1 Fall ISSUE September 2018 Fall Issue Timber Hill Community Association BOARD MEETINGS: 2ND WEDNESDAY OF EACH MONTH AT 7PM AT THE ADMINISTRATION BUILDING. Sixty m.p.h. winds left THCA pretty much a mess; trees down, branches, and debris in drainage ditches, tree parts in the road easements, etc. Although crews from other surrounding states did a great job restoring power, they did leave a trail of cut up trees and branches behind that had to cleaned up. This type of work doesn t come cheap. As you may have noticed a lot of road repair has gone on this spring and summer. Instead of filling pot holes individually, we used a procedure called scratch coat which overlays ten to fifteen pot holes at a time in a much larger focused area. Snow Mass Rd needed the most attention, which is now probably the most traveled road in the community besides Timber Hill Rd. Wobbly Barn, Inverhouse, Powder Horn, Bromley, Tahoe, and Timber Hill roads were all roads that received scratch coat repairs. In addition, Haystack Rd and Mt. Snow Trail were newly paved. The total cost of these three major areas was $109,100; $56,200 out of Capital Improvement and $52,900 out of Reserve. As of this month, we have prepared the paperwork for 20 homeowners to be turned over to our attorney to obtain judgements. Also, we will be meeting face to face with our attorney to discuss our options on members that we have filed 2-3 judgements on and owe an excess of 5 figures. Hopefully, he will have some concrete suggestions on how to pursue those members who have no interest in fulfilling their responsibility to the community. For all that continue to support THCA, Thanks again. It s no secret that your support determines what gets done in the community. A special thanks to Brett, Buddy, and crew for the massive clean up effort on all the down trees and branches in the aftermath of the storms. Plus having our backs whenever an emergency pops up. A special shout out to the BRACE Committee for all the work they do to make sure our By-Laws and Rules & Regulations are followed, it s been the toughest committee to chair. 2 2 Treasurer Report Currently we have collected $113, in dues, $38, in Reserves (includes road work repairs), total in Reserves $124, and $16, in prior dues. The collection process has been implemented this year. It s a three-tier letter process. The last letter has gone out to members in bad standing. There is still time to set up a payment plan before we proceed with judgements. Please call or the office if you are interested in setting up a payment plan. Far too many years, delinquent members have not been pursued. This will no longer continue! Twenty judgements have been filed this month and more will follow. You can rest assure that every member who is not paying their dues will be aggressively pursued. COMMUNITY EVENTS COMMITTEE REPORT Hello Neighbors! Here we are with school in session and hopefully some cooler weather. The events committee is still looking for members and ideas to make the community a fun place to meet our neighbors. We will be having our Trick or Treat & Trunk and Treat on Wednesday, October 31, 2018 from 5:30-8:30pm. If you would lie to participate in the Trunk N Treat, please come to the association parking lot or the pool parking lot at 5:30pm. If you would like to participate in the Trick or Treat, please leave your porch light on for the children to know you welcome them. We will be having our Christmas event again this year on December 15 from 12-2pm. There will be more information late. Have a Happy Fall and hope to see you soon. Rose Aumick Events Community Chair
3 3 Annual Meeting Our annual meeting will be held on Sunday, October 28, 2018 at 1pm. Community members should plan to be present. If there is no quorum, the meeting will be held on Sunday, November 04, 2018 at 1pm. Those of you who would like our community to be energized, educated, and enjoyable, please help us to make it happen. We would like to see some new faces! Remember, only members in good standing are allowed to participate. 4 4 A Little Trash Talk Scattered Trash: The Bylaw Review and Compliance Echelon (BRACE) Committee has been receiving numerous complaints regarding the trash scattered throughout the neighborhood including overturned trash cans, ripped open trash bags and garbage and articles strewn around private property and on the easement. We all contend with wild animals as a part of Poconos life. Most of us have experienced our trash cans being overturned and garbage dragged out across the lawn from bears or raccoons. There are a few precautions we can take to minimize the access of animals to our trash: All trash should be placed in appropriate receptacles Make sure lids are securely placed on the cans Do not put trash out for collection the night before It is the responsibility of every property owner to clean up any trash left in their yard or on community roads within a timely manner. All property owner received a copy of the revised Timber Hill Community Association Rules & Regulations. Please familiarize yourself with those regulations that pertain to trash. General Rules: 1. Littering or dumping of refuse anywhere in the community is prohibited. Reported and documented infractions will be referred to local authorities and may result in fines starting at $ Refuse shall be placed in plastic bags and then securely deposited in cans or containers of plastic, aluminum or other construction, with a locking lid, for pick up by sanitation service providers. Township ordinance prohibits trash being placed on the curb in plastic bags. 3. Trash containers should not be left at the curb/easement longer than 24 hours before or after pick-up. Violation of this rule may result in an imposed fee. 4. Members are responsible for the conduct of their guests and tenants and their adherence to community rules and regulations.
