1 CITY OF TIMMINS BY- LAW NO BEING A BY- LAW to amend the City of Timmins Zoning By-law No WHEREAS the Planning Act, R. S. O. 1990, c. P. 13, Section 34, as amended, authorizes Councils of Municipalities to pass by-laws to regulate the use of land and the character, location and use of buildings and structures; AND WHEREAS it is considered desirable to amend the City of Timmins Zoning By-law No ; NOW THEREFORE the Council of the Corporation of the City of Timmins enacts as follows: 1. That Schedule 9 of the City of Timmins Zoning By- law No , as amended, is hereby further amended as it pertains to those lands shown more particularly on Schedule 1 affixed hereto and forming part of this By- law, by placing the said lands into the Residential Medium Density 2 ( NA- RM2) ( SP6-164) Zone. 2. That Section 6 entitled Special Provisions, as amended, is hereby amended by amending the following Special Provision SP which shall permit: Reduction of the minimum eastern interior side yard requirements from 3. 5 metres to metres. Reduction of the eastern landscaping buffer from 7. 5 metres to 3. 0 metres. Reduction of the minimum front yard requirements from 7. 5 metres to 3. 6 metres for the townhouse building. Reduction of the northern landscaping buffer from 7. 5 metres to 0. 0 metres. Reduction of the minimum distance between an entrance or exit and the west interior side lot line from 3. 0 metres to 0. 0 metres. S. O., 1990, C. P. 13. AND TAKE NOTICE the Planning Act, Section 34; Subsection ( 19) states that in order to be able to appeal to the Ontario Municipal Board that a person or public body must make oral or written submission before the Bylaw is passed by City Council. Any person or public body who has made a previous submission may appeal to the Ontario Municipal Board in respect to the By- law by filing with the Clerk of The Corporation of the City of Timmins, not later than the 1st day of March, A Notice of Appeal setting out the objection to the By- law and the reasons in support of the objection, along with the filling fee of $ payable to the Minister of Finance, can be submitted to the City Clerk. An explanation of the Purpose and Effect of the By- law, describing the lands to which the By- law applies, and a key map showing the location of the lands to which the By- law applies are attached. The complete By- law is available for inspection in my office during regular office hours, 8: 30 a. m. to 4: 30 p. m.
