2 ZONING BOARD OF APPEALS ACTION: Commissioner Jester moved, seconded by Commissioner Perl, that the Zoning Board of Appeals recommends approval to the Village Board of Trustees, by a 4-0 vote, of Variations in the case of Z , 155 Harlem Avenue, for the applicant, Illinois Tool Works, from the provisions Sections (4)(b) of the Code in accordance with the following: 1. Installation of thirty-one (31) ground signs instead of two (2) ground signs. 2. All light fixtures shall be installed in substantial accordance with the plans prepared by ER2 Image Group dated 09/23/2015 as submitted and consistent with the testimony and discussion provided during consideration of the petition by the Zoning Board of Appeals and Appearance Commission. 3. The proposed site improvements shall be subject to additional review and approval by the Appearance Commission, and Board of Trustees. ZONING BOARD OF APPEALS DISCUSSION: Staff summarized the applicant s proposal, the applicable signage requirements, and the previous Appearance Commission review related to the proposed signage exhibits. Illinois Tool Works moved into the previous Kraft campus in 2015 which has approximately 40.0 acres in Glenview and includes three entrances off of Harlem Avenue, Golf Road, and Waukegan Road. The proposed signs are similar to the signage Kraft had when they occupied the campus. The existing directional ground signs remained in place and the new ground signs were designed to fit in with the existing color scheme. The four new ground signs proposed by ITW are identification signs for ITW. The Zoning Board of Appeals questioned the placement of the sign at the Waukegan Road entrance. The applicant explained they were replacing the sign at that location because of poor placement at the previous signage installation. The Zoning Board asked whether additional verbiage was needed on the Golf Road frontage sign to indicate where visitors should go for the visitor entrance. The applicant indicated that ITW did not want additional verbiage on the sign. The Zoning Board questioned whether any other identification signage was proposed for the Golf Road frontage of the property and the applicant stated no other signage would be proposed. There were no additional questions from the Zoning Board and there were no questions or comments from the public. APPEARANCE COMMISSION DISCUSSION: The Appearance Commission reviewed the proposed signage for the site and the installation locations and approved the signage exhibits on November 11, The Commission verified that landscaping would be provided around the sign installed at the Golf Road entrance. The Appearance Commission had no other substantial comments and approved the signage exhibits as proposed pending the required zoning variation. ATTACHMENTS: 1. 7 Project Summary BACKGROUND: The applicant is requesting approval of four (4) new ground signs in addition to the existing twentyseven (27) for ITW at 155 Harlem Avenue. The proposed signage is intended to serve as identification signage for the business and as additional way-finding signage for visitors and employees. The campus has twenty-seven (27) existing directional and informational signs on site. No changes are proposed for the twenty-seven (27) existing signs. All existing signage includes a dark bronze finish with panel and post construction. The applicant has included a site plan showing where the existing signage is located. The proposed signs include the following: Harlem Avenue entry gate signs Panel with inch ITW lettering mounted to left side existing corten steel gate and a panel with 6.0-inch address on the right side. Monument sign in front of visitor entrance in vehicle turn around median 15.0-foot by 5.0-foot cabinet with 58.8-inch aluminum lettering externally illuminated by flood lights. Golf Road post and panel sign 3.0-foot by 2.5-feet aluminum panel with black vinyl ITW Employee Entrance Only lettering. Waukegan Road post and panel sign foot by 4.0-foot aluminum panel with black vinyl ITW, 150 Waukegan Road, Employee/delivery entrance only, Visitor entrance at 155 Harlem Avenue lettering. Panel to be mounted in front of guard shack. APPEARANCE COMMISSION SUMMARY: The Appearance Commission reviewed the proposed signage on November 11, The Appearance Commission reviewed each sign individually. The Commission noted that the signage on the Harlem Avenue frontage including both the signage on the entry gate and the larger monument sign in the vehicle turn-around area were appropriate based on the size of the building. The applicant stated they tried to keep a similar appearance of signage throughout the site as the gate signage also had raised letters on a backer panel. The Commission applauded the proposed ground sign landscaping to be installed with the monument sign. The Commission understood the necessity for the two (2) proposed post and panel signs off of the Waukegan Road and Golf Road entrances to direct visitors and delivery drivers to the correct entrance. Landscaping or sod in the island where the post and panel sign off of Golf Road is to be located was requested. The Commission questioned the size of the lettering on the guard shack but ultimately decided it was appropriate since it was the only identification signage on the eastern property line. The Commission granted a waiver to allow the lone wall sign proposed for the south façade of the western building to be mounted at the rooftop. Based on viewing pictures from Golf Road it was deemed that it would not have an impact on surrounding property owners. 7

