Denny, Robert Exile Glasgow Tried 2 October years - THE END OF CONVICTISM On August 8, 1849, the ship Randolph entered Port Phillip with convicts on board. But the citizens of Melbourne had been warned from London that she was coming, and several excited meetings had been held to organize resistance. The tone was stern and menacing. One influential speaker declared, amidst great cheering, that 'he should be one for resisting, even to the death, the landing of such cargoes.' Edward Wilson, the editor of the ARGUS--which was established in wrote in his newspaper that a resort to force was 'warranted alike by the laws of God and man,' and he urged a union of colonists 'to repel by physical force any other attempt to land convicts on our shores.' Latrobe, the Superintendent of Port Phillip, recognized that the feeling of the population was dangerous, and he therefore directed the captain of the Randolph to take the convicts round to Sydney. He did the same when a second vessel with 'Pentonvillains' on board, the Hashemy, arrived in May. Thus did the Melbourne people, by the menace of rebellion, free their province from an infliction which they loathed. In Sydney the Governor, Sir Charles Fitzroy, found himself confronted with an antipathy hardly less violent. The Legislative Council had already passed a resolution protesting against New South Wales being 'again made a place to which British offenders may be transported,' and public meetings had expressed the same feeling. The Sydney HERALD (founded 1831) had as far back as 1834 urged that the convict system involved 'an abominable system of misrule and total depravity,' and that only by its abolition could this country 'gain a standing among the British colonies.' This journal had steadily worked for the abolition of the system, and a strong body of public opinion had been formed to support that policy. Fitzroy, perceiving that the landing of the convicts from the Randolph and the HASHEMY would probably lead to trouble, sent them on to Moreton Bay. Lord Grey quite failed to understand the change that had come over Australia after over half a century's experience of convictism. He never realized the difference that was made by the free settlers far outnumbering the malefactors. He could not appreciate that the time had come when there was a large population whose native land was Australia, and who nourished an affectionate care for its future wellbeing. When he wrote his book on COLONIAL POLICY in 1853, he advanced the proposition that England was 'perfectly justified in continuing the practice of transportation to Australia, the colonies being only entitled to ask that in the arrangements for conducting it their interests and welfare should be consulted as far as possible.' He had not moved from that vicious attitude of English statesmen towards the colonies which was largely responsible for the American Revolution. The colonies, in this view, existed primarily for the benefit of the mother-country, and their own wishes and interests must be kept subordinate. Lord Grey commented on the 'great advantage of not allowing men who have been guilty of serious crimes to return to their former homes,' and asked what the consequence to England would be if several thousand men 'who under the existing system would be permanently removed from the United Kingdom, are to be annually turned loose on society.' That they had been turned loose on society in the colonies, with deplorable results, did not trouble this unimaginative Whig politician. The same view was expressed in a House of Commons debate. 'The country had a right to look to our colonies to receive our convicts without complaint,' babbled an indignant member. These incidents of the revolt from convictism in the country which had been colonized by the British for that very purpose, represented the death-struggle of the system in New South Wales. It was continued in Van Diemen's Land till 1853, and in Norfolk Island till The connection of Western Australia with it has been related.

Government House, 1st Sept., MY LORD-I have the honor to transmit the report of the Principal Superintendent of Convicts of the arrival, classification, and distribution of the convicts by the ship Randolph, which vessel arrived here on the 20th ultimo, having been sent on from Port Phillip under the instructions given by me to Mr. Latrobe, which I reported to your Lordship in my despatch, No. 42, of the 21st of March last. As this is the first ship that has been sent on under those instructions, I have much satisfaction m being enabled to state that three days after her arrival, without any public notice, the convicts on board were open to hire, and the whole of them (excepting thirty-nine intended to be distributed between the Moreton Bay and the Clarence River districts, from whence numerous applications have been received) were hired within seven hours of their being allowed to engage themselves, by respectable employers, at wages varying from 10 to 20 a year, with ample weekly rations. With these facts before your Lordship, I trust I may be considered as having been rally justified in complying with the application so "urgently pressed upon me by Mr. Latrobe, and by the inhabitants of the Port Phillip district, that no convicts should be landed within its precincts, and that the additional expense incurred in chartering the Randolph on to Sydney will be deemed by your Lordship of little moment in comparison with the great excitement and ill feeling towards her Majesty's government which would have been created had Í persisted, contrary to the unanimously and strongly expressed opposition of the most respectable inhabitants of this important district, m forcing - convicts upon it, which sob sequent and recent proceedings which have taken place m Melbourne leave it beyond a doubt that such a step would have led to the adoption of measures of passive resistance to the reception and employment of these people, of a similár nature to those which are re- ported in newspapers lately received to have taken place at the Cape of Good Hope, and which by thus defeating the instructions of government, and throwing back the convicts on its hands, could not have' failed to have caused, great excitement and much confusion; whereas by transferring' them. at once to Sydney, they have not only been distributed without the slightest remark 'or opposition, bat have been, eagerly sought after. I may add.also, that in order to the proper réception and distribution of the convicts landed at Melbourne, it would have been necessary to have established there a branch of the convict department, which, as your lordship will perceive from the annexed report and estimate of the Principal Superintendent of Convicts, could not have been done under An annual expense of upwards of 550.-I have, &c, CHAS. Downing-street, 29th January, SIR-I have the honour to acknowledge your despatch, No. 189, of the 1st of September last, reporting the arrival of the ship Randolph with 196 convicts, which vessel had been sent on to Sydney from Port Phillip under the authority which you gave to Mr. Latrobe for that purpose. From your report it appears that, with the exception of thirty-nine of these convicts, who were retained in order to meet the demand, for their services at Moreton Bay and the Clarence Biver, the whole of the men who arrived in the Randolph were able, within seven hours of their being allowed to engage themselves, to find employment at fair wages.. I have had much satisfaction in receiving this intelligence. It is also due to you to state that the circumstances which yon explain in your despatch appear quite sufficient to prove that your decision to provide for sending on these people from Port Phillip to Sydney was very judicious, and I have to convey to you my approval of that measure. I shall accordingly move the Secretary of State for the Home Department to take the necessary steps for procuring a sanction of the extra expenditure of 500 required for the conveyance of this party of men to Sydney.
