1 Generation 1 1. LYDIA 1 TIVEY was born in 1788 in Melbourne, Derbyshire, England. She died on 24 May 1866 in Burton upon Trent, Staffordshire, England (Burton on Trent District of Staffordshire). She married John Houghton on 15 Oct 1808 in St Michael with St Mary Church, Melbourne, Derbyshire, England. He was born about 1788 in Forsbrook, Staffordshire Moorlands, England. He died in 1857 in Melbourne, Derbyshire, England. Notes for Lydia Tivey: * Not 100% sure if she was Edward & Mary's daughter, could have been the daughter of one of Edward's siblings - No Baptism available - my reasoning is below. 15th October 1808 Married John Houghton, Witnesses Ann Tagg and William Tivey: Born around 1788 in the Parish of Melbourne, Derbyshire. Parentage not yet confirmed but she had close links with William Tivey born c1790 Melbourne (who married the Salsbury sisters) and Hannah Tivey who married John Berresford. William witnessed her marriage to John Houghton and when William married for a second time, her husband John was witness. John Houghton was also a witness to the marriage of Hannah Tivey. There are numerous links to other Tivey families including Group 2 (Sidney Elson Tivey married Elizabeth Hannah Houghton, Lydia's granddaughter). Lydia's death was registered by Mary Ann Wilkins (nee Tivey) who was the daughter of John Tivey and Ann Edwards (Our Group 6) I am quite convinced that Lydia is the sister of John and Therefore, Joseph (10) and Thomas (2) and probably William (4, though others disagree, and have him as the son of William Tivey and Sarah Wade) Another piece of evidence connecting tha families is on the death certificate of Sarah Tivey (daughter of Joseph Tivey and Mary Edwards Group 10) her death, aged 10 was registered by John Houghton 30th September John is the earliest Houghton appearing in the Parish registers at Melbourne firstly as he witnessed the marriage of Lydia's (probable) Sister Hannah and later that year on his marriage to Lydia Tivey 18th October 1808 at St Michael's CE. The next entry for Houghton is that of the couple's son William on his Marriage to Ann Wright. Husband (or Son John) appear in Pigot & Co's National Commercial Directory for Melbourne, Derbyshire 1835, "John Houghton, Beer Retailer" a further reference to this appears in the Derby Mercury, 11th April Advertising Column - By BREARY AND SON MELBOURNE Lot 3 "A Good Accustomed PUBLIC HOUSE, known by the name of the WOOL PACK INN situated in Castle-street, Melbourne, in the Occupation

Mr W T Shaw appeared for the prosecution, on the several indictments. Prisoner was undefended. Prisoner pleaded guilty in the 1st, 3rd and 4th indictments and of the 2nd, not guilty. P W Holbrook, draper, Queen-street, said that on the 6th January last, he received a note, signed Thomas Turner, Canal-street, which stated that he must send four yards of black cloth as his mother was dead. and he want some mourning, witness said Mr Turner traded with him and thinking it was right; after speaking to his sister respecting Mr Turner's mother's death, he sent the four yards of cloth by the boy; in a short time another boy came and asked for 71/2 yards of cloth for Mr Turner according to the pattern. As we have given the particulars of this case in the police report before, we forbear to go further into it. The boy, Ryde, recalculated his former evidence as to being sent to Mr Holbrooke's &c. Constable James Allen swore to finding a piece of cloth at prisoner's house similar to that sent my Mr Holbrooke. Prisoner in his defence said, that the piece of cloth found at his house was a part of some that he bought of Mr Holbrooke about 2 months ago,. he had the bill then at his house. Mr Holbrooke allowed him to have a running account, and that cloth had not been paid for, as he (the prisoner) had been very ill. The jury returned a verdict of guilty. Mr Holbrooke said he wished to state in favour of the prisoner, that he had always paid very honourably before. Several persons came forward to give prisoner a good character for honesty and industry up to the time of his committing these frauds. Mr

Mr John Lee, manager of the Britannia Foundry, Mr William Bancroft, who had known him for some 15 to 20 years, Mr Livesey, Mr Wingfield, and Mr Pritchett, who all spoke to his general good character. The Recorder before passing sentence on the prisoner remarked that he had been living for some months practising fraud, and by the deepest hypocrisy, in obtaining goods from tradesmen, under false pretences. There was one feature in this line of conduct which tended to aggravate his guilt: the instruments he signed out to effect his purposes were boys and by promising them small sums of money he had made them the channel of defrauding those who had been in the habit of dealing with him. The recorder then said it was impossible he (the prisoner) could be allowed to remain in this country and longer; there were four acts of fraud, to three of which he had pleaded guilty, the other the jury had convicted him of; Several of the persons he had defrauded had formerly been like friends and by his cant and deepest hypocrisy he had preyed on their credulity. He should only pass sentence upon him for the indictment to which he had pleaded guilty.
