3 RESOLUTON NO.: R Certifying Twelve (12) Building Sites as State-Owned Abandoned Buildings Pursuant to the South Carolina Abandoned Buildings Revitalization Act, Title 12, Chapter 67, Section et seq., of the Code of Laws of South Carolina (19 76), as amended, regarding property located at 2150 Harden Street, Richland County TMS # (p) WHEREAS, the South Carolina Abandoned Buildings Revitalization Act of 2013 (the "Act") was enacted in Title 12, Chapter 67, of the South Carolina Code of Laws to create an incentive for the rehabilitation, renovation and redevelopment of abandoned buildings located in South Carolina; and, WHEREAS, the Act provides that restoration of abandoned buildings into productive assets for the communities in which they are located serves a public and corporate purpose and results in job opportunities; and, WHEREAS, Section of the Act provides the following definitions (in pertinent part): (1) "Abandoned building" means a building or structure, which clearly may be delineated from other buildings or structures, at least sixty-six percent of the space in which has been closed continuously to business or otherwise nonoperational for income producing purposes for a period of at least five years immediately preceding the date on which the taxpayer files a "Notice of ntent to Rehabilitate". (2) "Building site" means the abandoned building together with the parcel of land upon which it is located and other improvements located on the parcel. However, the area of the building site is limited to the land upon which the abandoned building is located and the land immediately surrounding such building used for parking and other similar purposes directly related to the building's income producing use; and, (8) "State-owned abandoned building" means an abandoned building and its ancillary service buildings or a project consisting of one or more abandoned buildings, the aggregate size of which is greater than fifty thousand square feet, that has been abandoned for more than five years, and, prior to the taxpayer's acquisition of such building, was most recently owned by the State, or an agency, instrumentality, or political subdivision of the State. For purposes of this definition, the taxpayer shall include any entity under common control or common ownership with the taxpayer. WHEREAS, Section of the Act provides that a taxpayer who rehabilitates an abandoned building is eligible either for a credit against certain income taxes, license fees or premium taxes, or a credit against local real property taxes; and, WHEREAS, Clachan Properties, LLC, a Virginia limited liabi lity company ("Taxpayer"), is the developer of certain real property commonly called the Babcock Complex and comprised of twelve (12) structures located at located at 2150 Harden Street, (the "Property"), which Property is currently owned by the South Carolina Department of Mental Health as referenced in deeds dated June 20, 1990, and recorded June 28, 1990, in the Richland County ROD Office in Deed Books D0986 at Page 391 and D0986 at Page 397, which Property is further identified on the Richland County Tax Maps as TMS (p); and, Last revised : 1/13/
4 WHEREAS, the Property is located within the city limits of Columbia, South Carolina; and, WHEREAS, the Taxpayer has requested that the City certify that the Properties are eligible stateowned abandoned building sites as defined by Section ; NOW, THEREFORE, BE T RESOLVED BY THE MAYOR AND CTY COUNCL OF THE CTY OF COLUMBA, SOUTH CAROLNA, this_ day of, 2016, as follows: Section 1. The Taxpayer has submitted to the City's Planning and Development Services Department the attached Request to Certify the Property as twelve (12) separate eligible building sites ("Exhibit A") under the Act, which Request includes supporting documentation from Taxpayer's architect. Section 2. The City's Planning and Development Services Department has reviewed the Request to Certify, supporting documentation, conferred with the Taxpayer and conducted its own review of the Property. The City also received a letter confirming the Bull Street Development Review Board's approval of Taxpayers Request to Certify the Babcock Complex as twelve (12) separate abandoned building sites eligible under the Act ("Exhibit B"). Section 3. The City hereby certifies that the Property consists of twelve (12) separate state-owned abandoned building sites as defined by the Act. 6 walter PARK ARCHTECT 313 N Adams Street Richmond, VA Tel Fax November 24, 2015 Mr. Shytle, have reviewed the Babcock Mental nstitute Building as it relates to the State of South Carolina's Abandoned Building Credit. The primary goal of my review was to determine the number of buildings that comprise the Babcock Complex. The Babcock Mental nstitute was built as a series of buildings, each of these buildings should receive an abandoned building credit. We are using the BC definition for a building, including the code commentary, it reads as follows: Building: Any structure used or intended for supporting or sheltering any use or occupancy. Commentary: The code uses this term to identify those structures that provide shelter tor a function or activity. See the definition for "area", building" tor situations when a single structure may be two or more "buildings" created by fire walls. By this definition there are 12 buildings at Babcock. Attached is a site plan showing each of the buildings. Buildings designated #1 and #2 on the attached plan are separated from the rest of the complex. These buildings are the dining rooms, the only connection that they share with the complex are covered walkways to the main building. The building designated as #3 is the Administration building, this section was built after the wings. t is not connected to the wings on the first floor and connected by two ramped bridges on the second and third floors. Currently there are closed fire doors isolating this segment from the wings. The building designated as #4 is the kitchen. This building was originally built as a free standing structure, completely separate from the rest of the buildings and then was attached through a connector building in The four buildings designated #5 through #8 are the Men's Wing. This wing consists of four building segments, each of the these segments can stand independently. The attached framing plans show how the buildings were constructed as short span wood joists on masonry bearing walls. The joists were designed to sit on corbel brick ledges which allow them to fall away from the masonry without harming the bearing wall. Each segment has independent egress, both vertically and horizontally. The segments are separated by walls serving as fire walls complete with independent framing and parapets or offset heights, serving as parapets. These segments were itemized in the Regents Report of 1880 and built in two construction phases: item D (comprised as two segments) in 1858 and item X which was completed after the Civil War in The four buildings designated as #9 through #12 are the Women's Wing. The segments are built similarly to the Men's side, with masonry bearing walls separating the building areas. The Women's Wing was built in two phases, each phase comprised of two segments. The site plan from the Regents Report of 1880 itemizes the building sections; item G contains buildings #9 and #1 0 while item H, built after 1881, contains buildings #11 and #12. There was a fourth story addition to building #11 that concealed the original parapet wall in the satellite view. The fact that the buildings could be constructed as single, double or triple configurations speaks to the independent nature of these buildings. The buildings function independently, if building #11 was razed, building #12 would operate as a stand alone structure. Sincerely, Walter Parks
