Councilmembers who are members of the Space Coast Transportation Planning Organization (TPO) may discuss TPO issues which may subsequently be addressed by the TPO. If an individual decides to appeal any decision made by the City Council with respect to any matter considered at this meeting, a record of the proceedings will be required and the individual will need to ensure that a verbatim transcript of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based (FS ). Such person must provide a method for recording the proceedings verbatim. Any aggrieved or adversely affected person desiring to become a party in the quasi-judicial proceeding shall provide written notice to the city clerk which notice shall, at a minimum, set forth the aggrieved or affected person's name, address, and telephone number, indicate how the aggrieved or affected person qualifies as an aggrieved or affected person and indicate whether the aggrieved or affected person is in favor of or opposed to the requested quasi-judicial action. The required notice must be received by the clerk no later than five (5) business days at the close of business, which is 5 p.m., before the hearing. ( 59.03, Palm Bay Code of Ordinances). This meeting was properly noticed pursuant to law; the minutes are on file in the Office of the City Clerk, City Hall, Palm Bay, Florida. The meeting was called to order at the hour of 6:30 P.M. PUBLIC HEARING: 1. Discussion of tax rate - City Manager. Mr. Lynk stated the proposed tax millage rate was mills, which was a 3.78% increase over the rolled-back rate. He stated the reasons for the tax increase over the rolled-back rate were: 1) 0.50 mils dedicated to the road maintenance program; 2) increase in health insurance costs; and 3) increase in debt payments. 2. Millage rate and final budget for Fiscal Year The public hearing was opened. A resident spoke against the increase in the utility rates and the need for transparency in government. The public hearing was closed. Mayor Capote and Mr. Lynk addressed the resident s concerns and advised on how the meetings were noticed to the public. PUBLIC COMMENTS: A resident commended staff on the budget and asked that there be more involvement from the citizenry during the process.

A resident asked that long-range planning for the roads be included in the Capital Improvement Plan (CIP) without utilizing the special assessment process. A resident said that the CIP showed that Community Development Block Grant funds were being used for Palm Bay Colony. Mr. Lynk advised that those funds could not be used for the Palm Bay Colony project and would correct same.

