V2A 5A9 P (250) E: development@penticton.ca DEVELOPMENT PERMITS IN GENERAL: Development Permits allow the municipality to manage the type of development that occurs in specific areas of the city. A set of Development Permit Area Guidelines apply in each area where a Development Permit is required. These guidelines are listed in the city s Official Community Plan and are the basis for staff s analysis of the application. Once a Development Permit is issued, the permit is registered on the title of the property. Development Permits are valid for a two years. If a project is not substantially started within that time period a new application will be required. PRIOR TO APPLICATION: It is the applicant s responsibility to know what permits are required for their development and make all applicable applications. It is also the responsibility of the applicant to know of any special conditions may exist on the subject property. For applications with identified hazards or environmental considerations, additional information is usually required. City staff are available to provide basic background information on any properties in the city. More detailed information, such as geotechnical data or servicing requirements is the requirement of the applicant and their consulting professionals. Staff suggest that prospective applicants schedule a pre-application meeting to discuss their application prior to detailed plans being prepared. 1 2 SUBMIT APPLICATION Only complete applications will be accepted. Once the application is deemed complete and the application fee has been submitted, the application will be assigned to a Planner for review. REFERRAL PERIOD All development permit applications are referred to the Technical Planning Committee and external agencies as required. The TPC members and outside agencies are given the opportunity to comment on the application to identify any issues that may come up as part of the development process. 3 COMPREHENSIVE REVIEW AND APPLICANT CONSULTATION Once the file manager has received comments from the Technical Planning Committee and any external agencies, a more comprehensive review of the project is undertaken. The file manager will correspond with the applicant to address any outstanding issues. The goal of this process is to make the project conform to city standards and the development permit guidelines. The applicant may be required to upgrade drawings and re-work the application to address staff s concerns. START WEEKS 1 2 WEEKS DECISION PROCESS Once an application is in conformance with the development permit guidelines, the file manager will make a recommendation for the Development Officer or Council to support the application or support the application with conditions. Typical conditions would be the registration of any easements or covenants or the payment of landscape securities. For larger applications, a report is prepared for Council s consideration. In those cases, Council is the decision making body. For smaller development permit applications, the City s Development Officer is the decision maker and for those applications, the file manager would prepare briefing notes outlining a recommendation for the Development Officer to consider. 5 ISSUANCE AND REGISTRATION If approval of the development permit is subject to any conditions, the conditions must be fulfilled prior to the issuance of the permit. Once the conditions are fulfilled, the permit is prepared and issued to the applicant and is registered on the title of the subject property at the Land Title Office. Once this process is complete, the applicant may apply for the necessary Building approvals to begin the development. WEEKS 4 8 PLEASE NOTE: Processing times vary depending on the complexity of the project and the volume of applications being considered by the Department. The above noted timelines are a rough guide. Partial refunds on applications are given if an application is retracted prior to Council consideration or final consideration.

They are completed and submitted when potentially contaminated sites are being decommissioned, are in foreclosure proceedings, are subject to local government applications and/or permits, and are being sold. The Site Profile Form is provided in Schedule 1 of the Contaminated Sites Regulation. Schedule 2 lists the industrial and commercial activities triggering site profile submission to the ministry. 10 Introduction SCHEDULE 1 Site Profile Version 4.0 Under section 40 of the Environmental Management Act, a person who knows or reasonably should know that a site has been used or is used for industrial or commercial purposes or activities must in certain circumstances provide a site profile. Schedule 2 of the Contaminated Sites Regulation sets out the types of industrial or commercial purposes or activities to which site profile requirements apply. If section 40 of the Environmental Management Act applies to you and you know or reasonably should know that the site has been used or is used for one of the purposes or activities found in Schedule 2 of the Contaminated Sites Regulation, you may be required to complete the attached site profile. Notes/Instructions: Persons preparing a site profile must complete Section I, II and III, answer all questions in sections IV through IX, and sign section XI. If the site profile is not satisfactorily completed, it will not be processed under the Environmental Management Act and the Contaminated Sites Regulation. Failure to complete the site profile satisfactorily may result in delays in approval of relevant applications and in the postponement of decisions respecting the property. The person completing this site profile is responsible for the accuracy of the answers. Questions must be answered to the best of your knowledge. Section 27 (1) of the Freedom of Information and Protection of Privacy Act requires that provision of personal information concerning an individual must be authorized by that individual. Persons completing the site profile on behalf of the site owner must be authorized by the site owner. One (1) site profile may be completed for a site comprised of more than one titled or untitled parcel, but individual parcels must be identified. The latitude and longitude (accurate to 0.5 of a second using North American Datum established in 1983) of the centre of the site must be provided. Also, please attach an accurate map, containing latitude, longitude and datum references, which shows the boundaries of the site in question. Please use the largest scale map available. If the property is legally surveyed, titled and registered, then all PID numbers (Parcel IDentifiers Land Title Registry system) must be provided for each parcel as well as the appropriate legal description. If the property is untitled Crown land (no PID number), then the appropriate PIN numbers (Parcel Identification Numbers Crown Land registry system) for each parcel with the appropriate land description should be supplied. If available, the Crown Land File Number for the site should also be supplied. Anything submitted in relation to this site profile will become part of the public record and may be made available to the public through the Site Registry as established under the Environmental Management Act. Under section 43 of the Environmental Management Act, corporate and personal information contained in the site profile may be made available to the public through the Site Registry.
