1 MINUTES OF MEETING OF THE ARCHITECTURAL AND HISTORIC REVIEW BOARD OF THE VILLAGE OF SAGAPONACK IN THE TOWN OF SOUTHAMPTON, COUNTY OF SUFFOLK AND STATE OF NEW YORK A regular monthly meeting of the Architectural and Historic Review Board of the Village of Sagaponack was held at 9:30 a.m. on Monday, August 16, 2010 at 3175 Montauk Highway, Sagaponack, N.Y. The meeting was called to order by Chairperson Sandford with a flag salute. Present were Board Members Vice Chairperson Tom White, Gideon Mendelson, Barbara Slifka and Alternate Board Member Sean Selfe. Also present was Pat Arancio-Remkus, secretary and Village Building Inspector John Woudsma. Absent were Clay Dilworth and Village Attorney Anthony Tohill. I. APPROVAL OF MINUTES MONTHLY MEETING A motion to approve the minutes from the July 16, 2010 AHRB meeting was offered by Barbara Slifka and seconded by Tom White. It was unanimously approved. II. OLD BUSINESS There was no old business before the Board. III. NEW BUSINESS a. Demolition 1. Richard Schimel 751 Daniels Lane Applicant proposes demolition of existing two story single family dwelling, walkway to beach and decks 1

2 Blaze Makoid, architect, represented the applicant. He presented the Board with photos of the existing house and surrounding houses. He stated they will be placing the new house as far north as possible to be behind the Coastal Erosion line. He stated that currently the Coastal Erosion line goes diagonally through the middle of the house. Chairperson Sanford asked for clarification of the location of the house. She asked if the house was built by Norman Jaffee to which Mr. Makoid stated he did not believe so. Tom White stated that this house previously was owned by Rene Battle and the architect was Mark Matthews, who was related to Ms. Battle. Chairperson Sandford stated that it is referred to as the Matthews House. A motion to approve the demolition of the existing two story, single family dwelling, walkway to beach and decks was offered by Tom White and seconded by Barbara Slifka. It was unanimously approved. b. New Construction/Additions 1. Richard Schimel 751 Daniels Lane Applicant proposes construction of two story single family dwelling, 1 st and 2 nd Fl decks Blaze Makoid, architect explained to the Board that they are proposing to construct a 5,200 sq. ft. house with no basement. Mr. Makoid provided a sample of the wood to be used on the exterior which is called afrormosia. He noted that the wood is similar to teak, but is less expensive than teak. Chairperson Sanford asked if the siding is to be oiled to which Mr. Makoid responded yes. Mr. Makoid stated that the siding will also be a thin-cut travertine stone with a matte finish adhered to an aluminum honey comb patterned base. He explained that this technique is used so the stone will not be too heavy. He also noted that the window & door frames will be wood which will be painted black, that they will be using 5 ½ tongue and groove vertical siding in order to keep the detail, that there 2

3 will be no corner boards and that the decks and skirts will be constructed using the same wood. Gideon Mendelson asked what was on the roof to which Mr. Makoid responded there are skylights that are above the bathrooms. Mr. Makoid stated that there is a change of location for the fireplace from the plans. He stated they moved the chimney more to the middle of the house and put windows and glass in its previous location. A motion to approve the construction of a two story, single family dwelling, 1 st and 2 nd Fl decks was offered by Gideon Mendelson and seconded by Barbara Slifka. It was unanimously approved. 2. Eugene & Barbara Green 11 Sagg Pond Court Applicant proposes extension of an existing screened porch Douglas Moyer, architect represented the applicants. He stated that they are proposing to extend the existing screened porch on the rear of the house by 42 sq. ft. He stated they will be maintaining the existing door and will be matching the existing roof and siding shingles. A motion to approve the extension of an existing screened porch was offered by Gideon Mendelson and seconded by Barbara Slifka. It was unanimously approved. 3. Morton I. Hamburg 511 Sagaponack Road Applicant proposes conversion of existing 2 car garage into study with a bathroom Morton Hamburg stated that he had a couple of amendments to his application. He stated that the garage he will be converting was originally a two car garage, but in 1986 they converted part of the garage into a recreation room and later converted the recreation room into a guest bedroom. Chairperson Sanford asked if the outer dimensions of the structure will change to which Village Building Inspection John Woudsma stated that according to the plans that were submitted there is nothing additional being done to the building. He stated that Mr. Hamburg will be converting the existing garage into a den with a 3