Mr. Bailey addressed a resident s comment with regard to the millage rate and advised that the proposed rate was a decrease from the current millage rate, but was above the rollback rate. She provided information on the various programs offered by the Center and how the community could donate and support the Center. 2. Video presentation by Lennar Homes. Scott Glaubitz, BSE Consultants, presented a video regarding the new development known as Palm Vista PUD. The video showed an existing subdivision that would be similar to the Palm Vista PUD. The Greater Palm Bay Chamber of Commerce provided an update. PUBLIC HEARINGS: 1. Ordinance No , amending the City s Comprehensive Plan Future Land Use Map to change the designated use of property located at the southeast corner of U.S. Highway No. 1 and Anglers Drive from Commercial Use to Bayfront Mixed Use (0.34 acres)(case No. CP , Alfred Agarie), only one reading required. The Planning and Zoning Board recommended that the request be approved. The City Attorney read the ordinance in caption only. The public hearing was opened. The applicant presented the request to City Council. A resident asked the future plans on the property or if it was going to be sold. Mr. Buchanan explained that the difference between the current zoning and proposed zoning was that Bayfront Mixed Use allowed for a residential component to be added to the site. An adjacent property owner asked if his site would be affected by the zoning change. Mr. Agarie stated he had no intention of selling the property, but may consider having a residence on top of the business in the future. An adjacent property owner presented pictures of Mr. Agarie s property. He said the property had not been taken care of in years. Mr. Agarie said there had been tension with the adjacent property owners, but said that he would be taking care of the property. Mr. Holton asked if there would be any non-conforming issues with the land use change. Mr. Buchanan answered that as the building already existed, the rezoning would allow future uses to be applied for by the applicant, such as a different business license, rehabilitation of the building, etc. The public hearing was closed. Motion by Deputy Mayor Santiago, seconded by Mrs. Paccione, to adopt Ordinance No Mr. Holton expressed concern based on the pictures presented, but felt the applicant should be given the opportunity to correct the property. A property owner spoke against the request as the proposed zoning prohibited retail automotive fuel sales and automotive body repair or painting, which was currently ongoing at the site. Mr. Agarie said that his property, along with a few others, were grandfathered in, but any new businesses were prohibited from doing same. Mr. Buchanan asked that staff research two issues: a) existing business tax receipts issued to the property; and b) the condition of the property. He would present an opinion letter on both items at the next regular meeting. The public hearing was closed. Motion by Deputy Mayor Santiago seconded by Mr. Holton, to table the item to the next regular Council meeting. Request by Fred Boozer Jr. for a final subdivision to be known as Turkey Creek Commons on property located at the northeast corner of Clearmont Street and Mandarin Drive (0.90 acres)(case No. FS ). The Planning and Zoning Board recommended that the request be approved subject to the requirements and conditions of the Staff Report; Section , Tree Preservation and Removal Code; and Resolution The public hearing was opened. Lance Kotowski, representative for the applicant, presented the request to City Council. A resident of Turkey Creek Subdivision spoke against the request as he felt the property would be detrimental to the quality and character of Turkey Creek. He said that Mandarin Drive was already congested and the request would add to same. He asked if a privacy wall would be erected behind the proposed homes and if the existing eight (8) foot berm and fence would be maintained. Mr. Kotowski did not feel that a wall would be aesthetically pleasing and said that three (3) homes would not generate a significant amount of traffic. The public hearing was closed. Motion by Deputy Mayor Santiago, seconded by Mrs. Paccione, to approve the request, subject to the requirements and conditions of the Staff Report; Section , Tree Preservation and Removal Code; Resolution ; and that the applicant would match the minimum home square footage with the neighboring homeowners association in the subdivision. Request by West Pointe Babcock, LLC to amend the City s Comprehensive Plan Future Land Use Map to change the designated use of property located at the southeast corner of Babcock Street and Plantation Circle from Single Family Residential Use to Commercial Use (4.41 acres)(case No. CP )(RESCHEDULED TO RCM ).

PROCUREMENTS: Waiver of Proposal Process: * 1. Ready-Mix concrete and related items for fiscal year 2016 Public Works, Utilities and Parks and Recreation Departments ($75,000). Staff Recommendation: Waive the formal request for proposal process for concrete and related materials, and authorize staff to continue to obtain price quotations for concrete on a bi-annual basis. The item, considered under Consent Agenda, was approved as recommended by City staff. Contracts: 1. Other Agency contract, Cisco core switch, components and services (NASPO ValuePoint DataCom Florida contract) Communications and Information Technology Department (Empire Computing and Consulting Inc. - $150,000). Staff Recommendation: Authorize the purchase of the Cisco core switch, components, and services, utilizing the NASPO ValuePoint DataCom Florida contract, with Empire Computing and Consulting Inc., Daytona Beach, in the amount of $150,000. Motion by Deputy Mayor Santiago, seconded by Mrs. Paccione, to approve the purchase as requested. Staff Recommendation: Authorize utilization of the General Services Administration (GSA) IT Schedule, Group 70, No. GS-35F-1056V, and authorize the City Manager to execute the support services agreement with an Avaya authorized business partner, Carousel Industries of North America, Inc., Exeter, Rhode Island, for an estimated amount of $60,