5 5 Unkempt Property: We have also received complaints from neighbors of property owner due to unkempt property due to trash, unregistered vehicles and unused building materials in their yards. Please review the Uniform Covenants, Conditions and Restrictions section of your Timber Hill Community Association Blue Book. If you do not have a copy, please contact the office. Each property owner will be held to these standards and BRACE Committee will pursue every issue that is brought to our attention. Uniform Covenants, Conditions and Restrictions: 10. No obnoxious or offensive use shall be made of any lot, nor shall any offensive trade or activity be carried on upon any residential lot, nor shall any use be made of such lots which may constitute a nuisance. Automobiles not having operated for a period of thirty (30) days or more constitute a nuisance 20. No lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall be placed in sanitary containers. MONROE COUNTY MUNICIPAL WASTE AUTHORITY: It is important all community members familiarize themselves with the rules and regulations pertaining to the proper disposal of trash are directed by our municipal waste authority which has the authority to cite and fine those who do not adhere to proper trash disposal regulations. Proper Containment of Trash: Article 5B: Municipal Waste Storage Containers: While solid waste is being stored and accumulated for collection in any can(s), dumpster(s), container(s), compactor(s), and roll-off(s), it shall be stored in a tightly fitted lid covered container, which shall be leak proof, watertight and rodent proof with properly functioning doors, lids or tarp to prevent litter and loss of solid waste.
6 6 Township Ordinances: In addition to the Timber Hill Community Association Rules and Regulations and Uniform Covenants, Conditions and Restrictions, both Paradise and Price township have specific ordinances regarding trash disposal. PARADISE TOWNSHIP CODE OF ORDINANCES: Unkempt property due to trash Owner to maintain premises free of litter. The owner or person in control of any private property shall, at all times, maintain the premises free of litter; provided, however, that this section shall not prohibit the storage of litter in authorized private receptacles for collection Litter on vacant lots. No person shall throw or deposit litter on any open or vacant private property within the township, whether owned by such person or not Clearing of litter from open private property by township. Notice to remove. A. Notice to remove. The Township Supervisors are hereby authorized and empowered to notify the owner of any open or vacant private property within the township or the agent of such property to dispose of litter located on such owner's property which is dangerous to public health, safety or welfare. Such notice shall be by registered mail, addressed to said owner at the owner's last known address B. Action upon noncompliance. Upon the failure, neglect or refusal of any owner or agent so notified to properly dispose of litter dangerous to the public health, safety or welfare within 10 days after receipt of written notice provided for in Subsection A above, or within 10 days after the date of such notice in the event the same is returned to the Township Supervisors because of inability to made delivery thereof, provided that the same was properly addressed to the last known address of such owner or agent, the Township Supervisors are hereby authorized and empowered to pay for the disposing of such litter or to order its disposal by the township.
7 7 Burning of trash is prohibited Prohibited burning; exceptions.1 All burning is prohibited except brush, leaves, untreated lumber or trees. Nuisance vehicles Motor vehicle nuisances prohibited. [Amended by Ord. No. 91] A. It shall be unlawful for any person, owner or lessee to maintain a motor vehicle nuisance upon the open private grounds of such person, owner or lessee within the township. A motor vehicle nuisance shall include any motor vehicle which is unable to move under its own power or which has not been licensed or inspected for a period of one year. PRICE TOWNSHIP CODE OF ORDINANCES: Burning of trash is prohibited SECTION 3: Prohibited Materials No garbage, offal, or materials prohibited by state law may be burned at any time either indoors or out of doors Unkempt Property SECTION 3 RESPONSIBIITY NUISANCES DELCARED It shall be the responsibility of the property owner of the premises upon which any junk, rubbish, refuse, garbage or waste is situated and the owner of any such item to comply with this Ordinance and to provide for the removal of the same and remediation of any environmental problems associated with it. By this Ordinance, the Township enumerates and declares certain nuisances, which shall be removed, disposed of or corrected as herein provided. Any person who fails to comply with the provisions of this Ordinance shall be deemed to be in violation thereof and shall be subject to the penalties and remedies described herein
8 8 Nuisance Vehicles SECTION 4 - RESPONSIBILITY NUISANCE DECLARED C. Number of Abandoned/Junk Vehicles Not more than two (2) abandoned or junked unlicensed / unregistered vehicles shall be stored on the premises. All such vehicles shall be screened as defined in Section 4. We appreciate the efforts of all residents in Timber Hill to keep their property free of trash and nuisance vehicles and our roadways and easement clear of trash. Thank you. No matter how many people are on the deed to this lot, only one ballot form can be filled out per household. For example, if husband and wife own this lot together, they must agree on who to vote for as they only get one ballot, not two. There is no cumulative voting. This means that no matter how many lots you own, your household may only vote once (i.e. only fill out one ballot form). There are SIX (6) seats open for the Board of Directors. Therefore, you may vote as little as 1 candidate or up to 10 candidates. Cast your vote by signing your initials next to the candidate of your choice. You can be assured that this is an official ballot for this election by making sure it contains the raised corporate seal of Timber Hill Community Association, Inc.