4 bath connecting into the house through a little hallway that has a laundry room off of it. Chairperson Sanford asked if there was anything different about the exterior to which Village Building Inspector John Woudsma stated that the garage doors will be replaced with new windows and a new exterior door will be installed on the east side of the house and the front of the house will remain the same. Barbara Slifka asked if the garage can be seen from the street to which Mr. Hamburg responded no, there is a large hedge that covers it. Tom White asked if the exterior of the garage is brick or black to which Mr. Hamburg stated that to the north it has wood garage doors and cedar siding and to the east it is concrete. Tom White asked if it will be fully enclosed to which Mr. Hamburg responded yes with windows with eight over six panes. A motion to approve the conversion of an existing 2-car garage into a study with a bathroom was offered by Gideon Mendelson and seconded by Tom White. It was unanimously approved. 4. Abri Properties, LLC 802 Townline Road Applicant proposes construction of a two story single family dwelling, 1 st & 2 nd Fl covered porches and decks, renovation of existing one story single family dwelling (old school house) The applicants, Clifford Wooley and Stanley Dalene came before the Board. Chairperson Sanford stated that the old schoolhouse located on the property was built in 1884 and was moved to the property in She stated that the AHRB wants this building preserved. Village Building Inspector John Woudsma stated that the applicants will be coming back before the AHRB to discuss the renovation of the schoolhouse. The applicants are here today to discuss construction of the main house. He stated that the schoolhouse has its own C.O. as a single family dwelling and there is an additional 2-story house they would like to demolish. He stated that the property is three acres and they would like to discuss a partial demolition and new construction. He stated that the foundation has already been built for the new construction under Southampton Town permit and the inspection has already been completed on the 4

5 foundation. However, since the Town permit has now expired, the building permit now has to be issued through the Village. Village Building Inspector John Woudsma stated that according to Sagaponack s code, the house is 2500 sq. ft. over the FAR, but because the foundation is in and it has vested rights, there is a reasonable expectation to build. There is nothing in NYS Law or in our code that would prevent the applicants from realizing their expectation to build two stories on their pre-existing foundation. He stated he discussed this with the Village Attorney and they have been out to visit the site. Chairperson Sanford asked what currently exists on the property to which Mr. Wooley responded that there are three existing structures--the old school house, a two story frame dwelling and a new foundation. He stated they will also be repositioning the driveway. They wish to demolish the existing 2-story residence and connecting foundation located on the southeast corner of the property. Chairperson Sanford asked if this is an application for demolition to which Village Building Inspector John Woudsma responded that this is an application for a partial demolition consisting of the existing concrete foundation between the two story structure and the remaining existing foundation and the two story structure located at the southeast corner of the property. Gideon Mendelson asked what the total square footage of the new structure will be to which Village Building Inspector John Woudsma stated is will be 11,000 sq. ft. Mr. Dalene showed the elevations of the proposed new structure to the Board and stated that they have removed the cupola and changed the chimney from what is on the plan. Chairperson Sanford noted that the height of the structure is actually below what is allowed. Mr. Dalene stated that the exterior of the structure will be natural cedar. He stated there will be scalloped shingles under the gables. Sean Selfe asked if it was necessary to have a cathedral ceiling in the garage. Gideon Mendelson asked if it was usable space to which Mr. Dalene stated no. Sean Selfe stated that since the building is already so much over the FAR, to eliminate the cathedral ceiling in the garage would help reduce the mass of the building. 5