8 ORDINANCE REQUIREMENTS: The following sections outline current ordinance requirements as these would be applied to the existing and proposed conditions. Maximum Number of Ground Signs in the I-1 Limited Commercial District: Per Sections of the Municipal Code and as applied to the subject property, the maximum number of ground signs upon the subject property is two (2) signs. The applicant requests approval of a variation to allow for the installation of the four (4) additional signs for a total of thirty-one (31) ground signs. Directional and informational signs without corporate copy 2.0 square feet or less do not count into the number of ground signs on the property. The applicant s directional and informational signs are all greater than 2.0 square feet, thus are included in the total number of thirty-one (31) ground signs. Other Bulk Regulations: The proposed signage would be in compliance with all other design and bulk requirements of the zoning ordinance. Other Requirements: The proposed improvements shall be subject to additional review by the Village Board of Trustees. The Appearance Commission previously reviewed the proposed signage design at their regular meeting on November 11, An excerpt from the meeting minutes including the Appearance Commission s consideration of the proposal is attached to this report. If the Zoning Board of Appeals may require changes to the area, height, or design of the signs, additional Appearance Commission review may be required. 8

9 Zoning Board of Appeals Review ZONING BOARD JURISDICTION & PURPOSE: The Zoning Board is vested with the authority to hear, and make a final determination regarding applications for residential variances subject to the standards set forth in Section of the Municipal Code. The Zoning Board of Appeals shall identify findings of fact based upon the standards prescribed whether the application of regulations of the zoning ordinance will create a practical difficulty or hardship for the owner, lessee, or occupant of land, buildings, or structures. KEY VARIATION STANDARD COMMENTS: Staff comments after evaluating the wide range of issues considered by the Zoning Board of Appeals, including but not limited to the following: Whether there exists a legal hardship of the property as distinguished from an inconvenience Whether the alleged hardship may be self-imposed Whether a.) the property; and/or b.) the application of the ordinance to the situation is unique Compatibility of the resulting conditions with other properties of the same zoning designation Demonstration of how other available options are not viable, regardless of economic impact Mitigation of impact(s) upon properties in the vicinity Staff Comments: The existing signage is for the benefit of visitors to the site to aid in wayfinding through the interior of the site. The proposed signage is to identify the tenant of the business from the main roads around the property and also identify where visitors should enter the site since only one entrance is open to the public. Many of the existing signs would be excluded from the total number of ground signs for the site if they were less than 2.0 square feet in area. Since they exceed that amount, even speed limit signs are included in the total number of ground signs. No changes are proposed to the existing directional and informational post and panel signs on site. POTENTIAL NEIGHBORHOOD IMPACTS: The proposed signage is not expected to have any negative impacts on surrounding property owners. 9

12 VARIATION STANDARDS: 1.) The Zoning Board of Appeals shall not vary the regulations of Chapter 98 of the Municipal Code unless it shall make a finding of fact based upon the evidence as presented to it in each specific case that the: a. Particular physical surroundings shape or topographical condition of the specific property involved would result in a practical difficulty or hardship upon or for the owner, lessee or occupant, as distinguished from a mere inconvenience, if the strict letter of the regulation were carried out. b. Conditions upon which the petition for a variation is based are unique and would not be generally applicable to other property within the same zoning classification. c. Alleged difficulty or hardship has not been created by any person presently having an interest in the property. d. Granting of the variation will not be materially detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. e. Proposed variation will not impair an adequate supply of light and air to adjacent property, substantially increase congestion in the public streets, increase the danger of fire or endanger the public safety. f. Variation, if granted, will not alter the essential character of the locality. 2.) If all of the standards set forth in subsection (1) of this section cannot be met, yet an identifiable overriding public benefit can be realized by the granting of the requested variation, the zoning board of appeals shall forward a written recommendation, including a specific finding of fact of overriding public benefit, to the board of trustees for final disposition. 3.) The Zoning Board of Appeals may impose such conditions and restrictions upon the premises benefited by a variation as may be necessary to comply with the standards set forth in this subsection (1) to reduce or minimize the injurious effect of such variation upon other property in the neighborhood, and to better carry out the general intent of Chapter 98 of the Municipal Code. 12