A resident questioned the funding from the CDBG program and why a bond was needed. Mr. Lynk explained that CDBG were grant funds that could be utilized for capital improvement projects. There would be no one on site to address issues that may arise at the meeting. A resident did not agree with eliminating the language that specified the sections of Florida Statutes as it related to the powers of eminent domain, or the deletion of the super majority requirement. Mr. Lynk advised that the language had been amended to coincide with other municipalities in Brevard County as well as the Board of County Commissioners. Mr. Lannon explained that the ordinance did not allow the City Council to take properties whenever it desired. The ordinance would be utilized for public capital projects in which a property would be a necessity. The ordinance reverted to the Florida Statutes instead of adding more provisions at the municipal level that were already delegated by the Florida Legislature. The City currently has a master Agreement with Communications International, Inc. (CII) for 800 MHz Radio Maintenance which includes pricing schedules in accordance with Brevard County Contract pricing. The City s Agreement with CII is in effect through September 30, 2016; however, the staff annually requests Council authorization for the estimated maintenance needs each fiscal year based on the latest equipment count. The 800 MHz EDACS (Enhanced Digital Access Communication System) radio communication system supports the Brevard County emergency operations center and all of the emergency service agencies throughout the County. Brevard County EOC is the primary contract holder. All agencies are required to utilize their system. CII is the Sole Source supplier for the Harris EDACS (previously known as Macom) radio equipment that operates on their system. Harris has defined territories throughout the State of Florida for their business operations. CII, located in Vero Beach, is the Harris representative for this region. The Police Department and Fire Department equipment list and pricing schedules are attached. In addition to the annual equipment maintenance contracts, equipment and services that are not included in the annual maintenance agreement (i.e. batteries microphones, ear pieces, headsets), are provided by CII at 25% discount from list price and are purchased on an as needed basis. Local Housing Partnership: SHIP Program encourages building active partnerships between government, lenders, builders and developers, real estate professionals, advocates for low-income persons and community groups. 79 The Plan is intended to increase the availability of affordable residential units by combining local resources and cost saving measures into a local housing partnership and using public and private funds to reduce the cost of housing. SHIP funds may be leveraged with or used to supplement other Florida Housing Finance Corporation programs and to provide local match to obtain federal housing grants or programs. Strategies within the LHAP may also be leveraged or combined with other housing strategies in order to assist income eligible households. G. Public Input: Public input was solicited through face to face meetings with housing providers, social service providers and local lenders and neighborhood associations. Public input was solicited through the local newspaper in the advertising of the Local Housing Assistance Plan and the Notice of Funding Availability. H. Advertising and Outreach: The City shall advertise the notice of funding availability in a newspaper of general circulation and periodicals serving ethnic and diverse neighborhoods, at least 30 days before the beginning of the application period. If no funding is available due to a waiting list, no notice of funding availability is required. I. Discrimination: In accordance with the provisions of ss , it is unlawful to discriminate on the basis of race, creed, religion, color, age, sex, marital status, familial status, national origin, or handicap in the award application process for eligible housing. J. Support Services and Counseling: Support services are available from various sources. Available support services may include but are not limited to: Homeownership Counseling (Pre and Post), Credit Counseling, Tenant Counseling and Transportation. Case Management to include, but not limited to the coordination of funding resources, taxes, insurance, mortgages, debris clearing, temporary housing and mental counseling. K. Purchase Price Limits: Purchase Price Limits: The sales price or value of new or existing eligible housing may not exceed 90% of the average area purchase price in the statistical area in which the eligible housing is located. Such average area purchase price may be that calculated for any 12-month period beginning not earlier than the fourth calendar year prior to the year in which the award occurs. The sales price of new and existing units, which can be - 4 -

80 lower but may not exceed 90% of the median area purchase price established by the U.S. Treasury Department or as described above. L. Income Limits, Rent Limits and Affordability: The income and rent limits used in the SHIP Program are updated annually from the Department of Housing and Urban Development and distributed by Florida Housing Finance Corporation. Affordable means that monthly rents or mortgage payments including taxes and insurance do not exceed 30 percent of that amount which represents the percentage of the median annual gross income for the households as indicated in Sections , F.S. However it is not the intent to limit an individual household s ability to devote more than 30% of its income for housing, and housing for which a household devotes more than 30% of its income shall be deemed affordable if the first institutional mortgage lender is satisfied that the household can afford mortgage payments in excess of the 30% benchmark and in the case of rental housing does not exceed those rental limits adjusted for bedroom size. M. Welfare Transition Program: Should an eligible sponsor be used, the City has developed a ranking system and selection criteria for applications for Awards to eligible sponsors, which includes a description that demonstrates how eligible sponsors that employed personnel from the Welfare Transition Program will be given preference in the selection process. N. Monitoring and First Right of Refusal: In the case of rental housing, the staff or entity that has administrative authority for implementing the local housing assistance plan assisting rental developments shall annually monitor and determine tenant eligibility or, to the extent another governmental entity provides the same monitoring and determination, a municipality, county or local housing financing authority may rely on such monitoring and determination of tenant eligibility. However, any loan or grant in the original amount of $3,000 or less shall not be subject to these annual monitoring and determination of tenant eligibility requirements. Tenant eligibility will be monitored for at least annually for 15 years or the term of assistance which ever is longer unless as specified above. Eligible sponsors that offer rental housing for sale before 15 years or that have - 5 -