6 Mr. Dalene stated that there is a connector space on the 1 st fl between the house and the 3 car garage. There is a cathedral ceiling because the homeowner may add a lift in the garage to house more cars. Sean Selfe asked why there is no access to the 2 nd fl deck and why they are creating a space that can not be used to which Mr. Wooley responded it is just an architectural detail. Gideon Mendelson suggested adding a door as it would be a better form of egress and you would be able to use the deck. Mr. Dalene asked if it would be possible to move the schoolhouse to another property to which Chairperson Sanford responded that the AHRB will postpone discussion on the schoolhouse for now, but she is very happy to know that the schoolhouse will not be demolished. A motion to approve the demolition of the existing 2-story residence and connecting foundation located at the southeast corner of the property, construction of a two story single family dwelling with the revised chimneys to reflect a simpler design and the removal of the cupola, 1 st & 2 nd Fl covered porches and decks including the addition of a door to access the 2 nd Fl deck was offered by Chairperson Sanford and seconded by Gideon Mendelson. It was unanimously approved. 5. Raphael Gonzalez 6 Sagg Road Applicant proposes construction of a two car detached garage with storage above This application was adjourned until the September, 2010 meeting as there was no one present to represent the applicant. c. DISCUSSION ITEMS 1. Melissa Osborne 444 Parsonage Lane Applicant is seeking AHRB opinion as to whether or not the structure is historic in nature Melissa Osborne, realtor, represented the applicant. Barbara Slifka asked how old the house was to which Ms. Osborne stated it was built in

7 She stated the property is for sale and she would like advice on how to market the property. The potential owners would like to know if they can add on to or tear down the house. There are 2.2 acres which includes a large horse paddock. There are three C. O. s for single family dwelling units on the property. There are two legal cottages that are pre-existing, non conforming and are grandfathered in. There is also an old cinderblock barn. She stated that potential buyers want to know if they can improve or combine the cottages. Paul Brennan, realtor, stated that the main house was the main house of the original farm of the Parsonage Pond Lane subdivision. Chairperson Sanford stated that this house is clearly historic and needs to stay. She stated that the façade is the overwhelming favorite. She stated she would not be opposed to changes or the demolition of the outbuildings. She stated the views would also need to be preserved. There will be no 20 hedges or overgrowth of trees. Mr. Brennan asked if how it looks from the street is what is most important to the AHRB. He asked if adding on to house or getting rid of the cinder block building would be something the AHRB would consider to which Chairperson Sandford responded yes. Melissa Osborne stated that the current owner will apply for a demolition permit for the cinderblock building, but she will not be taking it down. A discussion was held regarding the possible combining of the cottages to which Chairperson Sanford stated that would be a question for the ZBA. Mr. Brennan asked for clarification of how the AHRB determines historic properties. He asked if the AHRB feels that with a historic house the facade is what is most important, that the owner can expand, but not destroy the integrity. He stated this is going to keep coming up. He stated that you have one value if you can do something with the house and another value if you can not. Gideon Mendelson stated that history, architecture and surrounding area all play a factor. 7