20 EXCERPT FROM MINUTES OF NOVEMBER 16, 2015 ZONING BOARD OF APPEALS MEETING Z Harlem Avenue ITW Request: Number of Ground Signs This case was published in the October 29, 2015 Glenview Announcements. Mr. Repp reported on the application for relief from certain sign regulations in the Municipal Code. The subject property is zoned I-1. The variation would allow the number of ground signs to exceed the maximum permitted by two signs. There are 27 total ground signs on the property. The applicant, ITW (Illinois Tool Works), requested approval of four more ground signs. Exhibits were shown of a sign plan illustrating the location of each existing sign (directional, informational or regulatory), and the proposed ground signs which require a variation. Wall signs aren t being considered tonight. The site has a monument sign at the main entrance, a sign at the gate by Harlem Avenue, a post and panel sign near the southern entrance coming from Morton Grove, and another at the Waukegan Road entrance. One ground sign per street frontage is permitted. While ITW has three street frontages, the Village can only permit two ground signs in accordance to the ordinance. The Appearance Commission reviewed the project, granted preliminary approval with comments, and recommended approval by the Zoning Board. Minutes from that meeting were included in the meeting material. Mr. Nick Fracasso and Mr. Chris Hogan from ER2 Image Group came forward. Chairman Greco disclosed that he is Mr. Hogan s neighbor but it would not affect his decision in this case. Mr. Hogan said some of the existing signs will be replaced. In the monument area, there is an existing post and panel sign that states no parking it is sign #1 on the photo exhibit of existing signs. The entrance signs at Waukegan Road, Harlem Avenue and Golf Road will be replaced (no photos were available). The new signs have a color scheme consistent with ITW s new building sign and monument signs resulting in a cohesive appearance. Replacement signs will be updated to conform to the new style. The applicant inquired about the Board report which states the variance is for the construction of 31 signs, when in fact ITW is only adding four new signs. Mr. Repp clarified this was referring to the total number of signs (27 existing plus 4 new signs). Chairman Greco asked about the sign on Waukegan Road which somewhat faces north. When driving on the road the sign is not visible until the vehicle has almost passed it. Mr. Fracasso said the sign will be straighter as shown in the picture, and this issue was one reason for replacing that particular sign. Chairman Greco asked about the sign off of Golf Road which sits far back. The current sign indicates to visitors how to get to another location, e.g. Harlem, Waukegan, but this information is not on the proposed sign. Mr. Hogan said ITW wanted the sign to indicate it was an employee only entrance without additional verbiage. No one from ITW was present to answer questions from the Board. Chairman Greco said the front of the property is mostly in Morton Grove so he wondered if another sign was planned to identify ITW. Mr. Fracasso did not think so. No one from the audience came forward to speak to this petition. Commissioner Perl didn t have an issue with adding the additional signs as proposed. Chairman Greco remarked that the Village s sign code is not typically set up for parcels as large as the ITW site. The hardship and uniqueness in this case is the size of the property and how far back it sits from the various roads. He did not object to the variance. There were no other comments from the Zoning Board. The sample motion in the Board report was altered to remove the word construction. 20

21 Based upon findings evidenced through testimony, discussion, and the petitioner s application materials which demonstrate compliance with Chapter 98, Article II, Section 98-47(c) of the Municipal Code; Commissioner Jester moved that the Zoning Board of Appeals recommend approval of a Variation to the Village Board of Trustees in the case of Z , 155 Harlem Avenue, for the petitioner, ITW, represented by Nick Fracasso of ER2 Image Group, from the provisions of Sections 98-4 and (4)(b) of the Glenview Zoning Ordinance to allow for thirty-one (31) ground signs instead of two (2) ground signs, as allowed and required by said ordinance, provided that the signs be in substantial accordance with the plans and drawings as submitted and consistent with the testimony and discussion provided during consideration of the petition. 22 Z Commercial Variation for Illinois Tool Works at 155 Harlem Avenue 01/05/2015 ORDINANCE NO. AN ORDINANCE GRANTING A COMMERCIAL ZONING VARIATION WHEREAS, the Village of Glenview (the Village ) is a home rule municipality in accordance with the Constitution of the State of Illinois of 1970; WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs that protect the health, safety and welfare of its citizens; WHEREAS, on October 29, 2015, a notice of public hearing before the Glenview Zoning Board of Appeals was duly published in the Glenview Announcements, a newspaper of general circulation within the Village, scheduling a public hearing for November 16, 2015 on an application seeking variances for property classified I-1 Limited Commercial District by the Glenview Municipal Code (the Code ); WHEREAS, pursuant to the aforesaid notice, a public hearing was held on November 16, 2015 at the hour of 7:00 P.M. by the Zoning Board of Appeals in accordance with Chapter 98, Article II, Section 98-43(d)(2) of the Code, and all persons who desired to be heard were heard, and an opportunity was given to all persons who desired to make objections thereto; WHEREAS, subsequent to the public hearing, the Zoning Board of Appeals recommended the granting of such variances, which recommendation was duly considered by the corporate authorities; and WHEREAS, the corporate authorities have determined that in order to further the health, safety and welfare of its citizens, it is appropriate and in the public interest to grant the applicant s request for a variance. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village as follows: Section 1: The facts and statements contained in the preamble to this Ordinance are found to be true and correct and are hereby adopted as part of this Ordinance. Section 4: To allow a period of up to twelve (12) months from the date of this Ordinance for the issuance of a signage permit for construction of the aforementioned improvements, or the variation shall be rescinded. Section 5: Appropriate notice shall be taken by the Office of the Director of Community Development and any other affected departments of the Village of the variance herein authorized and suitable records of same shall be maintained by the Village to guarantee such variance to the property heretofore described. Section 6: Every section and provision of this Ordinance shall be separable, and the invalidity of any portion of this Ordinance shall not affect the validity of any other portion of this Ordinance. Section 7: This Ordinance shall be in full force and effect from and after its passage and approval according to law. 23
