1 Sec Minimum useable open space. The minimum useable open space required for multi-family dwellings in this district shall be twenty-five (25) percent. Sec Finish. All structures, including accessory buildings and structures shall be finished in a neat and workmanlike manner by paint, stucco or other finish suitable for the type of materials used in their construction. ARTICLE 10. COM-N NEIGHBORHOOD COMMERCIAL Sec Intent. The intent of the Com-N Neighborhood Commercial district is: (a) To provide for the development of mixed use commercial centers to serve the convenience, shopping and service needs of the neighborhood. To serve as a focal point for pedestrian activities within a neighborhood, suited in size to the surrounding neighborhood. Mixed-use buildings with street level commercial and upper level office and/or residential uses are encouraged. Sec General restrictions/regulations. (a) All uses conducted in this district shall be contained within structures, except as specifically allowed in this Article. Outdoor storage, outdoor displays, and outdoor sales are not permitted. Drive-thru facilities are not permitted within this district. 41

2 (d) Trash storage containers shall be provided and screened from public view with the use of a solid fence, wall or hedge. Solid fence does not include a woven wire or chain link fence with filler or fabric, or snow fences. Screening materials shall be esthetically compatible with the architecture of the property. Trash storage containers shall comply with the requirements of Section 66-3 of the Sheridan Municipal Code. (e) Portable storage containers are not allowed in this zone district. This does not preclude the use of dumpsters and portable storage containers during construction being conducted under a valid building permit issued by the City. Sec Permitted uses. The following are permitted uses in the Com-N - Neighborhood Commercial district: (a) All uses permitted by right in the Res-MF District; provided that any structure use shall comply with the density schedule for the Res-MF District. Membership clubs. Office uses. (d) Banks and financial institutions of less than 2000 square feet (e) Personal service establishments, including, but not limited to, laundry and pressing establishments, barbershops, beauty parlors, provided that the services of all such establishments are confined within a building. (f) Restaurants, retail bakeries, coffee shops, or tea rooms with seating capacities of no more than 100 patrons; provided that outdoor service is permitted between 6:00 a.m., through 10:00 p.m. (g) Neighborhood Retail Store. (h) Recreation facilities. (i) Tourist homes. 42

3 (j) Studios including, but not limited to, art, photographic, dance, music. (k) Colleges, trade schools, and universities. (l) Office support service facility, including light reproduction services. (m) Skilled nursing facility. Sec Building coverage requirements. The maximum building coverage per lot or parcel shall be 50%. Sec Maximum building height. The maximum building height permitted in this district shall be thirty-five (35) feet. Sec Yard/setback requirements. (a) For any lots directly abutting residentially zoned properties, the residential setback requirement of the abutting residential district shall apply to that portion of the affected lot. For the purposes of this section, properties that are separated by streets, or public rights-of-way, shall not be considered directly abutting. Designated parking areas shall be set back at least 10 feet from the property line. Front set back and rear set back shall be a minimum of 20 feet. (d) There shall be no side set back, except that on lots with a side lot line that is adjacent to a public street or right of way, a 10-foot side set back shall be maintained. Sec Minimum Useable Open Space. The minimum useable open space shall be twenty-five (25) percent of the lot area. 43

4 Sec Accessory Buildings. (a) Accessory buildings shall be a maximum of fifteen (15) feet in height. Accessory buildings shall not be located in the front yard of the principal building. Accessory buildings shall have rear and side setbacks of not less than five (5) feet, except for direct entry garages, which shall have driveways of not less than twenty (20) feet. ARTICLE 11. BUS-1 BUSINESS DISTRICT. Sec Intent. The intent of the Bus 1 Business District is to provide for areas which encourage a mixture of civic, office, retail, restaurant, housing and cultural land uses. Sec General Restrictions/Regulations. (a) All uses conducted in this district shall be contained within structures, except as specifically allowed herein. No outdoor storage, outdoor displays or outdoor sales uses will be conducted within this district. Trash storage containers shall be provided and screened from public view and adjacent properties with the use of a solid fence, wall or hedge. Solid fence does not include a woven wire or chain length fence with filler or fabric, or snow fences. Screening materials shall be esthetically compatible with the architecture of the property. Trash storage containers shall comply with the requirements of Section 66-3 of the Sheridan Municipal Code. Sec Permitted uses. The following are principal permitted uses in the Bus-1 Business district: (a) All uses permitted by right in the Com-N District, except that residential use is limited to floors 44