81 remaining mortgages funded under this program must give a first right of refusal to eligible nonprofit organizations for purchase at the current market value for continued occupancy by eligible persons. O. Administrative Budget: A detailed listing including, a line-item budget of proposed Administrative Expenditures is attached as Exhibit A. These are presented on an annual basis for each State fiscal year submitted. The City of Palm Bay finds that the monies deposited in the local housing assistance trust fund shall be used to administer and implement the local housing assistance plan. (The City may not exceed the 5 percent limitation on administrative costs, unless its governing body finds, by resolution, that 5 percent of the local housing distribution plus 5 percent of program income is insufficient to adequately pay the necessary costs of administering the local housing assistance plan. The cost of administering the program may not exceed 10 percent of the local housing distribution plus 5% of program income deposited into the trust fund, except that small counties, as defined in s (17), and eligible municipalities receiving a local housing distribution of up to $350,000 may use up to 10 percent of program income for administrative costs.) The City of Palm Bay has adopted the above findings in the attached resolution, Exhibit E. P. Program Administration: Administration of the LHAP is the responsibility of the City of Palm Bay. Should a third party entity or consultant contract for all or part of the administrative or other functions of the program, the City shall provide in detail the duties, qualifications and selection criteria involved. Q. Definition of Essential Personnel: Essential personnel is defined as, but not limited to: government personnel, police officers, fire fighters, education personnel, or health care institution or any building trade personnel, as well as financial and hospitality personnel. R. Reduction of Long Term Costs (Green Building): The City of Palm Bay has approved Green Rehab Standards for rehabilitation of existing residential housing. These standards include us of ENERGY STAR windows, doors, appliances, roofing products, hot water heaters, HVAC systems and lighting. Also included are standards relating to water conservation, hurricane strengthening measures such as shutters and garage door improvements, and general sustainability measures such as use of low- or no-voc paints and adhesives

82 II. LHAP HOUSING STRATEGIES: A. Down payment Assistance Program with Rehabilitation- $200,000 a. Summary of the Strategy: Thirty Ten (30) (10) year, zero percent loans will be issued to extremely low, very low, low-income and moderate income persons (up to 120% AMI) households seeking to purchase homes within the city limits of Palm Bay. The strategy is to assist persons who have not owned a home in the past three (3) years or have lost a home as a result of a disaster or emergency. In addition, all applicants are required to complete a First Time Homebuyer Counseling and Training. The amount of the loan is intended to reduce the monthly housing expense to no more than thirty percent (30%) of the gross monthly income for a household s median income group, as it provides the initial up-front cash required for down payment/closing costs. In addition to the down payment loan, the applicant may receive up to $10,000 for necessary property repairs which are included in the maximum amount of assistance. Recipient Selection Criteria: First come first ready. In the case of a natural disaster, priority will be given to displaced families. g. Sponsor Selection Criteria: This strategy includes the administration and implementation through a partnership with an outside eligible non-profit sponsor. The eligible sponsor must demonstrate the ability to administer this strategy at a cost savings relative to existing staff time and expenses. Should the City decide to select a non-profit sponsor to carry out any or all of this strategy, the City procurement procedures will apply. Sponsorship criteria shall include, but not limited to: Demonstrate the capacity and experience to carry out the strategy - 7 -

