The subject site contains Village 3 within the proposed Villages at Tule Springs Master Planned Community. With this proposal the applicant intends to remove all the old zoning districts from the subject site and use the base PCD, Planned Community District. As builders request tentative maps for individual development parcels with the community, they will rezone the parcels to the respective zoning district. The actual zoning districts will be described within the Development Standards and Design Guidelines. A separate and concurrent application for an amendment to the development agreement (DA-01-16) has been submitted proposing to change the land use map within the master planned community. That request is also on this agenda for Planning Commission consideration.
3 DEPARTMENT COMMENTS: Public Works: Fire Prevention: No comments No comments ANALYSIS: In 2011 the City of North Las Vegas adopted the current zoning ordinance which changed the underlying Master Planned Community (MPC) category to the Planned Community District (PCD). The Villages of Tule Springs is being developed in compliance with current Title 16 & 17 requirements. Additionally, the current zoning classifications, within the master planned community, are being changed with the Development Standards and Design Guidelines. The first step to developing the community is to remove the old and outdated zoning classifications and rezone the property in compliance with the current Development Agreement and Zoning Ordinance. The proposed base zoning classification is in compliance with the existing Development Agreement for the Villages at Tule Springs. It is also in compliance with the existing Zoning Ordinance. Approval Criteria: (Zoning Map Amendments) The City Council may approve zoning map amendments, and the Planning Commission may recommend approval, if the zoning map amendment meets all of the following criteria: (1) The rezoning will promote the public health, safety, and general welfare; (2) The rezoning is consistent with the comprehensive master plan and the purposes of this Code; (3) The rezoning is consistent with the stated purpose of the proposed zoning district(s); (4) Facilities and services (including roads and transportation, water, gas, electricity, police and fire protection, and sewage and waste disposal, as applicable) will be available to serve the subject property while maintaining adequate levels of service to existing development; (5) The rezoning is not likely to result in significant adverse impacts upon the natural environment, including air, water, noise, storm water management, wildlife, and vegetation, or such impacts will be substantially mitigated; (6) The rezoning is not likely to result in significant adverse impacts upon other property in the vicinity of the subject tract; and
4 (7) Future uses on the subject tract will be compatible in scale with uses on other properties in the vicinity of the subject tract. RECOMMENDATIONS: The Community Development and Compliance Department recommends that ZN be approved and forwarded to the City Council for final action.