5 above ground-level floors. Banks or financial institutions, with or without drive-through facilities. Veterinary offices and small animal hospitals, without outside kennels or exercise areas. (d) Nursery schools, day care centers. (e) Convenience stores with no fuel sales. (f) Restaurants, retail bakeries, coffee shops, or tea rooms, that do not include drive-through facilities. Outdoor seating and service is allowed. (g) Dressmaking, tailoring, upholstering and similar establishments and businesses of a similar nature, subject to the following provisions: (1) All goods or products produced or processed in these establishments shall be sold at retail on the premises. (2) Any occupancy considered hazardous by the building code as adopted by the City is prohibited in this zoning district. (h) Adult entertainment establishments, subject to the requirements and location/spacing provisions as otherwise provided in the Sheridan Municipal Code. Sec Accessory uses. The residence of a caretaker, or watchman, but only as accessory to an allowed use. Sec Conditional uses. The following uses are allowed in the Bus-1 Business district only upon approval of a conditional use permit as provided herein: (a) Motor vehicle service facilities. 45

6 Public or private meeting halls. Veterinary clinic and small animal hospitals with outdoor kennels or exercise areas. (d) Hotel or apartment hotels, or motels. (e) Mortuaries without crematoriums. (f) Taverns and nightclubs, with or without outside services. Sec Maximum building coverage per lot or parcel. The maximum building coverage per lot or parcel in this district shall be fifty (50) percent. Sec Maximum building height. The maximum building height permitted in this district shall be thirty-five (35) feet. Sec Yard/setback requirements. The minimum useable open space required in this district shall be ten (10) percent. ARTICLE 12. COM-C COMMERCIAL DISTRICT REGULATIONS Sec Intent. The intent of the Com-C Commercial District is to provide for the location of auto-oriented and auto-dependant uses and/or uses which provide a wide range of general retail goods and services for residents of the entire community, as well as businesses and highway users, primarily inside of enclosed structures. Sec General restrictions/regulations. (a) All uses conducted in this district shall be contained in a completely enclosed structure(s) except as otherwise provided herein. Trash storage containers shall be provided and screened from public view and adjacent properties with the use of a solid fence, wall, or hedge. "Solid fence" does not include woven wire fences with filler or fabric, or snow fences. Screening materials shall be aesthetically compatible with the architecture of the development. The items being screened from public view shall not extend above the screening barrier. Trash storage containers shall comply with the requirements of Section 66-3 of the Sheridan Municipal Code. 47

8 Sec Principal permitted uses. Subject to the other regulations of this Chapter, the following uses are permitted uses in this zone district: (a) All permitted uses, but not conditional uses, allowed in the Bus-1 district, but excluding residential uses unless allowed below, and excluding adult entertainment. Retail sales, with outdoor display of items for sale permitted as an accessory use, only if loxcated within ten (10) feet of the building. Parking area or parking structure but only for temporary parking of seven (7) days of less. (d) Places of amusement and recreational facilities. (e) Medical and dental offices and clinics. (f) Animal hospitals and clinics without outside kennels or exercise areas. (g) Day care centers. (h) Retail greenhouses, including the outdoor display and storage of planted or potted nursery stock in the side or rear yards. (i) General contractors and/or special trade contractors, including but not limited to plumbing, heating and electrical contractors. Outside storage is permitted, provided screening separates such storage from public view and adjacent properties. (j) Restaurants, including drive-through "fast food" establishments. (k) Hotels and motels. (l) Temporary outdoor seasonal "tent" or "sidewalk" sales not to exceed 45 consecutive days, or a total of ninety (90) days in any one (1) calendar year, per property. Seven (7) consecutive days must occur between permitted events. No temporary outdoor seasonal sale can occur until a permit for such has been issued by the Zoning Administrator. (m) Office warehouse. Outside storage is permitted, provided screening separates such storage from public view and adjacent properties. Sec Accessory uses. Notwithstanding anything contained in this section to the contrary, there shall be permitted as an accessory use within this zone district the residence of an owner, caretaker, or watchman. 48

9 Sec Conditional uses. The following uses are allowed in the Com-C district only upon approval of a conditional use permit as provided herein: (a) Helipad operations approved by the Federal Aviation Administration and not located closer than one thousand (1,000) feet from any existing or zoned residential area. Temporary use for a fair or carnival not to exceed thirty (30) days in one (1) calendar year. Motor vehicle service facilities. (d) Motor vehicle washes and/or detailing establishments. (e) Night club and taverns, with or without outdoor services. (f) Retail sales with outdoor storage or displays in excess of principal permitted use. (g) Mortuaries with or without crematoriums.. (h) Kennels, animal clinics and hospitals, with outside kennels and exercise areas. (i) Hospitals. (j) Pawn shops, but not within 1000 feet of a church, school, residentially-zoned areas, or another pawn shop. Sec Maximum building coverage. The maximum building coverage permitted in this district shall be fifty (50) percent. Sec Maximum building height. The maximum building height permitted in this district shall be fifty (50) feet. 49