83 Demonstrate the primary purpose of the organization is to provide the necessary work under this strategy, and Sponsors with employed personnel from the Welfare Transition Program will be given priority The agreement with the eligible sponsor may be renewed annually at the sole discretion of the City of Palm Bay provided that the City determines that the eligible sponsor performs all its duties and obligations to the satisfaction of the City. Renewal is also conditioned upon renewed funding and budgeting for the SHIP and HOME programs by the City Council of the City of Palm Bay. Record keeping for client information will be in accordance with program rules and regulations governing the SHIP and HOME programs. The eligible sponsor shall assume all responsibilities for closing and for the recordation of all documents. The eligible sponsor shall maintain all client information as required by program regulations of the SHIP and HOME programs. Mobile homes are not considered eligible housing under SHIP. h. Additional Information: This strategy is for the purchase of existing homes as well as the construction of new homes. The sales price or value of new or existing eligible housing may not exceed 90% of the median area purchase price. There is minimum contribution required on behalf of the applicant. Those ELI and VLI applicants must contribute $750; LI applicants must contribute $1,250 and MI applicants must contribute $2,000. All applicants must complete a firsttime homebuyer class. Should an applicant default of the loan the full amount of the loan will be owed to the City of Palm Bay. in addition to a pro rated share of the difference between the sale price and the initial cost of the home at the time assistance was provided. 84 This program will also assist eligible homeowners with the cost associated with reconstruction when it has been determined that it is not economically feasible to rehabilitate the unit as determined by the City. The maximum amount of assistance an eligible applicant can receive under reconstruction will not exceed $50,000. b. Fiscal Years Covered: ; and c. Terms, Recapture and Default: There will be a sliding scale for the repayment of loans issued under this strategy. Families between % of the median income will be required to pay back the entire loan at 5% with a maximum of 15 years. Families between 70-80% of the median income will be required to pay back the first $25,000 at 5% with a maximum of 15 years. Families between 50-70% of the median income will pay back 75% of the first $25,000 at 5% with a maximum of 15 years. Assistance will be available to both insured and uninsured homeowners for payment of insurance premiums, temporary relocation vouchers and non-insured rehabilitation costs. b. Fiscal Years Covered: ; and c. Income Categories to be served: ELI; VLI; LI and MI d. Maximum award is noted on the Housing Delivery Goals Chart: $50,000 e. Sponsor Selection Criteria: The strategy will be administered by the City of Palm Bay s Housing and Neighborhood Development Services (HANDS) Division, and will be implemented only in the event of a Federal, State, or Local declared natural disaster as declared by Executive Order. h. Additional Information: The house must have been owned and was the primary residence at the time of the disaster. Repairs are limited to only damages incurred from the natural disaster. The word of the City of Palm Bay s Housing Rehabilitation Specialist and/or the City s Building Official will be final in determining the work. This strategy is listed as unfunded. The strategy will be implemented in the event of a disaster. Funds will come from another strategy with unencumbered funds. Assistance will only be provided for those repairs not covered by insurance, or for those families not able to pay its insurance deductible. Voucher assistance may be provided up to $3,000 for income-eligible families that are homeless as a result the home being uninhabitable or condemned. This voucher may be used to cover temporary rental or hotel room only expenses for a period not to extend one-month or $3,000 whichever is greater. This assistance may also be made available to families unable to remain in their home during the time of repairs. The voucher will be paid directly to the temporary housing provider. Assistance for relocation and temporary rental assistance will only be provided during the term of the issued Executive Order

