either the house or the doctor's office property. Re "Parking" Page 84 Item (x) "a" uses the word "minimum" number to describe the parking spaces i.e. 3 for the professional office and for the dwelling unit. I suggest that the phrase " maximum 4 parking spaces in total" be added" I think these matters are minor to the developers and when I receive their confirmation everything should be in place to allow commencement of the work. 8 February 5, 205 Lindsay Lambert Senior Planner City of Kingston Dear Ms. Lambert, Re: Application for Zoning By-Law Amendment & Site Plan Control 80/82 Bagot Street & William Street Your File Nos.: D & D Please accept this letter in response to comments received from Mr. Peter Davy on February 4, 205 as they relate to the applications for zoning by-law amendment and site plan control at 80/82 Bagot Street and William Street. We have reviewed the comments and are confident that these have largely been addressed in site plan revisions and will be further addressed in the site plan agreement. In our original submission there was a strip of grass indicated between the proposed new building and Mr. Davy s property along the access lane. This strip of grass has been removed in subsequent submissions and the area between the buildings will be entirely paved with asphalt, from building wall to building wall. The width of this asphalt will be approximately 2 feet. There is nothing physically changing with respect to the existing right-of-way servicing the properties and it is our opinion that the burden on the right-of-way is not being increased through this proposal but is in fact being reduced. At present, the right-of-way accommodates traffic from 3 vehicles onto 80/82 Bagot Street. Following the proposal, the right-of-way will accommodate 4 vehicles onto 80/82/84 Bagot Street. The proponents are therefore going to use the right-of-way less than they are presently entitled to. No fence is proposed along the property boundary separating the parking area from Mr. Davy s property. The site plan indicates this and will be binding upon approval. A fence will not be permitted where it is not shown on the site plan. In regards to snow removal, the current proposal will see the removal of snow from the site. This will effectively be registered on title through inclusion as a condition of the site plan agreement. I trust this information is helpful. I moved last December to that vicinity and I noticed in the summer that the streets were really congested. There are a lot of small children in the neighborhood and my concern would be safety. I found in the summer that I was boxed in most times and had to be very careful when leaving my driveway. There were cars parked in front of my home and across the street so backing out or even driving out was very tight. As well although I am new to the neighborhood I don't notice any other rental properties on the crescent. They seem to be mostly single family dwellings, so a rental units surrounded by single family dwellings would be a bit out of place.