Gloria Strong 603 Town Line Road Parsonage Lane Applicant is seeking AHRB opinion as to whether or not the two structures are historic in nature Hedda Strong Gebbia, realtor and cousin of the applicant, represented the applicant. She first spoke about the cottage at the corner of Town Line and Parsonage Lane. This property is part of a subdivision that was created in the mid 1990s that included four residential parcels and an 8+ acre farm reserve. Two of the four pieces are long sold. She stated that the property they are now discussing consists of a small one bedroom cottage with a large garage type building on.8 of an acre. Chairperson Sanford stated that she believed there was a second story to which Ms. Strong Gebbia responded that the cottage does have a partial 2 nd Fl, but it is not fully enclosed and just has stairs that go to it. She stated there is a living room, a full bath, an eat-in kitchen and a basement which was recently added. The house was moved to the property in the early part of the last century. Ms. Strong Gebbia stated there is also a large 1,500 sq. ft. garage building on the property. She explained that it is a 3 4 car garage with a pot belly stove, which was the mechanical building of the farm. There are 3 garage doors on one side and one door on the other side. There is also a milk shed to the right of the garage. Ms. Strong Gebbia stated that considering what currently exists, a run down cottage and a ramshackled old garage building, purchasers are not looking at the property for the cottage. Chairperson Sandford stated that it does not trouble her that something is ramshackled, but this is not historic. Tom White agreed that it is not historic. Ms. Strong Gebbia stated that the cottage is not original to the site, it was moved there. She asked if the Board would be opposed to the demolition of this structure to which Chairperson Sanford stated she is not opposed to it, but she didn t know how the rest of the Board felt. Ms. Strong Gebbia stated that her cousins have owned the property since the mid 1990s. She explained that there are four residential parcels, two of which have been sold. She noted there are no covenants on these two remaining lots. She stated that up until recently it was a working farm where they sold eggs off of their front porch and people could come to the property and pick pumpkins, strawberries, etc. 8

9 Ms. Strong Gebbia asked if the Board would consider the demolition of the house on the corner of Parsonage to which Chairperson Sandford and Gideon Mendelson stated they had no objection. Tom White stated he objected. Ms. Strong Gebbia then spoke about the house on Town Line Road. She explained that the white farmhouse was built in the 1850 s, is a two story house with a 3 rd story attic and the basement is original stone from the area and has a dirt floor. She stated there is no architect of note that built it. She noted that it is a solid farmhouse that has one fireplace that works on two sides. She explained that the original fireplace was built with sand from the ocean and because of the salt in the sand it collapsed. The rest of the house is original. She stated that behind the farmhouse is an above ground potato barn that was built in approximately , which is a one story building on a concrete slab and to the left of the potato barn is a chicken coop. Chairperson Sanford asked if the farmhouse was always painted white to which Ms. Strong Gebbia responded yes, but now it has aluminum siding. Ms. Strong Gebbia stated that the extension off the back is original as well. She stated there is a new basement with a poured floor. Ms. Strong Gebbia stated that the question she has been getting is would they be permitted to tear the house down or to pick it up and move it back. She asked that if someone came with a plan to tear it down with an intelligent plan to replace it would that be something the Board would consider or would the Board require that the façade be preserved. Chairperson Sanford stated that she would not be in favor of demolition of the farm house as it is historic. Ms. Strong Gebbia asked if that is just because it is from the 1850 s to which Chairperson Sanford stated that the architecture is older than that and it is a very traditional 19 th century farmhouse. Ms. Strong Gebbia asked if it is old and traditional is it then considered historic to which Chairperson Sanford stated that is not a criteria. Ms. Strong Gebbia asked if the AHRB would object to the demolition of the barn building or the chicken coop to which Chairperson Sanford responded she personally would not be. Ms. Strong Gebbia asked if the AHRB is considering the main building as historic in nature, subject to somebody wanted to do things to it, is it the facade that really counts to which Gideon Mendelson stated that there is more involved than just the façade. This is about the structure and the history of the structure. Barbara Slifka stated you would have to maintain the integrity of the elements, not just the façade. 9

10 Ms. Strong Gebbia asked if someone could possibly add on to the structure to which the Board responded it could be considered. Tom White noted that as far as the barn is concerned, maybe it could be moved to the agricultural reserve or the little house be moved to the agricultural reserve to which Ms. Strong Gebbia responded assuming they bought that property and the agricultural reserve. V. MOTION TO ADJOURN MEETING A motion to adjourn the meeting was made by Gideon Mendelson and seconded by Barbara Slifka and unanimously approved.