88 Insurance deductible assistance in an amount not to exceed $1,000 will be awarded to income-eligible families that can demonstrate the ability to not have sufficient funds to cover the deductible. Construction assistance may not exceed $50,000 deferred over ten (10) years forgiven at the rate of ten percent (10%) each year. Repairs to homes may include but not limited to the following: purchase of emergency supplies for eligible households to weatherproof damaged homes; interim repairs to avoid future damage; tree and debris removal required to make individual housing units habitable; and post-disaster assistance for non-insured repairs. However, the standard practice of the contractor selection process may be waived. Other construction procedures of the Owner Occupied Rehab Strategy will be followed. Funds can be leveraged with other sources of funds including FEMA, SBA, insurance coverage, etc. No assistance will be provided unless attempts to recover damage expenses have been made through applicable sources. Administration of this strategy will be in accordance with SHIP Rules and Regulations and subsequent Emergency Rules. G. Owner Occupied Emergency Repairs- a. Summary of the Strategy: SHIP funds will be used to provide assistance to owner-occupied households that are at or below the very-low income (VLI) level (50% of the area s median income) to make emergency repairs. The maximum award for this strategy is $10,000. b. Fiscal Years Covered: ; and c. Income Categories to be served: ELI and VLI d. Maximum award is noted on the Housing Delivery Goals Charts: $10,000* *The City Manager may approve exceeding this maximum, on a case by case basis, if conditions so warrant as recommended by the HANDS staff. e. Terms, Recapture and Default: Assistance will be in the form of a five year, 0% interest, loan, completely forgiven after five years. Prior to any processing of the application, the emergency conditions must be verified by HANDS staff. Following verification, the application, certification and required work will proceed as expeditiously as practicable to resolve the emergency. g. Sponsor Selection Criteria: Strategy to be administered by the City of Palm Bay s Housing and Neighborhood Development Services Division. h. Additional Information: Emergency repairs will be limited to the minimum necessary to resolve the immediate threat to the homeowner. An emergency repair is the minimum necessary to correct a verified safety or health hazard. This is not a rehabilitation strategy, it is limited to making emergency repairs. Eligible activities include, but are not limited to: roof leaks, HVAC, plumbing, septic system, potable water wells, electrical and other similar items. It does not include replacement of appliances, new construction, expansions, additions or other similar activities. Expedited Permitting Permits, as defined in s (7) and (8) for affordable housing projects, are expedited to a greater degree than other projects. The City of Palm Bay clearly identifies affordable housing projects through coordination of the builder/developer and the HANDS Division. A letter is issued from the HANDS Division to the City s Building Division, which identifies the project as affordable and specifically requests expedited processing and issuance of building permits. The Building Division has pledged that all permit applications that are identified in this manner will receive expedited processing and issuance. In addition, the City s Growth Management Department has identified a dedicated staff person responsible for coordination of expedited site and plan reviews with regard to planning and zoning issues for affordable housing projects. B. Ongoing Review Process An ongoing process for review of local policies, ordinances, regulations and plan provisions that increase the cost of housing prior to their adoption. a. Established policy and procedures: The Community Development Advisory Board acts in the capacity of a local affordable housing task group (formerly, the Local Affordable Housing Committee) will meet on an as needed basis to discuss updates on current SHIP strategies and issues which may affect affordable housing. In addition, the Board has been given the additional responsibility for review of policies, ordinance, regulations, or plan provisions which could have a significant impact on the continued production of affordable housing units. By June 30, 2008, the existing Board will be expanded to fulfill the newly established requirements of an affordable housing committee

General Fund Cash & Investments at 8/31/15 totaled $7,434, From its primary General Fund revenue source, the City has received through August 31st, $22.9 million or 98% of the budgeted Ad Valorem Taxes for FY 15. Ad Valorem Taxes budgeted for FY 15 is $23.3 million. An additional $94, in delinquent ad valorem tax revenue was received through August 31st. At the end of August 2015, General Fund s Fund Balance was $6,721,185.00, $1.4 million or 13% above the minimum required fund balance. Road Maintenance Fund In FY15, the equivalent of.25 mils of current year property taxes is to be transferred from General Fund to the Road Maintenance Fund, along with any property sales proceeds. With a recovering economy and most of the City s revenues derived from ad valorem taxes, the revenue budget is essential for existing and critical City services. The City is conservative in budgeting revenues to account for the current economic condition. 3

The majority of the Fire Protection Service Charges are billed annually in November. Meter Installation Fees are recorded at 131% of the budgeted amount. The Utility Lien Costs are recorded at 325% of the budgeted amount. Operating Interest Income is recorded at 66% at this time. The interest for Palm Bay Estates Loan ($23,742) was recorded in June Excluding Fund Balance, the total FY15 Operating Revenue is recorded at 86.17% of the budgeted amount compared to FY14 which was at 84.24%. Water Connection Fees are recorded at 183% of the budgeted amount, and Sewer Connection Fees are recorded at 394% of the budgeted amount. Water MLEs are recorded at 272% of the budgeted amount, and Sewer MLEs are recorded at 426% of the budgeted amount. 9
